Docking Facility Expansion 1) This permit authorizes only the docks and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application.No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification.No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes 2 additional formalized boat slips for a maximum of 4 formalized boat slips at this docking facility. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) All portions of the authorized structure shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 10) This permit shall not be assigned,transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 12) The permittee and/or their contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. v NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2023-01 155). Proposed: Floating dock= 10' x 30' =300 sq.ft. Gangway landing=3' x 4' = 12 sq.ft. Proposed Total=312 sq. ft. Existing: Platform =16' x 30'=320 sq. ft. Floating dock=8' x 16' =96 sq. ft. Total: 728 sq. ft. The construction would provide docking space for up to four(4)vessels at this location. As proposed, the project would be CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the '/ width rule, the eight-square foot rule and the pier-width rule. PROJECT DESCRIPTION: The project site is located at 1202 Carolina Boulevard, adjacent to Banks Channel and Topsail Sound, in Topsail Beach, Pender County. Existing man-made features on the property include a single-family residence with bulkhead, and a private residential docking facility. High ground vegetation consists of ornamental vegetation and lawn grasses complete the ground cover.According to the application package, the high ground portion of the property is elevated approximately 3' above the normal high water(NHW) level. The shoreline measures approximately+/-95 linear feet and is stabilized by a vinyl bulkhead.There is a fringe of Coastal Wetlands (approximately 150' in width and consisting primarily of Smooth Marsh Cordgrass {Spartina Alterniflora}) bordering the property along the western shoreline. Residential properties border the property to the north, south and east and Banks Channel borders the property to the west. The applicant currently maintains a private pier and docking facility (2-slips)which has a permit history dating back to the 1990's. The most recent activity was the issuance of CAMA General Permit 71878, which was issued to the prior property owner, and authorized replacement of the 6' x 211' access pier and installation of a new bulkhead. Presently,the docking facility consists of an approximate 6'x 211' access pier, 16' x 20' T-head shaped platform, a boatlift and an approximate 8' x 16' floating dock(located on north side of existing pier,just inshore/landward of the platform). The waters of Banks Channel and Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA)by the North Carolina Division of Marine Fisheries,and they are OPEN to the harvest of shellfish. Based on visual observations made by DCM staff during the May 2023 site visit,there appears to be NO Submerged Aquatic Vegetation(SAV)in the surrounding area.Water depths in the vicinity of the proposed facility range from -3'to-5',relative to normal low water(NLW). PROPOSED PROJECT: Through this permit application, the property owner proposes to expand an existing docking facility, by adding a new floating dock, creating a total of four(4) boat slips. As designed, a new 10' x 30' floating (with 3'x 4' landing for gangway)dock would be installed along the southern side of the existing pier and platform, near the pier's terminus. The proposed floating dock would run perpendicular to the shoreline, and the outer edge of the dock would be located in alignment with the existing platform.As shown on the attached site plan drawings, the floating dock would be located approximately 28' from the adjacent property owner to the south,and roughly 21' from the riparian corridor.As designed,the proposed floating dock would be located along the existing pier-head line,well inshore of the'A width limitation and the near shore edge of channel. The proposed floating dock would be located in an area of Banks Channel that has approximately-3'to-5' of water during periods of low tide.Just beyond(waterward)of the floating dock, the bottom contour begins to drop off into the channel, which is approximately -5' to -12' deep during normal low water. The proposed development would be centrally located along the shoreline, with no encroachment into the applicant's riparian corridor setback(i.e. no waivers required). In this location,the width of waterbody measures approximately 1,125' from marsh to marsh. Based on the design,the applicant would have the ability to dock up to four vessels at the docking facility.
