Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification.No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes a maximum of 4 formalized boat slips at this docking facility. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) In order to satisfy the concerns of the resource agencies, physical stops shall be placed on the floating dock at a minimum height of 18" above the bottom substrate to prevent the floating dock from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) All portions of the authorized structure shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 1 8) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 9) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 10) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. x 11) The roof of the covered platform shall not be designed for second story use. Upland Development 12) This permit authorizes the proposed wooden walkway and elevated wooden deck, as depicted in the attached permit application, project narrative, and workplan drawings. Any other work or development proposed in an Area of Environmental Concern (AEC), including but not limited to the Coastal and Estuarine Shoreline AECs and located within the applicant's property, shall require a review and authorization from the Division of Coastal Management prior to work commencing. USACE Conditions 13) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines2017.pdf. Greg and Caroline Gianoplus Permit No. 56-23 Page 3 of 3 ADDITIONAL CONDITIONS Sedimentation and Erosion Control 14) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 15) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2023-00514). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4497 and assigned the project DWR Project No. 20230316. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high-water level. Proposed: Finger Pier=6' x 36' =216 sq. ft. Platform = 10' x 20'=200 sq.ft. Floating dock=8' x 50'=400 sq.ft. Gangway landing=6' x 6' =36 sq. ft. Proposed Total=636 sq. ft. The construction would provide docking space for up to four(4)vessels at this location. As proposed,the project would be CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the 1/4 width rule,the eight-square foot rule and the pier-width rule. With exception of the walkway and upland decking, all other structures would be located entirely over open water.This office has NO OBJECTION to the proposed work provided it is consistent with all other state and federal permitting requirements. It is recommended that any permit issued should include standard conditions for private docking facilities and upland development within the 30' Coastal Shoreline buffer. The applicant proposes to construct a new 4-slip docking facility at 312 Olde Point Loop, adjacent to Old Topsail Creek and Topsail Sound in Hampstead, Pender County. I have reviewed this proposal for consistency with the Pender County Comprehensive Land Use Plan and offer the following comments. The general area of the project is classified as Conservation. Waters at the project site are classified as SA and are not open to the harvesting of shellfish. The area is not a Primary Nursery area. Areas of Environmental Concern are PT and EW. Pender County allows development in Conservation classified AECs, which is consistent with the State's minimum use standards. The Pender County Comprehensive Land Use Plan contains some policies,which exceed the State's minimum use standards. However, none of these policies appear to be applicable to this project. This project appears to be consistent with the Pender County Comprehensive Land Use Plan Update. PROJECT DESCRIPTION: The project site is located at 312 Olde Point Loop, adjacent to Old Topsail Creek and Topsail Sound, in Hampstead,Pender County.Existing man-made features on the property include a single-family residence. High ground vegetation consists of Live Oaks, and ornamental vegetation completes the ground cover. According to the application package, the high ground portion of the property is elevated approximately 4'-27' above the normal high water(NHW) level. The shoreline measures approximately +/- 100 linear feet and is stabilized by natural vegetation. There is a fringe of Coastal Wetlands(approximately 20'-30' in width and consisting primarily of Smooth Marsh Cordgrass {Spartina Alternfora}) bordering the property along the western shoreline. Residential properties border the property to the north,south and east and Old Topsail Creek borders the property to the west. The waters of Old Topsail Creek and Topsail Sound (adjacent to the project site) are classified as SA by the North Carolina Division of Water Resources. They ARE NOT designated as a Primary Nursery Area (PNA)by the North Carolina Division of Marine Fisheries,and they are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during September 2022 site visit,there appears to be NO Submerged Aquatic Vegetation(SAV)in the surrounding area.Water depths in the vicinity of the proposed facility range from-2'to-2.5', relative to normal low water(NLW). PROPOSED PROJECT: Through this permit application,the property owner proposes to install a new four(4)slip docking facility. As designed, a new 6' x 100' elevated, wooden walkway would extend from the existing residence to a new 10' x 20' elevated, uncovered wood deck located along the properties shoreline. The proposed deck would be located within the 30' Coastal Shoreline buffer,just landward of Coastal Wetlands. From the proposed deck,the applicant intends to install a new 6'x 36' access pier that would extend toward the west and terminate into a new 10' x 20'platform.The platform would be partially covered(10' x 12')with a hip roof and the remaining 8' x 10' section would remain uncovered. A new 8' x 50' section of floating dock would be located just offshore of the proposed platform, and would run parallel to the creek and shoreline. As designed,the proposed floating dock would be located along the existing pier-head line,just inshore of the'A width limitation and the near shore edge of channel.The proposed floating dock would be located in an area of the creek that has approximately -2.0' to -2.5' of water during periods of low tide. Just beyond (waterward) of the floating dock, the bottom contour begins to drop off into the channel, which is approximately-4.0' to-4.5'deep during normal low water.The proposed development would be centrally located along the shoreline, with no encroachment into the applicant's riparian corridor setback (i.e. no waivers required). In this location, the width of waterbody measures approximately 145' from marsh to marsk Based on the design,the applicant would have the ability to dock up to four vessels at the docking facility. 10. ANTICIPATED IMPACTS: The proposed structure would incorporate approximately 636 sq. ft. of Estuarine Waters and Pubic Trust Area.
