Authorizing development in Pender County at adj.to Mill Creek. at 719 Hughes Rd in
Hampstead , as requested in the permittee's application dated 3/20/23 (MP-1, MP-2, MP-
4), including work plan drawings (5) Sheets 1-5 dated 3/20/23.
This permit, issued on July 21, 2023 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to civil or criminal penalties; or may cause the permit to be null and void.
Docking Facility Expansion
1) This permit authorizes only the docks, piers, boatlifts, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non-water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) This permit authorizes 5 additional formalized boat slips for a maximum of 10 formalized boat slips
at this docking facility.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance. 4

ADDITIONAL CONDITIONS
3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
4) No portion of the authorized docking facility shall extend more than one quarter of the width of the water
body. Measurements to determine width of the water body shall be made from the normal high-water line
or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more
restrictive.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six
feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured
from the bottom of the decking.
8) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
Boat Basin Expansion
9) No excavation shall take place outside of the area indicated on the workplan drawings.
10) Excavation shall not exceed -4 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
11) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
12) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawing(s).
13) No excavation shall take place within 10 feet of any Coastal Wetlands.
14) All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the recent of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed.

Maintenance Clause
•
15) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross-hatching indicating the area to be maintained, the
• area to be used for dredge material disposal, and the estimated amount of material to be removed.
The location, design and holding capacity of the dredge material disposal site shall be approved •
• by a representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Dredge Material Disposal •
•
16) No dredge material shall be placed within 30 feet of the normal high-water line. •
17) All excavated materials shall be confined above normal high water and landward of regularly or
• irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the
site is graded and stabilized.
18) The diked disposal area shall be constructed a sufficient distance from the normal high-water level or
any marsh and sufficiently maintained to eliminate the possibility of dike erosion or dredge material
• deposition into surrounding wetlands or waters.
19) The dredge material disposal area shall be inspected and approved by a representative of the Division of
Coastal Management prior to the commencement of any dredging activities.
20) The permittee and/or their contractor shall take all necessary precautions to ensure that the dredge
material is properly contained during transport to the disposal site, and that all the proper coordination
has taken place with the local or state governments to ensure that any damage to public streets caused by
transport of the dredge material has been addressed.
USACE Conditions

21) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

Sedimentation and Erosion Control
22) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
F. 23) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.

General
24) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
25) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
26) The permittee and/or their contractor shall meet with a representative of the Division prior to project
initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2023-00717).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4497 and assigned the project DWR Project No. 20230471.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at(910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of$400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

RECOMMENDATIONS FOR: Long Point Estates HOA,Inc.
The construction would provide docking space for up to five(5)additional vessels at the existing
five(5)slip docking facility resulting in the creation of ten(10)slips. As proposed,the project
would be CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including
the eight-square foot rule and the pier-width rule. With exception of the walkway and upland
decking, all other structures would be located entirely over open water.The excavation would
disturb approximately 7,919 sq. sf. of previous undisturbed and disturbed shallow bottom habitat,
and approximately 9,288 sq. ft. of previously disturbed high ground. The proposed work appears
to be consistent with 15A NCAC 07H .0208(b) Specific Use Standards for dredging. This office
has NO OBJECTION to the proposed work provided it is consistent with all other state and
federal permitting requirements.
It should be noted the proposed project appears to extend just beyond the 'A width of water body
limitation and any approvals should contain conditional requirements to limit the finger pier and
boat lift length to no more than 1/4 of the width of the water body.
Additionally,Long Point Estates HOA, Inc. has an existing five(5)slip facility (immediately
adjacent to the proposed facility)as well as a nine slip docking facility located along the AIWW.
The nine slip facility was authorized under CAMA Major permit No. 94-07, which was issued on
August 23, 2007. With many of the residents of Long Point Estates HOA,Inc having access to
either private single family residential docks,or slips associated with the existing community
docking facilities,consideration should be given to the purpose and need of the proposed
development.
It is recommended that any permit issued should include standard conditions for private docking
facilities and upland development within the 30' Coastal Shoreline buffer.

Dear Mr. Howell:
Reference the permit application request of Long Point Estates HOA, Inc. c/o Terry Williams to
expand an existing docking facility and conduct maintenance and new dredging within waters of
Mill Creek, adjacent to 719 Hughes Road, in Hampstead, Pender County,North Carolina.
Specifically,the applicant proposes to construct a new 6'x 110'access pier that would
originate along the western shoreline of 719 Hughes Road. The pier would extend toward the
south, abutting the outer edge of coastal wetlands,just along the open water shoreline. Extending
from the access pier,the applicant proposes to install five finger piers (each measuring 4'x 36')
that would run perpendicular to the shoreline. Along the outer edge of each finger pier,the
applicant proposes to install five(5)boatlifts, each measuring approximately 12'x 12'.
In addition to the proposed docking facility,the applicant is requesting authorization to perform
new dredging within the footprint of the proposed docking facility. As designed, an approximate
125'x 36' boat basin would be dredged to a depth of approximately-4' @NLW. Along with the
proposed new work, a maintenance dredging request is being sought for the area beneath and
around the existing facility (81'x 25'x-4'NL W), and around the existing boat ramp(41'x 34'x
-4'NLW). The proposed dredging would remove approximately 4,500 sq. ft. of previously
undisturbed shallow bottom habitat and approximately 3,419 sq. ft. of previously dredged
shallow bottom.
The proposed dredge method is bucket to barge,with the disposal location directly adjacent to
Hughes Road, approximately 250 feet west of the project area.

The Federal agencies have completed review of the proposal as presented by tkfp
application and your field investigation report. We recommend that the followinguesidiVgy
included in the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,

approved by the US Army Corps of Engineers(USACE) prior to implementation.
4. Except as specified in the plans attached to this permit,no excavation, fill or
mechanized land-clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
5. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project,within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
6. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste,the
permittee shall immediately report it to the N.C. Division of Water Resources at(919) 733-
5083, Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
7. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials (including debris from land
clearing activities), or unsightly debris will not be used.
8. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District

Engineer who will initiate the required coordination procedures.
9. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
10. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to,the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally,the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statutes Chapter 113A Article 4).
11. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management(NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
12. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will,without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre-project condition.
13. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S.Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

9. PROJECT DESCRIPTION:
The project site is located at 719 Hughes Road adjacent to the AIWW, in Long Point Estates,
Hampstead, Pender County. To access the site from Wilmington,take US Hwy 17 N. Travel
approximately 11 miles to Washington Acres Road. Turn right onto Washington Acres Road and
travel approximately 1.8 miles to the Atlantic Intracoastal Waterway. The site is located ahead
and on the right at 719 Washington Acres Road.
The subject property is void of any made-made development with exception of a boat ramp, five
slip docking facility and bulkhead,which was permitted under CAMA Major Permit No 77-08,
and issued to The Land Company of Pender County,LLC in May 2008. CAMA Major permit
77-08 was modified on April 28, 2010, for expansion of the existing facility to include a total of
nine slips(four additional); however,the work was never completed, and the permit expired on
August 19, 2014. The applicant is now proposing to re-apply for a new five slip docking facility
(creating ten slips total within the basin), perform maintenance dredging around the existing five
slip docking facility and perform new dredging around the proposed five slip docking facility.
The width of the waterbody in the location of the proposed docking facility is approximately
150'-165' from the edge of marsh on one side to the edge of marsh opposite,allowing a
maximum distance of 37'-41' beyond the nearshore edge of marsh.
The canal has a documented history of dredging,as documented in CAMA Major/Dredge and
Fill Permit 175-07,which was issued to Mill Creek Waterway Restoration, Inc. According to the
permit,the subject channel was dredge at a width of approximately 25', along the centerline. As
proposed,the new dredge work associated with the subject application would be located outside
of the existing dredge footprint; therefore, it would be considered new dredging.
The waters of the AIWW adjacent to the project site are classified as SA-HQW by the North
Carolina Division of Water Resources. They area is NOT designated as a Primary Nursery Area
(PNA)by the North Carolina Division of Marine Fisheries,and they are CLOSED to the harvest
of shellfish.
PROPOSED PROJECT:
The applicant proposes to expand an existing community docking facility,by adding five(5)additional
slips(totaling ten boat slips),and excavate a boat basin within Mill Creek.. As proposed,the total slip
count at the subject property would be expanded from five(current)to ten. In addition to
construction of a new docking facility,the applicant is proposing to dredge an area around and
beneath the proposed slips, as well as perform maintenance dredging around the existing facility
and boat ramp. Please refer to Sheet No. 2 of 5 for detailed location of the proposed docking
facility and dredge footprint.

As designed,the docking facility would be access by a new 6' x 110' access pier that would
originate along the western shoreline of 719 Washington Acres Road. The pier would extend
toward the south, abutting the outer edge of coastal wetlands,just along the open water shoreline.
Extending from the access pier, the applicant proposes to install five finger piers(each
measuring 4' x 36')that would run perpendicular to the shoreline. Along the outer edge of each
finger pier,the applicant proposes to install five(5)boatlifts, each measuring approximate 12' x
12'. Based on the site plan drawings(specifically sheet 2 of 5),it appears the southern most
finger piers and boat lifts would be located beyond the 1/4 width of waterbody limitation, so I
encourage staff to condition any potential permit to address this discrepancy. According to
information presented on the site plan drawing, existing water depths in the vicinity of the
proposed dock range from 0' to -3.0' at normal low water(NLW).
In addition to the proposed docking facility,the applicant is requesting authorization to perform
new dredging within the footprint of the proposed docking facility.As designed,an approximate
125' x 36' boat basin would be dredge to a depth of approximately-4' @ NLW. Concurrent to
the proposed new work, a maintenance dredging request is being sought for the area beneath and
around the existing facility (81' x 25' x -4' NLW),and around the existing boat ramp(41' x 34'
x-4' NLW). Considering the main channel of Mill Creek, including the side channel which
provides access to the subject facility,has been previously dredged under CAMA major permit
175-07,the new proposal does not appear to be inconsistent with current DCM Rules. Spoil
material resulting for the proposed dredging operations would be handled via a bucket to barge
type operation, and would be disposed of on property located at 719 Hughes Road,which is
owned by Long Point Estates HOA,Inc. Based on previous site visits,there does not appear to
be any SAV within the project area; however,there are shellfish resources scattered throughout.
10.ANTICIPATED IMPACTS
The proposed new docking facility would incorporate approximately 2,100 sq. ft. of Estuarine
Waters and Pubic Trust Area. The proposed docking structure would not encroach into the
adjacent 15' Riparian Corridor Setback Areas; however, it may extend beyond the width
limitation(approximately 40' beyond the edge of marsh). The proposed dredging would disturb
approximately 4,500 sq. ft. of previously undisturbed bottom and approximately 3,419 sq. ft. of
previously disturbed bottom. Minor increases in turbidity should be expected; however,no long
term impacts are anticipated.
The total area of the proposed structures was calculated as follows:
Shoreline length=+/-370 ft.x 8 sq.ft.=2,000 sq.ft.allowable.
Proposed:
Access Pier=6' x 110'=660 sq. ft.
Finger Piers=4'x 36' x 5=720 sq.ft.
Proposed Total=720 sq.ft.
Existing Total=432 sq.ft.(existing finger piers—3 @ 4'x 36').

4.1 Section 6. a. Project Narrative
4.1.1 Project Location and Existing Conditions
This project is located off Hughes Road in Hampstead, Pender County, North Carolina. It is found on Mill Creek where the
surface water classification is SA;HQW and considered secondary nursery area. The area is also permanently closed to
shell fishing. A survey of the project area water depths, referenced to Mean Low Water NAVD88, was conducted by ESP
Associates on April 5,2022 and represents conditions at that time.There is an existing boat ramp, bulkhead,one floating
dock,and three finger piers accommodating five boat slips.The most recent maintenance dredging was permitted in 2019
under CAMA general permit no.74266 and permitted dredging under the existing finger piers and boat lifts.Both adjacent
properties have water and boat access structures.The property to the north has a boat ramp and parking and the property
to the south is a single-family home with a fixed pier and floating dock.
4.1.2 Proposed Action
Within the Long Point Estates community, all properties have water access excluding 5 homeowners. The applicant
proposes 5 additional boat lifts to accommodate the remaining property owners within the community that are lacking
water access. A fixed pier measuring 110 by 6 feet will tie into the existing bulkhead and provide access to 5 fixed finger
piers that will measure 36 by 4 feet.The lift pilings measure 12.5 by 12.5 feet on center. With the addition of 5 more lift
slips, the property will have a total of 10 boat slips.
The total dredging footprint is 7,230 square feet and includes the area under both the existing and proposed structures.
Both proposed dredging and maintenance dredging are requested to be authorized under this permit, and the total
volume of dredge material for the entire footprint is 510 cy.At this time, only 350 cubic yards will be dredged under the
proposed structures. Under the existing structures, the remaining 160 cy (110 cy maintenance& 50 cy proposed)will be
dredged at a later date. The landowners will use an upland on-site location on the property for the spoil location. See
Appendix A for details.

Good afternoon,
This pre-file submission is for 719 Hughes Rd located on Mill Creek in Hampstead, Pender County. The surface water
classification is SA;HQW and considered secondary nursery area. The area is also permanently closed to shell fishing.A
survey of the project area water depths, referenced to Mean Low Water NAVD88,was conducted by ESP Associates on
April 5, 2022 and represents conditions at that time. There is an existing boat ramp, bulkhead, one floating dock, and
three finger piers accommodating five boat slips. The most recent maintenance dredging was permitted in 2019 under
CAMA general permit no. 74266. Both adjacent properties have water and boat access structures. The property to the
north has a boat ramp and parking and the property to the south is a single-family home with a fixed pier and floating
dock.
The applicant proposes installing a fixed pier measuring 110 by 6 feet that will tie into the existing bulkhead. Connected to
the pier will be five fixed finger piers that will measure 36 by 4 feet and provide access to the 5 proposed boat lift slips.
The lift pilings measure 12 by 12 feet on center and will be designated for use by the Long Point Estates HOA. With the
addition of 5 more lift slips, the property will have a total of 10 boat slips.
The total maintenance dredging footprint is 7,250 square feet and includes the area under both the existing and proposed
structures.At this time, only 350 cubic yards will be dredged under the proposed structures. The landowners will use an
upland on-site location on the property for the spoil location.

Resources Commission for development activities 719 Hughes Road,adjacent to Mill Creek and Topsail Sound,in
Hampstead,Pender County. It was received as complete on March 22,2023 and appears to be adequate for
processing at this time.The projected deadline for making a decision on your permit application is June 5,2023.An
additional 75-day review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above,you should consider the review period
extended. Under those circumstances,this letter will serve as your notice of an extended review. However,an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 22,2023,you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner,developer,and project designer/consultant.
NCGS 1 13A-119(b)requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a"Notice of Permit Filing"postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be:Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property;or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made,and if additional information is required,you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

Just to follow up with some additional information. The secondary nursery for Mill Creek is defined with coordinates:
(8) Mill Creek - all waters west of a line beginning on the north shore at a point 34° 20.6420' N — 77°
42.1220' W; running southwesterly to the south shore to a point 34° 20.3360' N — 77° 42.2400' W
Shellfish sanitation also has a closure boundary for Mill Creek and it also has coordinates. RECEIVED

Past guidance has been to rely on the written descriptions over maps or GIS.All that I can find is"From the source to the Intracoastal Waterway".
Does DWR have coordinates that can be verified?
If not, it would seem the boundary should be where we have shown it and that the subject property based on that description alone would be in
the waters of Mill Creek and not the AIWW, and therefore SA;HQW.

We're working on a project located at 719 Hughes Rd in Hampstead on Mill Creek. It's my understanding per 02B .0225 (d) (7) (E), section
.0311 (e) (1)and section .0312 (e) (1)that Mill Creek is classified as SA:HQW and the boundary for ORW is the AIWW Does the attached
figure accurately show the boundary? I've copied Robb just in case this has come up in the past.

Page 128 of the Pender County Registry,SAVE AND EXCEPT AND RESERVING TO THE GRANTOR,
its successors and assigns. the 20-foot access easement to Hughes Road benefiting Tract B-2 as shown on

TOGETHER WITH an access easement for ingress,egress and regress between the portion of Tract

between the margin of the right of way of Hughes Road (SR 1603)and a point sixty (60) feet from such

the future addition of up to four(4)additional boat slips on or adjoining Tract B-2.
By the acceptance of this deed,Grantee agrees to operate,maintain,repair and replace for the benefit
of the owners of boat slips, docks, parking spaces and bulkhead located on Tract B-2 and the adjoining
riparian area in the same manner as the Grantee currently does for the benefit of the pier,dock and nine (9)
boat slips referred to as the Community Boating Facility in the Amendment to the Declaration of Covenants,
