This permit, issued on June 27,2023 , is subject to compliance with the application (where consistent with the permit),all applicable regulations, special conditions and notes set forth below.Any violation of these terms may be subject to civil or criminal penalties; or may cause the permit to be null and void. Marina Expansion 1) This permit authorizes the construction of additional wooden decking and 7 tie piles at the existing marina, all as expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes 6 additional formalized boat slips fora maximum of 28 formalized boat slips at this marina, as shown on the attached workplan drawing dated 2/17/23. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) All portions of the authorized structure shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard. through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. • Easement 8) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management, prior to the construction of any new boat slips or other docking facilities authorized under this permit. Sedimentation and Erosion Control 9) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. • 10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. USACE Conditions 11) In order to further protect the endangered West Indian Manatee, Trichechus manatus,the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines2017.pdf. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2023-01239). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Individual Water Quality Certification 6035 and assigned the project DWR Project No. 20230900v1. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at(252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of$400 was received by DCM for this project. Morehead City,North Carolina 28557-3421 Dear Mr. Howell: Please reference the application of the Southern Shores Civic Association for Department of the Army authorization and a State Water Quality Certification to install 7 tie pilings parallel to an existing bulkhead to create 6 additional boat slips in an existing marina in a man-made canal connected to Jean Guite Creek at 3 Loblolly Drive,in Southern Shores, Dare County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers(USACE)prior to implementation. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters,the permittee will be required, upon due notice from the U.S. Army Corps of Engineers,to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal, relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910- 3282 at least two weeks prior to beginning work and upon completion of work. 3. Except as specified in the plans attached to this permit,no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 4. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in the construction or maintenance of this project,within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 5. Unless otherwise authorized by this permit,all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 6. The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the work authorized by this permit and again upon completion of the work authorized by this permit. 8. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 9. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to,the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally,the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 10. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trog0ED the North Carolina Division of Environmental Management(NCDEM), 25 NTU's 51W saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, a.not2023 considered significant. Due to local ordinances, the tie piles will be placed to create a 7'x25' slip, a 8'x25', and four 11'x25' slips. The slips are intended to accommodate boats 15'x25' in size. The applicant also proposes the construction of a 4'x200' section of wooden decking to be connected to and incorporate the existing boardwalk. The site of the proposed development is located at 3 Loblolly Dive,Common Area Block 105 within the Town of Southern Shores,Dare County,adjacent to a man-made canal connected to Jean Guite Creek which leads to the Currituck Sound. The development proposal involves the Public Trust Area (PTA) and Public Trust Shoreline (PTA) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H.0208 Use Standards Paragraph (a) addresses General Use Standards, and sub-paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The applicant proposes the construction of 6 additional boat slips by placing 7 tie piles parallel to an existing bulkhead. Consistent: The development is designed to not interfere with shellfish beds, submerged aquatic vegetation, or spawning and nursery areas. Paragraph (a)(2)(B) states that development shall comply with state and federal water and air quality standards. Consistent: The proposed development will not violate water and air quality. Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural Resources. Consistent: There are no known archaeological or historical resources on the property. Paragraph (a)(2)(D) states that development shall not increase siltation. Consistent: It does not appear that this development will measurably increase siltation. Paragraph (a)(2)(E) states that development shall not create stagnant water bodies. Consistent: It does not appear that this development will create stagnant water bodies. Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent:The development will have minimum adverse effects on estuarine resources. Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The development proposes minimal effect on navigation. Paragraph (b) addresses Specific Use Standards. Of these, subparagraphs (5) Marinas pertain to this project,and those subparagraphs not listed are not applicable to this project. Paragraph(b)(5)(A) Marinas shall be sited in non-wetland areas or in deep waters (areas not requiring dredging) and shall not disturb shellfish resources, submerged aquatic vegetation as defined by the MFC, or wetland habitats, except for dredging necessary for access to high-ground sites. The following four alternatives for siting marinas are listed in order of preference for the least damaging alterative; marina projects shall be designed to have the highest of these four priorities that is deemed feasible by the permit letting agency: Southern Shores Civic Association Page 3 of 7 (i) an upland basin site requiring no alteration of wetland or estuarine habitat and providing flushing by tidal or wind generated water circulation or basin design characteristics. (ii)an upland basin site requiring dredging for access when the necessary dredging and operation of the marina will not result in significant adverse impacts to existing fishery,shellfish,or wetland resources and the basin design shall provide flushing by tidal or wind generated water circulation. (iii)an open water site located outside a primary nursery area which utilizes piers or docks rather than channels or canals to reach deeper water. (iv) an open water marina requiring excavation of no intertidal habitat, and no dredging greater than the depth of the connecting channel. Consistent: The proposed development is part of an existing marina expansion and requires no dredging or alteration of wetland or estuarine habitat and provides flushing by wind generated water circulation. Paragraph (b)(5)(B) Marinas that require dredging shall not be located in primary nursery areas nor in areas which require dredging through primary nursery areas for access. Maintenance dredging in primary nursery areas for existing marinas shall comply with the standards set out in Part (b)(1)(I) of this Rule. Consistent: The marina already exists and no dredging is being proposed. (C) To minimize coverage of public trust areas by docks and moored vessels, dry storage marinas shall be used where feasible. Consistent:The proposed development is consistent with the intent of this rule. (D) Marinas to be developed in waters subject to public trust rights (other than those created by dredging upland basins or canals) for the purpose of providing docking for residential developments shall be allowed no more than 27 square feet of public trust areas for every one linear foot of shoreline adjacent to these public trust areas for construction of docks and mooring facilities. The 27 square feet allocation does not apply to fairway areas between parallel piers or any portion of the pier used only for access from land to the docking spaces. Consistent: The parcel has a shoreline of± 518 ft2 which allows a maximum of± 13,986 ft2 of Public Trust Area occupation. The current marina has an estimated ± 6,160 ft2 of occupied Public Trust Area and the proposed additional slips will add± 2,250 ft2 for a new total of± 8,410 ft2 which is below the allowable maximum. (E) To protect water quality in shellfishing areas, marinas shall not be located within areas where shellfish harvesting for human consumption is a significant existing use or adjacent to such areas if shellfish harvest closure is anticipated to result from the location of the marina. Consistent: The proposed development is located adjacent to Jean Guite Creek and associated canals which are closed to shellfish harvest. Southern Shores Civic Association Page 4 of 7 (F) Marinas shall not be located without written consent from the leaseholders or owners of submerged lands that have been leased from the state or deeded by the State; Consistent:There are no submerged land leases within or adjacent to the project area. (G) Marina basins shall be designed to promote flushing through the following design criteria: (i) the basin and channel depths shall gradually increase toward open water and shall never be deeper than the waters to which they connect; (ii) when possible, an opening shall be provided at opposite ends of the basin to establish flow-through circulation. Consistent: The proposed development is consistent with the intent of this rule, and the existing marina is adjacent to man-made canals that are open to the north,south,and west promoting flow-through circulation. (H) Marinas shall be designed so that the capability of the waters to be used for navigation or for other public trust rights in estuarine or public trust waters are not jeopardized while allowing the applicant access to deep water. Consistent:The proposed development is consistent with the intent of this rule. (I) Marinas shall be located and constructed so as to avoid adverse impacts on navigation throughout all federally maintained channels and their boundaries as designated by the US Army Corps of Engineers. This includes permanent or temporary mooring sites; speed or traffic reductions; or any other device, either physical or regulatory, that may cause a federally maintained channel to be restricted. Consistent: The proposed development is consistent with the intent of this rule. (J) Open water marinas shall not be enclosed within breakwaters that preclude circulation sufficient to maintain water quality. Consistent: There are no breakwaters associated with this marina. (K) Marinas that require dredging shall provide areas in accordance with Part (b)(1)(B) of this Rule to accommodate disposal needs for future maintenance dredging, including the ability to remove the dredged material from the marina site. Consistent:The proposed development is consistent with the intent of this rule. (L) Marina design shall comply with all applicable EMC requirements (15A NCAC 02B .0200) for management of stormwater runoff. Stormwater management systems shall not be located within the 30-foot buffer area outlined in 15A NCAC 07H.0209(d). Consistent: The proposed development is consistent with the intent of this rule. (M) Marinas shall post a notice prohibiting the discharge of any waste from boat toilets and listing the availability of local pump-out services. Southern Shores Civic Association Page 5 of 7 Consistent: The proposed development is consistent with the intent of this rule. (N) Boat maintenance areas shall be designed so that all scraping,sandblasting, and painting will be done over dry land with collection and containment devices that prevent entry of waste materials into adjacent waters. Consistent: There are no boat maintenance areas associated with this marina. (0) All marinas shall comply with all applicable standards for docks and piers,shoreline stabilization, dredging and dredged material disposal of this Rule. Consistent: The proposed development is consistent with the intent of this rule. (P) All applications for marinas shall be reviewed-by the Division of Coastal Management to determine their potential impact to coastal resources and compliance with applicable standards of this Rule. Such review shall also consider the cumulative impacts of marina development in accordance with G.S. 113A-120(a)(10). Consistent:The proposed development is consistent with the intent of this rule. (Q) Replacement of existing marinas to maintain previous service levels shall be allowed provided that the development complies with the standards for marina development within this Section. Consistent:The proposed development is consistent with the intent of this rule. i SA NCAC 07H.0209 Use Standards Paragraph (d) addresses General Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph(c)of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, mitigate, or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use,and design characteristics shall comply with the general use and specific use standards for coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands,estuarine waters,and public trust areas described in Rule.0208 of this Section. Development shall be compatible with the following standards: Paragraph (d)(1) states all development projects, proposals,and designs shall preserve and not weaken or eliminate natural barriers to erosion including peat marshland, resistant clay shorelines,and cypress-gum protective fringe areas adjacent to vulnerable shorelines. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (d)(2) states all development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to adequately service the major purpose or use for which the lot is to be Southern Shores Civic Association Page 6 of 7 developed. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively demonstrate,through innovative design,that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are not increased and the applicant designs the project to comply with the intent of the rule to the maximum extent feasible. Consistent: The proposed 4'x200' of boardwalk will be constructed of slatted wooden decking and is therefore considered pervious. Paragraph (d)(3) states all development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. (B)No development project proposal or design shall permit an angle for graded slopes or fill which is greater than an angle which can be retained by vegetative cover or other erosion-control devices or structures. (C)All development projects,proposals,and designs which involve uncovering more than one acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of completion of the grading; provided that this shall not apply to clearing land for the purpose of forming a reservoir later to be inundated. Consistent: The proposed development is consistent with the intent of this rule. The property contains a man-made canal that connects to Jean Guite Creek and the Currituck Sound. The parcel is platted at ± 65,605 ft2 (± 1.51 acres). The parcel contains ± 518 ft of shoreline and elevations average 3.5 ft above Normal Water Level (NWL) in the high ground areas.The upland area is semi-developed with man-made features including gravel and asphalt driveways, gravel parking areas, concrete handicap parking pad, storage shed, porta-john, kayak racks, picnic tables, and benches. Upland areas that are undeveloped are primarily vegetated with domestic lawn grasses, pines, live oaks, Smilax species, and shrubs including wax myrtles and bays. The entire shoreline is hardened and contains a marina. The existing development within the marina includes finger piers, tie piles, 22 designated boat slips, platform, slatted wooden boardwalks, and electric and potable water access points. The property is adjacent to a man-made canal which is connected to Jean Guite Creek and the Currituck Sound. The waters of Jean Guite Creek and connecting canals are designated inland waters, classified as SC, and are closed to shellfish taking. Jean Guite Creek and connecting canals are also designated as a Primary Nursery Area by the North Carolina Wildlife Resources Commission (NCWRC). The widths of the canal within the project area (southern border) ranges from 45 ft to 52 ft. The width of the canal on the western side of the parcel ranges from 103 ft to 115 ft. No wetlands were found to exist within the parcel or project area. No Submerged Aquatic Vegetation (SAV) was observed growing within the project area. The shorelines of adjacent properties are similarly hardened and are developed with man-made structures including single family dwellings, platforms, and docking facilities. The property has undergone a series of permitted developments including the construction of the marina components including excavation, finger piers, tie piles, and platforms under Major Permit #149-01 and an associated modification (#149-01 MM). This major originally approved a walkway in the area they are currently proposing, but it was never constructed. There have also been two general permits issued for the property. Those permits include General Permit#48031A issued in 2007 for a boat lift and GP #55642A issued in 2010 for a floating platform. At this time, the property has not been evaluated for archeological significance. Development Proposal/Project Description The applicant is proposing the construction of six additional boat slips within the existing marina. These slips will be created by the placement of 7 tie piles resulting in a 7.5' x 25' slip, a 8' x 25' slip, and four 11' x 25' slips. Due to local ordinances within the Town of Southern Shores, the tie piles shall not protrude into any area within 15 ft of the centerline of the waterway. So while the boat slips are intended to accommodate boats up to 15'x25' in size, the tie piles will not be placed in those dimensions. Depths within the project area average 3'below NWL. The proposed boat slips will be constructed like others in the area, meet the'/4 width rule, and do not encroach within the 15' riparian access setback. The proposed boat slips are located ± 41 ft west of the platform located on the Camis Property and are ± 355 ft to the southeast of the dock located on the Pfizenmayer property. Southern Shores Civic Association Field Investigation Report Page 3 of 3 In addition to the docking spaces, the applicant is also proposing the construction of 4' x 200' slatted wooden boardwalk to be connected to an already existing boardwalk of similar structure and function. The proposed wooden boardwalk will begin where the existing boardwalk ends on the western side of the parcel, follow the bulkhead to the east, and stop ± 12 ft from the Cam is property line. This boardwalk is to provide access to the area of the proposed docking spaces and will incorporate a 4' x 30' area of already existing wooden decking. The wooden decking is within the 30' Coastal Shoreline Area of Environmental Concern (AEC) Buffer for a total of 800 ft2. Anticipated Impacts • The construction of the six docking spaces will usurp 1,488 ft2 of Public Trust Area AEC's. • The construction of the boardwalk will place 800 ft2 of slatted wooden decking within the 30' Coastal Shoreline AEC Buffer. • The installation of the proposed six docking spaces will increase the number of designated slips at the existing marina from 22 to 28 slips. As the adjacent property owners to the Loblolly Marina, as well as members of the SSCA, we are aware of the need for additional boat slips and are mostly in favor of these additions. We do have several concerns. The first concern is the potential erosion of privacy. This privacy currently exists because of the green belt consisting of a large number of trees. Trees are a great pride of the residents of Southern Shores, and we all lament the need to cut any down. From the description in the permit application, it would appear that no trees will be removed during the construction process. I would hope that this is true. The second concern is the proximity to the property line. From the site plan, it would appear that 6 slips will allow for 14 additional boats with one boat located very close to the property line. We are not concerned about the occasional comings and goings of boats, but this puts the walkway just shy of the property line. There are a lot of people who use this marina as a place to walk their dogs, and as such, we would request it be clear to all where one property ends and the next begins. And lastly, while not a concern, our last name is Camis and should be corrected.
