This permit, issued on March 16,2023 , is subject to compliance with the application (where
consistent with the permit),all applicable regulations,special conditions and notes set forth below.Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the docks,piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application.No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification.No non-water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) In order to protect juvenile shrimp and finfish populations,no pile driving shall be permitted between
April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of
the width of the water body. Measurements to determine width of the water body shall be made from the
normal high water line or the waterward edge of any coastal wetland vegetation which borders the water
body,whichever is more restrictive.
4) No sewage,whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharged at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
5) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six
feet in width and shall be elevated a minimum of four(4) feet above the wetland substrate as measured
from the bottom of the decking.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard,through regulation or otherwise, on the authorized facilities. At minimum,permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
7) This permit authorizes a maximum of one(1) formalized boat slip.
8) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource
agencies, electric stops shall be placed on the boat lift at a minimum height of 18" above the bottom
substrate to prevent the boat lift from disturbing the bottom substrate. The physical stops shall remain in
place for the life of the permitted docking facility.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
10) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
11) The authorized project is located within a primary nursery area(PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission,no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
Sedimentation and Erosion Control
12) In order to protect water quality,runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
13) Appropriate sedimentation and erosion control devices,measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.

14) In order to further protect the endangered West Indian Manatee, Trichechus manatus,the applicant must
implement the U.S. Fish& Wildlife Service's Guidelines,and strictly adhere to all requirements therein.

15) This permit shall not be assigned,transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
16) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
17) The permittee and/or their contractor shall meet with a representative of the Division prior to project
initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2022-02209).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of Individual
Water Quality Certification No. 005415 and assigned the project DWR Project No. 2022-1392.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at(252) 515-5400 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of$250 was received by DCM for this project.

Hello,
This is Hunter Bailey with Blue Water Marine. Gregg Bonnard sent me and email today explaining that instead of a 6'
access walk a 4' access walk will be allowed instead. He also stated that a moratorium was going to go in place April 1st-
September 30th and that the boatlift will need a limiter so it can go no lower than 18" off of the bottom. I would like to
stress some concerns and see if we can come to a compromise.
4' Access(Main dock out). In the emailed it said you would allow it to be 4'wide at 3' off the base of the marsh. We
would like to ask you to go back to the 6'width. Reason being the customers are an older couple and for safety reasons
the 6'width would be a much safer option for them than the 4'.The customers have also already punched there poles
and going any more than 4' off the marsh the poles would not be long enough to meet code.There are also several

docks adjacent to this one that are 6'wide at 3' off the marsh. Basically what we are asking is that would you permit the
6' width if we increased height off of the base of marsh from 3'to 4'.
If this can get sorted in a timely manner we will have not problem at all getting this job finished well before April 1st
when the moratorium goes into affect.This will not be a problem for us at all. If we can get the permit in the nest few
weeks we should have the project done middle of march at the latest.
The boatlift will be from Tide Tamer and it will come with a electronic limit switch so there will be no problem at all
having it set up to stop at 18" above the bottom. We can also install a more ridged option if that is more comfortable for
y'all.This will be no problem at all for us to meet.
Please let me know if you have any questions about this and again i do wish that you would consider letting my
customers have the 6'width because of them being an older couple and for there safety.

I did the drawings for the major permit for Bryan Hanson via Bluewater Marine Construction.The reason
the water depths changed is because I misinterpreted the field measurement drawing when I did them
in my office. I explained this to Brad early on once I noticed the mistake before they were circulated but
I think it fell through the cracks so to speak. It was an honest mistake and I apologize for the
inconvenience.The new drawings reflect the correct water depths and we decided to go ahead and put
the boat lift at the end of the dock. I am fully comfortable with any of the agencies doing their own

The following is my assessment and consequent recommendations of the above referenced proposal: The proposal
would shade 1,020 square feet of high ground, 3,300 square feet of Coastal Wetlands, and usurp 2,360 square feet
of Public Trust Area. The proposal is not adjacent to a Federal Channel. These waters of Harlowe Creek are
closed to shellfish harvest. There is no submerged aquatic vegetation present at this location.
This waterbody is a Primary Nursery Area.The proposed boatlift would be located in-1.0' nlw depth. This may
impact shallow bottom PNA habitat. Assuming that other State and Federal agencies concur, I would recommend
authorizing this proposal contingent upon the following conditions:
1. This permit authorizes a maximum of one boat slip. At no time shall more than one vessel be moored or
docked at the facility. The restriction on the number of vessels shall apply to all marine vessel types,
including but not limited to motorboats, sailing vessels and personal watercraft.
2. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, may become a permanent part of this docking facility without permit modification. No non-water
dependent uses of structures may be conducted on, in or over public trust waters without permit modification.
3. The docking facility and associated structures shall have a minimum setback distance of 15 feet between any
parts of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel,then drawing a line perpendicular to the channel line that intersects with
the shore at the point where the upland property line meets the water's edge.

Consistency Determination:The request is consistent with/not in conflict with Carteret County Land Use
Plan certified by the CRC on February 7, 2022.
Overview: The property is located at 221 Settlement Lane within Harlowe Creek near Newport, Carteret
County. This lot is currently developed with a residential dwelling. The elevation of the high ground on
the property is approximately 4' above the normal high water level. Vegetation on the property mainly
consists of pine trees, lawn grasses, and Coastal Wetlands. There is approximately 530' of shoreline on
this 8-acre tract.
AECs onsite include Estuarine Waters, Coastal Wetlands, Estuarine Shorelines, and Public Trust Areas.
Harlowe Creek surface water classifications are SA; HQW. This proposal is not located near a Federal
Channel. The site is designated as a Primary Nursery Area and is closed to shellfish harvest. Coastal
Wetlands are present onsite. SAV was not observed at this location. There are no historic/cultural
resources.
The applicant is proposing to construct a fixed pier, fixed platform, floating platform, and a boatlift. The
proposed pier would be 6' wide and 760' long. The proposed pier would originate at the high ground on
the property and traverse the Coastal Wetlands into Harlowe Creek. At the pier's waterward terminus,
the applicant is proposing a fixed"L" platform that would be 10' by 16'.On the north side of the proposed
fixed platform,the applicant is proposing a 13' by 13' boatlift. On the southern terminus of the platform,
the applicant is proposing a 3' by 12' aluminum gangway connection to a 6' by 20'floating platform.The
water depth within the proposed boatlift area is
-1.0' nlw.
Anticipated impacts
This proposal would not pose a hazard to navigation. The proposed docking facility would extend
approximately 550' waterward of nhw, and 40' waterward of the shoreline into this 188'-wide tributary.

This proposal would impact shallow bottom Primary Nursery Area habitat,as the proposed boatlift would
be sited in a location with -1' nlw. The proposal would shade 1,020 square feet of high ground, 3,300
square feet of Coastal Wetlands, and usurp 2,360 square feet of Public Trust Area.
Basis for Determination:
The project site is subject to the 2021 Carteret County Land Use Plan Update. The Future Land Use Map
(FLUM) designates the site as Rural with Services (land) and Conservation (Areas of Environmental
Concern). Uses allowed in Areas of Environmental Concern are those consistent with the State's minimum
use standards and state and federal regulations.
The following LUP policies may be applicable to this request:
Policy 2.1
Carteret County's policies for development in coastal and non-coastal wetlands(also known as
401,404, or jurisdictional wetlands) are as follow:
1. Carteret County will allow only land uses in coastal wetlands that require water access,
cannot function elsewhere,and are consistent with state and federal regulations.
Examples of acceptable uses are utility easements, piers, and docks.
Policy 2.4
Carteret County's policies for development in estuarine and public trust waters are as follow:
1. Carteret County will only allow development activities in estuarine and public trust
waters that are associated with water-dependent uses,consistent with state and federal
standards, and meet all local policies contained in this plan.

A North Carolina Division of Marine Fisheries (DMF)Fisheries Resource Specialist has
reviewed the N.C. Division of Coastal Management(DCM)Coastal Area Management Act
(CAMA)permit application for proposed actions that may impact fish and/or fish habitats. The
proposed work is located at 221 Settlement Lane,Newport,within Carteret County,North
Carolina. The applicant is proposing to construct a 1-slip docking facility within Harlowe Creek
at the project location. The waters of this site are classified as SA;HQW, are closed to shellfish
harvest,and are designated as Primary Nursery Area(PNA). The substrate at this location is soft
with shell and submerged aquatic vegetation(SAV) is not present.
The applicant is proposing to construct a fixed pier, fixed platform, and boatlift. The proposed
pier would be 6' wide and 760' long. The pier would begin on the high ground of the property,
cross coastal wetlands,and terminate in Harlowe Creek.At the terminus of the pier,the applicant
is proposing a 10' by 16' fixed L-shaped platform. On the north side of the platform,the
applicant is proposing a 13' by 13' boatlift. On the southern side of the platform,the applicant is
proposing a 3' by 12' aluminum gangway that connects to a 6' by 20' floating platform. The
water within the proposed boatlift area is-1.0' at normal low water(NLW).
As noted above,the location of the proposed construction is within waters designated as PNA.
Waters that have been designated as PNA are important estuarine waters where initial post-larval
development occurs. These areas provide the required environmental conditions, habitat, and
foraging grounds during vulnerable life history stages. Species found within PNAs are often
between early post-larval and juvenile stages of development,including finfish,crabs, and
shrimp. The species that utilize waters for PNA often have very strict water quality requirements
for continued growth to maturity, such as temperature and pH.Additionally,areas designated as
PNA often feature habitat specifics required by the species utilizing that area. Taking the above
into consideration, it is of the utmost importance that areas designated as PNA be protected from
impacts to the fullest extent possible.
DMF has significant concerns with the proposed project. Specifically,the proposed structure will
be located in waters designated as PNA that are less than 2' NLW and that feature soft bottom
habitat. Construction of the structures as proposed would likely result in immediate impacts,
including increased turbidity and noise during construction activities.The project would likely

result in long-term impacts associated with the continued use and life of the structure, including
prop dredging during boat use, smothering(if any boat or portion of the structure is allowed to sit
on the substrate), and increases in turbidity from while any boats are operating or when the boat
or structure lifts off the substrate. Increases in turbidity can cause injury and/or mortality to
species utilizing the area. The concerns regarding turbidity are particularly true in areas such as
the proposed project site that feature softer substrate that is easier to re-suspend into the water
column. Furthermore,the location of the project limits the ability of species utilizing the area as
PNA to avoid the project location. For example,the waterbody width may limit the ability of fish
to avoid the site by swimming around while migrating up-or down-stream, and there appears to
be no alternative route to avoid the area.As such,this could cause further direct and indirect
impacts to species, such as loss of foraging habitat and impacts associated with noise and
turbidity.
Taking the above into consideration, DMF would likely be opposed to the project unless the
design is adjusted. First,the purpose and necessity of the floating 6' by 20' floating dock was not
made clear,particularly as the application is for one slip. Removing this aspect would aid in
minimizing continued impacts of the structure,particularly the impacts associated with
smothering and turbidity. Therefore,the floating dock should be removed from the design unless
reasoning describing its necessity is provided.The plans should also be adjusted so that the
terminal platform and boatlift are within waters-2' at NLW. Additionally,the platform should
include design elements and/or restrictions that prevent this structure from being used as short-
or long-term docking. These could include elements such as railings and restrictions such as a
requirement preventing cleats from being installed on the platform. This will help to minimize
the likelihood of continued impacts with use of the structure. Updated plans should be provided
to reflect these recommended changes. Additionally,the updated plans should include
bathymetry lines with 0.5' to 1' increments. This will aid in minimizing any potential confusion
regarding water depths at the locations of proposed structures. As noted above, fish species
utilizing the area may be impacted due to the nature of the waterbody at this site, such as
waterbody width and substrate type.As such,DMF would recommend that any permit issued
include a 1 April through 30 September moratorium for in-water work to minimize potential
impacts to important fisheries species in this area.

The DWR has consulted with the Division of Marine Fisheries (DMF) regarding aquatic resource impacts associated with
this design proposal. The proposed facility is located within the water of Harlowe Creek which are classified as SA;HQW
by the DWR and have been designated as Primary Nursery Area by the DMF. As proposed, the DWR has concerns
regarding impacts to the aquatic resources associated with the construction and use of the facility. The DWR is required
to evaluate that if the proposed activity has avoided and minimized impacts to surface waters and wetlands to ensure any
remaining surface waters or wetlands,and any surface waters or wetlands downstream, continue to support existing uses during and
after project completion; in accordance with 15A NCAC 02H .0506 (b)(1). It appears the project can be redesigned and
relocated to further avoid and minimize potential significant adverse impacts by extending the docking facility to provide
access to the lift and dock into deeper waters. The DWR recommends the applicant provide additional information that
further demonstrates avoidance and minimization of impacts to the resources. The DWR is placing the project on-hold

Dear Mr. Hanson:
Attached hereto is a copy of Certification No.WQC005415 issued to Brian Hanson, dated January 23,
2023. This approval is for the purpose and design described in your application.The plans and
specifications for this project are incorporated by reference as part of this Water Quality Certification. If
you change your project,you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold,the new owner must be given a copy
of this Certification and is responsible for complying with all conditions. [15A NCAC 02H .0507(d)(2)].
Please understand that the waters around your project area have been identified as a Nursery Area and
requests to dredge within these areas must be consistent with 15A NCAC 02B .0220; 15A NCAC 02B
.0224 which requires that conditions of waters be suitable for all best uses provided for in state rule
(including, at minimum: aquatic life propagation, survival, maintenance of biological integrity, and
fishing,fish, and Primary Nursery Area(PNAs) wildlife; secondary contact recreation; and that activities
must not cause water pollution that precludes any best use on a short-term or long-term basis. The
Division supports the concerns and recommendations from the Division of Marine Fisheries and the
Wildlife Resources Commission regarding design and construction of the docking facilities located in the
shallow waters of designated Primary Nursery Areas.
This Water Quality Certification does not relieve the permittee of the responsibility to obtain all other
required Federal, State, or Local approvals before proceeding with the project, including those required
by, but not limited to, Sediment and Erosion Control, Non-Discharge,Water Supply Watershed,and
Trout Buffer regulations.
This Water Quality Certification neither grants nor affirms any-property right, license,or privilege in any
lands or waters,or any right of use in any waters. This Water Quality Certification does not authorize
any person to interfere with the riparian rights, littoral rights, or water use rights of any other person
and does not create any prescriptive right or any right of priority regarding any usage of water. This
Water Quality Certification shall not be interposed as a defense in any action respecting the
determination of riparian or littoral rights or other rights to water use. No consumptive user is deemed
by virtue of this Water Quality Certification to possess any prescriptive or other right of priority with
respect to any other consumptive user.

Upon the presentation of proper credentials,the Division may inspect the property.
This Water Quality Certification shall expire on the same day as the expiration date of the corresponding
Section 404 Permit. The conditions shall remain in effect for the life of the project, regardless of the
expiration date of this Water Quality Certification.
Non-compliance with or violation of the conditions herein set forth may result in revocation of this
Water Quality Certification for the project and may also result in criminal and/or civil penalties.
If you are unable to comply with any of the conditions of this Water Quality Certification you must notify
the Wilmington Regional Office within 24 hours(or the next business day if a weekend or holiday)from
the time the permittee becomes aware of the circumstances.
The permittee shall report to the Wilmington Regional Office any noncompliance with, and/or any
violation of, stream or wetland standards [15A NCAC 02B .0200] including but not limited to sediment
impacts to streams or wetlands. Information shall be provided orally within 24 hours(or the next
business day if a weekend or holiday)from the time the permittee became aware of the non-compliance
circumstances.
This approval and its conditions are final and binding unless contested [G.S. 143-215.5].
This Certification can be contested as provided in Chapter 150E of the North Carolina General Statutes by
filing a Petition for a Contested Case Hearing (Petition) with the North Carolina Office of Administrative
Hearings(OAH)within sixty(60)calendar days. Requirements for filing a Petition are set forth in Chapter
150E of the North Carolina General Statutes and Title 26 of the North Carolina Administrative Code.

Dear Mr. Howell:
Reference the application of Brian Hanson to construct a private, single slip docking
facility in waters of Harlowe Creek, adjacent to 221 Settlement Lane,in Mill Creek, Carteret
County,North Carolina.
Specifically,the applicant proposes to construct a fixed pier, fixed platform, floating
platform, and a boatlift. The proposed pier would be 6' wide and 760' long, originate at the high
ground on the property and traverse the Coastal Wetlands into Harlowe Creek. At the pier's
waterward terminus,the applicant is proposing a fixed"L"platform that would be 10' by 16'.
On the north side of the proposed fixed platform,the applicant is proposing a 13' by 13' boatlift.
On the southern terminus of the platform,the applicant is proposing a 3' by 12' aluminum
gangway connection to a 6' by 20' floating platform.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the following conditions be
included in the State authorization:
1. In order to comply with the North Carolina Coastal Habitat Protection Plan, all in
water work will occur outside of April 1 through September 30.
2. Stops will be installed on the floating dock at least 1.5' above the mudline.
3. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at

4. The pennittee must install and maintain, at his expense, any signal lights and signals

prescribed by the U.S. Coast Guard,through regulations or otherwise, on authorized facilities.
For further information,the permittee should contact the U.S. Coast Guard Marine Safety
Office at(910) 772-2191.
5. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers(USACE)prior to implementation.
6. Except as specified in the plans attached to this permit,no excavation, fill or
mechanized land-clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
7. Except as authorized by this permit or any USACE approved modification to this
permit,no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project,within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
8. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste,the
permittee shall immediately report it to the N.C. Division of Water Resources at(919) 733-
5083, Ext. 526 or(800) 662-7956 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
9. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products,organic materials (including debris from land
clearing activities), or unsightly debris will not be used.
10. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the,authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
11. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
12. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to,the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of

earthen fill,and the immediate stabilization of all disturbed areas. Additionally,the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statutes Chapter 113A Article 4).
13. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management(NCDEM),25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
14. The permittee,upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will,without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre-project condition.
15. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S.Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Dear Mr.Howell:
Reference the application of Mike Chesson,Leonard Furlough,and Mike Parrish to
construct a shared,private docking facility within waters of Tar Landing Bay,adjacent to 1805
E. Fort Macon Road, in Atlantic Beach, Carteret County,North Carolina.
Specifically,the applicant proposes to construct a 5' by 1,158' access pier that would
straddle the shared property line of 1805 & 1807 E. Fort Macon Road on the north side of the
lots in order to support access to Tar Landing Bay. A 5' by 88'pier would connect this proposed
pier to an existing neighboring access to the west. At the pier's waterward terminus,a 16' by 16'
fixed platform is proposed.North of this fixed platform, a 4' by 88' "T"platform would be
constructed to facilitate access to the six proposed boat slips. Each boat slip would have a 12' by
13' boat lift installed. There are four 3' by 24' finger piers proposed to extend northerly from the
"T"platform. Adjacent to the eastern terminus of the"T"platform, a 6' by 20' floating platform
is proposed to connect via a 3' by 12' aluminum gangway.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the following conditions be
included in the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus
manatus,the applicant must implement the U.S.Fish and Wildlife Service's Manatee Guidelines,

more light penetration from the edge of marsh waterward over the open water areas of
the pier and fixed platform will be used.
b. Due to the shallow water depth,physical stops will be placed on the floating platform at
18"above the substrate to prevent the floater from hitting the bottom as well as limiter
switches or physical stops will be placed on each boatlift to prevent bottom disturbances.
3. The permittee must install and maintain, at his expense,any signal lights and signals
prescribed by the U.S. Coast Guard,through regulations or otherwise, on authorized facilities.

project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
11. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include,but is not limited to,the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally,the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statutes Chapter 113A Article 4).
12. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management(NCDEM),25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
13. The permittee,upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will,without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre-project condition.
14. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Narrative Description:
The proposal is located adjacent to 221 Settlement Lane within Harlowe Creek near Newport,
Carteret County. This property is currently developed with a residence. This proposal is for private
use. The adjacent property to the property to the south is similarly developed and the adjacent
property to the north is undeveloped.
The elevation of the high ground on the property is approximately 4' above the normal high water
level. Vegetation on the property mainly consists of pine trees,lawn grasses,and Coastal Wetlands.
There is approximately 530' of shoreline on this 8-acre tract.
Water depths in the project area range from—0.0' to—2.0' nlw. The subaqueous substrate is soft
with shell. There is not a Federal Channel in the nearby vicinity of the project area. There is not a
cultural resource in the project area. This waterbody is approximately 188' across at this location.
These estuarine waters are classified as a Primary Nursery Area. Submerged aquatic vegetation
(SAV) is not present within the project area. This waterbody is closed to shellfish harvest and is
classified as SA; HQW.
Proposed Development:
The applicant is proposing to construct a 1-slip docking facility within Harlowe Creek in the
Chadwick Shores subdivision of Mill Creek.The proposed development would take place adjacent to
221 Settlement Lane, Carteret County. This proposal is for private use.
The applicant is proposing to construct a fixed pier,fixed platform,floating platform,and a boatlift.
The proposed pier would be 6' wide and 760' long. The proposed pier would originate at the high
ground on the property and traverse the Coastal Wetlands into Harlowe Creek. At the pier's
waterward terminus,the applicant is proposing a fixed"L"platform that would be 10'by 16'. On the
north side of the proposed fixed platform, the applicant is proposing a 13' by 13' boatlift. On the
southern terminus of the platform, the applicant is proposing a 3' by 12' aluminum gangway
connection to a 6' by 20' floating platform. The water depth within the proposed boatlift area is
-1.0' nlw.

Anticipated Impacts:
This proposal would not pose a hazard to navigation. The proposed docking facility would
extend approximately 550' waterward of nhw, and 40' waterward of the shoreline into this 188'-
wide tributary. This proposal would impact shallow bottom Primary Nursery Area habitat, as the
proposed boatlift would be sited in a location with-1' nlw. The proposal would shade 1,020
square feet of high ground, 3,300 square feet of Coastal Wetlands,and usurp 2,360 square feet of
Public Trust Area.
Traditional marine construction methodology would be utilized during the construction of this
project. Turbidity impacts are not anticipated during the construction activities within Harlowe
Creek. This waterbody is classified as a Primary Nursery Area. There is no SAV habitat present
within the project area. This waterbody is closed to shellfish harvest.

Our project is located at 221 Settlement Lane in Newport, NC. We are proposing
a new docking facility. The docking facility will have a 6'x760' dock walkway, 10'x16' dock
platform, 3'x12' gangway, 6'x20' floating dock, and a 13'x13' boat lift. The purpose of this
project is for recreational boating, fishing and wildlife observation. Logging malts will be used

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development located within Harlowe Creek adjacent to your property at
221 Settlement Lane near Newport,Carteret County. It was received on September 16,2022,
and appears to be adequate for processing at this time. The projected deadline for making a
decision is November 30, 2022. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above,you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 16, 2022, you
may request a meeting with the Director of the Division of Coastal Management and permit staff
to discuss the status of your project. Such a meeting will be held within five working days from
the receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along
the road right-of-way fronting your property, or at a point along the road right-of-way
where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
