Soundview Dr., in Newport , as requested in the permittee's application dated 11/7/22,
including attached workplan drawings (2), Sheet 1 of 2 dated "Rev 11/4/22" and Sheet 2 of 2 dated 9/15/22.
This permit, issued on March 27,2023 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the docks, piers, boat lifts, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non-water dependent uses of structures shall be conducted on, in or
over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharged at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.

ADDITIONAL CONDITIONS
3) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six
feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured
from the bottom of the decking.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of two(2) formalized boat slips.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
8) The permittee is advised that submerged aquatic vegetation(SAV)habitat exists in close proximity to
the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat
does not result from the construction and/or operation of the authorized facilities. Should dredging of
these areas be proposed in the future,the permittee is further advised that the Rules of the Coastal
Resources Commission prohibit new dredging within SAV beds.
9) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.
Sedimentation and Erosion Control
10) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
12) This permit shall not be assigned,transferred,sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
13) All construction debris associated with the removal or construction of the permitted development shall
be contained within the authorized project area and disposed of in an approved upland location.
14) The permittee and/or their contractor shall meet with a representative of the Division prior to project
initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2022-02604).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4497 and assigned the project DWR Project No. 2022-1631.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non-water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of$250 was received by DCM for this project.

Morning Ron,
I got back comments from USACE for Mr. Corbett. So I am ready to finalize. In looking back on our conversation with
the property line the above attachments were sent around to show the corrected/updated riparian lines for both
sides. This was a result of Mr. Campbell's objection to the riparian lines. The corrected/updated lines were signed off
on by Heather and we discussed adding them to the workplans(below). In my workload I do not think I followed up on
those changes. Can you make those changes on the plans and send them to me ASAP. Once I have those to me quick I
can get this out immediately.

Happy New Year and Good morning,the west line of roger Corbett and the east line of Campell is the same.Glenn
surveyed the lot and high water several years. When we started this project,we did a new high water and soundings.
The older high water is on the drawing. I am updating to the newest high water which is what I used for the riparian
lines. Mr. Cambell's sketch from gis is miss leading. I am attaching the two surveys,while the distances to the irons are a
little different you can see they are the same line. Will send the correct, latest version of high water,the riparian lines

Afternoon Ron,
I tried your office but you were not in, so I wanted to ask you a question about the property lines on this one. If you look
on page 2 I noticed that the property line between Corbett and Pelletier looks to be shifted towards the Corbett
property. We have an objection from the other neighbor(Campbell)where he believes, based off the plans you
provided, that his property line is shifted where he is losing about 2 feet or so of property. I think that the property lines
may be shifted to the left on the plans which would make Mr. Campbell's objection make sense.
Can you review the property lines and readjust if necessary? And let me know if this impacts the riparian buffers if the
adjustment is made?

I wanted to follow up on this request and provide NMFS' initial comments/questions regarding the proposed docking
facility. Specifically, NMFS is asking for detailed information regarding minimization efforts/considerations taken during
dock design to SAV habitat.Their questions are related to dock width reduction,decking materials and spacing, and
clarification of the height of the structure over SAV habitat. Please see attached for details regarding NMFS'questions.
I'll need to have these questions resolved in order to complete coordination/consultation w/NMFS and continue my
review of the proposed dock.

The following is my assessment and consequent recommendations of the above referenced proposal:
The applicant is proposing a pier, platform and two boatlifts that would extend into Bogue Sound a
maximum of 374'from the existing bulkhead. There would be a total of two slips along this parcel. The
proposed docking facility would exceed existing pier head length (275' from NHW) along this shoreline
however would remain within an existing pier headline (utilizing an existing longer pier approximately
700'to the east and a land peninsula approximately 650' to the west). The longer length would allow
the applicant to span beyond SAV and shallow water depths within the project area. All portions of the
development would be landward approximately 1000' of the ICW channel setback. The proposed
platform and slips with boatlifts would be located approximately 25'to 60'waterward of any SAV
depending on location. The development conforms to the guidelines set forth under 15A NCAC
07H .0208. Assuming that state and federal agencies concur with the proposal,the district recommends
the project be authorized as proposed, contingent upon the following conditions:
• The total number of slips shall not exceed a maximum of 2.
• All parts of the docking facility shall be landward of the ICW channel setback, not exceed a
maximum distance of 374' from the existing bulkhead and not exceed a maximum of 344' from
the edge of marsh (354' from NHW).The proposed docking facility shall also remain in line with
or landward of the existing adjacent docking facility to the east and the land peninsula to the
west.
• The pier, boatlifts and platform shall be placed as shown on plats dated received 11/8/22.
• All portions of the docking facility shall meet the minimum 15' riparian access line setback
(determined using the ICW alignment).

Consistency Determination:The request is consistent with/not in conflict with Carteret County Land Use
Plan certified by the CRC on February 7, 2022.
Overview: The property is s located at 149 Soundview Drive Newport, Carteret County. The residential
property is.781 acres(34,014.6 sf)in its entirety and an average of 7'above nhw. Bogue Sound runs along
the south side of the property. The property is cleared with fill and has an existing bulkhead that runs
along the shoreline.The waters of Bogue Sound have approximately 2.5'to 3' lunar tidal amplitude.
AECs onsite include Coastal Wetlands, Estuarine Waters and Public Trust Areas. Bogue Sound surface
water classifications are OR W/SA Waters. This area of Bogue Sound is not designated as a Primary
Nursery Area and is open to the taking of shellfish.There is a 30'x 111"section of coastal wetlands,which
consists mostly of(Spartina alterniflora)and (Spartina patens)along the 111'of shoreline on Bogue Sound.
The bottom substrate is sand and no SAV were observed within the proposed platform and slip areas(SAV
approximately 25'to 60' landward of the proposed platform and boatlifts). Bogue Sound is approximately
2.5 miles wide at this location. According to the Google Earth SAV 2018 flyover data provided by DMF,
there are SAV within this location approximately 300'from NHW.No SAV were observed beyond this point.
The applicant is proposing a pier, platform and two slips with boatlifts. SAV was not observed within the
proposed slip areas.
Anticipated impacts
The proposed docking facility would shade/incorporate 180 ft2 of coastal wetlands, shade/incorporate
1692 ft2 of SA V habitat, shade 528 ft2 and incorporate 840 ft2 of shallow bottom habitat (no SAV). The

located landward approximately 1000' landward of the ICW and would remain within an existing pier
headline (utilizing an existing longer pier approximately 700' to the east and a land peninsula
approximately 650'to the west).The longer length has the potential to allow the applicant to span beyond
SAV and shallow water depths within the project area.The proposed docking facility would also meet the
minimum 15' setback from the riparian access lines and not exceed a maximum distance of 344'
waterward of the edge of marsh or 354'from NNW. No SAV were observed within the proposed platform
and slip areas.
Basis for Determination:
The project site is subject to the 2021 Carteret County Land Use Plan Update. The Future Land Use Map
(FLUM) designates the site as Limited Transition (land) and Conservation (Areas of Environmental
Concern). Uses allowed in Areas of Environmental Concern are those consistent with the State's minimum
use standards and state and federal regulations.
The following LUP policies may be applicable to this request:
Policy 2.2
Carteret County's policies for development in coastal shoreline areas are as follow:
1. Residential and commercial development meeting the state's minimum use standards shall be
allowed in coastal shorelines and ORW estuarine shoreline classified lands. Construction will be
in accordance with all Carteret County ordinances. Allowed densities are set forth in future land
use map category descriptions beginning on Page 85 of this land use plan.
2.Carteret County will allow all uses(such as residential,commercial,industrial,and institutional)
in estuarine shoreline and ORW estuarine shoreline areas, provided all local, state, and federal
standards are satisfied.
Policy 2.1
Carteret County's policies for development in coastal and non-coastal wetlands (also known as 401, 404,
or jurisdictional wetlands)are as follow:
1.Carteret County will allow only land uses in coastal wetlands that require water access,cannot
function elsewhere,and are consistent with state and federal regulations. Examples of acceptable
uses are utility easements, piers, and docks.

I wanted to follow up on this request and provide NMFS' initial comments/questions regarding the proposed docking
facility. Specifically, NMFS is asking for detailed information regarding minimization efforts/considerations taken during
dock design to SAV habitat.Their questions are related to dock width reduction,decking materials and spacing, and
clarification of the height of the structure over SAV habitat. Please see attached for details regarding NMFS' questions.
I'll need to have these questions resolved in order to complete coordination/consultation w/NMFS and continue my
review of the proposed dock.

dated received by this office on November 1, 2022. DWR issues approval in the form of a Water Quality
Certification (WQC) in conjunction with the CAMA Major Permit and Regional General Permit(s)
198000291 or 197800056 issued by the US Army Corps of Engineers (USACE). This Certification allows
you to use the CAMA Major Permit when the Division of Coastal Management issues it.
In accordance with the attached General Certification #4497 (GC 4497), the impacts described in your
application do not require written authorization to utilize GC 4497. However,you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal,state and local requirements before you go ahead with your project including(but not limited to)
erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a

nhw.Bogue Sound runs along the south side of the property.The property is cleared with fill
and has an existing bulkhead that runs along the shoreline. There is a 30' x 111" section of
coastal wetlands,which consists mostly of(Spartina altemiflora)and(Spartina patens)along
the 111' of shoreline on Bogue Sound.The waters of Bogue Sound have approximately 2.5'to
3' lunar tidal amplitude.
The Division of Water Resources classifies this area as ORW/SA Waters.This area of Bogue
Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish.The
Carteret County Land Use Plan classifies this area as Residential with Conservation within the
AECs. According to Google Earth spacial data, the ICWW is located approximately 1000'
waterward(south)of the most southern proposed platform and proposed slips with boatlifts.
Water depths within this project location are -.5'nlw/mlw to -1.5' nlw/mlw depending on
location. The bottom substrate is sand and no SAV were observed within the proposed
platform and slip areas(SAV approximately 25'to 60'landward of the proposed platform and
boatlifts). Bogue Sound is approximately 2.5 miles wide at this location. According to the
Google Earth SAV 2018 flyover data provided by DMF,there are SAV within this location
approximately 300' from NHW. No SAV were observed beyond this point.
10) Proposed Development:
The applicant is proposing a pier,platform and two slips with boatlifts. SAV was not
observed within the proposed slip areas.
The applicant is proposing to add a 6' x 362' pier that would extend from the existing
bulkhead over coastal wetlands and into Bogue Sound. The pier would intercept a 12' x
20' t-head platform that would have a 12' x 13' boatlift on either side (max of two slips).
The closest section of the proposed platforms and boatlifts are approximately 25' to 60'
waterward (depending on location)of the edge of SAV habitat. The most waterward
portion of the proposed docking facility would not exceed a maximum of 354' from NHW,
and 344' from the edge of coastal wetlands. The proposed docking facility would exceed
existing pier head length(275' from NHW) along this shoreline however would remain
within an existing pier headline (utilizing an existing longer pier approximately 700' to the
east and a land peninsula approximately 650' to the west). The longer length would allow
the applicant to span beyond SAV and shallow water depths within the project area. All
parts of the docking facility would be landward of the ICWW channel (approximately
1000' landward) and a minimum of 29.5' from both riparian corridors. Riparian corridors
were determined utilizing the ICWW aligment. There would be a total of two slips with
boatlifts. The boat size would be limited to a maximum of 24' and of open runabout
design. The water depths within the slip areas are -1.2' nlw to -1.7' nlw/mlw depending on
location,with connecting water depths of-1.9' plus nlw/mlw.

11. Anticipated Impacts:
The proposed docking facility would shade/incorporate 180 ft2 of coastal wetlands,
shade/incorporate 1692 ft2 of SAV habitat, shade 528 ft2 and incorporate 840 ft2 of shallow
bottom habitat(no SAV). The increase in suspended sediment and turbidity levels from the
piling placement would be temporary, occur while the piling placement is taking place and
should be minimal given the bottom composition. The proposed docking facility should
not be a hindrance to navigation due to the fact all portions would be located landward
approximately 1000' landward of the ICW and would remain within an existing pier
headline (utilizing an existing longer pier approximately 700' to the east and a land
peninsula approximately 650' to the west). The longer length has the potential to allow the
applicant to span beyond SAV and shallow water depths within the project area. The
proposed docking facility would also meet the minimum 15' setback from the riparian
access lines and not exceed a maximum distance of 344' waterward of the edge of marsh
or 354' from NHW. No SAV where observed within the proposed platform and slip areas.

The proposed development includes a pier to a platform with two boat lifts. The slips are

approximately 830' to the west with no current docks. The location of this line is waterward of
the visible SAV's but still is less than 2' at low water. The proposed line follows the main shore
uniformly until reaching the peninsula.

Coastal Area Management Act(CAMA)major permit application submitted by Roger Corbett to the N.C.
Division of Coastal Management(DCM)requesting authorization to construct a docking facility.
The Coastal Area Management Act permit review process involves a coordinated multi-agency review of
each permit application, with all review agency and public comments considered by the Division before
final action is taken. In this case,no inconsistencies with the Coastal Area Management Act were
identified. Consequently,the Division of Coastal Management(DCM)issued CAMA Major Permit No.
42-23 for the proposed activity on March 27,2023. A copy of the Major Permit is enclosed. I would like
to draw you attention to condition no. 9 requiring the structure to be a minimum of 15 feet from the
riparian area of access.
If you wish to contest our decision,you may file a request for a Third-Party Appeal pursuant to N.C.G.S.
113A-121.1(b). The hearing request must be filed with the Director,Division of Coastal Management, in
writing and must be received within twenty(20)days of the permit decision. The Chair of the Coastal
Resources Commission will consider the case and determine whether to grant your request. More

Thank you for speaking with me on 12/09/22. I am the property owner of the adjacent lot to
the West and North of the proposed project listed above. After review of the documents sent, I
feel that the western waterfront property line is not correct thus the 15 feet Riparian Setback is
incorrect. As documented in the Boundary Survey for Garton Lee Campbell, FB 313 PG 75, Mr.
Corbett's bulkhead encroaches 2.1 feet onto my property with a SIS/Set Iron Stake in place and
boundary line coordinates of S 01'06'09" as represented by attached Boundary Survey.
On the Overall Site Plan Sheet from The Cullipher Group, PA dated 9/12/22, the Riparian Line is
placed incorrectly on the wrong western boundary edge. The correct boundary edge is
appreciated on the graph by a faint line more eastern to the bold proposed boundary line as
noted by the above bulkhead encroachment and boundary line coordinates.
Please re-evaluate the western water boundary line, Riparian Line and 15 foot Riparian Setback
to make sure they are correct secondary to the above stated encroachment onto my property
as I will be applying for the development of a private boat docking facility in the near future for
my property.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your project at 149 Soundview Drive. in Newport, Carteret County. The
application was received as complete on 11/8/2022 and appears to be adequate for processing at this time.
The projected deadline for making a decision is 1/22/2023.An additional 75-day review period is provided
by law when such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 11/8/2022,you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of your
written request and shall include the property owner,developer,and project designer/consultant
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property,or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required,you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing
if you wish to receive a copy of my field report and/or comments from reviewing agencies.
