This permit, issued on May 10,2023 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Offshore Sill and Revetment Placement 1) This permit authorizes the placement of the offshore sill and revetment and revetment. No other structures shall become a permanent part of this structure without permit modification. No non-water dependent uses and structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee is advised that submerged aquatic vegetation(SAV) habitat exists in close proximity to the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat does not result from the construction of the authorized offshore sill and revetment and revetments. The offshore sill and revetment and revetments shall be located in areas with no SAV coverage at the time of construction, to the greatest extent practicable. Permit No. 51-23 Page 2 of 3 ADDITIONAL CONDITIONS 3) To reduce direct impacts to oyster resources, the permittee shall relocate all oysters falling within the footprint of offshore sill and revetment to an area immediately adjacent to the project area. 4) The offshore sill and revetment material shall consist of clean oyster shell, granite, marl, or broken concrete units with no exposed rebar. Sill materials shall be of a sufficient size and design to prevent its movement from the approved alignment by wave or current action. The permittee shall be responsible for immediate removal of any materials or debris that becomes dislodged or moves outside the authorized alignment. 5) The alignment of the offshore sill and revetment shall not exceed the alignment as depicted in the attached permit application and workplan drawings. 6) The height of the permitted offshore sill and revetment shall not exceed the heights, as depicted on the attached workplans. 7) Offshore sill shall be marked at 50-foot intervals with yellow reflectors extending at least three feet above normal high water. 8) No open water shall be excavated or filled, even temporarily, outside of the approved offshore sill and revetment alignment. 9) No vegetated wetlands shall be excavated or filled, even temporarily. 10) This permit does not authorize any fill waterward of the approved alignment. 11) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4501 and assigned the project DWR Project No. 20161173v3. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 515-5400 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high-water level. • NOTE: An application processing fee of$400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. These waters of Bogue Sound are open to shellfish harvest and classified as Outstanding Resource Waters (ORW). This waterbody is not a Primary Nursery Area. This proposal will not pose a hazard to navigation. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) The offshore sill section along the west shall be setback 15 feet from the adjoining property line and the riparian access dividing line (no waiver obtained). 2) The sill should be marked at 50-foot intervals with yellow reflectors extending at least three feet above mean high water. 3) The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 4) The revetment along the west side of the parcel shall not exceed 6' waterward f the escarpment and shall not exceed a height of 6 inches above the marsh substrate. DATE: March 2, 2023 Consistency Determination: The request is consistent with/not in conflict with the Town of Indian Beach Core Land Use Plan certified by the CRC on November 20, 2007. Overview: The property is located adjacent to Bogue Sound at 1700 Salter Path Road in Indian Beach, Carteret County. This property is developed with condominium units, a docking facility, amenities, vinyl bulkheads and a dilapidated offshore sill. A major modification was issued on 12/12/2016(expired on 12/31/2020)for the construction of an oyster shell bag offshore sill. Since the placement of the sill, per the applicant, harvesting activities have severely damaged and weekend the existing structure. The applicant wishes to construct a Quick Reef living shoreline with a new alignment approximately 30' waterward of NHW/MHW using the remaining oyster shell bags from the damaged sill as a base as well as 42'revetment(along the west side of the parcel)within Bogue Sound, Carteret County. The average elevation of the high ground of the parcel is about 8'above the normal high water level(nhw). There is approximately 1,202'of continuous shoreline along Bogue Sound on this tract of land.Vegetation on the property mainly consist of palm trees, coastal wetlands, and lawn grasses. Immediate offshore water depths adjacent to the parcel range from-0.3'to-1.2' normal low water level(nlw).The subaqueous substrate is firm with shell. There is submerged aquatic vegetation in the nearby vicinity of the project area. AECs onsite include EW & PTA. Bogue Sound is classified as ORW (Outstanding Resource Water), is not a Primary Nursery Area (PNA), and is open to the harvesting of shellfish. The site presently contains no Submerged Aquatic Vegetation (SAV).There are no cultural resources in the nearby vicinity of the project area. Anticipated impacts The proposal will not pose a hazard to navigation. The proposed sill would extend approximately 30'-35' waterward into Bogue Sound.The proposed sill and revetment would fill approximately 7,403 square feet of shallow bottom habitat. Basis for Determination The project site is located in Carteret County and is subject to the 2007 Town of Indian Beach Core Land Use Plan.The Future Land Use Map(FLUM)designates the site as Multi-Family Residential. The following LUP policies may be applicable to this request: P.17, pg. 105: "Except as otherwise permitted in this plan, residential, multi-family/mixed use, and office/institutional development should not be supported in natural heritage areas, conservation areas, or coastal wetlands. Residential and commercial development which meets 15A NCAC 7H(complies with state and federal environmental regulations) use standards will be allowed in estuarine shoreline, estuarine water, and public trust areas". P.35,pg. 112: "The town supports the installation of properly engineered and permitted bulkheads." P.46, pg. 115: The town supports the guidelines of the Coastal Area Management Act, the efforts and programs of the North Carolina Department of Environment and Natural Resources, Division of Coastal Management, and the Coastal Resources Commission to protect the coastal wetlands, estuarine waters, estuarine shorelines, and public trust waters of the town. Specifically, the applicant proposes to construct a 1,312-foot-long offshore sill with baffled and overlapping gaps, and a 42-foot-long revetment. These structures are being proposed to further protect the shoreline and replace the previously constructed oyster sill, which according to the applicant has been damaged/weakened due to harvesting activities and recent King tides. The current proposal is to construct a Quick Reef living shoreline on new alignment, approximately 30' waterward of NHW/MHW, utilize the remaining oyster shell bags from the damaged sill base, and construct a 42' long revetment along the west side of the property. The project consists of constructing a 1,312'offshore sill with 13'of baffled or overlapping gaps and approximately 30' waterward of the normal high-water level,and a 42' marsh toe revetment (revetment along the west side of parcel) immediately waterward of mean low water. The total sill length along the shoreline would be 1,312', base width of 5' and a centerline height of 21 inches. There would be (9) 5'wide baffled gaps and (3) 5'wide overlapping gaps to allow for water flushing, fish movement as well as kayak launching areas. All sections of the sill would be 100' long or shorter except for the sections at each end of the structure. They are also proposing a 42'revetment(Quick—Reef) landward of the proposed sill and along the west side of the parcel where the erosion is more prevalent. The revetment would not extend farther than 6'waterward of the escarpment and no more than 6 inches above the coastal wetland substrate. There is no earthen fill or marsh planting being proposed in conjunction with this sill at this time. -2- The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.goviraleigh/pdfs/ManateeGuidelines2017.pdf 2. The permittee must install and maintain,at his expense, any signal lights and signals prescribed by the U.S. Coast Guard,through regulations or otherwise, on authorized facilities. For further information,the permittee should contact the U.S. Coast Guard Marine Safety Office at(910) 772-2191. 3. All work authorized by this permit must be performed in strict compliance with the submitted plans,which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers(USACE)prior to implementation. 4. Field Investigation Report: Ocean Club Master Assoc Page 2 Narrative Description: The property is located adjacent to Bogue Sound at 1700 Salter Path Road in Indian Beach,Carteret County. This property is developed with condominium units, a docking facility, amenities, vinyl bulkheads and a dilapidated offshore sill. The adjacent property to the east used to be a campground and the property to the west is undeveloped. The average elevation of the high ground of the parcel is about 8' above the normal high water level (nhw). There is approximately 1,202' of continuous shoreline along Bogue Sound on this tract of land. Vegetation on the property mainly consist of palm trees, coastal wetlands, and lawn grasses. Immediate offshore water depths adjacent to the parcel range from—0.3' to—1.2' normal low water level(nlw). The subaqueous substrate is firm with shell. There is submerged aquatic vegetation in the nearby vicinity of the project area. There is not a cultural resource in the nearby vicinity of the project area. This waterbody is approximately 2.3 miles across at this location. These coastal waters are not classified as a Primary Nursery Area and submerged aquatic vegetation habitat is present at this location. This area is open to shellfish harvest and is classified as Outstanding Resource Waters(ORW). There is not a defined Federal Channel in the nearby vicinity of this project area. This project area is within the White Oak River Basin. Traditional marine construction methodology will be utilized during the construction of this private project. Minimal temporary turbidity impacts are anticipated during construction. There is not a cultural resource in the nearby vicinity of the project area. These waters of Bogue Sound are not classified as a Primary Nursery Area and the presence of submerged aquatic vegetation was not observed in the immediate vicinity of the project area but should not be impacted by this proposal. This area is open to shellfish harvest and is classified as Outstanding Resource Waters. There is not a defined Federal Channel near the project area. Heather Styron February 13,2023 Morehead City Project Name: Ocean Club Living Shoreline Project Address: 1700 Salter Path Rd,Atlantic Beach, North Carolina (NC) Owner: Ocean Club Master Association Non-Project Project Sponsor: North Carolina Coastal Federation Consultant and Contractor: Native Shorelines, a division of Restoration Systems, LLC The subject soundside shoreline at the Ocean Club condominium complex is in direct need of stabilization and restoration due to ongoing, consistent erosion with no significant accretion of material. An oyster shell bag offshore sill was constructed on this site in 2017, but harvesting activities severely damaged the structure, weakening it. King tides in 2022 subsequently destroyed most of the damaged structure. The proposed conceptual plan includes construction of a QuickReefTM living shoreline on a new alignment approximately 30 feet(ft)waterward of mean high water(MHW)using the remaining oyster shell bags from the damaged sill as a base. The proposed living shoreline will provide protection to the existing bulkhead and remaining natural salt marsh wetlands on site. This will reduce future maintenance of the bulkhead for The Ocean Club Master Association as well as protect the remaining natural shoreline from further erosion. It will improve intertidal habitat and increase resilience of the property to storm events. The sill system in this location will allow oyster recruitment and growth and is intended to generate an intertidal oyster reef but will be more resistant to harvesting damage than the previous structure The proposed living shoreline will consist of a 1,312-ft long offshore sill with baffled and overlapping gaps and a 42-ft long revetment.The offshore sill will have a base width of 5 feet (ft) and a height of 21 inches (in)along the centerline. It will extend no more than 30 ft waterward of MHW and will be constructed using QuickReefTm. QuickReefTm is an alternative living shoreline material composed of limestone from the Belgrade and Castle Hayne quarries, oyster shells, and portland cement. Mesh bags from the existing damaged sill containing recycled oyster shells (not alive)will be moved to the new alignment to form the base of the new sill.A 42-ft section of the living shoreline where erosion is significant will be a QuickReefn" revetment behind the sill. This portion will not extend further than 6 ft waterward from the escarpment and no more than 6 in higher than the existing coastal wetlands. There will be nine (9)5-ft wide baffled gaps and three (3)5-ft wide overlapping gaps to allow for water flushing and fish movement.The overlapping gaps are placed and designed to facilitate water access and kayak launching by Ocean Club residents.
