This permit, issued on August 25, 2023 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Breakwaters 1) The breakwater sections shall be positioned no more than 25 feet waterward of the pre-project normal water level contour. 2) Breakwater sections authorized under this permit shall be allowed only in waters that average less than three feet in depth along the proposed alignment as measured from the normal water level contour. 3) The height of the permitted breakwater shall not exceed six inches above the normal water level. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty(20)days of the issuing date. of the Coastal Resources Commission. In issuing this permit,the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Bertie County Permit No. 95-23 Page 2 of 4 ADDITIONAL CONDITIONS 4) The breakwater shall be constructed with an equal gap between each sheathing board totaling at least one inch of open area for every linear foot of breakwater. 5) The alignment of the authorized breakwater sections shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re-staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 6) The permitted breakwater sections shall be constructed of treated wood,plastic lumber, metal or vinyl sheet piles or other suitable materials approved by Department personnel. 7) Each breakwater sections shall be marked with yellow reflectors extending at least three feet above mean high water. 8) No backfill of the breakwater sections or any other filling of wetlands, estuarine waters, public trust areas or high ground is authorized by this permit. 9) The offshore breakwater sections shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 10) Perpendicular sections, return walls or sections which would enclose estuarine waters or public trust areas shall not be allowed under this permit. 11) In accordance with commitments made by the permittee, the permittee shall maintain the breakwater sections in good condition and in conformance with the terms and conditions of this permit and the Monitoring Plan, dated "Received MP Section MHD 7/10/2023". Damaged breakwater sections shall be removed within 90 days of notification from the Division of Coastal Management. Shoreline Stabilization—Coir Loss 12) The shoreline stabilization shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 13) No open water shall be excavated or filled, even temporarily, outside of the approved shoreline stabilization alignment. 14) The alignment of the authorized coir log and plantings shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re-staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. Bertie County Permit No. 95-23 Page 3 of 4 • ADDITIONAL CONDITIONS Sedimentation and Erosion Control 15) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 16) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. Department of Natural and Cultural Resources • 17) Prior to the initiation of any land-disturbing activities authorized by this permit,the permittee shall, in coordination with the N.C. Department of Cultural Resources (NCDCR), develop and implement an archaeological survey of the proposed project area. Initiation of permitted land-disturbing activities shall not begin until written approval is obtained from NCDCR, and a copy of such approval has been • submitted to the Division of Coastal Management. USACE Conditions Y 18) No in-water work shall be conducted in waters of the U.S. designated by the National Marine Fisheries Service as Atlantic sturgeon critical habitat from February 1st through June 30th. 19) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish& Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines2017.pdf. General 20) In accordance with commitments made by the permittee, the Estuarine Waters located immediately landward of the breakwater sections shall be planted with native Cyprus tree species, and the Estuarine Shoreline shall be planted with native species all expressly and specifically detailed in the attached narrative, workplan drawings and memo "Plant Specifications for TGOW Project dated 10/18/21". These plantings shall be monitored, and replanted as necessary, for a minimum period of 5 years after the first planting event, or until the Division of Coastal Management has notified the permittee in writing that the planting efforts has been deemed successful. Documentation of the monitoring results shall be provided annually to the Division of Coastal Management. Division of Water Resources has authorized the proposed project under Individual Water Quality Certification No. 005997 (DWR Project No. 2023-0602). • NOTE: The U.S.Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2023-01332). NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of$400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The species identified reflected species at the site which are existing and vigorous in their growth and distribution. • Robinia pseudo-acacia is principally found in the mountains and piedmont environments,however,appears as a ubiquitous distribution at the site. The choice was intended because the root system appears to be very effective in the slope stabilization. This choice can be eliminated and replaced with Acer rubrum. • Yucca filamentosa is the preferred species for this zone of planting but was rejected because native species were not available. However,since we may now have time for the supplier to provide this species,we can use this plant;and • Our plant supplier can provide native(non-cultivar)Rosa carolina and Acer rubrum. In addition, at the base of the erosion escarpment the entire shoreline will involve the installation of coir logs implanted with bald cypress to stabilize the base of the escarpment.Along the crest of the escarpment a mix of vegetation which has been observed at the site will be planted with the expectation that the escarpment will obtain a stable slope. The site will be monitored for planting mortality every two months for the first half of year after implementation.The site will then be monitored for planting success every six months for the following two years.Once the plants have established a sufficient root system to withstand wave energies,the temporary wooden sills will be removed. It is anticipated that there will be plant and/or structural failure due to the high potential of a storm or series of storms with sufficient energy to cause damage. We have reviewed the submittal and offer the following comments: One archaeological site,31BR49,has been previously recorded within the project area. The site has not been systematically investigated to delineate its boundaries and it has not been assessed for listing in the National Register of Historic Places(NRHP). Based on previous archaeological investigations,we expect the site to contain significant archaeological features and artifacts relating to the settlement of the Roanoke Colony. Prior to the initiation of any ground disturbing activities within the project area,we recommend that a comprehensive archaeological survey be conducted.The purpose of this survey will be to delineate the boundaries of site 31 BR49,evaluate the significance of the site that may be damaged or destroyed by the proposed project,and make recommendations regarding the site's eligibility status in terms of the National Register of Historic Places. Overview: The applicant proposes to construct a series of 14 parallel sills 20 feet apart for the planting of Bald Cypress and the placement of core logs along the erosion escarpment to help with the erosion along the shoreline. The property known as the "Tall Glass of Water" is located at 234 Bal Gra Road in Bertie County and consists of approximately 132 acres adjacent to the Chowan River.The property currently is a vacant lot with an access road down to a sandy beach area.The property to the north is a vacant lot used for farming and the property to the South is a wooded vacant lot. Vegetation on the site includes, but is not limited to, Bald Cypress (Taxodium distichum), Red Maple (Acer rubrum), Adam's needle (Yucca filmentose), Carolina Rose (Rosa Carolina), Prickly bramble (Rhus argutus), Muscadine (Vitis rotundifolia), Virginia creeper (Parthenocissus. quinquefolia), along with other trees and shrubs. Soil Types include Bibb & Johnston loarns (BB), Goldsboro sandy loam (GoA) and Winton Fine sandy loam (WtE). The property has an elevation of approximately 25 feet above normal water level (NWL)along the shoreline. The shoreline is 4,400 feet in length and currently has no shoreline protection which has created a very steep erosion escarpment (+/-25 ft). AECs onsite include EW, ES, PTS, and PTA. The water classification for this area is Primary Contact Recreation, Fresh Water(B) and Nutrient Sensitive Waters (NSW) and is closed to shellfishing. The water depths within the project area average 2.5 feet. When the site visit was conducted there was no Submerged Aquatic Vegetation present in the proposed project area. Project Setting The property proposed for development known as the "Tall Glass of Water" is located at 234 Bal Gra Road in Bertie County and consists of approximately 132 acres adjacent to the Chowan River. The property currently is a vacant lot with an access road down to a sandy beach area. The property to the north is a vacant lot used for farming and the property to the South is a wooded vacant lot. Vegetation on the site includes, but is not limited to, Bald Cypress (Taxodium distichum), Red Maple (Acer rubrum), Adam's needle (Yucca filmentose), Carolina Rose (Rosa Carolina), Prickly bramble(Rhus argutus), Muscadine(Vitis rotundifolia),Virginia creeper(Parthenocissus quinquefolia), along with other trees and shrubs. Soil Types include Bibb & Johnston loarns (BB), Goldsboro sandy loam (GoA) and Winton Fine sandy loam (WtE). The property has an elevation of approximately 25 feet above normal water level (NWL) along the shoreline. The shoreline is 4,400 feet in length and currently has no shoreline protection which has created a very steep erosion escarpment (+/-25 ft). The water classification for this area is Primary Contact Recreation, Fresh Water (B) and Nutrient Sensitive Waters (NSW) and is closed to shellfishing. The water depths within the project area average 2.5 feet. When the site visit was conducted there was no Submerged Aquatic Vegetation present in the proposed project area. Development Proposal The applicant proposes to construct a series of 14 small, temporary parallel sheet pile sills that are 5 foot long with 3 pilings placed in a "v" to establish 2 walls approximately 10 foot long to offer protections for the planting a 3 Bald Cypress along 456 feet of shoreline adjacent to the beach area. The sills will be placed 20 feet apart. The applicant also proposes to place_ core logs at the base of the erosion escarpment using three 4 X 4 pilings to secure each log. Each of the ?7 1ags will be implanted with 1 gallon plants spaced with 10-12 foot centers with bare roots plants between them. ".,e--„,,,:, —44 i f•A t4 .-4 '6- DCM-MHD CITY Project Narrative Shoreline Erosion Control for Tall Glass of Water February 1, 2023 The proposed plan is to construct a series of small,temporary parallel sheet pile sills of non-salt treated material (5 foot long 4 x 4 pilings)with 3 pilings placed in a vee to establish 2 walls±10 foot long with wooden sheet piles(8 inches wide by 6 foot deep)to offer protection for planting of 3 Bald Cypress along the 456 feet of shoreline adjacent to the bathing beach area (phase 1).The sills will be spaced 20 feet apart and constructed of consistent with T 15 NCAC 07H.2100.The trees will be one 3 gallon and two 1-gallon plants placed on 10 foot centers. At the base of the erosion escarpment along the shoreline in phase 1, core logs will be secured using three 4 x 4 piling(non-salt treated)to secure each log.The logs will be implanted with 1-gallon plants spaced at 10-to-12-foot centers with bare root plants installed between the 1 gallon plants.These will be installed along the entire length of the shoreline in phase 1 at the erosion escarpment (not including the bathing beach or at existing shoreline wetland areas). After installation,the project will be monitored to determine the efficacy of the proposed erosion control. Modifications will be made for subsequent applications for the remainder of the shoreline and are not part of this application. That statute addressed wetlands subiect to the Clean Water Act be limited to those areas should only include relatively permanent, standing or continuously flowing bodies of waler. The result of that rule was to trigger actions by the North Carolina Division of Water Quality (NCDWQ) which administered Section 401 of the Clean Water Act to require a request for an agency meeting and provided a 30-day window for such actions before a CAMA Major Development Permit could be considered. That rule was overturned during the current administration (President Biden). The abandonment of that rule was challenged to the U.S. Supreme Court and decided on April 6, 2022 to reinstate the rule and thus the North Carolina Division of Water Quality procedures. I was informed that an email to NCDWQ will suffice to begin the 30-day review process to satisfy the period before the CAMA Major Development process can begin. The members of the Trust have the following concerns about this project: First, a certified letter about this proposal, from George H. Wood of Environmental Professionals, Inc. dated November 30,2022, and labeled return receipt requested, was placed on my porch on December 2, 2022. The receipt requiring a signature had been removed, but I have not signed any receipt. A copy of this letter and of the envelope containing the letter are enclosed. Second, 30 days during the holiday season does not provide sufficient time to study the proposal. The members of the Bell Family Trust are not able to discuss the proposal in person until the last week of December. That is not enough time to communicate any objections we may have before the 30-day deadline. Third, we need to determine any possible negative effects to our adjacent property. This would be challenging to accomplish during the holiday season. Many businesses which might be of assistance with this research may limit their hours during the holiday season. Using the `Identify Base Data'tool, the plot of land was identified. Then unselecting the option `Rivers'from the Base Map option allowed for a more precise view of the shoreline. With the '2020 Orthos' map layer selected, ten points were picked along the vegetation line. The points were chosen based on even spacing and visibility of vegetation line. In some cases even spacing had to be disregarded due to poor visibility of the vegetation line. The latitude and longitude of the points were recorded. Using the the 'Get Coordinates on the Map'tool, the coordinates were input. From there, the 'Measure an Area of the Map'tool was used to measure the distance from the vegetation line to the water. This was done for each available orthos layer: 2020, 2016, 2012, 2010, 2009, 2004. The coordinates and its corresponding distance were recorded for each available year.
