HomeMy WebLinkAbout87-23 Roper Town of Beaufort 87-23 Issued by DCM Permit Number CAMA MINOR DEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environmental Quality and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statutes,"Coastal Area Management" Issued to Wayne and Susan Roper c/o Byron Mitchell, authorizing development in the Estuarine Shoreline (AEC) at 546 Sheldrake Court, in Beaufort, Carteret County, as requested in the permittee's application, dated July 26, 2023, and received on August 1, 2023, and accepted as complete on August 7, 2023. This permit, issued on August 8, 2023 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Construction of a single family home and fill/grading in 75'AEC (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s)dated DCH-MHD CITY August 8,2023. (2) Any change or changes in the plans for development,construction,and/or land use activities will require re-evaluation and modification of this permit.All construction shall conform to the N.C. Building Code requirements and all other local, State and Federal regulations,applicable local ordinances, and FEMA Flood Regulations. (3) Any change or changes in the plans for development,construction,or land use activities will require a re-evaluation and modification of this permit. Prior to any land-disturbing activities,a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (6) Unless specifically allowed in 15A NCAC 07H.0209(d)(10),and shown on the permitted plan drawing,all development/construction shall be located a distance of 30 feet landward of Normal High Water Level. No portion of the roof overhang shall encroach into the 30 ft. buffer. (7) The amount of impervious surface/coverage on this property shall not exceed 30%within 75 feet of the Normal High Water Line, in this case, 2,105 square feet is authorized. (8) Any proposed for grading within the 30' buffer from the Normal High Water Level must be contoured to prevent additional stormwater runoff to the adjacent marsh.This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (9) All graded and filled slopes shall be of a sufficient angle to retain a vegetative cover or other erosion control device or structure. (10) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Sedimentation and erosion control measures shall be properly maintained throughout the construction period. (11) This permit does not authorize the excavation or filling of any wetlands or open water areas, even temporarily. (12) Any structure(s)constructed within the Estuarine Shoreline AEC shall comply with the NC Building Code, including the Coastal and Flood Plain Construction Standards of the N. C. Building Code,and the Local Flood Damage Prevention Ordinance as required by the National Flood Insurance Program. If any provisions of the building code or a flood damage prevention ordinance are inconsistent with any of the following AEC standards,the more restrictive provision shall control. (13) Pursuant to 15A NCAC, Subchapter 7J.0406(b),this permit may not be assigned,transferred, sold or otherwise disposed of to a third-party. (14) The Permittee and/or the Permittee's Authorized Agent shall be responsible for obtaining any and all necessary authorizations, approvals,or zoning and building permits from the local government having jurisdiction(Town of Beaufort and/or Carteret County)prior to commencing work.
