To be clear- my objection was to the plan not being clearly defined. It was unclear as to dimensions. This document is
clear except for the cross section you mentioned in a previous email. It is my understanding that the boathouse
construction will be permitted through the county and meet those requirements.

Dear Mr. Raymond
The Division of Coastal Management has reviewed your email correspondence, received between the
dates of February 27, 2023 and March 16, 2023, that related to your objection as an adjacent riparian
property owner to a permit request from Lauren Burch of Caps Marine Construction, an agent for Vicki
Ansell & David Barham, for proposed development consisting of an 84' x 5' pier with a 16' x 12' wide
"L-Shned°' platform, and a 24' x 14' wide boathouse with a boatlif at' 185 Bay Orchard Lane, Knotts
Island, Cuff ituck County. I conducted a site visit on April 4, 2023 to evaluate the permit applicant's
request.
Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has
established Rules for General Permits for this type of development that are found in 15A NCAC 07H.
1200.
The Division has reviewed your objections, along with all aspects of this development proposal for
consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this
type of development. Our review of the proposed development has found it to be consistent with the
Rules of the CRC and the State's Coastal Management Program, and that all pre -requisites have been
satisfied. Therefore, the Division of Coastal Management issued General Permit No. 86871A on April
11, 2023 (copy attached) for the proposed development.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the
Director of the Division of Coastal Management within 20 days of the permit issuance date. If you
choose to pursue an appeal, please contact this office so that we can provide you with the appropriate
forts and addresses.

Well — that answers many questions. Thank you.
The processes we have had with this property have been disheartening— not just with this boat house.
For example— I know an engineer plan is not required, yet the applicant presented it as such.
We never really obtained a complete notification to know exactly what was being presented for development.
I am considering this email to represent the scope of the CAMA general application.
And that the following will be adhered to, as well as other requirements, even though the drawings presented did not
include these requirements.
15A NCAC 07H .1205 SPECIFIC CONDITIONS
(1) Boathouses shall not exceed a combined total of 400 square feet and shall have sides extending no further than
one[1]half the height of the walls as measured in a downward direction from the top wall plate or header and only
covering the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions.
Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. (m) The area enclosed by a boat lift
shall not exceed 400 square feet. In) Piers and docking facilities shall be single story. They may be roofed but shall not
allow second story use*

Your objection to the proposed docking facility is noted. Since you have responded with an
objection, there is no need for Caps Marine to notify you again via certified mail. CAMA
general permits do not have an application for the applicant to fill out. However, it is a
requirement that the adjacent riparian owners be notified of the proposed development along
with a drawing, which has occurred. It is not a requirement that this drawing must be
professionally drawn by an engineer. Based on the recent drawing sent to the both of us, the
85'x5' pier will be constructed 33' off the property line (with an L-shaped 16'x12' platform),
with the northern piles of the 24'x14' boat house being set no closer than 18' from the riparian

corridor line. This placement will not be within the 15' setback area. The Division is satisfied
with this drawing (attached).
A site visit will be conducted in the near future to evaluate the request and you will be notified
in the event of permit issuance.

To clarify, since you state this is an engineers drawing, I am assuming the boat lift is a manual boat lift. Is my assumption
correct?
Also, it seems some of the dimensions don't add up.
I also do not see any height dimension for the boat house.

How are you going to build this without a written plan to include drawings with clear dimensions?
I'm not asking for much here. It seems a contractor will have the information requested in order to not only inform the
customer but also public officials and riparian property owners as to the scope of work proposed.
Please be clear in your email that will be considered notification.
Please have all documents in one email that you are asking for review.

You must provide an actual drawing of the proposed development with dimensions indicating
lengths, widths and distances from property lines. This is to avoid any confusion on what is
actually proposed. I can tell you that if I don't understand it, the adjacent owners may not
understand it. For example, I cannot tell if the 12'x16' platform is 12' wide by 16' long or vice
versa. Also, where is the boathouse proposed to be constructed? Is the docking facility
proposed within the 15' setback area? The adjacent owner notification form was also not
properly filled out ( top section must be filled out with applicant information) and was an older
form we no longer use, please use the attached form for future notifications. While we will still
accept the one that was sent, the newer version clarifies and separates out the waiver section
to avoid confusion. We also require a cross-section drawing of the boathouse (as well as
roofed covered platforms) be submitted as part of the notification and permit request.
Please provide Mr. Raymond an updated drawing and adjacent riparian owner notification
form as described above. If Mr. Raymond is fine with receiving the materials via email, that will
be fine.

The Division of Coastal Management has reviewed your email correspondence, received March 17, 2023,
that related to your objection as an adjacent riparian property owner to a permit request from Lauren
Burch of Caps Marine Construction, an agent for Vicki Ansell & David Barham, for proposed
development consisting of an 84' x 5' pier with a 16' x 12' wide "L-Shaped" platform, and a 24' x 14'
wide boathouse with a boatlift at 183 Bay Orchard Lane, Knotts Island, Curritdek County. 'I cd$ftudted a
site visit on April 4, 2023 to evaluate the permit applicant's request.
Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has
established Rules for General Permits for this type of development that are found in 15A NCAC 07H.

The Division has reviewed your objections, along with all aspects of this development proposal for
consistency with the.aforementioned Rules, which.describe-:the CRC's standards and guidelines for this..
type of development. Our review of the proposed development has found it to be consistent with the
Rules of the CRC and the State's Coastal Management Program, and that all pre -requisites have been
satisfied. Therefore, the Division of Coastal Management issued General Permit No. 86871A on April
11, 2023 (copy attached) for the proposed development.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the
Director of the Division of Coastal Management within 20 days of the permit issuance date. If you choose
to pursue an appeal, please contact this office so that we can provide you with the appropriate forms and
addresses.

Your objection to the proposed docking facility is noted.
CAMA general permits do not have an application for the applicant to fill out. However, it is a
requirement that the adjacent riparian owners be notified of the proposed development along
with a drawing, which has occurred. It is not a requirement that this drawing must be
professionally drawn by an engineer. Based on the recent drawing(s) (attached) sent by Capps
Marine to you via email on Monday March 20, 2023, the 85'x5' pier will be constructed 33'
south of the northern property line (with an L-shaped 16'x12' platform), with the northern
piles of the 24'x14' boat house being set no closer than 18' from the northern riparian corridor
line. This placement will not be within the 15' setback area off of your property located to the
south of the applicant's property. Based on the below email chain and the attached email
recently sent by Capps Marine to you on Monday March 20, 2023 (attached), the Division is
satisfied that proper notification has taken place.
A site visit will be conducted in the near future to evaluate the request and you will be notified
in the event of permit issuance. Please feel free to reach out to me id you have any further
