Dear DCM Administrator,
This letter is to document my objections to the notice/form I received as Adjacent Riparian
Property owner to the proposed 50-foot-long pier, dock, swim platform, and covered
boathouse at 289 N. Dogwood Trail, owned by Mr. Craig Graulich A copy of the notice is
attached.
My objections are as follows:
1) 1 object to any further encroachment into the sound by the proposed new bulkhead.
2) The proposed boathouse structure is very large and complicated. The sketch provided is a
small-scale GIS overlay and does not adequately describe the design of the structure. Key
information such as its base elevation above sea level, height of the structure, architecture, and
materials to be used are not provided. The owner should be advised by CAMA to resubmit the
notice after adequate architectural and engineering drawings have been produced.
3) The information provided by Mr. Graulich does not include sightlines from my property or
other adjacent property that would allow us to determine how views might be affected. The
drawing should at least include the shorelines of the adjacent riparian owners being notified, as
the boathouse will obstruct a portion of the horizon over the water.
4) Most importantly, this is a very large structure (528 sf boathouse/platform plus 300 sf pier)
that could pose an environmental hazard and danger to my property and that of others if it
were damaged or destroyed by a significant wind or storm surge event. We know that very few
marine structures along the west coast of the Dare Outer Banks survived Hurricane Irene. How
soon we forget!

This letter is intended to notify you of the issuance of CAMA General Permit No. 89949A for
proposed development by Craig & Pamela Graulich, located at 289 N. Dogwood Trail, in
Southern Shores, Dare County. The authorized project consists of the construction of a
replacement vinyl bulkhead with 12' returns, a one slip docking facility comprised of a 50'x6'
pier, a roofed 12'xl2' platform, a 12'x5' lower platform and a 29'xl2' boathouse with a 13'x13'
boat lift. The proposed project has been determined to comply with the Coastal Area
Management Act and/or State Dredge & Fill Law, and the Rules of the Coastal Resources
Commission, specifically the development is consistent with North Carolina Administrative
Codes 07H A 100 & 07H. 1200 (attached). As such, a permit has been issued to authorize the
development. I have enclosed a copy of the permit for reference.
If you wish to contest our decision to issue this permit, you may file a request for a Third -Party
Appeal pursuant to N.C.G.S. § 113A-121.1(b). The Chair of the Coastal Resources Commission
will consider the case and determine whether to grant your request to file a Contested Case
Hearing in the Office of Administrative Hearings. The hearing request must be filed with the
Director of the Division of Coastal Management in writing (email or hard copy) and must be
received within twenty (20) days of the disputed permit decision. More information about this

Thank you for the information, but hold off on sending in the check for the time being. We received an objection
from one of the adjacent property owners and we also have some questions about the bulkhead replacement. The
bulkhead was replaced in 2019 which was only 4 years ago. Why are the property owners wanting to replace it again? I
have scheduled a site visit for this location next week on June 21"so I can get a better idea of what is going on and take
water depths. So let me take a look and see if we can resolve the objection before you mail in a check.
Also, are the previous drawings that were submitted still valid? I have attached them to this email for your reference.
These drawings help clarify what is being proposed as long as nothing has changed. Thank you for your time and

I have answered the below. Based on the below it appears I am well within limits of standard permitting. I dont
understand the "grass" issue I guess thats something we can discuss. The walkway to the 12x12 will cross over some
near shore grass (starts about 4' from the bulkhead and goes about 8' out then turns to almost all sand. The depth as
you know varies however the area I chose is the deepest part and at around 30' from the bulkhead averages around 30"
in depth. It pretty much stays that depth all the way out. Clearly a Northerly or Southernly wind can change that. I would
like to talk to you guys about the boat lift as I have seen a couple different kinds but based on what I am reading that
should make much of a difference given both sides are covered.
Lastly, It looks like we are moving forward with the construction on the house so in addition to the pier would like to get a
quote on replacing the bulkhead with something that's about 2' higher than what's there now. We spoke about it when you
guys came out to look.
What do you need to get this going?

Proposed structures:
Pier: ??? x 6'
- I will need to know the total length of the pier.
Total Length: 60' (Shore to furthest point of pier)
Boat House: 29'x12' (Dripline dimensions w/ a 2' overhang on the ends; No overhang on the sides) = 348 ft2
- Cross section shows no sidewalls. Is this correct? Correct, no sidewalls
- I will need the dimensions for walkway under the boat house. If it is all under the roof then it may not
count towards shading allowance.

Boat lift: ??? x ???
I will need the dimensions of the boat lift underneath the boat house.
Because of limited depth it would be a strap based system with lifts mounted on each of the piers.
Covered Platform: 12'x12' = 144 ft2
No overhang indicated. Is this correct? Correct
Lower Platform: 5'x12' = 60 ft2
Does he want to raise and lower this portion? Yes
Is this for a boat/jet ski or for pedestrian use? Pedestrian only (Senior with disability)
It also looks like he wants to possibly put an OPEN pergola over it. Is this correct? Depends on lift
mechanism prefer no pergola.
Stairs to water: Tx7' Yes.
Shoreline Length: - 120'
Total Allowable Shading: 800 ft2
Total Proposed Shading: 348 + 144 + 60 = 552 ft2
(Add Walk Way 6' wide 40' long total 240) New total 792 ft2
Total Proposed Length: TBD (60'
Total Proposed Width: 12' + 12' = 24'
Concerns and Observations:
- This area tends to be shallow and contain Submerged Aquatic Vegetation (SAV). They will most likely
need a water depth of 2' or greater. (15A NCAC 07H.1205(h)).
Answer: Walk way crosses over grass area, boat area and dock area are in clear sand 2-3'
- Pier length may be limited by local ordinance. I would suggest that you contact the Town of Southern
Shores if the structure is proposed at a total length greater than 75'.
Total length less than 75'.
Answer: Total length 60' from shore to furthest point. Pier 1 lot over is -100' from shore to furthest point.
It appears that the total proposed shading is below the allowable amount of 800 ft2.
- Where on the property is the docking facility proposed?
Answer: Would come off the North 1/3 of the property approximately 20' from Northern Property line.
- It appears that only one docking space is being proposed under the boat house. Two spaces are allowed
under a GP. Are any additional tie piles being proposed?
Answer: No just one boat lift and sitting area on other section.
I will need to conduct a full review once a complete application is received and no permitting determination can be made
at this time, but hopefully this answers questions you may have about moving the application forward and the calculations
