Re: Culvert replacement proposal at 47180 Quidley Road in Buxton, Dare County There's no designated nursery area at this location, so DMF would not have any timing restrictions based on that. We do have a record of SAV in close proximity, though. In 2013, the SAV extended into the mouth of the canal, a little more than halfway to that first crossing to the east of this project. The 2020 record shows SAV along the shoreline and in front of the mouth of the canal, but not in it. With that in mind, I'm not entirely sure that a moratorium would be necessary, given the lack of SAV within the actual project area. If you observe any during a site visit, that would likely impact my response. But based on what I have available, I don't foresee requiring any moratorium. Installation or a turbidity curtain, particularly during the portions of the work that cause increase sediment in the water, may be helpful at limiting the amou�ediment that leaves the canal, thereby minimizing impacts associated with sediment deposition to any SAV outside of the canal. Other than that, I'm not seeing anything on the surface that's overly concerning. Thanks! Per 07H.2300, our general permit for replacement of existing bridges and culverts, 07H.2304 general conditions states that, "Review of individual project requests shall be coordinated with the Division of Marine Fisheries (DMF) and the Wildlife Resources Commission (WRC). This may result in a construction moratorium during periods of significant biological productivity or critical life stages as determined by the WRC and DMF." It was my opinion that this proposal may meet the General Permit (GP) through 07H.2300. The replacement would widen the road to allow for larger trucks (i.e. fire truck/emergency vehicles), and the base by only an additional 4'. Although they are proposing the surface to increase from 12 feet to 15 feet, the driving lane will still be singular, and the road will remain a 2-track drive. One of the specific conditions under 07H.2305(2) notes that, "The total area of public trust area, estuarine waters, and wetlands to be excavated or filled shall not exceed 2,500 square feet except that the coastal wetland component shall not exceed 750 square feet." I have not had the opportunity to make a site visit yet, but taking preliminary measurements from ConnectExplorer, it does not appear that the proposal would exceed that condition under 07H.2305(2). Mr. Midgette also noted that the current culverts/pipes are not functioning properly, and the replacement culvert would be installed to offer better drainage, based on his discussions with Tommy Woods of Cape Dredging. Condition #9 in our GP does require that all pipe and culvert inverts placed within the Public Trust or the Estuarine Waters AECs shall be buried at least one foot below normal bed elevation to allow for passage of water and aquatic life. Culverts placed in wetlands are not subject to this requirement. The next upstream crossing appears to be a private road/culvert, which I can site -verify; I can check with Greg Daisey, our NCDOT Field Rep, to see if he can provide information about the crossing off SR 1230/Rocky Rollinson Road in Buxton. I have several questions about the culvert replacement that perhaps you or Mr. Midgett can answer. There was no cross -sectional diagram in the proposal. This is important to show placement of the culvert within the canal, burial, height of culvert to bank, NWL, etc. The diameter of the culvert was increased, but the number decreased, so it may be appropriate to have more than one culvert or a larger culvert with flood plain culverts depending on the characteristics of the canal. Since there is a bridge downstream the site, this is the "pinch point' for flow and aquatic passage. Information on the upstream crossings would be beneficial as well, especially since NC Hwy 12 is one of the crossings. This may be an opportunity to improve flows. I imagine this will also need a 401 certification since there is a change in design that results in an increase of waterbody/wetland fill. NCW RC does not have a moratorium restriction in this area, but would support concerns or requests stated by NCDMF. Thank you again Yvonne, Maria Maria T.
