Re: Objection to the Issuance of CAMA General Permit No. 86866A for an Elevated Wetland Access
Walkway Development Project, at 117 Nautical Lane, Currituck County, and on Coinjock Bay
Dear Mr. & Mrs. Corbo:
The Division of Coastal Management has reviewed your correspondence dated February 4, 2023 and
received on February 9, 2023 that related to your objection as an adjacent riparian property owner to a
permit request from Robert Midgett, an agent for Jerry & Delores Merritt, for the construction of a 6' wide x
300' long elevated wetland access walkway to the existing pier at 117 Nautical Lane, Currituck County. I
conducted a site visit on February 28, 2023, to evaluate the permit applicant's request.
Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has
established Rules for General Permits for this type of development that are found in 15A NCAC 07H .1200.
The Division has reviewed your objections, along with all aspects of this development proposal for
consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this
type of development. Our review of the proposed development has found it to be consistent with the Rules
of the CRC and the State's Coastal Management Program, and that all pre -requisites have been satisfied.
Therefore, the Division of Coastal Management issued General Permit No. 86866A on March 10, 2023
(copy attached) for the proposed development.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form with the
Director of the Division of Coastal Management within 20 days of the permit issuance date. If you choose
to pursue an appeal, please contact this office so that we can provide you with the appropriate forms and
addresses.

This correspondence is in response to documents I received in the mail on February 3
from Robert Midgett, agent for Mr. Jerry Merritt, owners of property at 117 Nautical
Lane, Currituck, NC.
We are the property owners (115 Nautical Lane, Currituck) adjacent to the referenced
property which is proposing to construct a walkway to the Coinjock Bay. The documents
sent to us (copies are enclosed) do not clearly show specific details on where the
walkway will begin and end. The aerial image from Google Maps, which has been
provided, is not up to date. Our property, including our home, fence and property lines
are not included. There are not any measurements that are certified.
In the past, when applying to put a fence within the AEC, we had to supply an updated
site plan, prepared by a licensed surveyor to ensure the accuracy of the proposed
measurement for construction. Presently we are applying to build a walkway as well
and submitted an updated site plan created by a licensed surveyor.
Furthermore, the property owners at 117 Nautical Lane have previously filled in a
walkway/path to Coinjock Bay and when there is an abundance of rain, the rain water
overflows to the back right corner of our property. I understand it has been longer than 5
years since they filled in their walkway, however before they build a walkway, I believe
they should be made to put in a swale ditch to alleviate this problem before
construction. This fill has interrupted the natural water flow. Additionally the
measurement from the bottom of the walkway needs to be from the natural grade, not
the filled in area.
When these issues are addressed, we will not have any objection to the construction.
