This permit, issued on November 7,2022 , is subject to compliance with the application(where consistent with the permit), all applicable regulations,special conditions and notes set forth below.Any violation of these terms may be subject to fines, imprisonment or civil action;or may cause the permit to be null and void. 1) Unless specifically altered herein,this Minor Modification authorizes the following: (a)an alternate temporary construction trestle design using stacked 4' x 20' logging mats as the supporting trestle bents that are spaced at approximately 25-foot intervals within the same footprint as the previously approved temporary construction trestle design; (b)the elimination of approximately 70 steel piles at the bent locations required for construction of the previously approved temporary construction trestle design; and(c)phasing plan for construction of the_sills_and placement of marine sand-fill,all as- depicted on the attached workplan drawings and as described in the permit modification request. 2) The activities authorized by this Minor Modification shall not result in any new temporary or permanent impacts to wetlands or waters of the State, including submerged aquatic vegetation(SAVs), without prior approval from DCM. Department of Transportation Permit#78-22 Page 2 of 3 ADDITIONAL CONDITIONS NOTE: The permittee shall limit in-water work between February 1 to June 30 of any year to the maximum extent practicable to protect juvenile fishes that may be in the vicinity and shall also limit in-water work to the maximum extent practicable from April 1 through October 31 to avoid additional impacts to submerged aquatic vegetation(SAV). 3) The authorized temporary construction trestle shall be elevated a minimum of 2 feet above the normal high water level of the White Oak River as measured from the low chord of the structure. 4) In accordance with commitments made by the permittee, all of the sills shall be constructed in their entirety prior to the placement of the authorized marine sand backfill landward of the sills. 5) The permittee shall remove the temporary construction trestle, including logging mats, and the temporary access ramps, in their entirety within 90 days after they are no longer needed. • Sedimentation and Erosion Control 6) Turbidity curtains shall be used where practicable to isolate all in-water work areas from the adjacent waters of the White Oak River, including but not limited to installation and removal of the temporary construction trestle and temporary access ramps, and placement of fill material within or adjacent to wetlands or waters of the State. The turbidity curtains shall be of sufficient length and effectiveness to prevent a visible increase in the amount of suspended sediments in adjacent waters. The turbidity curtains shall be properly maintained and retained in the water until construction is complete. The turbidity curtains shall be removed when turbidity within the curtains reaches ambient levels. 7) This project shall conform to all requirements of the N.C. Sedimentation Pollution Control Act and the N.C. Department of Transportation's (NCDOT's) Memorandum of Agreement with the N.C. Division of Energy,Mineral and Land Resources. General 8) The permittee shall develop a demobilization/evacuation plan for the authorized construction trestle and any equipment on the project site that is subject to potential flooding during storm events, such that it may be removed out of the potential flood hazard area within 24 hours of receiving a weather forecast that suggests the project site may become inundated with water. 9) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from DCM and/or USACE shall be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM and/or USACE. The permittee shall contact representatives of DCM and USACE prior to commencement of any such activity for this determination and any permit modification. 10) This Minor Modification does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. Department of Transportation, Division 3 Highway Unit is requesting a minor modification for an alternate temporary work trestle design as proposed by the contractor in the enclosed submittal for the construction of the M-0540A NC 24 Living Shoreline.The proposed alternate trestle design would be constructed within the same footprint as the existing approved trestle and would not exceed the currently authorized permanent impact area. The alternate trestle design would eliminate the use of piles at the trestle bents and instead proposes the use of 4' x 20' logging mats to be stacked as the supporting trestle bents to maintain the minimum low chord 2' above normal high water. Eliminating the use of pipe piles from the from the trestle design eliminates the approx.1 cu. yd. of substrate per pile that is typically displaced during pile extraction. Approximately 70 piles would be required for the construction of the trestle as currently authorized. The proposed alternate design would prevent the need to fill in voids in the substrate typically left by pipe piles. The elimination of the piles also eliminates the vibration associated with pile driving and reduces the heavy equipment required for construction by eliminating the need for a crane and vibratory hammer. The quicker construction and increased mobility of the proposed system would allow for faster deconstruction in the event of severe weather forecasts. Using the logging mats as trestle bents would not significantly increase the weight per square foot that is currently proposed by the authorized marine sand backfill.As noted on the enclosed work trestle plan submitted by the contractor,the sills will be constructed in their entirety prior to placing any of the proposed backfill in an effort to minimize losses of material. Included in this submittal is information and photos provided by the project contractor, T.A. Loving Co.,on their previous used of a logging mat system in constructing the Living Shoreline for Carteret Community College(CCC)in Morehead City,N.C.. The system was utilized from October 2021 to May 2021 and did not suffer any failures due to tides or weather and resulted in no observable impacts to the environment. The N.C. Coastal Federation has also acknowledged the success of this system in constructing the CCC project and has vocalized their support for the proposed alternate trestle design. The request is for authorization to modify the design of the currently authorized construction trestle. The currently authorized trestle was designed to utilize steel piles at the bent locations to support the trestle above the White Oak River. The revised design as proposed by the modification request would substitute stacked 4' x 20' wooden logging mats to support the construction trestle instead of steel piles. The current modification request is for an alternate trestle design as discussed at the October 6th onsite pre-con for M- 0540A. The following is additional information received from NCDOT in an e-mail dated 10/25/22: The Rock Sill installation will be completed in 3 phases working WEST to EAST and the marine sand fill will be placed by placing the trestle back into phase 2 and then phase 1. Once the Rock sills are completed,the trestle will be removed from Phase 3, and placed back into the phase 2 location. As the trestle in phase 3 is being removed and repositioned at Phase 2,marine sand fill will be placed behind the rock sills in phase 3 placing sand from EAST to WEST. When the marine sand fill reaches phase 2, the trestle will begin being repositioned into phase 1. Sand fill will be placed from EAST to WEST behind the rock sills in the phase 2 area. At that time, the access at 22+50 will be removed. When the marine sand fill reaches phase 1,the marine sand fill operation will then begin at the WEST end of phase 1 in order to maintain access at 19+75. The phase 1 trestle will then be removed from WEST to EAST and demobilized from the site. As phase 1 trestle is being removed sand fill will be placed in its place from WEST to EAST. The marine sand fill operation will be a continuous operation until complete. Also attached please find a form in WORD for you to indicate your agency's position or viewpoint on the proposed project. The current modification request is for an alternate trestle design as discussed at the October 6th onsite pre-con for M- 0540A. The following is additional information received from NCDOT in an e-mail dated 10/25/22: The Rock Sill installation will be completed in 3 phases working WEST to EAST and the marine sand fill will be placed by placing the trestle back into phase 2 and then phase 1. Once the Rock sills are completed, the trestle will be removed from Phase 3, and placed back into the phase 2 location. As the trestle in phase 3 is being removed and repositioned at Phase 2, marine sand fill will be placed behind the rock sills in phase 3 placing sand from EAST to WEST. When the marine sand fill reaches phase 2, the trestle will begin being repositioned into phase 1. Sand fill will be placed from EAST to WEST behind the rock sills in the phase 2 area. At that time, the access at 22+50 will be removed. When the marine sand fill reaches phase 1, the marine sand fill operation will then begin at the WEST end of phase 1 in order to maintain access at 19+75. The phase 1 trestle will then be removed from WEST to EAST and demobilized from the site. As phase 1 trestle is being removed sand fill will be placed in its place from WEST to EAST.
