The NCDOT request, including a cover letter and one drawing, is also attached. The DCM Letter of Authorization provides approval for the following: (1) update the plans for the embankment and low marsh habitat creation areas within an area of approximately 2,414 square feet (0.05 acres) due to the discovery of previously unknown and unsuitable fill material; (2)reduce fill within existing Coastal Wetlands; and (3) allow the use of a truck mounted"Telebelt" (Telescopic Belt Conveyor) as the method of installing marine sand fill on the project. The authorized changes will not result in any additional permanent impacts to wetlands or waters of the State, and will potentially reduce impacts to Coastal Wetlands. Please let me or Stephen Lane know if you have any questions or concerns. Dear Ms. Westphal: This letter is in response to the N.C. Department of Transportation (NCDOT)request dated March 16, 2023, including a cover letter and one attached drawing dated as received on March 16, 2023. NCDOT proposes the following: (1)update the plans for the embankment and low marsh habitat creation areas within an area of approximately 2,414 square feet(0.05 acres)due to the discovery of previously unknown and unsuitable fill material; (2)reduce fill within existing Coastal Wetlands; and(3) allow the use of a truck mounted "Telebelt" (Telescopic Belt Conveyor)as the method of installing marine sand fill on the project. The authorized changes will not result in any additional permanent impacts to wetlands or waters of the State, and will potentially reduce impacts to Coastal Wetlands. NCDOT states that fill will be limited between STA. 20+25 and 22+75 with the goal of maintaining the existing coastal wetland vegetation to the extent practicable, and recently discovered unsuitable fill will be removed between STA. 23+00 and 24+50. Additionally,NCDOT states that unsuitable debris will be removed from the embankment and slope area between STA. 23+75 and 24+75. Approximately 1,559 square feet of Class II riprap will be placed at a 3:1 slope in the area where unsuitable materials are removed from the existing embankment. Approximately 855 square feet of marine sand fill will be placed at a 10:1 slope with Coastal Wetland plantings in the area where unsuitable materials are removed from the slope area as authorized in the current landscape plan for the adjacent areas. The request also indicates that NCDOT is planning to implement the use of a truck mounted"Telebelt" (Telescopic Belt Conveyor)as the method of adding the authorized sand fill landward of the inner and outer sills. The Telebelt methodology change would eliminate the need to construct Phase 1 and Phase 2 of the"alternate trestle"design during the sand fill operation. Please be advised that through this Letter of Authorization, the Division of Coastal Management conveys its determination that the revision as described in the NCDOT request dated March 16, 2023 is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of CAMA Major Development Permit Number 78-22. STATE OF NORTH CAROLINA DEPARTMENT OF TRANSPORTATION ROY COOPER J.ERIC BOYETTE GOVERNOR SECRETARY March 16,2023 Mr. Stephen Lane Coastal Management Representative, Transportation Projects Division of Coastal Management 400 Commerce Ave. Morehead City,NC 28557 Subject: Modification Request for removing debris and establishing additional embankment, removing debris only, and limit of fill within existing coastal wetlands. CAMA Major Permit No. 78-22, TIP No. M-0540A NC 24 Resiliency and Living Shoreline Project. WBS No.49083.3.1 Dear Mr. Lane, The N.C. Department of Transportation,Division 3, is requesting a modification to the above referenced permit for proposed changes to the existing permitted plan for the subject project. The proposed changes are being requested due to previously unknown and unsuitable fill materials discovered on site and discussions among agency personnel about the goal of maintaining a portion of existing coastal wetlands on site. The agency personnel discussions were held on-site on March 1, 2023. The attached plan modification sketch summarizes the requested changes. The limits and areas of the requested changes shown in the modification sketch have not been surveyed and are meant to be approximate limits. An as-built survey plan sheet will be provided when the project is complete. The changes include: • Embankment area and slope area from approximately Sta.23+75 to 24+75 (shown as blue and green shaded areas on the plan modification sketch): Originally no supplemental Class 1 riprap was proposed in this area as the existing embankment was thought to be stable. However, it was determined to be unprotected embankment with sand, asphalt, broken concrete and other debris. For the resilience and stability of the roadway, removal of the unsuitable fill materials in the embankment area and installation of Class 2 riprap at a 3:1 slope to match the proposed embankment on either side(east and west)is proposed. In the slope area, Mailing Address: Telephone:910-341-2000 Location: NC DEPARTMENT OF TRANSPORTATION Fax:910-675-0143 5501 BARBADOS BOULEVARD DIVISION OF HIGHWAYS Customer Service: 1-877-368-4968 CASTLE HAYNE,NC 28429-5647 5501 BARBADOS BOULEVARD CASTLE HAYNE,NC 28429-5647 Website:ncdot.gov 1 removal of the unsuitable fill material, adding marine sand fill and grading to a 10:1 slope, and wetland grass plantings at the same density as in the existing landscape plan are proposed. • Slope area from approximately Sta.23+00 to Sta.24+50 (shown as red block symbology on the plan modification sketch): Recently discovered unsuitable fill and asphalt debris will be removed from this area. • Slope area (beyond the embankment)from approximately Sta.20+25 to 22+75 (shown as orange shaded area on the plan modification sketch): Originally approved marine sand fill in this area will be limited with the goal to maintain the existing coastal marsh (existing coastal wetland vegetation)in this area. However, limiting the fill operations in this entire area may not be possible if field measurements indicate additional fill is needed due to low areas or at the toe of slope to protect the embankment. In addition to the three changes detailed above, the department is also planning to implement a truck mounted"Telebelt"(Telescopic Belt Conveyor)as the method of adding the marine sand fill on the project. If this method is utilized, it will provide the benefit of eliminating the replacement of the phase 1 and phase 2"alternate trestle"during the marine sand fill operation. Please let me know if any additional information is needed in support of this request.
