Bridge Construction 1) In order to protect juvenile shrimp and finfish populations, no in water work will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal , Management, in consultation with the Division of Marine Fisheries and the Wildlife Resources , Commission. , 2) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). 3) The riprap used for embankment stabilization must be free from loose dirt or any pollutant. It must , be of a size sufficient to prevent its movement from the site by wave or current action. The riprap material must consist of clean rock or masonry materials such as but not limited to granite or broken / concrete. (See attached sheet for Additional Conditions) ' This permit action may be appealed by the pennittee or Signed by the authority of the Secretary of DENR and the ' ' other qualified persons within twenty (20) days of the Chairman of the Coastal Resources Commission. Sedimentation and Erosion Control • 6) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 7) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. , General NOTE: The permittee is advised that this permit does not authorize the construction of any temporary detour within a designated CAMA Area of Environmental Concern (AEC). State Project No. 5.2151. The North Carolina Department of Transportation proposes to replace Bridge No. 15 over the Tributary of Ward Creek on SR 1152 near Otway in Carteret County. An application for replacement of this bridge with a culvert was submitted in September 1996. In response to the concerns of the agencies we have redesigned the project to conform to their requests. The proposed action will involve replacing the existing 45.8 foot long by 19.2 foot wide (roadway width) timber bridge with a cored,concrete slab bridge. The replacement structure will be 50 feet long and approximately 27 feet wide (roadway width). This replacement will take place on existing alignment and local traffic will be detoured along existing roadways. The new structure is wider than the existing bridge. To facilitate the wider structure we propose to excavate about 20 cubic yards of material from the coastal wetland adjacent to the present structure. The construction of the roadway embankment and the raising of the road grade will result in fill in coastal wetlands and on highground (see sheet 3 of 4). We therefore request that the proposed work be authorized under the appropriate Coastal Area Management Act (CAMA) permit. Enclosed is a permit application for a CAMA Major Development Permit including permit drawings and a copy of the fee application check for $250.00 that was submitted with the original application. 2 By copy of this letter, we are also requesting issuance of a 401 Water Quality Certification from the North Carolina Division of Water Quality. We do not anticipate requesting an individual permit from the Corps of Engineers for discharge of dredge or fill material in waters of the United States. We propose to proceed under General Permit 31 in compliance with Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). PROJECT SUMMARY: The NC DOT is proposing to replace an existing bridge with culverts at a site on SR1152 and over a tributary to Wards Creek, near the community of Otway, Carteret County. FIELD INVESTIGATION REPORT: NC DOT PAGE #2 9. NARRATIVE DESCRIPTION: The NC Department of Transportation (DOT) is requesting a permit to replace an existing bridge with culverts at a site located on SR 1152 and on a tidal tributary of Wards Creek, near the community of Otway, Carteret County. The existing bridge is ± 46' long x 19' wide and has a vertical clearance above the mean high water line of ± 2'. On either side of the bridge a border of coastal wetlands exist which is vegetated primarily by spartina alterniflora, juncus roemerianus, distichlis spicata. The width of the tributary is ± 45' wide except directly underneath the bridge where the headwalls have narrowed the Creek to ± 35' wide. Beyond the bridge, the tributary and its adjacent coastal wetlands continues inland for ± 1400' before ending. This tributary and the adjoining Wards Creek has been designated a primary nursery area by the Division of Marine Fisheries. The Creek is also designated as SA and is open to the harvesting of shellfish. DOT is proposing to remove the bridge and replace it with 4 lines of culverts. The culverts will be ± 40 in length, each having a width of ± 8.5' and a height of ± 5.9'. Four feet of fill material will be provided between the culverts which will result in a total crossing width of ± 46.3'. To facilitate the installation of the culverts, ± 2,700 ft.2 of Creek bottom would be excavated with ± 575 ft.2 of Coastal Wetlands being either excavated or filled. Approximately 400 ft.2 of high ground would also be excavated to provide a sufficient opening for culvert installation. The culverts and associated fill would result in a permanent filling of ± 1800 ft.2 of estuarine resources. The construction of the roadway embankment and the raising of the road grade will result in ± 50 ft.2 of coastal wetlands and ± 15,500 ft.2 of high ground within the existing road right of way being filled. 10. ANTICIPATED IMPACTS: The project as proposed will result in the excavation of ± 2,700' of shallow water bottom and ± 400 ft.2 of high ground, the excavation and filling of ± 625 ft.2 of Coastal Wetlands and the filling of ± 15,500 ft.2 of highground within the existing road right of way. Approx. 45 yds.' of material would be placed below the mean high water line and ± 275 yds.' of material would be excavated and trucked off site. Turbidity levels in the immediate area will increase significantly during excavation activities. The negative effects of this increase can be lessened if excavation is timed to periods of least biological activities or turbidity curtains are deployed during construction. Proper erosion control techniques will also need to be undertaken along all disturbed areas during construction in order to prevent sediment runoff from entering adjacent wetland and water areas. There has been various concerns expressed by some federal and state agencies over the years concerning the potential negative impacts of culverts to fisheries resources. These concerns may be amplified since this work is occurring within a designed primary nursery area. Areas of Environmental Concern (AECs) impacted by the proposed work include Coastal Wetlands, Estuarine Waters, Public Trust Areas and the Estuarine Shoreline. Waters at the project site are classified as SA and are open to the harvesting of shellfish. The area is also a Primary Nursery Area (PNA) . I have reviewed this proposal for consistency with the 1991 Carteret County Land Use Plan (LUP) Update, as amended September 24, 1993 , and offer the following comments . The general area of the project is classified as Rural, while the AECs impacted by the work are classified as Conservation. Relevant policies contained in the amended Plan include Resource Production and Management Policies for Marine Resource Areas. With certain exceptions, none of which appear to be applicable to this proposal, Carteret County supports the use standards for estuarine and public trust areas. The LUP allows development in Coastal Wetlands which is not prohibited in the policy section of the Plan, provided the 7H Use Standards can be satisfied. I can find no policy in the amended LUP which would appear to prohibit this project . Economic and Community Development Policies include those for Stormwater Management . Carteret County supports the policy that all NCDOT projects should be designed to limit to the extent possible stormwater runoff into estuarine waters . The County' s commitment to State and Federal Programs is also discussed in the Plan. Carteret County is generally receptive to state and federal programs which provide improvements to the county, especially the NCDOT road and bridge improvement programs, which the Plan notes as being of great importance to the County. Based on the above policies and land classifications, this project appears to be consistent with the amended 1991 Carteret County Land . Use Plan Update, provided all state standards can be satisfied. The destruction of non- vegetated, vegetated and coastal wetlands in these Primary Nursery Area, SA waters will negatively impact the productivity of these waters. If culverts are finally decided upon, the largest size box type culverts structurally feasible are recommended. Culverts create water flow problems that could impact the ingress and egress of finfish and shellfish larvae. Further, improper placement could result in scouring to the extent that all flow is restricted. The moratorium period on construction will be strictly adhered to due to the sensitivity of the Primary Nursery Area. Again, a replacement bridge is much preferred over the culverts in this case. Staff biologists with the Wildlife Resources Commission have reviewed the project and associated impacts on wildlife and fishery resources. A site visit was made on November 7, 1996. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area Management Act(G.S. 113A-100 through 113A-128). The NCDOT is proposing to replace an existing bridge with four 103"X 71"X 40' corrugated aluminum pipe arches and to raise the existing road elevation. Activities, include preparation of the bridge approaches, excavation of the creek bottom, installation of the four culverts and elevation of the roadway, which will impact about 625 ft2 of coastal wetlands and 4,500 ft2 of shallow water bottom. Best Management Practices(i.e. silt fences and check dams) are proposed to minimize adverse impacts resulting from project related sedimentation. This tributary of Wards Creek is classified as 'SA' waters. This creek is also designated as a Primary Nursery Area and open to shellfishing. Active wildlife travel corridors were observed on both sides of the creek We are concerned about the potential adverse impacts to aquatic fauna in a Primary Nursery Area resulting from the proposed project. Replacing the bridge with four culverts may increase stream velocities in the area and may reduce the chance of fish passage in this creek. Therefore, we recommend that a spanning structure be used in place of the culverts. A spanning structure would minimize potential negative impacts to fisheries resources resulting from the bridge replacement. We are also concerned about turbidity associated with proposed activities. Elevated turbidity could reduce water quality in these areas and stress aquatic organisms. Excessive . turbidity is particularly damaging to egg and larval life stages of aquatic organisms. Therefore, we recommend that in-water work be prohibited between April 1 and September 30. Turbidity curtains placed immediately upstream and downstream of the project site would localize> . sediment impacts. Also,because active wildlife travel corridors under the bridge were dbserved on both sides of the creek, we recommend that the new structure provide clear bank areas for wildlife passage on both sides of the stream. These comments specifically asked the North Carolina Department of Transportation to describe hydrological changes to Wards Creek and associated Primary Nursery Area resulting from the installation of the culverts. It was received on September 30, 1996, and appears to be adequate for processing at this time. The projected deadline for making a decision is December 15, 1996. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
