Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes the following: (a) a change in the bridge construction technique at the Pea Island Breach Site by eliminating construction of the previously authorized temporary work bridge, and instead operating from a temporary 12-foot wide timber mat access placed within the existing right of way; (b) Operation of a crane on timber mats outside of the existing right of way to lift and set girders; (c) Elimination of jetting water intake point #10, (d) Addition of jetting water intake point#17; (e) Extending the length of jetting water intake point#16; and(f) Revised utility workplan drawings, all as indicated on the attached workplan drawings. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty(20) days of the issuing Chairman of the Coastal Resources Commission. date. Department of Transportation Permit No. 106-12 I Page 2 of 3 ADDITIONAL CONDITIONS NOTE: The changes in construction authorized by this Minor Modification are anticipated to reduce environmental impacts due to reduced total construction time, reduced placement of temporary pilings, reduced amount of jetting, relocation of jetting water intakes to environmentally less sensitive areas, and reduced routing of piping for jetting intakes through coastal marsh. 2) All equipment and timber mats shall be removed within 12 hours of receiving a weather forecast that suggests the Pea Island Breach Site may become inundated with water from the ocean or sound. 3) Storage of equipment and materials within the Pea Island Breach Site shall be limited to upland areas and only those items that will be used readily and only for the current tasks at hand. 4) The authorized timber mat access shall not result in any permanent or temporary impacts to wetlands or waters of the State, without permit modification. 5) Construction staging areas shall be located only in upland areas, and not in wetlands or waters of the State. 6) All construction access shall be through the use of the timber mat access, existing bridge, temporary detour roadway, the partially constructed new bridge, and/or existing high ground areas. 7) All temporary structures shall be removed in their entirety as soon as practicable. This condition applies to the authorized timber mats and associated materials. Jetting Intake Structures 8) Jetting water intake piping shall be attached to temporary wooden stakes with guy lines to limit pipe swing in order to ensure it is not a hazard to navigation. It shall also be marked with floating buoys at every 100' to clearly identify it in the water. 9) In accordance with commitments made by the permittee,the jetting intake screens shall be inspected and serviced at the beginning of every shift. 10) In accordance with commitments made by the permittee, the permittee shall coordinate with the United States Fish and Wildlife Service(USFWS) staff to determine the specific location of the Site 17 jetting water intake pump and associated piping. 11) In accordance with commitments made by the permittee, the jetting water intake pumps shall not be operated if adjacent water levels fall below 2.0 feet of normal water level. 12) During construction, the permittee shall exercise all available precautions to ensure that the authorized jetting water intake structures and associated equipment do not pose a hazard to navigation. Department of Transportation Permit No. 106-12 Page 3 of 3 ADDITIONAL CONDITIONS General 13) The permittee shall provide the public with adequate notice that access to the public boat ramp near the Pea Island Breach Site will be closed during construction. The notice shall include an estimate of the amount of time that access to the public boat ramp will be closed. 14) The permittee shall minimize the need to cross wetlands to the maximum extent practicable. 15) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorized permit application, a permit modification and/or additional authorization from the N.C. Division of Coastal Management(DCM) may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 16) Nothing in this Minor Modification authorizes any activity that has not received approval from USFWS for work within the Pea Island National Wildlife Refuge (PINWR). The proposed work shall not commence until the permittee has been issued a Special Use Permit from the USFWS, if required, and a copy of the Special Use Permit is received by DCM. 17) DWR authorized the proposed project on 4/10/14 with a modification of the 401 Water Quality Certification (DWQ Project No. 20130144 v.4). Any violation of the Certification approved by DWR shall be considered a violation of this Minor Modification. NOTE: This Minor Modification does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. 18) This Minor Modification shall be attached to the original of Permit No. 106-12, which was issued on 9/19/12, as well as the Major Modification of Permit No. 106-12 authorizing construction of TIP No. B- 2500A, which was issued on 4/26/13, as well as the Major Modification that was issued on 10/17/13, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 19) All conditions and stipulations of the active permit remain in force under this Minor Modification unless altered herein. 04000040CW.. This modification is being requested following the contractors request to change the New Inlet Bridge construction technique.The contractor (Parsons)has determined that utilizing the current filled in sand flat area(inlet)to install bridge pilings,bent construction and girder erection will likely eliminate approximately 4 months of construction time,within the sensitive Inlet area. Their proposal eliminates construction of a temporary work bridge. In lieu of the construction bridge,they propose to place temporary wooden mats along the alignment, as illustrated on the provided work plats. The construction equipment can operate from the wooden mats and traverse from south to north,as progress is made at each bridge span. All of the proposed work will take place within the existing NCDOT R-O-W, with the exception of the girder placement. This process will require a crane to temporarily move outside the R-O-W for a 3-4 day time period to lift and set the girders. The crane will only be moved outside the R-O-W when necessary. This operation will move from south to north and once girder placement for a span is completed, access beyond NCDOT R-O-W will no longer be needed. A schematic is provided in Figure 4 that describes this process. In addition to the proposed construction technique modification,the contractor is requesting an adjustment at water intake point# 16 (boat ramp),due to water depth constraints. An adjustment is also needed at water intake point# 10(inlet), which is no longer viable, due to the inlet filling in with sand. Point# 17 is now being proposed at a location,just north of the inlet, within a man-made canal bordering the USFWS dike/service road. United States Department of the Interior/USFWS Special Use Permit SUP 2013-003. 1 Permit Modification Request-Substructure Contract ID C203171 Long Term Improvements(Phase II) to WBS# 32635.3.FR6 Pea Island on NC-12 F.A. #BRNHF-0012(55) March 26, 2014 Dare County(82500A) 1.0 INTRODUCTION Conditions in and around the Pea Island (New) Inlet Project Area (Figure 1-Relevant portion of USGS Topographic Map-Pea Island) have changed substantially since the permit was written. Most notably, the Inlet (breach) has shoaled in and only has very shallow water that rarely and temporarily connects the sound and ocean during sustained nor'easters and potentially during high wind tide events (see Attachment 3-Photographs page 3) for a recent aerial provided by NC DOT). Therefore, Parsons is requesting a permit modification that will allow timber mat access inside the permitted Right of Way (ROW) during substructure construction and up through the girder erection phase as opposed to constructing a temporary work bridge east of the existing temporary bridge now being used. In addition, it is necessary to permit alternate water intake sites to provide adequate water for jetting piles. The idea of accessing the permitted ROW with timber mats was discussed in general with the regulatory community in a meeting on February 12, 2014. Representatives of Parsons, NC DOT and USFWS met at the breach to discuss the requested methodology changes on the following Friday- February 14, 2014. A proposed modification request was sent to NC DOT on February 24, 2014. NC DOT distributed the request to USFWS and provided additional feedback and comments to Parsons. The comments from the regulatory community and particularly the NC DOT and USFWS have been incorporated into this request, and Parsons has worked to avoid and minimize impacts associated with the construction methodology change. Proposed methodology changes are shown on the attached Figure 2. Parsons is committed to avoiding and minimizing impacts and will work closely with NC DOT, USFWS and other regulatory agencies to that end. Overland access via mats is preferred to construction of a temporary bridge alongside the proposed new permanent bridge alignment. Benefits of this construction methodology change include a reduction in overall time needed to complete the project—it is estimated that this change in methodology will save nearly four months of construction time. This savings in time will significantly reduce impacts to within the sensitive inlet area. The attached construction sequence schedule (Attachment 1) indicates that the bridge substructure construction (to include girder erection) can be completed within four months of project initiation. In addition, the elimination of the work bridge will not require any pilings to be driven that need to be removed at a later date. This will negate the potential for broken pilings and lasting impacts in the area of the breach. A construction schedule for erection of a temporary bridge (trestle) has been generated for comparison and is attached as Attachment 2. Pile jetting was chosen in the permit as the method for installation of the bridge piles. To achieve this, ample water (minimum of 2.0 feet) is required for the pump intakes. Three sites were selected and permitted. These sites are listed within the permits and shown on the attached Figure 1-Relevant portion of USGS Topographic Map-Pea Island. Site 10 was the breach/"New Inlet", which has completely closed. Site 16 is the New Inlet Boat Ramp (inadequate water within granted ROW) and Site 15 is the Wreck Creek Jetting Intake. The permitted easement at the New Inlet Boat Ramp only extends to the end of the paved/improved section of the ramp and there is only one (1.0) feet of water in this location during periods of normal water level (NWL). Site 15 is the only currently viable site and is the least desirable as access involves routing piping through coastal marsh. This modification request includes a request for an additional water intake at Site#17. 2.0 SUBSTRUCTURE AND GIRDER ERECTION CONSTRUCTION METHODOLOGY Parsons is requesting permission to use timber mats within the ROW as shown on the attached Figure 3 and as discussed in detail below. The proposed methodology also requires that cranes be allowed to walk around bents using timber mats for girder erection. 2.1 TIMBER MAT TRUCK LANE A 12 feet wide timber mat access is requested to allow for delivery (by truck) of construction materials. This matting alignment will be emplaced at the beginning of the project and can be moved rapidly (within 12 hours) to secure mats or equipment in the event of a storm or other occurrence that requires removal of materials from the area. Materials storage within the breach will be limited to those materials that can be used readily and only for the current task(s) at hand. All personnel will be trained and informed of the sensitive nature of the working environment. Parsons will work closely with USFWS to understand nesting bird requirements, follow all instructions from the Refuge staff and fulfill all permit conditions. Parsons will not store materials within the area of the breach identified as the "Relict Channel" and as defined in the permit drawings and on the drawings included in this modification request. Please note, the proposed mat alignment providing conventional truck access is entirely within the existing permitted ROW as shown in detail on the attached Figure 3. 2.2 TIMBER MATS CRANE AND PILE DRIVING Figure 3 shows the general footprint of a crane and associated mats moving between the bents within the existing ROW and how the mats will be used and placed as the project progresses. In general, the sequence involves beginning construction on the southern end and moving north. It is estimated that it will take one week to install pilings at each bent location. Timber mat location for the piling installation and substructure installation is shown on Figure 3. It is estimated that it will take approximately six weeks per bent to construct the substructure. 2.3 SUBSTRUCTURE OPERATION Substructure construction will require the use of timber mats and moving within the existing ROW as shown on the attached Figure 3. The equipment that will be used for this task is capable of moving around the pilings without encroaching into any areas outside of the permitted 100' ROW. Timber mats will be moved with the crane and formwork with an overall footprint measuring approximately 2,200 square feet at any one time. R E c E I `yI E ID 3 MAR 2 8 2014 DIV. Substructures should be completed by the end of June (Attachment 1-Project Timeline). 2.4 GIRDER ERECTION Using the proposed construction methodology (not building temporary work bridge) girder erection requires that a crane be allowed to move between and around the bents to erect the girder system. Each span will take approximately three (3) days to erect. Typically, the crane and timber mats will be outside of the permitted ROW for about one or two days with a maximum of 3,640 square feet of timber mat needed as the crane moves around the bents. Detailed girder sequencing is shown on the attached Figure 4. 2.5 SUPERSTRUCTURE OPERATION The construction methodology for superstructure construction will be achieved using a combination of top down and conventional construction techniques within permitted ROW and as allowed under the current permits and any subsequent modifications as allowed. 3.0 ALTERNATIVE WATER INTAKES Detailed water depth surveys have been performed at the three water intake sites specified in the permit. Copies of these surveys are included with this document: Figure 5 (Site 15); Figure 6 (Site 16); and Figure 7 (Site 17) Based on the shoaling and subsequent closing of the New Inlet/Breach and the measured shallow water depths at the New Inlet Boat Ramp (Site 16), Parsons is requesting that an additional water intake location be permitted. In addition, it is requested that piping be allowed to extend out into Pamlico Sound to allow for adequate water intake depths at Site 16 (Figure 6). The pumps will operate best with a minimum of two (2.0) feet of water. Wind tides in the area of Site 16 can fluctuate as much as 1.25 feet. Therefore, a minimum depth of 3.25 feet is desired for constant delivery of water. Parson's has determined that a viable source of water may exist in a location that was suggested by NC DOT staff during an on-site meeting on February 14, 2014. This location is referred to as Site 17 on the attached Figure 7, and extends from an already permitted "pull in" access at a maintained USFWS path along the south side of the southern waterfowl impoundment nearest the breach. In addition to the newly proposed Site 17, the New Inlet Boat Ramp can be used for water intake provided that an intake pipe can be extended out into the Sound (approximately 1000' with no part of the pipe more than 150 feet from the shoreline) as shown on the attached Figure 6. 3.1 NEW INLET INTAKE EXTENSION During NWL conditions, and especially during northeast and north dominated wind events, there is not sufficient water depth within the permitted ROW at the New Inlet -,- 7 io Rarripktcacrmodate an intake pump (please see Attachment 3-Photographs). OF COASTAL MANAGEMENT RALEIGH Permit Modification Request-Substructure Contract ID C203171 Long Term Improvements(Phase II)to WBS# 32635.3.FR6 Pea Island on NC-12 F.A. #BRNHF-0012(55) March 26, 2014 Dare County(82500A) As permitted, the ROW ends at the ramp and the water depths are less than -1.0' at normal water level (NWL). Parsons is requesting that an intake and associated piping be allowed to be extended as shown on the attached Exhibit 8. Intake piping will consist of floating 8"-12" HDPE pipe (dependent on pump requirements and permitted distance) with buoys tied every 100 feet or more frequently if deemed necessary. In addition, the piping will be anchored or attached to temporary wooden stakes (whichever is preferred) with guy lines attached to piping to limit pipe swing. The piping and pump will be serviced daily and inspected at the beginning and end of each shift. It is also expected that the screen at the intake will need to be serviced at the beginning of each shift. All required entrapment, entrainment and impingement precautions (0.5 cfs with 1 mm screen opening—or other allowable materials and pump speeds as allowed and negotiated with NC Division of Marine Fisheries) will be met and as specified by the NC Division of Marine Fisheries (NC DMF). In addition, all permit conditions will be strictly adhered to. 3.2 PROPOSED SITE 17 INTAKE An alternative intake is proposed as shown on the attached Figure 7. This intake was reviewed in the field by USFWS staff on Friday, February 14, 2014. Initially, it was believed that there was an open water connection to the sound. However, a detailed water depth survey on February 17, 2014 revealed that the proposed Intake 17 is not directly connected to the Sound. This location is ideal in its proximity, ease of access, and limited environmental impact (along maintained road and not directly connected to the Sound). Parsons respectfully requests that this location be allowed to be used for jetting water intake as shown on the attached Figure 7. Please note, no wetlands will be impacted and the location of the pump, piping etc... will be sited with the assistance of USFWS staff to provide continued unimpeded access to the refuge and allow for any necessary maintenance of the access/path that USFWS requires. The pump intake will be positioned vertically in the water column a minimum of 2.0 feet above the substrate and sited in approximately 3.0 feet of water. The pump will not operate if the water level drops below 2.0 feet. Pumps are expected to run in short 2-3 hour bursts 1-2 times a day and will not run for lengthy periods of time. WBS#32635.1.1 Dear Mr. Lane, The North Carolina Department of Transportation is requesting a minor permit modification to permit# 106-12. This modification is being requested to address temporary wetland impacts associated with the relocation of a fiber optic line owned by Century Link. This utility line relocation was previously included in permit# 106-12, in which the relocation would occur by boring methods under wetland areas and open cutting in uplands. This approach avoided all wetland impacts associated with the utility relocation. The utility contractor hired by Century Link to relocate the utility line, was advised to follow CAMA permit # 106-12,as per the permit conditions and plans. NCDOT reviewed the permit requirements on-site with the contractor and surveyed field points for the contractor to follow along the utility alignment. The utility contractor chose not to follow NCDOT direction or CAMA permit# 106-12,which resulted in 1,255 square feet of temporary coastal wetland impact. This impact occurred while establishing bore/splice points in wetlands and operation of a utility boring machine. The wetland impacts are characteristic of mechanized clearing clue to the root mat disturbance. NCDOT discovered the unauthorized activity and directed the contractor to cease operations, until the Division of Coastal Management could be notified and direction was received on permitting the impacts. Following contact with the Division of Coastal Management and their review of the impacts, it was decided a permit modification should be pursued. Therefore,NCDOT has submitted this permit modification request along with a location map, illustrated permit drawings and impact table. In addition to this request DOT is also providing a set of updated utility drawings, which show a different boring operation than what was submitted with the original permit request. The alignment of the easement/mats is shown in the attachment. There is the obvious concern of"what if the inlet washes back through". I think that will need to be clearly addressed. Especially, in terms of a small shallow 10' wide channel developing during a storm event and will that be considered jurisdictional, etc. I would like the contractor to know clearly understand the risk with regards to what will be considered jurisdictional and our ability to fill major or minor channels that form. I think there is some advantages to not building a temporary bridge, the obvious being a savings in time and reduction in on-site construction impact. Hopefully, the weather will not cancel our meeting. We will send out an update tomorrow, once we know a little more about the weather conditions.
