Bridge Construction
1) The relocation of any utility lines will require additional authorization, either by way of a r
' modification of this permit or by the utility company obtaining separate authorization.

ADDITIONAL CONDITIONS '
• 4) Placement of rip rap shall be limited to the slopes underneath the proposed bridge, as depicted on
the attached workplan drawings. The riprap material must be free from loose dirt or any
pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current '
action. The riprap material must consist of clean rock or masonry materials such as but not
limited to granite or broken concrete.
5) The fill material will be clean and free of any pollutants except in trace quantities.
6) No excavated or fill material will be placed at any time in any vegetated wetlands or surrounding
waters outside of the alignment of the fill area as indicated on the workplan drawing(s). ,
7) All fill material will be obtained from an upland source.
8) The temporary placement or double handling of any excavated or fill material within waters or
vegetated wetlands is not authorized, with the exception of that fill necessary for the construction
of the temporary detour bridge/causeway. This condition also applies to the removal of the
• existing bridge structure.
• 9) All temporary fill must be placed on geo-textile fabric to facilitate the total removal upon the
completion of the project.
• 10) All temporary fill material must be removed in its entirety immediately following project
completion and placed in an approved high ground disposal area.
Sedimentation and Erosion Control
• 11) A ground cover sufficient to restrain erosion must be provided within the shorter of 15 working
or 30 calendar days of completion of any phase of grading on cut or filled slopes.

12) Erosion control structures must be installed on the out board edge of both the temporary and
permanent fill in or adjacent to wetlands, between the area to be filled and the existing creek to ,
prevent sediment from entering the adjacent wetlands/watercourses/property.
,
' 13) In order to protect water quality, runoff from construction must not visibly increase the amount '
of suspended sediments in adjacent waters.
• 14) The cut or filled slopes shall be at an angle which can be retained by vegetative or other
appropriate cover.

Mitigation
,
15) Temporary fill areas are to be returned to pre-project contours and elevations. These areas will
be undercut below the adjacent marsh elevation(minimum 1') and refilled to adjacent wetland
elevation with suitable wetland or organic substrate to ensure revegetation of the impacted areas. '
16) Due to the possibility that compaction and/or other site alterations might prevent the temporary
wetland impact area from re-attaining wetland jurisdictional status,the permittee shall provide an .
annual update on the wetland areas temporarily impacted by this project. This annual update will •
' consist of photographs provided during the agency monitoring report meeting and a brief report
on the progress of these temporarily impacted areas in re-attaining wetland jurisdictional status.
Three years after project completion,the permittee shall schedule an agency field meeting with ,
DCM,the NC Division of Water Quality and the NC Wildlife Resources Commission to
determine if the wetland areas temporarily impacted by this project have re-attained jurisdictional '
wetland status. If at the end of 3 years the wetland areas temporarily impacted by this project
have not re-attained jurisdictional wetland status,NC DOT and the above listed agencies shall
determine whether a compensatory wetland mitigation plan will be required.
• 17) In order to properly gauge the effect of construction on existing SAV habitat, and in accordance
' with the permittee's application letter dated 7/19/99,the permittee shall conduct an underwater
survey to establish spatial distribution of SAV, species composition and population densities.
This pre-construction survey will serve as the base line for comparing a later post-construction
survey. In order to determine the effects of factors unrelated to construction activities, the
permittee shall also conduct similar surveys in a nearby "control" site. Results of the pre-
construction survey will be forwarded to DCM and the U.S. Army Corps of Engineers when the
report is published.
NOTE: In accordance with the 401 Water Quality Certification(DWQ Project No. 000040)
issued 3/9/00, if total wetland fills for this project(now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6)
and (7). '
General
• 18) This permit does not authorize the interference with any existing or proposed Federal project,
and the permittee will not be entitled to compensation for damage to the authorized structure or '
work or injury which may be caused from existing or future operations undertaken by the United
States in the public interest. ,

Permit Number 23 (Action ID No. 199810334) which was issued on 11/17/97.

SUBJECT:Application for CAMA Major Development Permit for the Proposed Replacement
of Bridge No.29 over Scranton Creek on US 264 NC 45 in Hyde County; TIP No. B-
3193; State Project No. 8.1080501; Federal Aid Project No. BRSTP-264(6)
The Department of Transportation is planning on replacing the bridge over Scranton Creek on
US 264 in Hyde County. The aging bridge is becoming structurally deficient and should be
replaced in the near future. The proposed design will result in the construction of a.new bridge at
the same location;however, it will be necessary to construct a temporary detour immediately east
of the existing bridge alignment to accommodate traffic during the construction interval. An off-
site detour utilizing existing secondary roads is not feasible.
Project construction will result in the Ioss of 0.15 acre of Section 404 wetlands due to the
permanent discharge of fill and 0.10 acre from excavation (relocation of ditch) for a total of 0.25
acre (0.247 acre). As part of the construction of the temporary detour, 0.34 acre of Section 404
wetland (including up to 0.1 acre of coastal wetland) will receive temporary fills. The
Department agrees to prohibit grubbing activities within the detour alignment and require the
placement of a geotechnical fabric under all fills that will be placed to accommodate the detour.
At the conclusion of construction, all temporary fills and fabric will be removed. Upon
inspection with staff from the DCM and the USACE, if substantial changes have occurred to the
underlying wetlands, the Department agrees to undertake compensatory mitigation for losses
agreed to during the post-project, interagency review.
Attempts to minimize impacts to adjacent wetlands from temporary construction were carefully
examined. For example, the use of sheet piling to eliminate impacts from temporary fill slopes
along the east side of the temporary fills could potentially reduce wetland impacts only up to 0.1
acre at an estimated cost of S100,000-200,000. The Department feels that such costs
substantially outweigh the benefits that would be derived.

One further resource issue which must be explored because of its importance to aquatic and
estuarine ecosystems is submerged aquatic vegetation. There are stands of SAV in the shallows
of the creek, particularly along the north shore. Since the proposed bridge is to be built on the
same alignment as the existing bridge, and since the proposed structure will have 5 less structural
bents in the water than the existing structure, it is reasonable to conclude that less SAV habitat
will be affected by the proposal. The temporary bridge may result in temporary impacts to SAV,
but it is also reasonable to anticipate that the population will adjust when the temporary pilings
and the bridge deck have been removed. In order to properly gauge the effect of construction on
existing SAV populations, the Department will conduct an underwater survey to establish spatial
distribution of SAV, species composition and population densities. This pre-construction survey
will serve as the base line for comparing a later post-construction survey. In order to determine
the effects of factors unrelated to construction activities, similar surveys will be conducted in a
nearby"control" site, Results of the pre-construction survey will be forwarded to the DCM (and
USACE)when the report is published.
Since the proposal will result in development activities in Areas of Environmental Concern,
CAMA application forms MP-1 and MP-5, as well as site drawings, letters and forms to adjacent
riparian landowners and a check for $250.00 are enclosed for your review and consideration.
Also enclosed is a copy of the Categorical Exclusion document and a tear sheet from the U.S.
Army Corps of Engineers, authorizing the proposal under NWP-23.

WASTE/BORROW SITE DECLARATION
For the record, the Department of Transportation requires its contractors to provide proof
that his plans to utilize a candidate waste/borrow area will not result in impacts to
wetlands (Coastal or Section 404) or waters. If the site is an agricultural field, we require
the contractor to provide copies of forms and aerial photo confirming the field's status as
either prior converted (PC) or nonwetland. These forms are obtainable from the Farm
Service Agency offices and/or the NRCS offices. If the site is in natural vegetation we
require the contractor to engage the services of an environmental consultant for the
purposes of performing on-site environmental evaluations. The environmental report
from the consultant is reviewed by the Division Environmental Officer to determine its
accuracy.
Since no contractor has been assigned to this project, it is not practical to identify a
suitable waste site at this time. In order to allay any concerns the Division of Coastal
Management has concerning the future selection and approval of a waste/borrow site, the
Department hereby declares that sites chosen for waste and/or borrow activities will not
result in secondary impacts to wetlands, waters or AECs.

Project Setting
The North Carolina Department of Transportation(NCDOT)proposes to replace Bridge#29
located on US 264 and NC 45 over Scranton Creek between Belhaven and Swan Quarter in Hyde
County,North Carolina. The bridge is oriented north-south,and the proposed construction will take
place on the upstream(east)side of the bridge.The wetlands in the project area have been delineated
as 404 wetlands by NCDOT but the delineation has not been approved by the US Army Corps of
Engineers.
The bridge is located in an undeveloped area with abundant wetlands, dominated by black
needle rush(Juncus roemerianus).The existing right of way contains vegetated uplands with various
grass species, and drainage ditches containing a mix of Coastal Wetlands and other 404 wetland
species. The dominant species in the ditches include wax myrtle, Iva frutescens, Carex sp., other
wetland species. A small area of Coastal Wetlands, dominated by Juncus roemerianus with Typha
spp. borders the creek, and extends approximately 20 ft. landward on the North side of the bridge.
Also on the North side of the project area, there is a narrow strip of wooded uplands between the
existing ditch and the adjacent Juncus roemerianus marsh. These uplands appear to be growing on
an old spoil berm. On the South side of the project area,there is a±150'wide area of mixed wetland
between the existing road shoulder and the Juncus roemerianus marsh. The dominant species in this
area include wax myrtle, Iva frutescens, and Carex sp..
The navigable water depth at the existing bridge is±5'. Scranton Creek is±300' wide at the
existing bridge crossing. All of the existing bridge bents are in the creek proper. Navigation is
limited by the bent configuration of the existing bridge,and the temporary structure will not further
impede navigation. The proposed bridge will increase navigability upstream because there will be
fewer bents in the creek. Scranton Creek is classified as SC-NSW by the Environmental
Management Commission and is not open to shell fishing at this location.
Project Description
The NCDOT proposes to replace an existing±26' wide by±300' long two lane bridge over
Scranton Creek with a±36'wide by±322'long two lane bridge and to construct a±24'wide by±289'
long temporary detour bridge. The existing bridge has twelve bents in Scranton Creek evenly spaced
across the creek. The creek is±300'wide at the crossing. The proposed bridge will have six bents
in the creek with the center bent approximately in the center of the creek. The existing bridge has
a navigation clearance of±3.5'and the proposed bridge will have a navigational clearance of±3.5'.
A temporary detour bridge will be constructed on the upstream side of the existing bridge .
NCDOT proposes to temporarily fill ±14,975 ft2 of noncoastal 404 wetlands to construct the
temporary detour structure and its associated approaches. These temporary impacts will be returned
to preproject contours and elevations upon completion of the permanent bridge. Construction of the
replacement bridge will result in the permanent filling of±400 ft2 of Coastal Wetlands and±5,903
ft2

of noncoastal 404 wetlands immediately adjacent to the existing structure. Construction of
permanent drainage ditches will result in excavation of±5,015 ft2 of noncoastal 404 wetlands.
Approximately 70,000 ft2 of highground will be temporarily filled during construction of the detour
structure, and ±40,700 ft2 of highground will be permanently filled during construction of the
replacement bridge.
Anticipated Impacts
Construction of the detour structure will result in temporary impacts that will be restored
upon completion of the replacement bridge. Approximately ±14,975 ft2 of noncoastal 404 wetlands
will be filled to construct the temporary detour structure. Approximately 70,000 ft2 of highground
will be filled during construction of the detour structure. These impacts will be temporary, and the
effected areas will be returned to preproject contours and elevations upon completion of the
permanent replacement bridge.
Construction of the replacement bridge and widened approaches will result in the permanent
filling of±400 ft2 of Coastal Wetlands, predominantly vegetated with Juncus roemerianus, and
±5,903 ft2 of other 404 wetlands adjacent to the existing structure. This area already impacted by
existing road fill and an existing unassociated fill area±20' to the east. Permanent drainage ditches
will be constructed in the area that will be impacted by the temporary detour structure, and will result
in the excavation of±5,015 ft2 of other 404 wetlands. Approximately 40,700 ft? of highground will
be filled during construction of the replacement bridge. Construction of the new bridge will result
in the shading of 4,152 ft2 of creek bottom. Turbidity from construction activities will vary with
construction technique, water depth and substrate type, and will temporary.
The net impact of the proposed bridge replacement is the permanent loss of±400 ft2 of
Coastal Wetlands and +29,109 ft2 of other 404 wetlands that will be filled or excavated.
Approximately 4,152 ft2 of creek bottom will be shaded by the replacement bridge.

I have reviewed the application for a CAMA Major Permit submitted to this
office on behalf of NC Department of Transportation in regards to the rules and
regulations adopted by the CRC, specifically NCAC 7H.0205, 0207, and 0208. My
review indicates that the proposal appears to be consistent with these regulations. If the
permit is issued, I recommend the following conditions be included:
Conditions:
1) debris associated with the removal of the existing bridge will be disposed
on an approved highground site unless otherwise permitted by this Division.
2)Tempo 1 areas are to be returned to preproject contours and elevations.
These as will be undercut below the adjacent marsh elevation(minimum 1')
refilled to adjacent wetland elevation with suitable wetland or organic
substrate to ensure revegetation of the impacted areas.

You have our approval,in accordance with the attached conditions and those listed below,to dredge 0.12 acres of wetlands,permanently
fill 0.34 acres of wetlands,and 0.09 acres of creek bottom for the purpose of replacing a bridge#29 over Scranton Creek Rd.US 264/NC 45,
as you described in your application dated January 12,2000. After reviewing your application,we have decided that this fill is covered by
General Water Quality Certification Number 3112.This approval is also valid for the Tar-Pamlico River buffer rules(15A NCAC 2B.0259).
In addition,you should get any other federal,state or local permits before you go ahead with your project including(but not limited to)
Sediment and Erosion Control,Coastal Stormwater,Non-Discharge and Water Supply Watershed regulations. This approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your
project,you must notify us and you may be required to send us a new application. If the property is sold,the new owner must be given a copy
of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project(now
or in the future)exceed one acre,compensatory mitigation may be required as described in 15A NCAC 2H.0506(h)(6)and(7).This approval
shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification.For this approval to be
valid,you must follow the conditions listed in the attached certification and any additional conditions listed below.
If you do not accept any of the conditions of this certification,you may ask for an adjudicatory hearing. You must act within 60 days of
the date that you receive this letter. To ask for a hearing,send a written petition,which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings,P.O.Box 27447,Raleigh,N.C.276 1 1-7447. This certification and its conditions are
final and binding unless you ask for a hearing.

This office received a copy of your CAMA application on January 11, 2000.
At our request, Mr. T. Lindsey Riddick, Jr. provided additional supporting
information on February 24, 2000. Staff review of the plans and specifications
has determined that the project, as proposed, consists of activities that will
not pose surface water quality threats from stormwater runoff. The Director has
determined that projects that are reviewed and approved by the Division as not
posing water quality threats from stormwater runoff should not be subject to the
stormwater management permitting requirements of 15A NCAC 2H.1000. For this
reason, we are informing you by way of this letter that your project will not
require a stormwater management permit.
Please keep in mind that this determination does not affect your legal
requirements to obtain other permits which may be required by the Division of
Water Quality, the Division of Land Resources, Coastal Area Management Act or any
other Federal, State or Local Government. In addition, any future modifications
to the project will require additional review from this office to assure that
stormwater impacts are not an issue.

knowledge of the area. it is unlikely that any archaeological resources which may be eligible for
inclusion in the National Register of Historic Places will be affected by the project construction.

' the 1997 Hyde County Land Use Plan.
The Land Use Plan policies relating to transportation do not specifically
lig NO P414' p .art address individual DOT projects in this plan. Water uses, wetlands, and other fragile
jareas are anticipated to be protected through enforcement of state and federal
regulations as described in policies on pages IV-7 through IV-9. Policies relating to
local commitment to State and Federal programs on page IV-37 states that the countyin generally receptive to such programs, particularly those which provide
improvements to the county. NCDOT is noted as one of the programs included in this
policy. Land classification will not pose consistency problems. Also, to the extent that
the project is expected to improve navigation at this location, the plan would appear
It 1 to support such action, as general concerns for navigation are expressed in the plan.

This letter serves to address concerns expressed during our phone conversation earlier
today. During our conversation we discussed the issue of excavated material being used
as temporary fill material for the proposed temporary on-site detour. Your main concern
is whether or not the NCDOT is certain that the material is suitable for use as temporary
fill; and if it is not suitable, what will be done with the material. Additionally, you would
like a more concise description of the removal and disposal of temporary fill material.
As we discussed, all excavated material will be used as temporary fill for the on-site
detour. If the excavated material is found to be unsuitable for use as temporary fill, it will
be disposed of at an upland disposal site. The disposal site is the responsibility of the
contractor who constructs the project. Any contractor awarded a construction project that
involves waste or borrow is required to provide proof that his plans to utilize a candidate
waste/borrow area will not result in impacts to jurisdictional areas. If the site is an
agricultural field, the contractor is required to provide copies of forms and aerial photos
confirming the field's status as either prior converted (PC) or non-wetland. These forms
are available from the USDA Farm Service Agency and/or the NRCS. If the site is in
natural vegetation, the contractor is required to engage the services of an environmental
consultant for the purpose of performing on-site environmental evaluations. The
environmental report is reviewed by the Division Environmental Officer to determine its
accuracy.

All waste or borrow associated with this project, including removal of the temporary
detour,will be subject to the above mentioned process. All waste will be disposed of in
an upland disposal area approved by the NCDOT.

Dear Landowner:
The North Carolina Department of Transportation is planning to replace the bridge over
Scranton Creek on US 264-NC 45 in Hyde County. A temporary, on-site detour will be
constructed immediately east of the existing bridge while the old bridge is removed and a
new structure built at this location. This action requires the approval of the Division of
Coastal Management (DCM) under provisions of the Coastal Area Management Act
(CAMA). One of the prerequisites to this approval is that adjacent riparian landowners
be given an opportunity to comment on the proposal.
The attached form is submitted to insure that you, one of four adjacent riparian
landowners, have an opportunity to comment on the proposal. The work planned is
depicted in the attached drawings. If you have no objections to the proposal, please
return the form with your response within 30 days to this office. If you do have
objections to the project,please forward your comments to:
