Dear Mr. Harris:
This letter is in response to the N.C. Department of Transportation (NCDOT) letter dated 6/13/05
regarding the Scranton Creek Bridge Site in Hyde County. In the letter, NCDOT requests that the
appropriate resource agencies provide documentation stating that no further monitoring of the
temporary impact areas is required and that the site is closed. The N.C. Division of Coastal
Management (DCM) apologizes for the delay in sending this response letter.
The Scranton Creek Bridge Site involved returning temporary fill areas due to a temporary on-site
detour in noncoastal wetlands to pre-project contours and elevations. The CAMA permit also required
monitoring to ensure that the temporarily impacted wetland areas re-attain jurisdictional wetland
status.
DCM has reviewed the annual monitoring reports prepared by NCDOT in 2002, 2003 and 2004. DCM
has also visited the site in June 2007, and consulted with the N.C. Wildlife Resources Commission
(WRC) and the N.C. Division of Water Quality(DWQ). Based upon this review,DCM agrees that no
further monitoring is required and that the site may be officially closed.
DCM appreciates NCDOT's efforts to ensure that the temporarily impacted wetland areas on this

"CAMA Permits with Temporary Impact Monitoring Condition"
The CAMA permit commitment review document prepared by RK&K dated 9/22/03 states: "RK&K
field-reviewed temporary impact areas with Mr. Midgett and Mr. Hernandez on January 15, 2003. The
temporary impact area associated with the work trestle located along the northwest bridge approach
appeared to be graded to wetland elevation. As completion of this project occurred in 2002, it is too
early to determine if these areas are reattaining jurisdictional status. Photographs of impact areas
located in the northwestern bridge quadrant taken in March 2003 are included below."
The CAMA permit commitment review document prepared by RK&K dated 9/22/03 states: "NCDOT
should continue annual monitoring at established mitigation sites as well as at temporary impact
areas....an agency meeting should be scheduled in 2005 (three years post-construction)to review the
status of temporary impact areas. As stated in WQC No. 3167 issued November 1997, all temporary
impact areas should be restored in accordance with the finalized DWQ restoration policy."
DCM has not received any annual updates from NCDOT on the wetland areas temporarily impacted by
this project. The CAMA Permits with Temporary Impact Monitoring Condition document prepared by
NCDOT dated 4/20/05 states: "This project is complete and an interagency inspection is requested to
determine compliance of the temporary impact condition of the permit." However, the NCDOT
4/20/05 report does not provide any data regarding the recovery status of the wetland areas temporarily
impacted by this project. DCM agrees that an interagency inspection is needed. However, DOT
should first provide DCM with an update on the wetland areas temporarily impacted by this project in
accordance with Condition No. 17 of the major CAMA permit modification issued on 9/23/98 and
Condition No. 4 of the CAMA permit minor modification issued on 5/1/00,taking into account the
change in the nature of temporary impacts resulting from the CAMA permit minor modification issued
on 8/16/00. NCDOT is hereby requested to submit the above referenced report as soon as possible.
RK&K determined the site to be complete in the document dated 9/22/2003. The NEU inspected the
site in 2005 and included pictures of the revegetation in the review document dated 4/20/2005. At that
time the NCDOT requested a site inspection by the NCDCM to determine compliance. To our
knowledge this has not been performed.
4. B-3193,REPLACEMENT OF BRIDGE NO. 29 OVER SCRANTON CREEK ON US 264-NC
45,HYDE COUNTY, CAMA PERMIT NO. 46-00.
DOT sent a letter to DCM dated 6/13/05 requesting that DCM provide documentation stating that no

regarding this question dated 10/19/05, 12/16/05 and 2/3/06. DCM needs to make a site visit to ensure

6. B-3435,REPLACEMENT OF BRIDGE NO. 4 ON SR 1207 OVER ROCKY HOCK CREEK,
CHOWAN COUNTY, CAMA PERMIT NO. 105-02.
DCM received the 2005 annual monitoring report for this project in 2005. DCM agrees with DOT's
recommendation to continue vegetation monitoring of the temporarily impacted areas at this site.
DCM will provide additional comments on the sections of the 2005 annual monitoring report
regarding wetland restoration of causeway fill areas under separate cover.
7. R-3850,INTERCHANGE AT SR 1140 (OKISKO ROAD) AND US 17 SOUTH OF
ELIZABETH CITY,PASOUOTANK AND PERQUIMANS COUNTIES, CAMA PERMIT NO.
82-03.
This project is complete, therefore DOT needs to begin providing DCM with annual updates on
the wetland areas temporarily impacted by this project in accordance with permit condition
number 24.

Hi Clay,
DCM is preparing a long overdue close-out letter for the Scranton Creek Bridge
Replacement (monitoring of temporary wetland impacts due to the on-site detour) . Jim
mentioned that you, he and Stephen Lane had been to the site. Jim said that it looks
good except for a patch of Phragmites approximately 20 feet wide. Jim mentioned that
you were going to look into having the Phragmites sprayed. While I was coordinating
with DWQ and WRC to close out the site, DWQ (David Wainwright) asked to be kept
informed about the spraying. Could you follow up with DWQ?

Travis and David,
I am catching up on some old business here, and have another wetland site to close
out. Sorry! This is a site where monitoring was required to ensure that
temporarily impacted wetland areas re-attain jurisdictional wetland status. DOT
wrote a letter dated 6/13/05 requesting that the appropriate resource agencies
provide documentation stating that no further monitoring is required and that the
site may be closed.
Travis, you were copied on the 6/13/05 letter. David, Christina Breen was copied
on the 6/13/05 letter. However, please let me know if either one of you needs an
additional copy given the time that has passed. Annual monitoring reports for
2002, 2003 and 2004 are on the NCDOT web site.
CAMA Permit No. 46-00 was issued for this bridge replacement project on 3/17/00.
The permit authorizes 0.145 acres permanent fill in wetlands, 0.344 acres
temporary fill in wetlands due to an on-site temporary detour, 0.294 acres
mechanized clearing and 0.10 acres due to excavation (relocation of ditch) . There
were approximately 400 square feet of permanent impacts to CAMA coastal wetlands.
The rest of the impacts were to 404 wetlands.
Mitigation was not required for the permanent wetland impacts. However, Condition
No. 15 requires that,the 0.344 acres of temporary fill areas are to be returned to
pre-project contours and elevations. Condition No. 16 of the CAMA permit requires
that NCDOT conduct monitoring to ensure that the wetland areas temporarily
impacted by this project re-attain jurisdictional wetland status. This condition
states that three years after project completion, the permittee shall schedule an

agency field meeting with DCM, DWQ and WRC to determine if the wetland areas
temporarily impacted by this project have re-attained jurisdictional wetland
status.
DCM (Jim Hoadley and Stephen Lane) conducted a site visit in June 2007. Although
the permit condition requires a field meeting with NCDOT, DCM, DWQ and WRC, Jim
and Stephen think that the site looks good, and DCM agrees that no further
monitoring is required and that the site is closed. Jim and Stephen did note that
there is a patch of /Phragmites/ at the site approximately 20 feet wide, and Clay
Willis was going to look into having the /Phragmites/ sprayed.
Have you visited this site previously? Have you already provided a response to
NCDOT? Are you willing to provide your approval that the wetland areas temporarily
impacted by this project have re-attained jurisdictional wetland status without a
site visit with DCM and DOT? In my opinion, it would not be worthwhile to try to
schedule a multi-agency site visit given the distance and apparent success of the
site. However, please let me know what you think.

Dear Mr. Harris:
Enclosed please find comments from the N.C. Division of Coastal Management (DCM) on the
following two documents submitted to DCM by the N.C. Department of Transportation
(NCDOT) on April 20, 2005 and August 15, 2005, respectively: "CAMA Permits with
Temporary Impact Monitoring Condition"; and "CAMA Permit Commitment Review." As you
know, in April 2002 DCM and NCDOT began a comprehensive effort to ensure that the
mitigation and monitoring conditions of the CAMA permits discussed in the attached documents
are satisfied.
DCM regrets that it took over a year to provide the attached comments. However, substantial
progress has been made during this period to achieve resolution on many of the projects
discussed in these documents. There are a total of 43 projects with CAMA permits discussed in
the attached documents: 20 projects have mitigation conditions only; 10 projects have temporary
impact monitoring conditions only; and 13 projects have both mitigation conditions and
temporary impact monitoring conditions. Based upon the attached analysis, DCM has
determined that the mitigation and/or temporary impact monitoring conditions of 17 projects
have been completely satisfied.
There are 23 CAMA permits discussed in the attached documents with mitigation and/or
monitoring conditions that remain unsatisfied. Compliance with some of these projects is
imminent or well underway. However, many of these projects have significant outstanding
unresolved issues, and are of particular concern to DCM. I do not believe that a general meeting
is necessary to discuss these projects. Instead, I hope that our staffs can put an emphasis on
working together to resolve the outstanding issues as detailed in the attached documents.

As you are aware, the Department has monitored the Scranton Creek Bridge Mitigation Site since
its construction in March of 2002. Located in Hyde County, at.Bridge No. 29 on US 264/NC 45,
this 0.60-acre site provides mitigation for wetland impacts associated with project B-3193. The
site was left to naturally re-establish vegetation in 2002; hydrologic monitoring was notrequired
for this project. NCDOT proposed to monitor the Scranton Creek Bridge Mitigation Site for
three years ur until success criteria were met; with vegetation monitoring conducted each year.
After each growing season, annual monitoring reports were submitted to the appropriate
regulatory agencies.
After three years of vegetation monitoring,by visual observation, the Scranton Creek Bridge
Mitigation Site shows that natural re-vegetation is occurring anc that the impacted area is re-
attaining jurisdictional status. Individual yearly monitoring data °s provided within the annual
monitoring reports submitted between 2002 and 2004.
During the annual monitoring report meeting on May 5, 2005,NCDOT and resource agencies
agreed that the Scranton Creek Bridge Mitigation Site could be closed and that monitoring could
be discontinued. NCDOT requests that the appropriate resource agencies provide documentation
stating that no further monitoring is required and that the site is closed. If you have any questions

SUMMARY
The Scranton Creek Bridge Mitigation Site is located in Hyde County. The site
was left to naturally re-establish vegetation in 2002 and was designed as
mitigation for wetland impacts associated with bridge project B-3193.
The mitigation encompasses approximately 0.60 acres total of wetland
restoration. The restoration effort involved the removal of the temporary roadway
fill related to the detour. The restoration effort involved allowing the temporarily
impacted area to naturally re-establish vegetation. The area is being monitored to
ensure that it re-attains wetland jurisdictional status. No hydrologic monitoring is
required for this project; however, vegetation monitoring is required for three
years.
After the third year of monitoring, the Scranton Creek Bridge Site shows by visual
observation, that the vegetation is re-establishing naturally, and that the impacted
area is re-attaining jurisdictional status.
NCDOT recommends to discontinuing vegetation monitoring of this site.
1.0 INTRODUCTION
1.1 Project Description
The Scranton Creek Bridge Mitigation Site is located at Bridge No. 29 on
US 264/NC 45 in Hyde County (Figure 1). The site consists of approximately
0.60 acres of mitigation for wetland impacts associated with project B-3193.
1.2 Purpose
In order for a mitigation site to be considered successful, a site must meet
vegetation success criteria. This report details the vegetation monitoring in 2004
at the Scranton Creek Bridge mitigation Site. Hydrologic monitoring was not
required for the site.

2.1 Success Criteria
Success Criteria states that the impacted area where the onsite detour was
removed shall be allowed to naturally re-establish vegetation. The area is being
monitored to ensure that it re-attains wetland jurisdictional status at the end of
three years.
2.2 Description of Species
No species of trees were planted. The site was graded down to its original
contours and elevation and left to re-establish vegetation naturally.
2.3 Results of Vegetation Monitoring
The impacted area where the onsite temporary detour was removed is re-
attaining jurisdictional status due to the re-establishment of natural vegetation.
This natural vegetation includes Juncus sp., water grass, smartweed, indian
grass, black willow, Baccharis sp., wax myrtle, nutsedge, fennel, cattail, and
other marsh grass species. Vegetation in the disturbed area is similar in type and
density as in the adjacent undisturbed areas.
2.4 Conclusions
There were approximately 0.60 acres total of wetland restoration on site. There
were no plots established on the site. By visual observation the Scranton Creek
Bridge Site shows that natural re-vegetation is occurring and that the impacted
area is re-attaining jurisdictional status.
3.0 Overall Conclusions and Recommendations
NCDOT's report from the past two years stated that the planted bottomland
hardwood species were meeting success criteria. The original construction plans
stated that the site was to be planted with bottomland hardwood species.
NCDOT reviewed permit information regarding questions about the planted
species that were brought up at the 2003 annual monitoring meeting. Neither
404 nor CAMA permits required any plantings. After discussing with field
personnel it became apparent that the site was never planted. The site has,
however, re-attained jurisdictional status through natural regeneration and is
covered in many different marsh grass species.
NCDOT proposes to discontinue vegetation monitoring at the Scranton Creek
Bridge Site.

2.1 Success Criteria

removed shall be replanted using bottomland hardwood species and must re-
attain jurisdictional status at the end of three years.
2.2 Description of Species
The following wetland species were planted in the Wetland Restoration Area:
Taxodium distichum, Baldcypress
Nyssa sylvatica var. biflora, Swamp Blackgum
Quercus phellos, Willow Oak
Quercus falcata var. pagodaefolia, Cherrybark Oak
Fraxinus pennsylvanica, Green Ash
2.3 Results of Vegetation Monitoring
The impacted area where the onsite temporary detour was removed and
revegetated is re-attaining jurisdictional status and the planted species are
surviving. The site looks similar to the surrounding wetland areas. Vegetation is
nearly as thick in the disturbed area as in the undisturbed areas.
Site Notes: Other species noted include: Juncus sp., cattails, and black willow.

INTRODUCTION
Rummel, Klepper, and Kahl, LLP conducted a review of the North Carolina
Department of Transportation's (NCDOT) mitigation commitments to the Division of
Coastal Management (DCM) for 33 transportation related projects. The project period
spanned the ten-year period from 1992 through 2002. RK&K thoroughly researched
files located in the PD&EA Branch of NCDOT as well as NCDOT archive files to locate
Coastal Area Management Act (CAMA), United States Army Corps of Engineers (COE)
and Division of Water Quality (DWQ) permits as well as mitigation plans and monitoring
reports, where applicable. Following this background review, RK&K personnel
conducted interviews with PD&EA personnel regarding specific projects. RK&K then
visited NCDOT Division and/or District offices as necessary to acquire as much
supplemental information as possible. Field visits to project sites consisted of visits to
temporary impact areas and any transportation projects containing on-site mitigation not
documented in annual NCDOT monitoring reports or mitigation bank debit ledgers.
The following report summarizes RK&K's findings. Each of the 33 projects is
described beginning with an executive summary of the project. The summary is followed
by a timeline listing dates that NCDOT received CAMA, COE and DWQ permits as well
as any significant dates pertaining to mitigation. The timeline is followed by a listing of
commitments quoted directly from the permits. Commitments are sorted into categories
by permits and subsequent modifications and/or refinements that affect compensatory
mitigation. This list represents documentation retrieved from NCDOT files. RK&K was
unable to locate all permits and modifications for all 33 projects. Permits or
modifications that did not address mitigation are not included in the list. Following permit
commitments, each project contains an update on the mitigation status and
recommendations of actions necessary to satisfy project commitments. It is possible
that additional measures have been taken by NCDOT to complete DCM mitigation
commitments and this information was not available at the time of RK&K's review.
Documentation of mitigation credits debited for specific projects is included, if applicable.
Throughout this document, reference to the "master" debit ledger refers to the wetland
debit ledger maintained by Mr. Phil Harris, P.E., Manager, NCDOT Office of Natural
Environment.

Bridge Mitigation Site was planted in 2002 and was designed as mitigation for wetland
impacts associated with bridge project B-3193. The mitigation encompasses
approximately 0.60 ac total of wetland restoration. The restoration effort involved the

revegetated with bottomland hardwood species. The area is being monitored to ensure
that it re-attains wetland jurisdictional status. No hydrologic monitoring is required for this
project; however, vegetation monitoring is required for three years. The mitigation areas
are 0.5 to 1 foot below adjacent wetland elevations and the substrate also appears to
have mineral soils. This indicates that the B-3193 restoration areas were not built to
satisfy Condition 15 of CAMA Permit No. 46-00. None of the planted tree species are
surviving, likely due to the low elevation of the mitigation areas. The B-3193 restoration
areas are not re-attaining wetland jurisdictional status. RK&K recommends that NCDOT
schedule an agency meeting to discuss remedial actions and submit a post-construction
SAV survey. NCDOT should also continue monitoring the mitigation site.
Project Description
NCDOT constructed a bridge replacement project for Bridge No. 29 over
Scranton Creek in Hyde County, North Carolina. The project consisted of replacing the
bridge on the existing alignment and constructing a temporary detour immediately east.
The temporary detour is to be removed, graded back to pre-construction contours and
elevations, then replanted. According to Mr. Lindsey Riddick, NCDOT Environmental
Supervisor, this project resulted in 0.25 ac permanent wetland impacts and 0.34 ac
temporary wetland impacts.
Project Timeline
• March 17, 2000: CAMA Permit No. 46-00 issued.
• March 2002: Project site planted.
• March 10, 2003: RK&K field review completed.
Permit Commitments
CAMA Permit No. 46-00 issued 3/17/00
15) Temporary fill areas are to be returned to pre-project contours and elevations.
These areas will be undercut below the adjacent marsh elevation (minimum 1') and
refilled to adjacent wetland elevation with suitable wetland or organic substrate to
ensure revegetation of the impacted areas.
16) Due to the possibility that compaction and/or other site alterations might prevent
the temporary wetland impact area from re-attaining wetland jurisdictional status, the
permittee shall provide an annual update on the wetland areas temporarily impacted

by this project. This annual update will consist of photographs provided during the
agency monitoring report meeting and a brief report on the progress of these
temporarily impacted areas in re-attaining jurisdictional status. Three years after
project completion, the permittee shall schedule an agency field meeting with DCM,
DWQ, and WRC to determine if the wetland areas temporarily impacted by this
project have re-attained wetland jurisdictional status. If at the end of three years the
al wetland areas temporarily impacted by this project have not re-attained wetland
jurisdictional status, NCDOT and the above listed agencies shall determine whether
a compensatory wetland mitigation plan will be required.
1111 17) In order to properly gauge the effect of construction on existing SAV habitat, and
in accordance with the permittee's application letter dated July 19, 1999, the
permittee shall conduct an underwater survey to establish spatial distribution of SAV,
species composition and population densities. This pre-construction survey will serve
as the base line for comparing a later post-construction survey. In order to determine
the effects of factors unrelated to construction activities, the permittee shall also
conduct similar surveys in a nearby "control" site. Results of the pre-construction will
be forwarded to DCM and the COE when the report is published.
Mitigation Status
NCDOT issued a monitoring report for B-3193 in December 2002. This
monitoring report states that the planted tree species are surviving by visual observation.
To verify these findings, RK&K conducted a site review of B-3193 on March 10, 2003.
Photographs of this visit are included below. The site was planted in March 2002 with
bottomland hardwood species. During the site review, RK&K counted no surviving trees.
The mitigation areas were 0.5 to 1 foot below adjacent wetland elevations and the
substrate also appears to have mineral soils. This indicates that the B-3193 restoration
areas were not built to satisfy Condition 15 of CAMA Permit No. 46-00. Likely due to the
low elevation of the mitigation areas, none of the planted tree species are surviving. The
B-3193 restoration areas are not re-attaining wetland jurisdictional status. These finding
are not consistent with the NCDOT Scranton Creek Monitoring Report dated December
2002.
According to Mr. Lindsey Riddick, NCDOT Environmental Supervisor, a pre-
construction SAV survey was conducted; however, no post-construction SAV survey has
been conducted. Condition 17 of CAMA Permit No. 46-00, has not been satisfied.

The Scranton Creek Bridge Mitigation Site is located in Hyde County. The site
was planted in 2002 and was designed as mitigation for wetland impacts
associated with bridge project B-3193.
The mitigation encompasses approximately 0.60 acres total of wetland
restoration. The restoration effort involved the removal of the temporary roadway
fill related to the detour. The restoration area was revegetated with bottomland
hardwood species. The area is being monitored to ensure that it re-attains
wetland jurisdictional status. No hydrologic monitoring is required for this project;
however, vegetation monitoring is required for three years.
After the first year of monitoring, the Scranton Creek Bridge site shows by visual
observation that the planted species are surviving and that the impacted area is
re-attaining jurisdictional status.
NCDOT recommends continuing monitoring of this site.

1.0 INTRODUCTION
1.1 Project Description
The Scranton Creek Bridge Mitigation site is located at Bridge No. 29 on
US 264/NC 45 in Hyde County. The site consists of approximately 0.60 acres of
mitigation for wetland impacts associated with project B-3193
1.2 Purpose
In order for a mitigation site to be considered successful, a site must meet
success criteria in vegetation. This report details the vegetation monitoring in
2002 at the Scranton Creek Bridge mitigation Site. Hydrologic monitoring was
not required for the site.

2.0 VEGETATION: SCRANTON CREEK BRIDGE MITIGATION
SITE (YEAR 1 MONITORING)
2.1 Success Criteria
Success Criteria states that the impacted area where the onsite detour was
removed shall be replanted using bottomland hardwood species and must re-
attain jurisdictional status at the end of three years.
2.2 Description of Species
The following wetland species were planted in the Wetland Restoration Area:
Taxodium distichum, Baldcypress
Nyssa sylvatica var. biflora, Swamp Blackgum
Quercus phellos, Willow Oak
Quercus falcata var. pagodaefolia, Cherrybark Oak
Fraxinus pennsylvanica, Green Ash
2.3 Results of Vegetation Monitoring
The impacted area where the onsite temporary detour was removed and
revegetated is re-attaining jurisdictional status and the planted species are
surviving.
Site Notes: Other species noted include: Juncus sp., cattails, black willow.
2.4 Conclusions
There were approximately 0.60 acres total of wetland restoration on site. There
were no plots established on the site. By visual observation the Scranton Creek
Bridge site shows that the planted species are surviving and that the impacted
area is re-attaining jurisdictional status.
3.0 Overall Conclusions and Recommendations
NCDOT proposes to continue monitoring at the Scranton Creek Bridge Site.

Project Name: Bridge No. 29 over Scranton Creek
Project Description: Bridge replacement for Bridge No. 29 replaced over Scranton
Creek in Hyde County, North Carolina. The project consisted of replacing the bridge on
the existing alignment and constructing a temporary detour immediately east.
Recommendations: The B-3193 restoration areas are not re-attaining wetland
jurisdictional status. RK&K recommends that NCDOT schedule an agency meeting to
discuss remedial actions and submit a post-construction SAV survey. NCDOT should
also continue monitoring the mitigation site.

Project Name: US 64, Plymouth to Columbia
Project Description: Project consists of widening the existing road to a median divided
multi-lane facility, with some portions on new location.
Recommendations: NCDOT is currently meeting the mitigation requirements outlined
in CAMA Permit No. 166-00. However, RK&K recommends that NCDOT provide DCM
with a current progress report on implementation of the restoration plan for the non-
riverine bottomland hardwood swamp near the relic oxbow channel in Tyrrell County,
and a copy of the debit ledger for the Great Dismal Swamp Mitigation Bank-Timberlake
Tract site. The debit ledger shall reflect that at least 99.875 of credits have been debited
for this project, and shall show the remaining credits available at the site.

Project Name: Montgomery Road Violation
Project Description: In January 1999, NCDOT began a road-widening project on SR
1149 without obtaining required permits. NCDOT scheduled a resource agency meeting
in June 2000. The DCM issued a Notice of Violation (NOV) to NCDOT on September
6
