As indicated in the permit drawings, the breakwater will not extend beyond its current boundaries. The purpose of the breakwater is unchanged, it will continue to reduce wave action at the ferry docking facility. Based on discussions with the Ferry Division, the location of this breakwater cannot be moved further north outside the required 15 foot property line setback. Based on current ferry boat lengths (150 ft) if the breakwater was moved northward it would inhibit their ability to maneuver the vessel safely when docking. Finally, the replacement structure will be built to comply with current rules to the maximum extent possible. As a result, it is NCDOT's opinion that the southern breakwater meets the conditions of non-conforming development and therefore does not require a 15 foot setback waiver from the adjacent property owner. Recent discussions with the Division Resident Engineer revealed that there are areas of the existing bulkhead that have failed and extend waterward ±2 feet. Therefore, the additional distance is needed to construct the replacement bulkhead. As we discussed, you will evaluate this request when writing the permit conditions for the project. The proposed action will include the demolition and replacement of the bulkhead and breakwaters for the Minnesott Ferry Docking Facility. The project will also involve the construction of a new access ramp and adding, replacing, and removing dolphin clusters . NCDOT will submit a request to the two adjacent property owners to waive the 15 foot setback required to construct the breakwaters on the north and south sides of the facility. Once the waiver is received it will be submitted to your office for review. The NCDOT is requesting that the proposed work be authorized under a Coastal Area Management Act (CAMA) permit . By copy of this letter we are requesting the review and issuance of a 401 Water Quality Certification from the NC Division of Environmental Management and Section 404 and Section 10 Permits from the • US Army Corps of Engineers . PROJECT SUMMARY: The NCDOT proposes to add an additional ramp at the Minnesott Beach Ferry Landing. The project involves the replacement, removal, and addition of numerous dolphin clusters in addition to the replacement of the existing 400' bulkhead. The applicant also proposes to add an additional 60' to the upstream breakwater as well as to replace the downstream breakwater. FIELD INVESTIGATION REPORT: NORTH CAROLINA DEPARTMENT OF TRANSPORTATION/PAMLICO COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The North Carolina Department of Transportation operates a ferry link crossing the Neuse River along NC 306 between Minnesott Beach in Pamlico County and Cherry Branch in Craven County. The ferry operates 7 days a week, 365 days a year, and during certain peak periods during the day provides three trips/hour each way. The Minnesott Beach Ferry Landing currently has a single 17'-wide ramp, a ferry- operations office building with public restrooms, and associated paved parking lot. The remaining part of the tract is undeveloped and vegetated with lawn grasses. The 400' of shoreline adjacent the Neuse River is bulkheaded but in poor condition. Two wooden and deteriorating breakwaters extend out into Neuse at the site, and are located immediately upstream and downstream along the adjacent property lines. The breakwater downstream is approximately 143' in length while the upstream breakwater is only 40' in length. Currently, 8 dolphin clusters exist within the groin-protected open water basin area. The Neuse River at this point is classified SB SW NSW and is closed to shellfishing. The area is not a designated Primary Nursery Area. Project Description The applicant proposes to add an additional loading ramp immediately downstream of and adjacent to the existing one. Associated development would include paving the access to the ramp and paving a small area adjacent the office building for parking. Construction of the new ramp would require the removal of 2 existing outer dolphin clusters and the addition of 7 new dolphin clusters (six of which would mirror the existing clusters). At the same time, the applicant wishes to replace the 6 remaining dolphin clusters. The addition of the new ramp requires that the applicant excavate approximately 180 ft2 of high ground and construct a bulkhead. At the same time, the applicant proposes to replace the remaining deteriorated bulkhead by constructing a steel sheet pile bulkhead 2' in front of the old alignment, and placing a 3'-wide concrete cap on it. The proposal also includes replacing the two deteriorating breakwaters with the same steel sheet pile and concrete cap. The downstream breakwater would be replaced along the same alignment and distance from the NWL. The upstream breakwater on the other hand would be replaced along the same alignment, but would also be extended another 60' from the NWL. FIELD INVESTIGATION REPORT: NORTH CAROLINA DEPARTMENT OF TRANSPORTATION/PAMLICO COUNTY PAGE #3 Anticipated Impacts The project as proposed would result in the filling of 1260 ft2 of Estuarine Waters and Public Trust Areas of the Neuse River as a result of the replacement of the bulkhead and the associated backfill (1200 ft2) and the 60' extension of the upstream breakwater (60 ft2). In association with the construction of the bulkhead, approximately 73 yds3 would be excavated for installation of the tie backs. Of this, approximately 22 yds3 would be below NWL. Approximately 98 yds3 of fill material would be placed below NWL and another 189 yds3 above NWL. It is proposed that 180 ft2 of high ground would be excavated for the construction and installation of the additional loading ramp. The installation of the 7 additional dolphin clusters would not encroach farther out into the Estuarine Waters and Public Trust Areas of the Neuse Rivers. The additional dolphin clusters would remain within the groin-protected basin area. Obviously, a temporary, constructed-related increase in turbidity during installation would be expected. Substrates in the area are of a coarse sandy material, thus keeping problems associated with increased turbidity to a minimum. The replacement of the breakwaters would also create temporary increases in turbidity. In addition, the lengthening of the upstream breakwater would encroach 60' farther into the Public Trust Areas of the Neuse River. A statement from the adjacent property owner specifically waiving the 15' riparian setback requirement is required. Similarly, on the replacement of the downstream breakwater, documentation from the applicant showing that the structure meets the replacement criteria for nonconforming structures must also be provided. The additional paving of the access road to the ramp and for the additional parking adjacent to the building would increase the impervious coverage within the Estuarine Shoreline to approximately 27%. Operated by the North Carolina Department of Transportation (NCDOT) , the ferry crosses the Neuse River between Minnesott Beach in Pamlico County and Cherry Branch in Craven County. The NCDOT proposes to add an additional ramp at the ferry landing. The project includes the replacement, removal, and addition of numerous dolphin clusters in addition to the replacement of an existing 400' bulkhead. The applicant also proposes to add an additional 60' to the upstream breakwater as well as to replace the downstream breakwater. AECs impacted by the proposal include Public Trust Areas, Estuarine Waters, and the Estuarine Shoreline . Waters at the site are classified as SB SW NSW and are closed to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 1992 Pamlico County Land Use Plan (LUP) Update and offer the following comments . The general area of the project is classified as Rural with Services . The Estuarine Shoreline AEC is classified as Conservation I and the Estuarine Waters and Public Trust Areas AECs are classified as Conservation IV. The Pamlico County LUP specifies strict development limits in Estuarine Shoreline areas . However, these development limitations apply only to properties subdivided pursuant to the Pamlico County Subdivision after January 26, 1990 . As such, these policies which exceed the State minimum standards, are not applicable to this proposal . Other than these policies, Pamlico County allows uses consistent with the 7H Use Standards for development in Conservation I areas . Pamlico County allows all uses which are consistent with the 15A NCAC 7H use standards in the Conservation IV classification. Applicable policies contained in the LUP include Resource Production and Management Policies for Marine Resource Areas (Page IV-14) . These policies reiterate Pamlico County' s support for the use standards for estuarine and public trust waters as specified in 15A NCAC 7H. Bulkhead Construction Policies are discussed on Page IV-10 . Pamlico County does not oppose bulkhead construction provided the use standards contained in 15A NCAC 7H and the North Carolina Building Code are satisfied. Economic and Community Development Policies regarding commitment to State and Federal Programs are discussed on Page IV-17 . Pamlico County is generally receptive to state and federal programs, particularly those which provide improvements to the County. Staff biologists with the Wildlife Resources Commission have reviewed the project and associated impacts on wildlife and fishery resources in the area. A site visit was made May 11, 1995 . Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat . 401, as amended; 16 U. S . C. 661 et . seq. ) and the Coastal Area Management Act (G.S . 113A-100 through 113A-128) . The NCDOT is proposing to add an additional ramp, replace 400' of existing bulkhead, remove and add several dolphin clusters and replace and add about 60' of breakwater at the Minnesott Beach Ferry Landing. This will result in the filling of about 1, 260 ft2 of open waters of the Neuse River. This section of the Neuse River is classified as SB SW NSW waters and is not designated as a Primary Nursery Area or open to shellfishing. Our major concern is the potential impacts to marine fauna. Elevated turbidity could reduce water quality in these areas and stress marine organisms, particularly during warm weather. Excessive turbidity is particularly damaging to egg and larval resulting from turbidity associated with the proposed activities . life stages of marine organisms. Therefore, we recommend that "in-water" work be prohibited between April 1 and September 30 . Prehistoric archaeological site 31PM5 is located at and around Wilkinson Point immediately east of the current ferry landing. While our site records are incomplete, it apparently consisted of a shell midden and possible village area which may extend into the ferry area. We recommend that any permits issued for this project contain a condition requiring a survey to determine if portions of 31PM5 extend into the project area. If so, the site should be evaluated in terms of National Register eligibility and the potential effects of the proposed project determined. If the effect will be adverse, a data recovery plan should be developed in consultation with us and carried out by the North Carolina Department of Transportation.
