Authorizing development in Hyde County at Adjacent to Swan Quarter Bay, off NC 45 on
a manmade canal. Swan Quarter , as requested in the permittee's application dated 10/26/00. including
attached workplan drawings (14), dated July 2000
This permit, issued on 2/22/01 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Swan Quarter Ferry Terminal Improvements
1) The boardwalks, loading ramps, and associated structures shall be elevated a minimum of 36" above any
coastal wetland substrate as measured from the bottom of the decking.
2) NC DOT's Design Standards for Sensitive Watersheds will be implemented.
3) This permit authorizes only the boardwalks, loading ramps, mooring pilings and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit application.
• No other structure, whether floating or stationary, may become a permanent part of this ferry terminal
• without permit modification. No non-water dependent uses of structures may be conducted on, in or
over public trust waters without permit modification.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
4) All debris associated with the removal of the existing dolphins, ramps and related structures will be
disposed of on an approved high ground site outside of the project area.
5) No vegetated wetlands will be excavated or filled.
6) No wet concrete may come into contact with any open water area.
7) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
8) No sewage, whether treated or untreated, shall be discharged at any time from any boats using this ferry
terminal. Any sewage discharge at the ferry terminal shall be considered a violation of this permit for
which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
Stormwater Management
9) The N.C. Division of Water Quality approved this project under stormwater management rules of the
Environmental Management Commission under Stormwater Permit No. SW7000814 on 9/27/00. Any
violation of the permit approved by the DWQ will be considered a violation of this CAMA permit.
Sedimentation and Erosion Control
10) A permanent ground cover sufficient to restrain erosion be provided on all exposed areas within the
shorter of 15 working or 60 calendar days after project completion.
11) Appropriate erosion and sedimentation control devises, measures or structures be used to prevent
sediment from entering the adjacent wetlands, watercourses or properties.
NOTE: The NC Division of Land Resources requires the use of a design standard of 25 year, type II
storm. The sediment control measures or devices are to remove 70% of the +40 micron sized
particles generated in a 2 year peak storm event.
12) A ground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30
calendar days of completion of any phase of grading on cut or filled slopes.
13) This project must conform to all requirements of the NC Sedimentation Pollution Control Act and NC
DOT's Memorandum of Agreement with the Division of Land Resources.
General
14) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work. The authorized structure and associated activity must not
cause an unacceptable interference with navigation.

15) The permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable
obstruction to the free navigation of the navigable waters, the permittee will be required, upon due
notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions
caused thereby, without expense to the United States. No claim shall be made against the United States
on account of any such removal or alteration.
16) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
17) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
E. 18) The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
project without having the permit transferred to a third party.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action ID. No.
200110188.
NOTE: Due to the potential of creosote treated lumber to leach toxic chemicals into the water, the NC
Division of Marine Fisheries has requested that the permittee explore alternatives to the use of
creosote treated timber dolphins, such as concrete or salt treated lumber.

Dear Sir:
The North Carolina Department of Transportation proposes to renovate the Swan Quarter
ferry terminal near Swan Quarter in Hyde County,North Carolina. The project will
involve installation of a new ferry loading ramp, replacing the existing ferry loading
ramp, adding dolphins and replacing existing dolphins, and adding pedestrian
boardwalks. All proposed improvements are depicted in the attached drawings.
A field review of the proposed project was held on June 7, 2000. Representatives from
the NCDOT and the North Carolina Division of Coastal Management (DCM) were
present. It was determined that this project may be authorized by a CAMA Major
Development Permit. A description of the proposed work is as follows:
1) A new loading ramp will be constructed south of the existing loading ramp.
This ramp will consist of a concrete bridge, 140 feet long and 21 feet wide
with bents approximately every 40 feet, which will tie into the existing fill
elevation and span the coastal marshes. The ramp will be constructed of
concrete cored slab and will serve to facilitate the evacuation of Ocracoke
Island in the event of a hurricane. Access roads will be built to connect
the proposed new loading ramp to the existing roadways which service the
ferry terminal. Construction of the access roads will require excavation of
300 cubic yards, fill of 1200 cubic yards, and will result in an additional
0.62 acres of impervious surface.

2) The existing loading ramp will be removed and replaced in place with a new
structure identical to the one described above. The existing ramp will be
utilized to access the ferry until the new ramp is completed. Then the
existing ramp will be closed and replaced.
3) Twelve existing creosote timber dolphins will be removed and replaced in
kind.
4) Twenty-four new creosote timber dolphins will be installed to service the new
loading ramp and to provide additional moorings to the south of the
proposed new ramp. These dolphins will be used to moor ferries in the
event of a hurricane.
5) Three pedestrian boardwalks will be built - one to service the new mooring
locations south of the proposed new loading ramp, and two at the north
end of the ferry basin.
6) The existing bridge maintenance ramp at the north end of the ferry basin will
be removed.
Swan Quarter Bay and the Swan Quarter Ferry Basin are designated Outstanding
Resource Waters and Primary Nursery Areas. As a result,NCDOT's Design Standards
in Sensitive Watersheds will be implemented. Also,NCDOT will implement the
Construction Precautions for West Indian Manatee (1996)to avoid possible impacts to
this species, although the probability of manatee occurrence within the ferry basin is
minimal. Review of existing records and site surveys revealed that no other federally
protected species occur within the project area.
The NCDOT hereby requests issuance of a CAMA Major Development Permit for this
project. Enclosed please find a project site map, a CAMA Major Development Permit
application, permit drawings, and a voucher letter from the Division of Coastal
Management in the amount of$400.00 for the CAMA processing fee. Also enclosed are
a copy of the North Carolina Environmental Policy Act Minimum Criteria Checklist and
copies of the adjacent landowner notification letters.
It is anticipated that construction of this project will be authorized under a Department of
the Army General Permit No.291. By copy of this letter,the NCDOT requests a
Department of the Army General Permit No. 291 and the applicable 401 Water Quality
Certification from the North Carolina Division of Water Quality. If you have any

the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff-colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh,NC 27611, (919) 733-2698 within twenty(20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval.Please read your permit carefully prior to starting work and review all project plans,as approved.If

Project Setting
The applicant owns a 104.7acre tract adjacent to Swan Quarter Bay on NC 45 near Swan
Quarter in Hyde County,North Carolina. The property consists of an upland area with the existing
ferry facility,a large manmade basin with four existing mooring areas,a vehicular loading ramp,and
associated access roads.There are four covered picnic tables on concrete slabs adjacent to the access
road in the highground area,and public rest room facilities attached to the Feny Division office. A
pumphouse and used oil storage area are located near the existing loading ramp.
The project area is bordered on the north, east and west sides by coastal wetlands that
transition into other 404 wetlands.The wetlands are vegetated with Juncus roemerianus,Distichlis
spicata, Spartina patens, Scirpus sp.,marsh elder,groundsel,sea ox-eye daisy,and Phragmites.The
NC Division of Marine Fisheries maintains a loading area for oyster shell on the eastern edge of the
existing basin.
The south side of property is predominately high ground and is vegetated with various upland
grasses. There is a coastal wetland on the edge of the basin that ranges from 7 to 33 ft in width.This
wetland is composed of Distichlis spicata, Spartina patens, Scirpus sp.,and is mixed with sporadic
Phragmites.The wetland is widest toward the southwest corner of the project area,and narrows close
to the existing vehicular loading ramp. There is a short wooden bulkhead around an abandoned
floatplane slip to the southwest of the existing ferry ramp.Immediately around the slip and bulkhead
there is a 43 by 36 ft area vegetated with a healthy stand of Distichlis spicata, Spartina patens,and
Scirpus sp.. The coastal wetland transitions quickly to a shrubby 404 wetland dominated by wax
myrtle,marsh elder,and groundsel with scattered red cedar and pine trees. Catbrier,blackberry and
poison ivy make up a thick understory in this transition area.
The existing basin contains 30 mooring dolphins that are arranged to create four slips for the
ferries. Two slips are located on the southern edge of the basin, and two are located on the eastern
edge. One of the slips on the south side of the basin is accessible for the loading and unloading of
vehicles, and the others are used to secure the ferries during hurricanes. There is a canal in the
western corner of the basin that connects to Swan Quarter Bay. Ferries run from the Swan Quarter
facility to Ocracoke Island year round. Water depth in the basin ranges from 6 ft in the southwest
corner to 26 ft in the center of the basin. The access channel and water around the loading ramp is
between 13 and 18 ft deep.
Swan Quarter Ferry Basin is classified SA ORW by the Environmental Management
Commission and is not open to shell fishing at this location.
Project Description
The applicant proposes to install a new ferry loading ramp,replace and enlarge the existing
ferry loading ramp,add new dolphin clusters,replace existing mooring dolphins,and construct two

pedestrian boardwalks to access hurricane mooring slips.Three slips will be added by the proposed
project, creating a total of seven mooring slips at the facility.
A new 140 ft by 21 ft concrete loading ramp is proposed south of the existing ramp. The
ramp will span the coastal wetland and transitional wetland areas.The new ramp will be accessed via
a proposed 28 ft wide road that connects to the roadway that currently services the ferry facility.The
existing loading ramp will be used during construction of the new ramp.Upon completion,the new
ramp will be used to provide access to the ferry while the existing ramp is removed and replaced
with a larger structure.The existing ramp is a 104 ft by 12 ft pile supported timber structure that will
be replaced with a 140 ft by 21 ft concrete pile supported ramp.
Twelve of the existing creosote timber dolphin clusters will be removed and replaced.
Twenty-four additional dolphin clusters are proposed to create hurricane slips. Of the new dolphin
clusters,twelve of the dolphin clusters will be six ft in diameter,five will be eight ft in diameter,and
five clusters will be 10 ft in diameter.Two clusters will be used to create bumpers at the waterward
end of the new vehicle loading ramp.
Two wooden boardwalks,4 ft by 60 ft and 4 ft by 115 ft,are proposed to provide pedestrian
access to the existing hurricane slips on the northeast side of the basin.These boardwalks will cross
coastal wetlands.A Y-shaped wooden boardwalk 4 ft by 240 ft is proposed to provide access to the
new hurricane mooring slips to the south of the new loading ramp.
An existing 45 ft by 15 ft loading ramp on the northeast edge of the basin, adjacent to the
Division of Marine Fisheries shell loading area will be removed.
Anticipated Impacts
The project as proposed would impact 33,560 ft2.Approximately 3,170 ft2f coastal wetlands
will be shaded by the proposed pedestrian boardwalks and new loading ramp.The loading ramp will
shade approximately 2,262 ft2 of basin bottom, 260 ft2 of basin bottom will be filled during
installation of the new mooring pilings, and 27,868 ft2 of highground will be filled and paved to
create access roads.Localized short term turbidity increases will result from construction activities.

We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
permit plans, which are a part of this permit.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States. No
claim shall be made against the United States on account of any such removal or alteration.

I have reviewed the application for a CAMA Major Permit submitted to this office on behalf of
NCDOT in regards to the rules and regulations adopted by the CRC, specifically NCAC
7H.0205, .0206, .0207, and .0208. My review indicates that the proposal will be consistent with
these regulations if the following recommendations and conditions are included in a conditional
issued permit:
Conditions:
1. 4:1) e boardwalks, loading ramps, and associated structures shall be elevated a minimum
f 36"above any coastal wetland substrate as measured from the bottom of the decking.
2)N ttempt will be made by the permittee to prevent the full and free use by the public
all navigable waters at or adjacent to the proposed work. The authorized structure and
associated activity must not cause an unacceptable interference with navigation.
3) The permittee must install and maintain at his expense any signal lights or signals
pres ' ed by the U.S. Coast Guard,through regulation or otherwise, on the authorized
cilities. At a minimum,permanent reflectors should be attached to the structure in order
to make it more visible during hours of darkness and inclement weather.
4) This ermit authorizes only the boardwalks, loading ramps and mooring pilings and
use ocated in or over the water that are expressly and specifically set forth in the permit
a lication. No other structures,whether floating or stationary, may become a permanent
part of this facility without permit modification.No non-water dependent uses of
structures may be conducted on, in, over, or under public trust waters without permit
modification.
5)N sewage, whether treated or untreated, shall be discharged at any time from boats
u ' g this docking facility.Any sewage discharge at hits docking facility shall be
onsidered a violation of this permit for which the permittee is responsible. This
prohibition shall be applied and enforced throughout the entire existence of the permitted
structure.
6) s permit does not authorize the interference with any existing or proposed Federal
roject, and the permittee will not be entitled to compensation for damage to the
authorized structure or work or injury which may be caused from existing or future
operations undertaken by the United States in the public interest.
7) a permittee will maintain the authorized work in good condition and in conformance
'th the terms and conditions of this permit. The permittee is not relieved of this
requirement if he abandons the project without having the permit transferred to a third
ply.

SUBJECT: NCDOT, Swan Quarter Ferry, Hyde County
The following comments by the North Carolina Division of Marine Fisheries (NCDMF)
on the subject permit are offered pursuant to G.S. 113-131. The NCDMF has a couple of
concerns with the proposed project.
The first concern deals with the use of creosote treated pilings for mooring dolphins.
Traditionally mooring pilings are treated with coal-tar creosote for protection against decay and
rot. About 300 chemicals have been identified in coal-tar creosote. Some components of
creosote (phenols and nitrogenous bases such as aniline, toluidine, and xylidines) are water
soluble and migrate easily from contaminated ties. Hepatic lesions and neoplasms have been
observed in fish exposed to creosote contaminated water. Although data is unavailable for
oysters, they are especially susceptible to bioaccumulation of pollutants due to their sedentary
life. This accumulation of toxins could cause a human health risk and/or directly affect the
health and reproductive success of oysters. In 1985 due to oncogenicity and mutagenicity
concerns the EPA limited the use of coal-tar creosote to wood-treatment and as a pesticide for
gypsy moth egg masses. In 1988 the EPA listed coal-tar creosote as a human carcinogenicity.
Additionally, in 1992 the government of Newfoundland and Labrador banned the use of new or
old creosote treated wood in fresh water and severely restricted it's use in the marine 0
environment in order to protect the water from a source of potential pollution. In order to protect
this and adjacent Outstanding Resource Waters and Primary Nursery Area's the NCDMF would
like to see an alternate (concrete, salt treated, etc.)type of pilings used.

The next concern deals with containing and stabilizing excavated material. Division of
Land Quality Bes anagement Practices for erosion and sedimentation control need to be used
to ntrol erosioiother area of concern is the disposition of concrete from the old loading
r p (no mention of. ,.osition of ramp material in application). This material should be
removed from the sit- e last area of concern deals with the timing of construction. Since
these is a Primary , sery Area located in Outstanding Resource Waters all efforts should be
made to limit water related construction during April 1 through October 1. If these concerns are
incorporated into the permit then the NCDMF would not object to the proposed project.

The Washington Regional Office received the completed Stormwater Application for the subject project
on August 24, 2000. Staff review of the plans and specifications has determined that the project, as
proposed,will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are
forwarding Permit No. SW7990814 dated September 25, 2000 to the North Carolina Department of
Transportation.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions
and limitations as specified therein.
If any parts,requirements,or limitations contained in this permit are unacceptable,you have the right to
request an adjudicatory hearing upon written request within thirty (30) days following receipt of this
permit. This request must be in the form of a written petition,conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the office of Administrative Hearings, P.O. Drawer 27447,
Raleigh,NC 27611-7447. Unless such demands are made this permit shall be final and binding.

construction, operation and maintenance of stormwater management systems in compliance with the
provisions of 15A NCAC 2H.1000(hereafter referred to as the "stormwater rules') and the approved
stormwater management plans and specifications, and other supporting data as attached and on file with
and approved by the Division of Water Quality and considered a part of this permit for the improvements
to the Swan Quarter Ferry Facility located near the town of Swan Quarter,NC.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following
specific conditions and limitations.
I. DESIGN STANDARDS
1. 0.08 acres of new impervious areas are proposed.
2. Approved plans and specifications for projects covered by this permit are incorporated by
reference and are enforceable parts of the permit.

3. No stormwater piping in addition to the existing piping shall be allowed except:
a That minimum amount necessary to direct runoff beneath an impervious surface
such as a road.
b. That minimum amount needed under driveways to provide access to lots.
H. SCHEDULE OF COMPLIANCE
1. Grasslined swales, vegetated buffers and other Best Management Practices used for
stormwater runoff control shall be adequately maintained throughout the life of the
project.
2. The permittee shall at all times provide adequate erosion control measures in conformance
with the approved Erosion Control Plan.
3. The permittee shall submit all information requested by the Director or his representative
within the time frame specified in the written information request.
III. GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statutes 143-215.6A to 143.215.6C.
2. The permit may be modified,revoked or terminated for cause. The filing of a request for
a permit modification, or termination does not void any permit condition.
3. The issuance of this permit does not prohibit the Director from reopening and modifying
laws,rules,and regulations contained in Title 15A of the North Carolina Administrative
Code, Subchapter 2H.1000;and North Carolina General Statute 143-215.1 et.aL
4. The following items will require a modification to the permit:
a. Any revision to the approved plans,regardless of size
b. Project name change
c. Transfer of ownership
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision of the project area
f. In addition,the Director may determine that other revisions to the project should
require a modification to the permit.

5. For any additions or modifications of the previously permitted built-upon area,the
permittee shall submit to the Director revised plans and specifications and shall receive
approval prior to construction.
6. The Director may notify the pennittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the pennittee shall submit a written time schedule to the Director for modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
7. The permit is not transferable to any person except after notice to and approval by the
Director. The Director may require modification or revocation and reissuance of the
permit to change the name and incorporate such other requirements as may be necessary.
A formal permit request must be submitted to the Division of Water Quality accompanied
by the appropriate fee,documentation from both parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its
merits,and may or may not be approved.
8. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes,rules,regulations,or ordinances which may be imposed by other government
agencies(local, state and federal)which have jurisdiction_

Land Use Plan Consistency: The project proposal is consistent with the Hyde
County 1997 Land Use Plan certified by the CRC
on September 28, 1998 provided all state and
federal agencies regulations are complied with.
Overview: The Department of Transportation proposes to construct a new ferry-
loading ramp, replace and enlarge and existing ramp, install new mooring dolphins,
replace existing ones, and add pedestrian boardwalks at the Swans Quarter Ferry
Basin. The basin connects to the Pamlico River. Anticipated impacts associated with
r this project includes: the shading of 3,170 sf. of coastal wetlands; the filling of about
260 sf. and the shading of an additional 2,262 sf. of Public Trust Waters
Basis for Determinations: The Hyde County Land Classification Map identifies the
site area as "Conservation". Policies applicable to this request include:

IMPLEMENTATION STARTEGIES
• Hyde County will rely on the North Carolina Department of Environment and Natural
Resources, Division of Coastal Management, to regulate development in coastal
wetlands and along estuarine shorelines and to protect estuarine waters through the
CAMA Permitting process. Also, it will rely on the regulations of other state and
federal agencies with regulatory authority, as well as existing local development
regulations to mitigate threats to coastal wetlands.

authority to regulate temporary mooring and mooring fields.
• Hyde County will consider analyzing the need to improve transient docking
facilities, channel depth, and general harbor facilities during the planning

Essential Fish Habitat assessment for DOT TIP project F-3305
The 1996 Congressional amendments to the Magnuson-Stevens Fishery Conservation
and Management Act(MSFCMA) (PL 94-265) set forth new requirements for the
National Marine Fisheries Service (NMFS), regional fishery management councils
(FMC), and other Federal agencies to identify and protect important marine and
anadromous fish habitat. These amendments established procedures for the identification
of Essential Fish Habitat(EFH) and a requirement for interagency coordination to further
the conservation of Federally managed fisheries. Table 1 lists the fish species that,may
occur in the study area that are managed under MSFCMA (species listed by NMFS for
Pamlico Sound), including the life stages which are known to occur.

Construction of the proposed improvements to the Swan Quarter Ferry Terminal (F-
3305)will result in impacts to surface waters within the ferry basin as a result of the
installation of a new loading ramp and 24 additional mooring clusters. These waters are
connected to Pamlico Sound via Swan Quarter Bay. Piles will be placed in the ferry
basin to support the ramp deck. Dolphin clusters will be placed throughout the basin for
emergency ferry mooring. In addition, 12 existing dolphins will be replaced, the existing
ferry loading ramp will be replaced, and three pedestrian boardwalks will be constructed
on piers across tidal marshes. Table 2 identifies the potential impacts resulting from the
construction of the proposed improvements to the Swan Quarter Ferry Terminal.
Replacement of the 12 existing dolphins or the existing loading ramp are not included in
.-
Table 2, because post project conditions will be nearly identical to current conditions.
The three proposed pedestrian boardwalks are also not included because of the very small
cross-sectional area of the supporting piers.

As indicated in Table 2, construction of the proposed improvements to the Swan Quarter
Ferry Terminal will permanently impact a very small area of the estuarine substrate of the
Swan Quarter ferry basin connected to Pamlico Sound(0.08 acres). Some hard structure
will be added to the water column in the form of loading ramp piles and dolphin clusters.
However, the net effect of the proposed construction will be insignificant in terms of
available Essential Fish Habitat in Pamlico Sound. Minor losses of estuarine substrate
will be limited to the Swan Quarter ferry basin. No impacts will occur to Essential Fish
Habitat within the natural (unexcavated) extent of Pamlico Sound or Swan Quarter Bay.

N.C.G.S. 113A-119(b)requires that notice of an application be posted at the location

notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: nailing the notice card to a telephone pole or tree along the

The North Carolina Department of Transportation proposes to renovate the Swan Quarter
ferry terminal near Swan Quarter in Hyde County,North Carolina. The project will

The Department of Environment and Natural Resources hereby gives public notice as required by
N.C.G.S. 113A-119(b) that an application for a development permit in an Area of Environmental
Concern as designated under the CAMA was received on 21 November 2000. The Division of
Coastal Management is processing a Major application/Dredge and Fill Permit in which N.C.
Department of Transportation proposes to construct a new ferry loading ramp, replace and enlarge
existing ferry loading ramp, install new mooring dolphins, replace existing mooring dolphins, and
construct pedestrian boardwalks. Project is located off NC 45 on manmade basin contiguous with
Swan Quarter Bay, in Swan Quarter, Hyde County, North Carolina. A copy of the entire
application maybe examined or copied at the office of Terry Moore, 943 Washington Square Mall,
Washington, North Carolina during normal business hours.
Comments mailed to DONNA MOFFITT, DIRECTOR, COASTAL MANAGEMENT,
