Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. B-3435, Bridge Replacement 1) Due to the presence of anadromous fish, including striped bass (Morone saxatilis), and in accordance with the Project Commitments contained within the Categorical Exclusion document dated May 2001, no in-water work shall be conducted from February 15th to October 31st of any year without prior approval of the NC Division of Coastal Management (DCM), in consultation with the NC Wildlife Resources Commission and the NC Division of Marine Fisheries. For the purposes of this moratorium, in-water is defined as those areas that are inundated at any time during construction. 2) Debris resulting from demolition of the existing bridge, including deck components, shall not enter wetlands or waters of the United States, even temporarily. 3) The bridge will be constructed using top down construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Department of Transportation Permit#105-02 Page 2 of 4 ADDITIONAL CONDITIONS 4) Placement of riprap shall be limited to the slopes underneath the proposed bridge, as depicted on the attached workplan drawings. The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. The riprap material must consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 5) Live concrete shall not be allowed to contact the water in or entering into the stream. 6) Turbidity curtains shall be used to contain all bottom disturbing activities, including pile or casement installation, placement of riprap, excavation or filling. 7) No vegetated wetlands will be excavated. 8) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 9) No excavated or fill material will be placed at any time in any vegetated wetlands or surrounding waters outside of the alignment of the fill area indicated on the workplan drawings. 10) All fill material must be clean and free of any pollutants, except in trace quantities. 11) If the permittee determines that additional permanent and/or temporary impacts will occur that are not shown on the attached permit drawings, additional authorization from DCM will be required. 12) All excavated materials will be confined above normal high water and landward of regularly or irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. 13) All excavated materials and debris associated with the removal of the existing bridge and existing causeway fill material will be disposed of on an approved upland site. An upland disposal site must be selected and approved by DCM prior to the initiation of any construction activities. 14) Any mitigative measures or environmental commitments specifically made by the applicant in the CAMA permit application or Categorical Exclusion document for this project shall be implemented, regardless of whether or not such commitments are addressed by individual conditions of this permit. Sedimentation and Erosion Control 15) The permittee shall follow Best Management Practices for the protection of Surface Waters and sedimentation and erosion control measures sufficient to protect aquatic resources. 16) This project must conform to all requirements of the NC Sedimentation Pollution Control Act and NC DOT's Memorandum of Agreement with the Division of Land Resources. 17) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. • • N.C. Department of Transportation Permit#105-02 Page 3 of 4 ADDITIONAL CONDITIONS 18) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 19) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Mitigation 20) On-site riverine mitigation will be carried out as described in the document titled "On-site mitigation plan for the proposed replacement of Bridge No. 04 on SR 1207 over Rocky Hock Creek in Chowan County, North Carolina" dated June 27, 2002. NOTE: The removal of approximately 639 feet of existing causeway fill material should result in the restoration of approximately 0.60 acres of riverine wetlands and the enhancement of approximately 7.36 acres of riverine wetlands. Because this project will impact approximately 0.21 acres of riverine wetlands, there will be a net gain of approximately 0.39 acres of riverine restoration mitigation credits and approximately 7.36 acres of riverine enhancement mitigation • credits. 21) This permit does not convey or imply approval of the suitability of the excess mitigation generated by this project as compensatory wetland mitigation for any particular future projects. The use of any portion of the excess mitigation generated by this project as compensatory mitigation for future projects will be approved on a case-by-case basis during the CAMA permit review and/or consistency process. • • 22) If the excess mitigation generated by this project is to be used as mitigation for impacts of future projects, written concurrence must be obtained from DCM that post-construction monitoring demonstrates that hydrologic success criteria have been met. Although annual monitoring reports will not be required, hydrologic monitoring data shall be made available to DCM at such time as the site is proposed for use as mitigation for future projects. 23) In accordance with the on-site mitigation plan, the permittee anticipates that there may be some areas where the current depth of fill material within the causeway, including asphalt, may be 8.0 feet deep or greater below the natural wetland elevation. The permittee will ensure the removal of all unsuitable material to prevent potential contamination of the adjacent water bodies. The permittee will fill any void left by the removal of this unsuitable material with clean, unconsolidated sand within approximately 6.0" to 1.0' of the elevation of the surrounding wetlands. Department of Transportation Permit#105-02 Page 4 of 4 ADDITIONAL CONDITIONS 24) Due to the possibility that compaction, mechanized clearing and/or other site alterations might prevent the temporary wetland impact area from re-attaining wetland jurisdictional status, the permittee shall provide an annual update on the wetland areas temporarily impacted by this project. This annual update will consist of photographs provided during the agency monitoring report meeting and a brief report on the progress of these temporarily impacted areas in re-attaining wetland jurisdictional status. Three years after project completion, the permittee shall schedule an agency field meeting with DCM, the NC Division of Water Quality and the NC Wildlife Resources Commission to determine if the wetland areas temporarily impacted by this project have re-attained jurisdictional wetland status. If at the end of 3 years the wetland areas temporarily impacted by this project have not re-attained jurisdictional wetland status, NC DOT and the above listed agencies shall determine whether a compensatory wetland mitigation plan will be required. General 25) Any relocation of utility lines will require additional authorization, either by way of a modification of this permit or by the utility company obtaining separate authorization. 26) This permit does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. This includes approval, if required, from the N.C. Division of Water Quality under stormwater management rules of the Environmental Management Commission. If a Stormwater Management Permit is required, it must be obtained and a copy provided to DCM prior to initiation of construction. NOTE: The N.C. Division of Water Quality (DWQ) has authorized the proposed project under General Water Quality Certification No. 3371 (DWQ Project No. 020939), which was issued on 7/02/02. Any violation of the Certification approved by the DWQ will be considered a violation of this CAMA permit. NOTE: The permittee is encouraged to contact the Public Health Pest Management Section at (919) 733- 6407 to discuss mosquito control measures. E., Structure Design On-site Mitigation Plan for the Proposed Replacement of Bridge No. 04 on SR 1207 over Rocky Hock Creek in Chowan County, North Carolina. TIP No. B-3435 June 27, 2002 Overview: The NCDOT will replace the existing 160.0-foot long bridge over Rocky Hock Creek with a new bridge approximately 799.0 feet in length. The additional bridge length will allow for the removal of 639.0 linear feet of causeway in previously filled wetlands. The existing causeway will be removed and returned to an elevation resembling that of the adjacent wetlands. Causeway Removal: The removal of the old causeway will mean that approximately 0.6 acres of fill will be removed from wetlands associated with Rocky Hock Creek and the Chowan River. Approximately 639.0 feet of existing causeway will be lifted, restoring the riverine wetland underneath. It is anticipated that after the causeway is removed, the same wind tides that presented a flooding problem for SR 1207 will now represent a return to the natural hydrologic cycle for the surrounding wetlands. The water will be able to flow unimpeded beneath the new structure, allowing the natural wetland hydrology to return. Therefore, in addition to the 0.60 acres of restoration, the NCDOT proposes riverine wetland enhancement extending outward from the lifted causeway. The area of enhancement will be calculated as a '/4 circle, the radius of which is the length of the causeway removed. The total enhancement area will equal 7.36 acres. Over the years, there has been a significant amount of compaction and settlement of the existing causeway. As a result of this settlement and the constant maintenance needed for continued operation of SR 1207, the NCDOT anticipates there may be some areas where the current depth of fill material within the causeway, including asphalt, may be 8.0 feet deep or greater below the natural wetland elevation. The NCDOT intends to ensure the removal of this material to prevent potential contamination of the adjacent Chowan River and Rocky Hock Creek. Due to the amount of fill material to be removed, there is the potential for a void to be left in place of the removed causeway. As has been the case in the past with similar projects, the NCDOT proposes to fill these voids with clean, unconsolidated sand. The voids will be filled to within 6.0 to 12.0 inches of the elevation of the surrounding wetlands. The reason for a range of 6.0 to 12.0 inches is twofold. The filling of the anticipated void with clean sand was recommended by the USACE and is intended to provide a base substrate while allowing the natural hydrologic processes to move organic material and sediment into the top 6.0 to 12.0 inches, thereby providing a natural organic surface over time. By leaving the area that has been filled with loose sand slightly lower than the adjacent wetlands, it is anticipated that organic materials carried by the wind tides and/or brought in and out by the flushing of the adjacent wetlands will settle into the void. This will create the desired upper layer of natural material. It will also create small areas of micro-habitat for fish, amphibians, and small mammals. The second reason for not attempting to match the exact elevation of the adjacent wetlands is that it is difficult to hit target elevations without mechanized grading activity. Allowing there to be a range of 6.0 to 12.0 inches avoids the possibility of unwanted consolidation of the material. Vegetation: The NCDOT does not propose any vegetation planting or monitoring. The area to be restored is underneath the new bridge and would be virtually impossible to plant and equally difficult to monitor. The NCDOT fully expects natural colonization of native flora to occur around and under the removed causeway. The proposed enhancement area is currently a standing Cypress-Gum Swamp community. The canopy of this area is dominated by bald cypress (Taxodium distichum) and swamp tupelo (Nyssa aquatica). The NCDOT does not propose any vegetative manipulation in this area as it is expected that the greatest benefit to the system will be realized through the return of the natural hydrologic processes.. Hydrology: The proximity of the enhancement and restoration areas to the Chowan River and Rocky Hock Creek ensure that both areas will be saturated and/or inundated for extended periods of time. However, as requested by the North Carolina Division of Coastal Management, the NCDOT will install a single surface water monitoring gauge and a corresponding rainfall gauge within the proposed enhancement area. The NCDOT will maintain and monitor the gauges for one year. While it is difficult to quantify success criteria for the proposed enhancement, the NCDOT will consider both the restoration and enhancement areas a success if the areas exhibit periodic fluctuations of the water level that do not correspond to local rain events or that correspond disproportionately to local rain events. The North Carolina Department of Transportation proposes to replace bridge No. 04 on SR 1207 over Rocky Hock Creek in Chowan County,North Carolina. The proposed project is intended to replace an obsolete bridge carrying SR 1207 over Rocky Hock Creek in Chowan County and resolve a long standing maintenance problem along SR 1207 in the vicinity of the bridge. Bridge Number 4 is a timber and steel bridge, with an asphalt wearing surface over timber decking. The decking is on steel I-beams supported by timber caps on timber piles. The bridge was constructed in 1950. The bridge has a clear roadway width of 5.9 meters (19.2 feet) and is 48.7 meters (160 feet) long. The bridge has a sufficiency rating of 18.1 (out of a possible 100 points). The bridge is posted with a weight limit of 10 tons for trucks. SR 1207 in the vicinity of Bridge Number 4 has two 3.0 meter(10-foot) lanes and 1.2 meter(4-foot) grassed shoulders. The speed limit along SR 1207 in the project area is 55 MPH. Currently, approximately 500 vehicles per day cross Bridge Number 4. By the year 2025, this volume is expected to increase to 800 vehicles per day. It is estimated that tractor trailers and single unit trucks make up two percent each of this total. SR 1207 parallels the Chowan River in the vicinity of Rocky Hock Creek(see Figure 1 of the approved Categorical Exclusion). At one location north of the creek crossing, the roadway is less than 9 meters(30 feet) from the river's edge. This section of roadway is also prone to flooding due to wind tides. The project involves the removal and replacement of Bridge Number 4 carrying SR 1207 over Rocky Hock Creek in Chowan County. The project also involves the removal of an approximately 195 meter(639-foot)long section of existing pavement and fill from the floodplain of Rocky Hock Creek north of the existing bridge. A new bridge approximately 259 meters (850 feet) long will be constructed to carry SR 1207 over the floodplain and creek. SR 1207 will be closed during construction and traffic rerouted along existing roads. The project area and the studied detour route are shown on Figure 1 in the approved Categorical Exclusion. The proposed new bridge will have a clear roadway width of 8.4 meters (28 feet). Two 3.3 meter(11-foot) lanes and 1.2 meter(4-foot) grassed shoulders will be provided on both approaches to the proposed bridge. A design speed of 100 km/h(60 MPH) is proposed for this project. It is anticipated SR 1207 will be signed at 55 MPH following project completion. As noted above, the project is located near the confluence of Rocky Hock Creek and the Chowan River. The geographic location and topography of this site lead to an overwhelming majority of the area surrounding the current SR 1207 and bridge No. 04 being comprised of wetlands and/or surface waters. The main wetland complex,through which the existing causeway and bridge are located, is dominated by a cypress-gum swamp community. This community type comprises 90 percent of the project area and occurs adjacent to SR 1207 and the banks of Rocky Hock Creek, except where human development or disturbance has displaced it. Approximately 0.17 acres of wetland will be filled by the proposed project. The project will also require 0.04 acres of wetland to be mechanically cleared to provide room for bridge construction. Originally, the proposed project planned to replace bridge No. 04 with a bridge of similar length as the existing bridge and included measures to alleviate the constant settlement and flooding problems on SR 1207 adjacent to the Chowan River. The original plan to stabilize SR 1207 called for the elevation of the existing roadbed to be increased by several feet. This would have necessitated a widening of the existing shoulder cross-section, and a considerable amount of new fill in the high quality wetlands adjacent to SR 1207 would have been needed. In order to reduce impacts to wetlands, extending bridge No. 04 was recommended. It was determined that a longer bridge would reduce impacts to wetlands as well as eliminate the settlement and flooding problems along SR 1207. The new, longer bridge will now span approximately 639.0' of previously filled wetlands. The existing causeway will be removed and returned to an elevation resembling that of the adjacent wetlands. The removal of the old causeway will mean that approximately 0.6 acres of fill will be removed from wetlands associated with Rocky Hock Creek and the Chowan River. After the causeway is removed, the same wind tides that presented a flooding problem for SR 1207 will now represent a return to the natural hydrologic cycle for the surrounding wetlands. The water will be able to flow unimpeded beneath the new structure, allowing the natural wetland hydrology to return. As was done on the R-2539 project in Craven County, the NCDOT asks that enhancement mitigation credit be granted for the wetland area that will benefit from the improved hydrology. Approximately 639.0 feet of existing causeway will be lifted, restoring the riverine wetland underneath. The NCDOT proposes riverine wetland enhancement extending outward from the lifted causeway. The area of enhancement will be calculated as a '/ circle, the radius of which is the length of the causeway removed. The total enhancement area will equal 7.36 acres. The intent of this is to provide a base substrate while allowing the natural hydrologic processes to move organic material and sediment into the top 6.0"to 1.0'. In summary,the NCDOT proposes to replace the current bridge and causeway along SR 1207 with a new bridge. Approximately 639.0' of existing causeway will be removed and the elevation restored to resemble the adjacent wetlands. The project will require 0.17 acres of permanent fill in wetlands and 0.04 acres of mechanized clearing to accommodate the new bridge approaches. The removal of the causeway will result in a net gain of 0.39 acres (0.6-0. 21). The project will also vastly improve the hydrology and function of 7.36 acres of surrounding wetlands. The NCDOT asks that the 0.39 acres of restoration and the 7.36 acres of enhancement be allowed as credits on future projects within the Chowan River Basin. The NCDOT is aware of at least one future project, TIP project B-3636 on SR 1222,that is actually on Rocky Hock Creek a few miles upstream of the current project. Should mitigation be required on B-3636,the NCDOT would like the option to use credits received from the removal of the causeway on B- 3435. It is anticipated that this project will be authorized by Nationwide Permit No. 23. Please find attached a completed Pre-construction Notification Form along with the appropriate permit drawings. By copy of this letter,the NCDOT is also requesting that the North Carolina Division of Water Quality issue the appropriate Section 401 Water Quality Certification. PROJECT SUMMARY: The N.C. Department of Transportation is proposing to replace the existing 160-foot long timber bridge over Rocky Hock Creek with an 850-foot long concrete bridge spanning Rocky Hock Creek and the adjacent Cypress-gum Swamp. 639 feet of causeway will be excavated from the existing roadbed and restored to its previous wetland hydrology. FIELD INVESTIGATION REPORT NC DOT - B-3435 Chowan County, Bridge No. 4 PAGE 2 9. PROJECT DESCRIPTION: The site of this proposal is Bridge No. 4 on State Road 1207, 4.5 miles northwest of Edenton at the crossing of Rocky Hock Creek, in Chowan County. The general purpose of the project is to replace the deteriorated 160-foot long by 19-foot wide timber and concrete bridge with an 850- foot long by 28-foot wide concrete bridge Spanning Rocky Hock Creek and the adjacent Cypress- gum Swamp, to alleviate flooding of the northern bridge approach and allow safer driving conditions for the traveling public. Bridge No. 4 crosses Rocky Hock Creek near its confluence with the Chowan River. The bridge crossing Rocky Hock Creek is flanked with Cypress-gum Swamp, except for the southwest quadrant, which is urbanized and currently supports a marina. Creek width at the crossing is approximately 120 feet and widens significantly downstream (southwest) of the bridge. Vertical clearance between the water and bridge bottom is approximately 3 feet. An approximately 1000- foot long by 45-foot wide causeway was constructed through the Cypress-gum Swamp on Dorovan Muck soils when the bridge was constructed in 1950.The causeway settlement and flooding have led to constant maintenance of the road. The Cypress-gum Swamp area consists of Bald Cypress, Sweetgum, Willow, Red Maple, Swamp Tupelo Gum, Sweet Bay, Giant Cane, Greenbrier and Poison Ivy. Soils on this site are mainly Dorovan Muck with a small portion of Udorthents in the upper elevations as classified by the NC Soil Conservation Service. Approximate elevations on the site range between 1 feet and 5 feet above normal water level. Freshwater Muscles were noted at Bridge No. 4. No evidence of SAV beds was noted. The North Carolina Division of Water Quality classifies waters of Rocky Hock Creek as B-NSW at the project site. No Primary Nursery Area, as designated by the North Carolina Division of Marine Fisheries, is located at this site. The Chowan County Land Use Plan designates the project area as Rural, with all CAMA Areas of Environmental Concern designated as Conservation. The proposal is to replace the existing 160-foot long by 19-foot wide timber and concrete bridge with an 850-foot long by 28-foot wide pre-stressed concrete bridge on the existing alignment. The proposed bridge will have a vertical clearance 1 foot greater than the existing bridge (approximately 4 feet). Constructing this project would include removing 639 feet of the previously filled causeway (that is approximately 45 feet wide) and grading it 6-12 inches lower than the surrounding Cypress-gum wetlands to facilitate the precipitation of organic sediment into the restored wetland area. The northern portion of the bridge will be approximately 5 feet higher than the existing fill causeway to prevent future flooding. The bridge is being widened from 19 feet to 28 feet to more closely correspond to the 11 foot paved travel lanes and 4 foot grassed shoulders of SR 1207. NC DOT Best Management Practices will be used for erosion control and bridge demolition. . • FIELD INVESTIGATION REPORT NC DOT - B-3435, Chowan County, Bridge No. 4 PAGE 3 10. ANTICIPATED IMPACTS: As proposed, the construction of the bridge approaches with 3:1 slopes would require the filling of approximately 7,405 square feet (0.17 acres) of 404 type wetlands and approximately 19,500 square feet (0.45 acres) of impacts to high ground. To allow room for grading, approximately 1742 square feet (0.04 acres) of 404 type wetlands will be cleared adjacent to the road shoulders by NC DOT Method III (mechanical clearing and grubbing). The additional width of the bridge will cause approximately 1260 square feet of additional shading impacts to Public Trust Waters AEC. Removal of 639 feet of previously filled causeway will result in the disturbance of approximately 29,250 square feet(0.67 acres) of high ground. A minimal disturbance of the creek bottom is expected during the installation of the pilings. Approximately 3,960 square feet of the above describe ground disturbance will be within the CAMA Coastal Shoreline AEC. The 30 foot buffer requirement implemented by the Coastal Resources Commission does not apply to this proposal, as bridges and culvert crossings were determined to be water dependent uses. NC DOT has reduced the 404 type wetland excavation and fill impacts associated with this proposal by lengthening the bride from 160 to 850 feet. This will reduce fill in wetlands that would have occurred in raising the causeway. Lengthening the bridge also creates a wetland buffer between the bridge approaches and the waters of Rocky Hock Creek, allowing some treatment of the storm water run off associated with the bridge and roadway. NC DOT has committed to dropping no materials from the bridge demolition in the water and to using top down construction to minimize impacts. Due to the presence of anadromous fish in Rocky Hock Creek, NC DOT has committed to an in-stream work moratorium from February 15 to October 31. The NC DOT has proposed to use standard BMP's to minimize the impacts of erosion. The proposed removal of 639 feet of existing causeway should restore approximately 0.6 acres of fill causeway to its natural hydrology. NC DOT is asking for riverine restoration mitigation credit for this area as well as enhancement mitigation credit for an area extending outward from the removed causeway, calculated as a quarter circle, the radius of which is the length of the removed causeway (7.36 acres). NC DOT has agreed to perform hydrologic monitoring in this area (see included mitigation plan). NC DOT will be impacting approximately 0.21 acres of 404 type wetlands in this proposal and would like to use the restoration created to offset these impacts, leaving a net gain of 0.39 acres of riverine restoration mitigation credit and 7.36 acres of riverine enhancement mitigation credit. NC DOT requests this credit be allowed for future projects within the Chowan River Basin, including TIP project B-3636 on SR 1222, approximately 2.5 miles upstream of Bridge No. 4. The collective disturbance area for the project is 1.42 acres. The proposal consists of replacing the degraded 160-foot long by 19-foot wide timber and concrete bridge with an 850-foot long by 28-foot wide pre-stressed concrete bridge on the same alignment. Approximately 639 feet of causeway that was previously filled through Cypress-gum Swamp will be removed to restore natural hydrology to the area. NCDOT has reduced the 404 type wetland excavation and fill impacts associated with this proposal by lengthening the bridge to avoid fill slopes in wetlands and by creating a wetland buffer between the bridge approaches and the waters of Rocky Hock Creek that should provide some treatment to the storm water leaving the roadway and bridge. Removal of the approximately 639-foot by 45-foot causeway will restore approximately 0.6 acres of previously filled wetlands to a more natural hydrology. NC DOT is asking to mitigate for the proposals 0.21 acres of wetland impacts (0.17 acres fill and 0.04 acres clearing) with the restored wetlands created by the removal of the causeway. NC DOT is also requesting riverine restoration mitigation credit for the remainder of the restored causeway area and riverine enhancement mitigation credit for the area adjacent to the restored causeway to be used to offset future impacts for transportation projects in the Chowan River Basin, including B-3636 on SR 1222, 2.5 miles upstream of Bridge No. 4. Rocky Hock Creek is inland water classified B-NSW. The project is well designed with minimization of impacts and a net gain of wetlands. Metal products, organic materials, or unsightly debris will not be used. 7) The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. 8) A simple mitigation plan is approved and hydrology is monitored in the mitigation areas. 9) All commitments in the application and CE made by NC DOT are observed. Excessive silt and sediment loads can have numerous detrimental effects on aquatic resources including destruction of spawning habitat, suffocation of eggs, and clogging of gills of aquatic species. The proposed wetland restoration and enhancement efforts are acceptable mitigation for the anticipated impacts. Remaining mitigation "credits" can be considered for future impacts to the same wetland type on a case by case basis. L./- I recommend the permit include a condition that requires monitoring of any temporary impacts for a period of time sufficient to confirm the impacts are not permanent. The restoration area should be monitored for at least a year or until such time that the natural resource agencies agree that it is successful. A monitoring report should be generated And distributed for agency review and discussion at the annual mitigation site monitoring ort meeting. r r CANIkr Ver It should be noted that enhancement credit for causeway removal has been a topic of discussion among agencies and the NCDOT for quite some time. Due to the substantial expense of causeway removal and bridge construction, it was determined that mitigation credit for the hydrologic enhancement of the adjacent wetlands should be given as an incentive for the removal of causeways in high quality wetlands. Enhancement credit is determined by calculating the acreage of a '/a circle with a radius the length of the causeway removed. This formula for calculating mitigation credit for hydrologic enhancement resulting from causeway removal was agreed upon by the agencies and by NCDOT as a reasonable method for determining enhancement credit. The formula is subject to change for future causeway removal projects pending further study and discussion of the success of projects such as this one. This wetland restoration/enhancement effort will be accomplished pursuant to the mitigation entitled, "On-site Mitigation Plan for the proposed Replacement of Bridge No. 04 on SR 1207 over Rocky Hock Creek on Chowan County, North Carolina", dated June 27, 2002. The on-site restoration work must be completed within one year after construction begins to the satisfaction of the Corps of Engineers. f. NCDOT will maintain the mitigation site in the condition established by the mitigation plan in perpetuity. Prohibited activities within the mitigation area specifically include, but are not limited to: the construction or placement of roads, walkways,buildings, signs, or structures of any kind (i.e.,billboards, interior fences, etc.); filling, grading, excavation, leveling, or any other earth moving activity that may alter the drainage pattern on the property; the cutting, mowing, destruction, removal, damage or other alternation of any vegetation; disposal or storage of any debris, waste or garbage; except as may be authorized by the mitigation plans or subsequent modifications which are approved by the Corps of Engineers. In addition, the permittee shall take no action,whether on or off the mitigation property, which will adversely impact the restored or enhanced wetlands. g. Special Condition (f.), above, runs with the land. The permittee shall not sell, lease, or otherwise convey any interest in the property used to satisfy mitigation requirements for this permit, to any third party, without the express written consent of the Corps of Engineers. 2 h.
