This permit, issued on 11/14/03 , is subject to compliance with the application(where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This minor modification authorizes 678.2 square feet (0.015 acres) of additional fill in wetlands to ensure a stable and safe fill slope near each bridge end bent, as depicted on the attached workplan drawings. 2) In order to mitigation for the 0.015 acres of additional wetland impacts, wetland restoration credits in the amount of 0.02 acres will be debited from the excess mitigation credits that were generated by construction of TIP No. B-3435. NOTE: This permit acknowledges the clearing of approximately 2,867 square feet of forested wetlands that were not shown in the original permit application. The Division of Coastal Management (DCM) was notified about this clearing in writing by NCDOT on 1/24/03 after the clearing had been conducted. The unauthorized clearing is also mentioned in the NCDOT letter dated 8/11/03, which was submitted with the request for this permit modification. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Department of Transportation Permit#105-02 Page 2 of 2 ADDITIONAL CONDITIONS 3) The permittee shall add the area of 2,867 square feet of unauthorized clearing in forested wetlands to the wetland impacts that are subject to the requirements of Condition No. 24 of CAMA Permit No. 105-02, which was issued on 8/2/02. Condition No. 24 requires that the permittee shall provide an annual update on the wetland areas temporarily impacted by this project. If at the end of 3 years the wetland areas temporarily impacted by this project have not re-attained jurisdictional wetland status, NCDOT, DCM, the Wildlife Resources Commission (WRC) and the Division of Water Quality (DWQ) shall determine whether a compensatory wetland mitigation plan will be required. 4) Prior to the expiration date of this permit, the permittee shall submit a debit ledger to DCM for the mitigation credits generated by TIP No. B-3435. The debit ledger shall reflect that 0.37 acres of wetland restoration credits have been debited for TIP No. R-3850 (Okisko Road, Pasquotank County) and that 0.23 acres of wetland restoration credits have been debited for TIP No. B-3435. The debit ledger shall show the remaining credits available at the site (0.00 acres of riverine wetland restoration credits and 7.36 acres of riverine wetland enhancement credits). 5) Placement of riprap shall be limited to the slopes underneath the proposed bridge, as depicted on the attached workplan drawings. The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. The riprap material must consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 6) This permit does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. This includes a Water Quality Certification from the N.C. Division of Water Quality, if required. 7) This minor modification must be attached to the original of Permit No. 105-02, which was issued on 8/2/02, the Letter of Refinement which was issued on 9/5/02, and the Letter of Refinement which was issued in 11/02, and all documents must be readily available on site when a Division representative inspects the project for compliance. 8) All conditions and stipulations of the active permit remain in force under this minor modification unless altered herein. • a •1 c 1 1. The new bridge will replace an obsolete bridge carrying SR 1207 over Rocky Hock Creek and to resolve a long standing maintenance problem along SR 1207 in the vicinity of the bridge. During the current removal of the existing causeway, it has been determined that the clearing contractor has inadvertently cleared approximately 2867.0 square feet(0.060 acre) of forested wetlands that were not shown in the original permit application. The cleared areas were not grubbed and will be allowed to naturally regenerate. No mitigation is proposed for this area. Additionally, it has been determined that an additional 678.2 square feet(0.015 acre) of additional fill in wetlands is necessary to ensure a stable and safe fill slope near each bridge end bent. The NCDOT proposes to use 0.015 acres of on-site restoration as mitigation for the additional fill. The NCDOT hereby requests that a minor modification be issued to Major Development Permit No 105-02 to allow the additional 0.015 acre of fill and associated mitigation as described above. In compliance with Section 143-215.3D(e) of the NCAC we will provide $475.00 to act as payment for processing the Section 401 permit application previously noted in this application (see Subject line). By copy of this letter the NCDOT also requests the North Carolina Division of Water Quality modify Water Quality Certification 3361 (DWQ Project No. 020939) and that the U. S. (trees were cut but no ground disturbance) The additional fill requested is minor and does appear to be necessary for installation of the fill slopes at the end bents. All conditions of CAMA Major Permit 105-02 should be adhered to. I have requested Jaye Poole to debit DOT $100.00 for the processing of this minor modification. This modification increases the overall fillip wetlands to 0.186 acres, which is within the threshold allowed by nationwide permit number 14. It is understood that all conditions of the original permit remain applicable and that the expiration date is unchanged. Additionally, the increase in wetland impacts will require an additional 0.016 acres of on site mitigation. Your proposal requests use of the remaining 0.02 acres of on-site mitigation not debited from this project. Originally,this project generated 0.60 acres of restoration mitigation credit and 7.36 acres of enhancement mitigation credit associated with the removal of 639 feet of causeway fill. The impacts are minimal and I believe we could process this as a minor modification. The first "note" under "Additional Conditions" on the CAMA Major Permit for R-3850 states there is 0.39 acres of restoration credit remaining at B-3435 and that R-3850 will debit 0.38 acres, leaving a remainder of 0.01 acres. If these figures are not correct direct me to the correct source of record. I'm not wishing to split hairs with you, however, would you like to debit 0.02 acres of the 7.36 acres of enhancement credit remaining from B-3435 at a 4:1 ratio in order to make up the additional 0 .005 acres of impacts? This would balance the equation for DCM. Would you like to use the new debit system between DCM and DOT to pay the $100.00 fee for the modification? Dr. Mr. Arrington, As you are aware, the NCDOT is currently in the process of replacing bridge number 04 over Rocky Hock Creek on SR 1207 in Chowan County, North Carolina. This activity was authorized through a Major Development Permit (MP 105-02) issued by the North Carolina Division of Coastal Management. Major Development Permit No. 105- 02 was issued on August 8, 2002 and will expire on December 31, 2005. A subsequent refinement to this permit was issued as a letter of refinement on September 5, 2002. The letter of refinement authorized 0.27 acres of non-mechanized clearing along the north side of SR 1207. Since the issuance of the referenced letter of refinement, the NCDOT has discovered that an error was made during the clearing activity. The contractor unintentionally cleared beyond the limits authorized in the permit. From Station 11+60 to Station 13+50 the contractor has cleared an additional 2,085 square feet (0.048 acres). The mistake is due to a misinterpretation of survey markings by the work crew installing the silt fence barrier. There is a permanent drainage easement in the vicinity of the additional clearing. The survey crew marked the perimeter of the permanent drainage easement. The silt fence was mistakenly installed at the edge of the makings and clearing was conducted up to the edge of the silt fence. The area was not grubbed and no further activities will be conducted within the additional cleared area. Due to the limited scope of the clearing and the fact that no grubbing was done, the NCDOT anticipates the area to quickly return to a naturally vegetated state once the growing season begins.
