Department of Transportation, 113 Airport Road, Edenton,NC 27932 Authorizing development in Hyde County at Rattlesnake Canal, which runs parallel to SR 1111. southwest of Middletown, as requested in the permittee's application dated 6/7/02. including attached workplan drawings (11i: 1 dated 2/20/02; 6 dated 2/18/02; and 4 dated 2/19/02. This permit, issued on 9/24/02 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below.Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization and Culvert Installation 1) The authorized alignment of the proposed riprap must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The riprap will not extend waterward more than 11 feet from the normal water level at any point along its alignment at the time of construction. 3) No vegetated wetlands will be excavated or filled. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. c date. Department of Transportation Permit#129-02 Page 2 of 3 ADDITIONAL CONDITIONS 4) Filter fabric associated with riprap/backfill, as shown on the attached workplan drawings, must be in place prior to the placement of any backfill. 5) Placement of riprap shall be limited to the areas as depicted on the attached workplan drawings. The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. The riprap material must consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 6) All fill material will be obtained from a high ground source. No unconfined fill material may be discharged into estuarine or public trust waters. The fill material will be clean and free of any pollutants except in trace quantities. 7) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 8) All excavated materials and debris associated with the replacement and removal of the collapsed 8" terra cotta farm tiles will be disposed of at an approved upland disposal site. Sedimentation and Erosion Control 9) All excavated materials will be confined above normal high water and landward of regularly or irregularly flooded wetlands behind adequate dikes or other retaining structures to prevent spillover of solids into any wetlands or surrounding waters. 10) Immediately prior to the initiation of construction, the permittee shall install turbidity curtains in the water area parallel to the canal bank immediately adjacent to the are of shoreline stabilization and culvert installation. The turbidity curtains shall be removed when turbidity within the curtains reaches ambient levels. 11) This project is in a High Quality Water Zone and must comply with the Design Standards in Sensitive Watersheds, 15A NCAC 4B .0124. 12) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property(e.g. silt fence, diversion swales or berms, sand fence, etc.). 14) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. Department of Transportation Permit#129-02 Page 3 of 3 ADDITIONAL CONDITIONS General 15) The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 16) The authorized activity will not cause an unacceptable interference with navigation. • NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit Number 3 (Action ID Number 200210971) for the culvert replacement and Nationwide Permit Number 13 (Action ID Number 200210982) for the placement of riprap. Both Nationwide Permits were issued on August 21, 2002. NOTE: The N.C. The North Carolina Department of Transportation proposes to stabilize a section of SR 1111.This road parallels a drainage canal that flows out to the Pamlico Sound.Along a portion of this canal,the bank has become destabilized and significantamounts of erosion have taken place.The erosion of the canal bank has caused SR 1111's roadbed to be undermined.If the canal banks are not stabilized then further erosion will continue and the roadbed will eventually be washed out completely,resulting in road closure. The length of the area to be stabilized along the canal bank with class B riprap is 415 feet,with an average distance waterward(NWJ...)of 6.8 feet.This will result in 65 cubic yards of fill below the NWL.The primary cause of the bank erosion was two drainage pipes that carry water from adjacent agricultural fields, under the road,and into the canal.These pipes are old pipes that have collapsed under the roadbed.These pipes will be replaced in conjunction with the bank stabilization.Once this work is complete we do not anticipate having any further problems with bank destabilization along this canal. The purpose of this letttr is to request authorization under a CAMA major permit for impacts to Public Trust Waters.Rattlesnake Canal is a navigable water and can be accessed by way of the Pamlico Sound. In the.area of the proposed work there is essentially no recreational use of the canal as Public Trust Water.Approximately 0.5 miles south of the project area,there are a few commercial boats that dock along the bank.of the canal.The purpose of the canal is drainage of the adjacent agricultural fields. PROJECT SUMMARY: The N.C. Department of Transportation is proposing to stabilize 415 feet of Rattlesnake Canal shoreline along SR 1111 and replace 8" terra cotta farm tiles with 24" culverts where two farm ditches cross SR 1111. FIELD INVESTIGATION REPORT NC DOT — SR 1111, Hyde County PAGE 2 9. PROJECT DESCRIPTION: The site of this proposal is SR 1111, between SR 1110 and SR 1108, approximately 1.5 miles southwest of Middletown, in Hyde County. Farm Tile One and Two are 1140 feet and 1368 feet respectively, southeast of SR 1110. The proposed stabilization begins 2060 feet southeast of SR 1110 and ends 2475 southeast of SR 1110.The general purpose of the project is to stabilize the road shoulder and repair the broken farm tiles under SR 1111,to alleviate erosion into Rattlesnake Canal and provide safer driving conditions for the traveling public. State Road 1111 parallels Rattlesnake Canal and provides a 15-foot gravel travelway and a road shoulder averaging 7 feet wide on the southwest side and 5 feet wide on the northeast side(outside of the proposed project area). In the proposed project area the canal bank has eroded into the gravel travelway in several areas and is less than 5 feet in the majority of the project area. Rattlesnake Canal was originally excavated for agricultural drainage and the proposed project area is completely surrounded by agricultural fields. A small marina exists approximately 4000 feet downstream of the proposed project area on the southeast side of the bridge crossing Rattlesnake Canal on SR 1108. In the proposed project area Rattlesnake Canal is approximately 50 feet wide, with the canal bottom 7.5 feet below the ground surface and terminates at the Pamlico Sound. Approximately 2.5 feet of water is in the canal at Normal High Water. Farm Tile One and Two are 8" terra cotta pipe sections connecting the existing farm ditches to Rattlesnake Canal. Both farm tiles have collapsed sections allowing water to escape under SR 1111 causing undermining of the road travelway and shoulder. The surrounding agricultural fields were planted with wheat, soybeans and corn. The ditch banks are vegetated with Dewberry, Honeysuckle, Poison Ivy, Virginia Creeper, Cat Brier and Bermuda grass. The NC Soil Conservation Service classifies soils in the project area as Hyde Land Silty Loam. Approximate elevations on the site range between -2 feet and 5 feet above normal high water. No evidence of SAV beds was noted. The North Carolina Division of Water Quality classifies waters of Pamlico Sound adjacent to the proposed project area as SA-HQW and they are subject to the Tar-Pamlico River Buffer Rules. No Primary Nursery Area, as designated by the North Carolina Division of Marine Fisheries, is located at this site. The Hyde County Land Use Plan designates the project area as Rural,with all CAMA Areas of Environmental Concern designated as Conservation. The proposal is to armor 415 feet of canal bank with rip rap, in an alignment approximating the original canal bank, to a height 2 feet above NHW to provide a stable base to backfill a 5-foot wide soil road shoulder to more closely correspond to the adjacent road shoulders. This riprap armament alignment would extend water-ward of the existing eroded areas from 6 feet to 11 feet and be covered with soil stabilizing fabric. The proposed soil road shoulder would be installed above the soil stabilizing fabric and include the same fabric between the existing canal bank and the soil backfill. Two 8" farm tiles that have degraded and collapsed would be replaced with 24" corrugated aluminum culverts after the erosion sediment is excavated from the canal bottom at the end of the farm tiles. The canal bank will be armored surrounding the culverts for a 15-foot radius. NC DOT Best Management Practices will be used for erosion control. ANTICIPATED IMPACTS: As proposed, the construction of the riprap armament would require the filling of approximately 3652 square feet of shallow (canal) bottom. The replacement of the two farm tiles with culverts would require the excavation of approximately 300 square feet of shallow bottom and 280 feet of high ground in addition to the filling of approximately 300 square feet of shallow bottom and 404 square feet of high ground (canal bank around culverts). NC DOT has reduced the shallow bottom excavation and fill impacts associated with this proposal by increasing the canal bank side slopes to 2:1. The NC DOT has proposed to use standard BMP's to minimize the impacts of erosion. Principally local residents use State Road 1111. The repair of the road shoulder and replacement of the deteriorated farm tiles with culverts should enhance the safety of motorists using SR 1111. The collective disturbance area for the project is 0.11 acres. DATE: July 17, 2002 The following are my comments and recommendations regarding the above-mentioned proposal. The proposal consists of repairing 415 feet of eroded canal bank/road shoulder by installing rip rap from the canal bottom to 2 feet above MHW to form a base for a 5-foot soil road shoulder to conform more closely with the adjacent road shoulders and to provide for the safety of the traveling public. NCDOT has reduced the shallow bottom fill impacts associated with this proposal by proposing 2:1 fill slopes on the canal bank.
