Department of Transportation, 113 Airport Road, Edenton,NC 27932 Authorizing development in Hyde County at Rattlesnake Canal, which runs parallel to SR 1111, southwest of Middletown, as requested in the permittee's application letter dated 8/18/03. including attached workplan drawings (2) dated 2/19/02. This permit, issued on 12/9/03 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization and Culvert Installation 1) This minor modification authorizes replacement of an additional collapsed drain tile approximately 150 feet north of the existing stabilization project, and the placement of an additional 320 square feet of rip- rap to be placed in the canal bottom. 2) The new riprap will not extend waterward more than 11 feet from the normal water level at any point along its alignment at the time of construction. 3) No vegetated wetlands will be excavated or filled as a result of the activities authorized by this minor modification. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Department of Transportation Permit#129-02 Page 2 of 2 ADDITIONAL CONDITIONS 4) Placement of riprap shall be limited to the areas as depicted on the attached workplan drawings. The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. The damaged tile was discovered after the permit was issued. This damaged tile is located approximately 150 feet North of the existing stabilization project.The shoulder of the canal has become unstabilized and is eroding into the canal bottom, which has caused the road to begin to collapse. Therefore,NCDOT is requesting a letter of refinement from DCM to allow the replacement of the drain tile and the placement of additional rip-rap to be covered under Major Permit 129-02. This will stabilize the canal bank and prevent and further damage to the roadway. This will result in an additional 320 square feet of rip-rap to be placed in the canal bottom.The rip-rap will be carried up the canal bank to stabilize the shoulder. My notes say that CAMA already issued the modification per my conversation with Bill Arrington on October 29,2003.Our comment would of been no objection to the project as proposed. It is authorized under nationwide#3 and 13 and was originally authorized on August 21,2002 with an expiration date of August 21,2004. The action I.D.numbers were 200210971 and 200210982. The modification would of been covered under the original issuance and didn't require further written correspondence from us. If you need anything else,please let me know. Thanks! We are also processing a minor modification for Major Permit 129-02 and would like to debit DOT for $100.00 for that project. It is on SR 1111 in Hyde County. Request date 8/18/03. I informed Clay that it would be processed as a refinement or minor modification. Due to the location being outside the permitted work area and the additional 320 Sq. feet of PTA impacts, it is my understanding it will be processed as a minor modification requiring a $100.00 fee which I requested Jaye Poole debit to DOT.
