This permit, issued on 3/18/02 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. U-3449, Improvements to Halstead Boulevard 1) In order to protect anadromous fish, including blueback herring, alewife and striped bass, no in-water work shall be permitted between February 15 to June 30 of any year without the prior approval of the N.C. Division of Coastal Management (DCM), in consultation with the N.C. Division of Marine Fisheries and the N.C. Wildlife Resources Commission. For the purposes of this moratorium, in-water is defined as those areas that are inundated at normal high water. 2) The bridge shall be constructed with driven piles. Specifically, piles shall not be jetted. Shall jetting of any bridge piles become necessary, a modification to this permit will be required. 3) The permittee shall remove the temporary work bridge, including piles, immediately after project construction is completed. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resou7s Commission. date. Department of Transportation Pe►znit#32-02 Page 2of3 ADDITIONAL CONDITIONS 4) Within the waters of the unnamed tributary to Knobbs Creek, the permittee shall install turbidity curtains immediately prior to the initiation of construction immediately adjacent to all bottom disturbing activities, including pile driving. The turbidity curtains shall be removed after construction is complete and when turbidity within the curtains reaches ambient levels. 5) In accordance with a commitment made within the CAMA permit application cover letter, a vegetated buffer shall be provided along the "agricultural drainage" that ties into a natural drainage just "downstream" of the project, as depicted on the attached workplan drawings. The vegetated buffer shall be 50 feet on each side of the cfiannel and shall run continuously for approximately 650 feet from the proposed road to the tree line. The vegetated buffer shall be planted with native vegetation, such as river birch, sycamore, willow oak and green ash. 6) Placement of riprap shall be limited to high ground at the end bent on the bridge abutments, as depicted on the attached workplan drawings. The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. 7) No excavation is authorized by this permit. 8) No fill material will be placed at any time in any vegetated wetlands or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). Fill material in any vegetated wetlands or surrounding waters shall be limited to the footprint of the bridge pilings. 9) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 10) The invert of any culvert or pipe that is placed within wetlands or jurisdictional streams must be buried at least one foot below normal bed elevation to allow for passage of water and aquatic life. 11) No vegetation clearing will occur outside the project area. 12) Live concrete shall not be allowed to contact the water in or entering into the stream. NOTE: In accordance with project commitments made within the Finding of No Significant Impact dated 5/13/99, the permittee shall minimize any construction activity in stream channels and wetlands. Canopy removal shall be minimized where practicable, and disturbed areas along stream banks shall be re-vegetated upon completion of construction. Sedimentation and Erosion Control 13) In order to protect water quality, runoff from construction must not visibly increase the amount of suspended sediments in adjacent waters. 14) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). Departmer4 of Transportation Permit#32-02 Page 3 of 3 ADDITIONAL CONDITIONS 15) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. 16) This project must conform to all requirements of the NC Sedimentation Pollution Control Act and NC DOT's Memorandum of Agreement with the Division of Land Resources. 17) The permittee shall follow Best Management Practices for the protection of Surface Waters and sedimentation and erosion control measures sufficient to protect aquatic resources. Stormwater Management 18) The N.C. Division of Water Quality (DWQ) approved this project under stormwater management rules of the Environmental Management Commission under Stormwater Permit No. SW7020109. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. General 19) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters,the permittee will be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 20) The permittee must install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the permanent bridge structure and temporary work bridge in order to make them more visible during hours of darkness or inclement weather. 21) The authorized activity will not cause an unacceptable interference with navigation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, a' provals or authorizations that may be required. NOTE: The permittee and/or his contractor is strongly encouraged to contact a representative of DCM's Elizabeth City Office at(252) 264-3901 to request a preconstruction conference prior to project initiation. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3289 (DWQ Project No. 01-1595), which was issued on 01/09/02. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under Nationwide Permit No. 14 (COE Action ID. The North Carolina Department of Transportation proposes to extend Halstead Boulevard in Elizabeth City,North Carolina, from the existing US 17 business to the new US 17 Elizabeth City bypass. The purpose of the proposed project is to provide expedient access to residential and commercial districts in Elizabeth City from the Elizabeth City Bypass. Completion of the project will also provide equally convenient access to the bypass for travel out of the immediate Elizabeth City area for those who want to avoid more congested urban routes. Northbound traffic on the new US 17 bypass could access the downtown area by exiting at the proposed Halstead Boulevard interchange. Southbound traffic on the bypass may choose to exit here as well if the destination is south and west Elizabeth City. Similarly, local traffic enroute to points south or north of Elizabeth City may choose to use the Halstead Blvd. extension to gain access to the more efficient freeway facility rather than traveling along existing urban routes. The project will result in the construction of a new section of roadway from the existing western terminus of Halstead Boulevard to a proposed interchange with the Elizabeth City Bypass. The project is approximately 5.8 km (3.6 mi) in length, more than 70% of which will cross open farm fields. The project is designed as a four-lane divided facility with a 16.0-foot median. This wetland is a bottomland community associated with the proposed crossing of an unnamed tributary to Knobbs Creek. The upland fringes and upper reaches of the floodplain are vegetated with sycamore (Platanus occidentalis), red maple, ironwood(Carpinus caroliniana) and tulip poplar(Liriodendron tulipifera), along with privet (Ligustrum sinense), greenbrier(Smilax spp.), grapevine (Vitis rotundifolia), honeysuckle (Lonicera japonica) and giant cane. In the wetter portions of the floodplain bald cypress (Taxodium distichum), tupelo (Nyssa aquatica), swamp gum (N. sylvatica. var. bijlora), green ash(Fraxinus pennsylvanica) and swamp white oak (Quercus bora) are abundant. Red maple and swamp chestnut oak (Q. michauxii) are common, but not co-dominants. This community will be bridged in its entirety from high ground to high ground. A temporary work bridge, instead of a fill causeway, will be utilized for construction of the permanent structure. Both the new structure and the temporary work bridge are approximately 208.0 meters (682.25 feet) in length. The permanent bridge will contain 7 interior bents. Each bent will have a single row of 12 concrete piles. Each pile will measure 3.67 feet by 3.67 feet and will be 65.27 feet long. Average span length will be 85.5 feet. Spans of this length minimize the number of permanent bents in wetlands. However, they present the challenge of accessing the bridge for construction. The length of the bridge and the length of the each span does not allow for top-down construction. Therefore, there are two options. The NCODT can build a temporary earthen causeway as a construction access or a temporary bridge can be built. The NCDOT has chosen to construct the more expensive temporary bridge as a way to minimize impacts to the high quality wetlands surrounding the unnamed tributary to Knobbs Creek. The temporary work bridge eliminates the need for a causeway while maintaining the ability of the wetland to continue its current hydrologic regime and function. Please note that the only fill that will be placed into this wetland will be from the temporary work bridge pilings and the permanent bridge pilings. The support pilings for the temporary bridge will be removed immediately following completion of the permanent structure. The area(square feet) of permanent fill resulting from the pilings themselves is discussed on forms MP2 and MPS. Please note that jetting will not be used to install pilings. The project will not require shoreline stabilization. However,there will be placement of rip-rap under each end bent on the bridge abutments. This will help to stabilize the bridge approach. It will not protect, nor is it intended-to protect,the shoreline of the unnamed tributary to Knobbs Creek. The placement of this rip-rap is noted on Form DCM MP-2 in item number 3; questions a and b. It should be noted that the project also crosses an agricultural drainage that ties into a natural drainage just"downstream" of the project. This area has been channelized heavily in the past and discussions with various members of the regulatory community have indicated that bank stability and water quality within the immediate area could be improved by providing a vegetated buffer from the edge of the crossing to the nearest tree line downstream of the pipe crossing. The vegetated buffer will be 50.0 feet wide on each side of the channel and will run continuously for approximately 200.0 meters (656.0 feet)to the tree line. The buffer will be planted with a • mixture of river birch Betula nigra, sycamore Platanus occidentalis, willow oak Ouercus phellos, and green ash Fraxinus pennsylvanica. The NCDOT hereby requests that this project be authorized by the issuance of a Coastal Area Management Act Major Development Permit. Please find attached the completed MP forms along with the appropriate permit drawings. The certified mail "green cards"from the adjacent riparian landowner notifications are also included. It should be noted that two attempts were made to contact Mr. Meliville Jones. Both packages were returned by the postal service. The Pasquotank County Tax Office was contacted after the first attempt, to ensure the correct address, and a new package was mailed. The receipts from these attempts are included even though no signature was obtained. The NCDOT has also requested authorization from the North Carolina Division of Water Quality and the U. S. NC DOT (HALSTEAD BOULEVARD EXTENSION BRIDGE) TIP No. U-3449 FIELD INVESTIGATION REPORT PAGE #2 Project Setting NC DOT proposes to create a connector road to link the existing US 17 Business road in downtown Elizabeth City to the new US 17 Elizabeth City bypass. The 3.6 mile connector road will extend from the western terminus of Halstead Boulevard to a proposed interchange with the Elizabeth City bypass. More than 2 1/2 miles of the four lane divided highway with 16' median will cross open farm fields. The road will cross an unnamed tributary to Knobbs Creek and associated "404" jurisdictional wetlands (bottomland) located 3/10 of a mile from the end of Halstead Boulevard. The lower portions of the floodplain are vegetated with bald cypress (Taxodium distichum), tupelo (Nyyssa aquatica), swamp gum (N. sylvatica), green ash (Fraxinus pennsylvanica), and swamp white oak(Quereus biflora). Upper portions of the floodplain are vegetated with sycamore (Pratanus occidentalis), red maple (Acer rubrum), ironwood (Carpinus caroliniana), and tulip poplar (Liradendron tulipfera). The waters of Knobbs Creek and tributaries to it are classified as CSW by the NC Division of Environmental Management. These waters are classified as Inland Fishing Waters by the NC Marine Fisheries Commission and NC Wildlife Resources Commission and as Public Trust Waters by the NC Coastal Resources Commission. At the proposed crossing the tributary ranges 100'- 110' in width and 1'-2' below NWL in depth. Proposed Project NC DOT proposes to cross the tributary and associated freshwater wetlands by constructing a 52' x 682' long concrete bridge with seven bents. Each bent is supported by twelve 44" x 44" driven concrete piles. Permanent impact to the tributary is reduced by the longer spans which require that only 12 supporting piles (for 1 bent) be placed within the tributary. However the lengthened spans do not allow top-down construction, thereby creating the need for a temporary work bridge. A 25' wide temporary work bridge with seven 25' x 64' long fingers is proposed approximately 6' east of the permanent structure. Vertical clearances for the permanent and temporary bridges are 10' and 3' respectively. Anticipated Impacts • The construction of the 52' x 682' concrete bridge will eliminate 161 square feet of public trust waters/shallow water habitat and shade 5250 square feet of public trust waters. The placement of six bents within the bottomland located adjacent to the tributary will result in the filling of 970 square feet of freshwater wetlands. The purpose of the proposed project is to provide expedient access to residential and commercial districts in Elizabeth City from the Elizabeth City Bypass, which is currently under construction. Completion of the project will also provide equally convenient access to the bypass for travel out of the immediate Elizabeth City area for those who want to avoid more congested urban routes. Northbound traffic on the new US 17 bypass could access the downtown area by exiting at the proposed Halstead Boulevard interchange. Southbound traffic on the bypass may choose to exit here as well if the destination is south and west Elizabeth City. Similarly, local traffic enroute to points south or north of Elizabeth City may choose to use the Halstead Blvd. extension to gain access to the more efficient freeway facility rather than traveling along existing urban routes. The project will result in the construction of a new section of roadway from the existing western terminus of Halstead Boulevard to a proposed interchange with the Elizabeth City Bypass. The project is approximately 5.8 km (3.6 mi) in length, more than 70% of which will cross open farm fields. The project is designed as a four-lane divided facility with a 16.0-foot median. The project will cross one jurisdictional wetland near the eastern terminus of the project. This wetland is a bottomland community associated with the proposed crossing of an unnamed tributary to Knobbs Creek. The upland fringes and upper reaches of the floodplain are vegetated with sycamore (Platanus occidentalis),red maple, ironwood(Carpinus caroliniana) and tulip poplar(Liriodendron tulipifera), along with privet(Ligustrum sinense), greenbrier(Smilax spp.), grapevine (Vitis rotundifolia),honeysuckle (Lonicera japonica) and giant cane. N lora), green ash (Fraxinus pennsylvanica)and swamp white oak (Quercus bWora) are abundant. Red maple and swamp chestnut oak(Q. michauxii) are common,but not co-dominants. This community will be bridged in its entirety from high ground to high ground. Additionally, a temporary work bridge, instead of a fill causeway, will be utilized for construction of the permanent structure. Both the new structure and the temporary work bridge are approximately 227.0 meters(744.5 feet) in length. It should be noted that the project also crosses an agricultural drainage that ties into a natural drainage just"downstream" of the project. This area has been channelized heavily in the past and discussions with various members of the regulatory community have indicated that the water quality within the immediate area could be improved by providing a vegetated buffer from the edge of the crossing to the nearest tree line downstream of the pipe crossing. The vegetated buffer will be 50.0 feet wide on each side of the channel and will run continuously for approximately 200.0 meters (656.0 feet)to the tree line. The buffer will be planted with a mixture of river birch Betula nigra, sycamore Platanus occidentalis,willow oak Quercus phellos, and green ash Fraxinus pennsylvanica. It is anticipated that this project will be authorized by Nationwide Permit No. 14. Please find attached a completed Pre-construction Notification Form along with the appropriate permit drawings. By copy of this letter,the NCDOT is also requesting that the North Carolina Division of Water Quality issue the appropriate Section 401 Water Quality Certification. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. Impacts to intermittent channel are limited to the minimum number necessary for the crossing. The remainder of the channel downstream of the crossing to the nearest tree line will be buffered by a new forested buffer provided by NCDOT. Page 7 of 13 VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE — In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. 1, Provide a brief description of the proposed mitigation plan. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area Management Act(G.S. 113A-100 through 113A-128). We do not object to the issuance of the CAMA permit for this project provided that the following conditions are include in the CAMA Permit: 1. To protect anadromous fish, including striped bass(Morone saxatilis), no in-water ( . work should be allowed from February 15 to June 15 of any year. For the purposes of this moratorium, in-water is defined as those areas that are inundated at mean high water. All riprap placed in-water should be free of pollutants and soil. 3. Knobbs Creek has been documented to function as a spawning and nursery area for blueback herring and alewife. Other species such as white perch, yellow perch and catfishes utilize the area as well. The proposed project will result in a temporary work bridge being constructed so that a permanent bridge can be built. The permanent bridge will be 52 ft by 682 ft over a 100 ft wide tributary to Knobbs Creek. The Division requests an inwater construction moratorium from February 15 through June 30. A copy of a Deed or other Title Indicating Document must be provided for the project areas. Please submit the needed documentation. 5. Documentation of Notification of Riparian Property Owners must be provided. Please submit Certified Return-Mail Receipts for this notification, along with a copy of the notification provided to these owners and any comments received in reply. 6. Evaluative testing was conducted at six archaeological sites--31PK88, 31PK89, 31PK90, 31PK92, 31PK93, and 31PK94. In each instance, CCR determined that the site was either disturbed or would not otherwise be affected by the proposed construction. Therefore, we recommend no further archaeological investigations in connection with this project. The report meets our office's guidelines and those of the Secretary of the Interior. The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36 CFR Part 800.
