1) In order to protect juvenile fish and shrimp populations, no construction may take place between
' April 1 - September 30 without prior approval of the Division of Coastal Management in
consultation with the Division of Marine Fisheries.

vegetated wetlands is not authorized. ,
3) No excavated or fill material will be placed at any time in any marsh or surrounding waters,
outside of the alignment of the fill area indicated on the workplans. .

ADDITIONAL CONDITIONS
• 5) A permanent ground cover sufficient to restrain erosion shall be provided on all exposed areas
within the shorter of 15 working or 60 calendar days after project completion.

Reference the application of the North Carolina Department of

The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
c. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
d. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 25 NTU's or less are not considered significant.

Enclosed is the application of the North Carolina Department of
Transportation, Division of Highways, for Department of the Army authorization
and a State Water Quality Certification to place fill material in
waters/wetlands of Tar Creek associated with replacement of Bridge No. 23 on
S.R. 1317, near Pamlico, Pamlico County, North Carolina. Your receipt of this
letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2 (b) (ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by September 9, 1993, the District Engineer will deem that
waiver has occurred.

Reference your application for Department of the Army (DA) authorization
to place fill material in waters/wetlands of Tar Creek associated with
replacement of Bridge No. 23 on S.R. 1317, near Pamlico, Pamlico County, North
Carolina.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404 (b) (1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.
b. It is necessary for you to have taken all appropriate and practical
steps to minimize wetland losses. Please indicate all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to minimize adverse impacts.
c. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please indicate your plan to
•
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.

This information is essential to our expeditious processing of your
application and it should be forwarded to us by July 29, 1993. Also, a copy
of this information must be sent to the North Carolina Division of
Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the

(copy enclosed) , which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.

DATE: July 29, 1993
The North Carolina Department of Transportation (NCDOT) proposes to replace Brdige #23,
on SR1317, over Tar Creek, near Pamlico, in Pamlico County, with a culvert crossing.
AECs impacted by the project include Public Trust Areas, Estuarine Waters, Estuarine
Shoreline, and Coastal Wetlands.
The project involves excavation of Coastal Wetlands and filling of shallow estuarine bottom
and coastal wetlands. The waters of Tar Creek are designated as a Primary Nursery Area,
'SA', and are open to shellfishing.
I have reviewed this project for consistency with the 1992 Pamlico County Land Use Plan
(LUP) Update and offer the following comments.
The general area of the project is classified as 'Rural With Services', while the Estuarine
Shoreline is classified as 'Conservation I', Coastal Wetlands are classified as 'Conservation
III', and Estuarine Waters and Public Trust Areas are classified as 'Conservation IV'.
Pamlico County's policies regarding Residential, Commercial and Industrial Development
Impacts on Resources are discussed on Pages IV-12 through IV-14 of the Plan. Pamlico
County allows uses consistent with 15A NCAC 7H to occur in AECs classified as
Conservation III and IV. Uses in Conservation I classified areas (Estuarine Shoreline) are
restricted, although paving for access is specified as an allowed use in these areas.
Economic and Community Development Policies contained in the Plan include Pamlico
County's commitment to State and Federal programs (Page IV-17). The policy indicates that
the County is generally receptive to State and Federal programs, particularly those which
provide improvements to the County. Transportation policies are discussed on Pages IV-18
through IV-19 and include the County's support of road and street improvements that are
necessary to insure that traffic congestion and dangerous traffic conditions do not exist.
Based on the above policies, this bridge replacement project appears consistent with the 1992
Pamlico County LUP Update.

PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that the North Carolina
Department of Transportation, filed an application on June 2, 1993, for a permit from the
Division of Coastal Management to develop in an Area of Environmental Concern and for
certification from the Division of Environmental Management that a discharge of fill material
in project wetlands will not violate applicable water quality standards.
According to said application, the applicant proposes to replace Bridge #23 with a
culvert crossing, on SR1317 and over Tar Creek, near the community of Pamlico, in
Pamlico County.

with a culvert crossing.

9. NARRATIVE DESCRIPTION: The applicant is the N. C. Department of
Transportation and the project site is bridge #23 located on SR1317 over Tar Creek
near Pamlico in Pamlico County. The proposed project is to replace the existing 21' by
31' bridge with three 95" by 67" culverts approximately 62' in length. The bridge
replacement will occur along the existing road alignment and local traffic will be
detoured along existing roadways. The low height of the existing bridge prohibits
navigation in Tar Creek. The average daily flow in Tar Creek is 0.5 cfs.
The installation of the culverts will require the filling of approximately 1300 sq. ft. of
mixed coastal wetlands, primarily Juncus roemarianus and Spartina cynosuroides.
Approximately 435 sq. ft. of mixed coastal wetlands will be excavated for the culvert
crossing. Approximately 1300 sq. ft. of shallow estuarine bottom will be filled.
ANTICIPATED IMPACTS: The waters of Tar Creek are designated as a Primary
Nursery Area by NCDMF, classified as SA by NCDEM and are open to shellfishing
by NCDMF and NCDEH. The proposed project will require the filling of
approximately 1300 sq. ft. of coastal wetlands and 1300 sq. ft. of shallow estuarine
bottom. Approximately 435 sq.ft. of coastal wetlands will be excavated.

The previous application dated May 17th was in error by
requesting authorization from the Corps of Engineers under
Nationwide Permit 26 . By copy of this letter we are hereby
notifying the Corps of Engineers that Nationwide Permit 14
should apply. We request that the proposed work be
authorized under the Coastal Area Management Act permit as
applied for on May 17 , 1993 . Because the acreage impacted
will be less than a third of an acre , no COE or DEM
notification is required but we are providing this
information for their files .

SUBJECT: Pamlico County, Replacement of Bridge No . 23 over
Tar Creek on SR 1317 near Whortonsville.
The North Carolina Department of Transportation proposes
to replace Bridge No . 23 over Tar Creek on SR1317 near
Whortonsville. The proposed action will involve replacing
the existing bridge structure with three 95" by 67"
corrugated steel pipe arch culverts approximately 62 ' in
length. This bridge replacement will take place on existing
alignment and local traffic will be detoured along existing
roadways .
Fill in wetlands and below ordinary high water will
total 0 . 06 acres in salt marsh habitat. The average daily
flow is estimated to be 0 .42. cfs . Excavation in wetlands
will be less than 0 . 01 acres and below ordinary high water
will be approximately 151 cubic yards . Best management
practices will be implemented to minimize any adverse effects
which may be caused by project-related sedimentation.
NCDOT is requesting that the proposed work be authorized
under the appropriate Coastal Area Management Act (CAMA)
permit. This project may be authorized under Nationwide
Permit 26 "Above Headwaters " and the corresponding General
Water Quality Certification, and because the acreage impacted
will be less than 1/3 of an acre, no agency notification will
be required. Included for your information is a permit
application and permit drawings ( 3 pages) . A processing fee
of $250 has already been sent to you. (Check # 458769 )

The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located in Pamlico County, Bridge#23 over
the Tar Creek, on SR1317, near Whortonsville. It was received on June 2, 1993, and appears
to be adequate for processing at this time. The projected deadline for making a decision is
August 17, 1993. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must

conspicuous point along your property where it can be observed from a public road. Some
