On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404 (b) (1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. c. The MOA requires that appropriate and practical mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practical minimization has been employed. VINSON SUBJECT: CONSISTENCY DETERMINATION - MAJOR PERMIT APPLICATION - NCDOT - SR1317 - TAR CREEK, PAMLICO COUNTY DATE: July 29, 1993 The North Carolina Department of Transportation (NCDOT) proposes to replace Brdige #23, on SR1317, over Tar Creek, near Pamlico, in Pamlico County, with a culvert crossing. AECs impacted by the project include Public Trust Areas, Estuarine Waters, Estuarine Shoreline, and Coastal Wetlands. The project involves excavation of Coastal Wetlands and filling of shallow estuarine bottom and coastal wetlands. The waters of Tar Creek are designated as a Primary Nursery Area, 'SA', and are open to shellfishing. I have reviewed this project for consistency with the 1992 Pamlico County Land Use Plan (LUP) Update and offer the following comments. The general area of the project is classified as 'Rural With Services', while the Estuarine Shoreline is classified as 'Conservation I', Coastal Wetlands are classified as 'Conservation III', and Estuarine Waters and Public Trust Areas are classified as 'Conservation IV'. Pamlico County's policies regarding Residential, Commercial and Industrial Development Impacts on Resources are discussed on Pages IV-12 through IV-14 of the Plan. Pamlico County allows uses consistent with 15A NCAC 7H to occur in AECs classified as Conservation III and IV. Uses in Conservation I classified areas (Estuarine Shoreline) are restricted, although paving for access is specified as an allowed use in these areas. Economic and Community Development Policies contained in the Plan include Pamlico County's commitment to State and Federal programs (Page IV-17). The policy indicates that the County is generally receptive to State and Federal programs, particularly those which provide improvements to the County. Transportation policies are discussed on Pages IV-18 through IV-19 and include the County's support of road and street improvements that are necessary to insure that traffic congestion and dangerous traffic conditions do not exist. PROJECT SUMMARY: The NCDOT proposes to replace bridge #23 on SR1317 over Tar Creek with a culvert crossing. FIELD INVESTIGATION REPORT: NCDOT-TAR CREEK PAGE #2 9. NARRATIVE DESCRIPTION: The applicant is the N. C. Department of Transportation and the project site is bridge #23 located on SR1317 over Tar Creek near Pamlico in Pamlico County. The proposed project is to replace the existing 21' by 31' bridge with three 95" by 67" culverts approximately 62' in length. The bridge replacement will occur along the existing road alignment and local traffic will be detoured along existing roadways. The low height of the existing bridge prohibits navigation in Tar Creek. The average daily flow in Tar Creek is 0.5 cfs. The installation of the culverts will require the filling of approximately 1300 sq. ft. of mixed coastal wetlands, primarily Juncus roemarianus and Spartina cynosuroides. Approximately 435 sq. ft. of mixed coastal wetlands will be excavated for the culvert crossing. Approximately 1300 sq. ft. of shallow estuarine bottom will be filled. ANTICIPATED IMPACTS: The waters of Tar Creek are designated as a Primary Nursery Area by NCDMF, classified as SA by NCDEM and are open to shellfishing by NCDMF and NCDEH. The proposed project will require the filling of approximately 1300 sq. ft. of coastal wetlands and 1300 sq. ft. of shallow estuarine bottom. The North Carolina Department of Transportation proposes to replace Bridge No . 23 over Tar Creek on SR1317 near Whortonsville. The proposed action will involve replacing the existing bridge structure with three 95" by 67" corrugated steel pipe arch culverts approximately 62 ' in length. This bridge replacement will take place on existing alignment and local traffic will be detoured along existing roadways . Fill in wetlands and below ordinary high water will total 0 . 06 acres in salt marsh habitat. The average daily flow is estimated to be 0 .42. cfs . Excavation in wetlands will be less than 0 . 01 acres and below ordinary high water will be approximately 151 cubic yards . Best management practices will be implemented to minimize any adverse effects which may be caused by project-related sedimentation. NCDOT is requesting that the proposed work be authorized under the appropriate Coastal Area Management Act (CAMA) permit. This project may be authorized under Nationwide Permit 26 "Above Headwaters " and the corresponding General Water Quality Certification, and because the acreage impacted will be less than 1/3 of an acre, no agency notification will be required.
