I Bridge Construction 1) A silt fence will be placed along the permimeter of the bridge project and the adjacent wetlands. Watts 6J SUBJECT: Recommendations for NC DOT Bridge #63 Project Major Permit Request DATE: April 7, 1993 I have no objections to this project. However, I am concerned that looking into the future, the public may increasing want to utilize lady Creek for canoeing, etc. and the culvert system will restrict this use. Admittedly, the current boating use of this portion of Jady Creek is minimal. I do not feel this project's wetland impacts warrant mitigation. The Gates County Water main relocation can be handled under a separate General Permit. I recommend the following conditions be imposed on this permit: (1) A silt fence should be placed along the perimeter of the bridge project and the adjacent wetlands. The fence will be left in place until the project is completed and the site stabilized with vegetation. (2) No work or filling will take place in wetlands outside of the platted work area. This portion of Jady's Creek is navigable and is considered public trust waters. The Gates County land use plan has no specific policy regarding public trust waters other than to place such waters in the Conservation classification. There, the County indicates that it finds acceptable all uses that can be permitted by existing local, state and federal regulations. Therefore, so long as this proposal meets all local, state and federal requirements, it will be consistent with the Gates County land use plan. P.O. PROJECT SUMMARY: The applicant desires to replace a deteriorated wooden bridge with three concrete culverts. Placement of the culverts will require excavation of approximately 550 cubic yards of the creek bed. An existing water main will be removed prior to the demolishing of the bridge and replaced after the culverts are in place. NC DOT Bio Report Page Two Site Report The NC DOT proposes to replace bridge NO. 63 over Jady Creek on S.R. 1118 west of Gatesville. Jady Creek is a natural, navigable creek which connects with the Chowan River. The creek is approximately 45 feet wide under normal water levels and has a normal depth of approximately 5". The creek flows at a normal rate of 10.3 C.F.S. and is part of the Public Trust category of the Estuarine System Area of Environmental Concern. The applicant proposes to replace bridge No. 63 with three reinforced concrete box culverts (@ 14' x 12') and make unspecified improvements to both approaches to the bridge. The 86 foot long bridge is constructed of treated timber, and is paved with asphalt. NC DOT maintains a 12 foot margin on each side of the road approaches to the bridge. Approximately 550 cubic yards of spoil will be removed from the creek and its flood terrace to facilitate the placement of the three box culverts. Approximately 100 cubic yards of uplands will be excavated for the same purpose. Backfilling the culverts to road grade will require 1,500 cubic yards of clean fill. A 2,614 square foot area of presumed wetlands will be filled in this process. Vertical clearance under the bridge is approximately 6 feet and will be reduced to approximately 5 feet under normal water levels. Presently the width of passage between pilings is 18 feet. The width of passage with the culverts will be reduced to 14 feet. A 4" county water line runs parallel to the existing bridge approximately 23 feet south east of the roads center line. Gates County will have to temporarily remove this pipe during the construction phase of this project. Anticipated Impacts This project will result in the filling of approximately 2,614 square feet of wetlands. The use of culverts will constrict the area of passage for canoeists. Excavating and backfilling the creek bed and adjacent terraces will temporarily increase the level of creek turbidity. NC DOT claims the proposed culverts will be able to handle the stream flow of Jady's Creek. The Gates County government will be required to remove their existing 4" water line during the construction phase. The would like to suspend the waterline above the creek along the proposed culverts. CAMA REVIEW The placement of the Gates County waterline across Jady Creek could be authorized under CAMA's General Permit conditions is request as a separate project from the NC DOT Bridge project. The replacement of Bridge NO. 63 is in the public's interest. The use of culverts will reduce the navigability of Jady Creek, however this area is rarely traveled boaters and only then primarily by canoeists. The wetland impact will be limited to an area of 2,614 square feet (.06 acre). USCOE may authorize this activity under their Nationwide 14 Permit. Submitted by: Richard L.
