Cobey,Jr.,Secretary Director MEMORANDUM TO: John Parker FROM: Terry Moore41791 DATE: 3 November 1992 SUBJECT: Major CAMA Permit No. 109-92 Issued to NCDOT for Replacement of Bridge No. 73 on SR 1518 in Bertie County I have reviewed the 26 October letter from Barney O'Quinn addressing the aforementioned permit and in particular Conditions No. 1 and 2. We had nothing to do with Condition No. 1 or No. 2 but do concur with Ted Tyndall's onsite comments in reference to Condition No. 1. I contacted Sara Winslow with regards to Condition No. 2 and discussed this project. She explained the Division of Marine Fisheries has documented anadromous usage of the downstream reaches of this creek but they did not have a documented use in the area of the bridge. Furthermore, she said she questioned potential use by anadromous fish in the area of the referenced bridge because of existing constrictions and the size of the waterbody. Therefore with her clarification of documented usage in this area and in the absence of any other supporting comment or recommendation from another review agency, I suggest we drop these conditions from the permit. On July 9 , 1992 , The North Carolina Department of Transportation applied for a Coastal Area Management Act (CAMA) permit to replace bridge 73 over an unnamed tributary to the Roanoke River on SR 1518 in Bertie County. The proposed action involved replacing the existing timber frame bridge structure with two (2 ) 103" x 71" corrugated steel pipe arches (C.S .P.A) . The replacement is proposed to take place on existing alignment, with no detour through existing wetlands planned. The dirt roadways leading to the paved approaches on either side of the bridge are not to be paved. On July 1, 1992 , a permit coordination meeting at the bridge site was held between Mr. Doug Huggett of NCDOT' s Environmental Unit and Mr. Ted Tyndall of DCM' s Washington field office. At this meeting, Mr. Huggett stated that because of the small quantity of wetland habitat to be impacted and the /lack of any practicable on-site mitigation /4ct/.5I N ✓° /H /K n=4,/, A-2 J O -L TG/ 4j( f a / / , L70/ �f /y -C f T e .7 % s t 3 An Equal Opportunity/Affirmative Action Employer option, NCDOT was not going to propose any active mitigation proposal to compensate for 0 . 03 acres of herbaceous wetland habitat loss . Mr. Tyndall did not disagree with this statement. Therefore, the permit application made no mention of a mitigation plan to compensate for wetland habitat loss . Mr. Tyndall raised no objections to the project as proposed, but did ask for silt fences above and below the bridge site during construction. This request was agreed to and the silt fence provisions included in our permit application. The CAMA permit for this project, issued by your office on October 13, 1992, included a condition (condition #1) that stated "The permittee must provide for "in-kind" and "on-site" replacement of wetlands impacted by this project. A wetlands replacement plan shall be formulated by the permittee and approved by the DCM in consultation with the WRC before constriction begins . " NCDOT disagrees with this condition based on the small acreage impacted the unavailability of practicable on-site mitigation options . We do not believe that suitable on-site mitigation options are available . Permit condition #2 also presents a problem to the Department. This condition states that "In order to prevent alterations to movement patterns of aquatic wildlife, the width and height (total under-bridge opening) of the culverts will be equal to or greater than existing conditions . " This condition is in conflict with the design presented in our permit application package (see sheet 2 of 2 ) . In order to meet this condition, the crossing will need to be redesigned to make use of a spanning structure, effectively invalidating our original permit application for a crossing using culverts . We are returning the unsigned permit due to the issues stated above. We are requesting that you reconsider these two conditions . It should also be noted that better lines of communication could have helped avoid this situation. We closely coordinated this application with DCM field representatives, and we had no indication that these conditions were forthcoming. AU8181992 MEMORANDUM TO: ed Tyndall FRO John Crew DATE: 12 August 1992 SUBJECT: Bridge Replacement: SR 1518, Bertie County This proposal is to replace an existing bridge with corregated steel pipe arches and comes under the auspices of the March 1991 CRC Certified Land Use Plan Update. The Plan contains some general guidance on proposals of this nature. The policy section dealing with AEC's and wetlands, pages 29 thru 30 is as follows: "In terms of developing policies, the Estuarine System AECs, which include Estuarine Waters and Estuarine Shorelines, and Public Trust Areas, will be treated as one uniform grouping since they are so closely interrelated. Another reason for grouping these AECs together is the fact that the effective use of maps to detail exact on-ground location of a particular area sometimes poses serious limitations. Bertie County's overall policy and management objective for the Estuarine System is to give the highest priority to their protection and perpetuate their biological, social, economic, and aesthetic values, and to ensure that development occurring within these AECs is compatible with natural characteristics so as to minimize the likelihood of significant loss of private property and public resources. In accordance with this overall objective, Bertie County encourages those land uses which conform to the general use standards of the North Carolina Administrative Code (15 NCAC 7H) for development within the Estuarine System. As the County Commissioners adopt land use controls, uses which are not water dependent would require approval . Specifically, each use permitted in the Estuarine System is discussed below. a. Estuarine Waters and Estuarine Shorelines Bertie County officials are very much aware that protection of the estuarine waters and adjacent estuarine shorelines is of paramount importance to fishing, both commercially and for recreation. Bertie County recognized that certain actions within the estuarine shoreline, which is defined as the area extending 75 feet landward of the mean high water line of the estuarine waters, could possibly have a substantial effect upon the quality of these waters. MEMORANDUM 12 August 1992 Page 2 In order to promote the quality of the estuarine waters, Bertie County officials will consider land use controls which protect the values of the estuarine system. Residential, recreational, and commercial uses would also be controlled within the estuarine shoreline, provided that: • A significant change of pollution occurring from the development does not exit; • Development does not have a significant adverse impact on estuarine resources; • Development does not significantly interfere with existing public rights or access to, or use of, navigable waters or public resources. b. Public Trust Waters Bertie County recognizes that the public has certain established rights to certain water areas, and that these public areas also support commercial, recreational and aesthetic values. Bertie County will continue to promote reasonable conservation and management practices of Public Trust Waters. Appropriate uses include those which protect public rights for navigation and recreation. Projects which would directly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below mean high tide, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters shall be discouraged. Encouraged uses shall be those which do not cause an unreasonable detriment to the physical or biological functions of Public Trust Waters. Such uses as navigational channels, drainage ditches, bulkheads to prevent erosion, piers, docks, marinas and bridges will be encouraged. Outstanding Resource Waters have not been identified in Bertie County. No policies have been adopted for this issue. 3. Hazardous and Fragile Land Areas a. Wetlands Soil and Water Conservation has designated several areas in Bertie County as wetlands. County officials realize the importance of freshwater swamps, marshes, and pocosins to the natural environment and support this designation. Many kinds of wildlife would be lost if this habitat was drastically altered. The wetlands future is based on maintaining existing drainage patterns. Bertie County supports the wetlands program by discouraging land uses that will alter the natural drainage pattern and vegetation. Farming and forestry that does not change the drainage pattern would be supported. . MEMORANDUM 12 August 1992 Page 3 Bertie County supports the CAMP, program and the US Corps of Engineers 404 program which has jurisdiction on regulating development in designated freshwater swamp areas. The County will encourage landowners to establish or maintain vegetative buffers around sensitive wetlands and water bodies. Development in coastal wetlands is regulated by the local and State CANA Permit Officers. Other wetlands (i.e. , 404 wetlands) are regulated by the U.S. Army Corps of Engineers. Bertie County policy is to continue support of these regulations in an effort to protect this sensitive natural environment. The Economic and Community Development Policy Section includes the following: Page 36 5. Commitment to State and Federal programs in the County . . . "Highway improvements, as stated earlier, are considered a major factor in ensuring the continued economic growth of the area. Bertie County will continue efforts to secure DOT funds to improve the county's major and minor thoroughfares." The Land Classification Map, page 62, shows the site to appear to be in the Conservation Land Class. (Map scale makes precise delineation difficult. ) This class is designed to illustrate natural resources present to the extent development proposals should be reviewed carefully. Revealing language concerning specific county intent for the conservation class is on page 48 of the Plan as follows: "Examples of permitted uses in the Conservation classification include: • Drainage: adequate drainage is essential to the economic vitality of Bertie County; therefore, drainage facilities over and through these areas, but not with the intent of draining the conservation areas will be allowed. Such facilities may include diking, tiling, and piping systems. • Low density residential development if and as approved by the County Health Department and local, State, and Federal regulations. However, water and/or sewer services will not be extended to such a residential area merely to stimulate additional growth and development. One-site sewer services will be required and must be feasible. Site plans should be reviewed to insure that, at a minimum, regulations on impervious materials are met. • Water-oriented uses such as piers, docks, and marinas, if they are shown not to cause detriment to the estuarine waters or the conservation lands. • MEMORANDUM 12 August 1992 Page 4 • Necessary utility service lines, such as water, sewer, electrical, natural gas, etc. , may be transmitted through areas classed as conservation. These lines would have a destination outside of areas classed conservation and would serve only areas outside the conservation class and would not act as a stimulus to development within the conservation class. These transmission lines shall not violate the environmental integrity of the conservation class, and if permitted, must meet all applicable Federal, State, and local regulations. • Roadways, when construction of roadways can be conducted without significantly altering the ecological system, and in compliance with existing Federal, State, and local regulations. • Timber harvesting and farming, provided natural drainage patterns are not changed. " The conservation classification includes the 100-year flood boundary as defined by the Federal Flood Insurance Program, Public Trust Waters, Estuarine Waters and Estuarine Shorelines. As noted on the Land Classification Map, conservation areas are shown for general use only and final determination of location shall be made by the responsible Federal, State, or local agency having regulatory authority. Such determination shall be made based on a field investigation of any area in question. The land would fall under the rural classification or the limited transition classification if the field investigation shows that it should not be in conservation. PROJECT SUMMARY: The applicant proposes to replace an existing bridge with two corrugated steel pipe arches. • • NC DOT Bridge No. 73 Bertie County Project Setting The North Carolina Department of Transportation (NCDOT) proposed bridge replacement site (No. 73) is located on SR 1518 approximately 1.3 miles east of SR 1521 at the crossing of an unnamed tributary to the Roanoke River in Bertie County, North Carolina. The bridge is bordered on both sides by wooded swamp. The canopy of the adjacent area is co-dominated by bald cypress Taxodium distichum and sweet gum Liquidambar styraciflua. Prevalent shrubs include sweetgum and red maple Acer rubrum. Herbaceous species include greenbriar Smilax rotundifolia, royal fern Osmunda regalis, chain fern Woodwardia areolata, and various grasses. The site is approximately 9' above mean sea level. This small tributary is classified C by the Environmental Management Commission. Project Description NCDOT proposes to replace the bridge with two (2) 103" by 71" corrugated steel pipe arches (C.S.P.A. ) . An area approximately 50' by 40' will be excavated to 3 feet below ordinary high water, the pipes placed into position, and the area around the pipes filled. Concrete bulkheading is proposed in order to retain the fill. Approximately 1000 ft2 of swamp and 1000 ft2 of creek bottom will be filled during the project. Spoil material will be transported to an undetermined approved upland site. Anticipated Impacts The project as proposed would result in the loss of approximately 1000 ft2 of swamp and 1000 ft2 of creek bottom. Localized turbidity would occur as a result of mucking out and filling activities. Silt fences are proposed to minimize the impact of sedimentation. The replacement of the existing bridge with the two C.S.P.A. would impact navigation (although already limited due to size of the creek) upstream of the crossing. The North Carolina Department of Transportation proposes to replace bridge 73 over a unnamed tributary to the Roanoke River on SR 1518 in Bertie County. The proposed action will involve replacing the existing timber frame bridge structure with two (2 ) 103" x 71" corrugated steel pipe arches (C. S .P .A) . The replacement of Bridge 73 is necessitated by concerns over the structural integrity of the existing bridge . This bridge replacement will take place on existing alignment, and no detour through existing wetlands is proposed. The proposed action calls for removing the existing bridge, excavating to approximately 3 feet below ordinary high water, placing the two pipes in position, filling in the area around the pipes, and grading and paving the new crossing. NCDOT is not proposing to pave any of the dirt roadways leading to the paved approaches on either side of the bridge. The proposed activity will lead to a loss of approximately 0 . 03 acres of wetland habitat. Representative species in the area include royal fern, chain fern, greenbriar, sweetgum and cypress . Best management practices will be implemented to attempt to minimize the amount of wetlands impacted. As was discussed with Mr. Ted Tyndall of your Washington field office during a July 1 , 1992 site visit, silt fences will be placed both above and below the construction site to limit sedimentation impacts . NCDOT is requesting that the proposed work be authorized under the appropriate Coastal Area Management Act (CAMA) permit . By copy of this letter, we are also requesting issuance of a 401 Water Quality Certification from the N.C.
