The North Carolina Department of Transportation (NCDOT) has received your letter of August 5 , 1991 which transmitted CAMA permit #112-91 . This permit specifically listed 12 conditions , which have been reviewed by NCDOT' s Highway Design Branch and Planning and Environmental Branch . On August 21 , 1991 , we provided comments on two of the specified conditions . Since that time , it has become apparent that we must request the revision of yet another condition . The second condition specifies that no excavation or filling will be allowed between February 15 and September 30 to protect juvenile fish populations . As you know, CAMA permit conditions are included in the construction contract for NCDOT projects . With the construction moratorium presently stipulated, contractors bidding on this project must assume that they will only be allowed to work on this project for 4 1/2 months of the year. NCDOT feels that this is an unreasonable construction period. In the environmental document , NCDOT proposed to disallow construction between March 1 and June 15 to protect the anadromous fish resource . No objections were raised to this proposed moratorium by the N.C. Division of Marine Fisheries , the National Marine Fisheries Service, and the U. S . Fish and Wildlife Service , and it is quite feasible from a construction standpoint . Consequently, NCDOT is proposing that condition #2 be revised to restrict construction between March 1 and June 15 . Division of Marine Fisheries continues to request a dredging moratorium between February 15 and September 30 to protect juvenile fish populations that utilize the Perquimans River as a nursery area. This moratorium is necessary to ensure the environmental integrity of the area is protected during critical times of usage by blueback herring, alewife, striped bass, spot, croaker, yellow perch, white perch and other commercially and recreationally important species. According to the letter you received from L. R. Goode, the proposed NC DOT moratorium from March 1 through June 15 to protect anadromous fish resources received no objection from DMF. This is incorrect, see attached memos to Steve Benton, dated 10 July and 15 October 1990 and Melba McGee, dated 12 December 1990. It should also be noted at this time there was no proposed excavation in the river. The importance of the Perquimans River and its tributaries as spawning and nursery areas was pointed out in the 5 July 1989 memo. The environmental integrity of the area must be protected during critical times of usage. In the FONSI , there is no mention of a loading/off-loading facility or access channel being needed for the bridge construction. Is this proposed; would dredging be required? This agency requests a moratorium 15 February through 30 June in relation to the installation of the box culverts in Raccoon Creek and Bear. Swamp. This creek has been documented to serve as a spawning area for alewife and blueback herring. The moratorium will ensure protection of these species during critical times of usage. If excavation is to occur in the river the moratorium would be 15 February through 30 September . The first condition specifies that a mitigation plan needs to be developed for anticipated impacts to submerged aquatic vegetation (SAV) . NCDOT shares your Department ' s concern over this potential environmental impact, and we are attempting to include this issue in our environmental coordination process . However, it is not possible for us to adequately anticipate environmental impacts or prepare mitigation measures for an issue when we receive no guidance on that issue. CAMA Permit #112-91 contains the first mention of the SAv issue in the history of this project . The environmental coordination for this project culminated in the approval of the State Environmental Assessment/Finding of No Significant Impact , which was completed May 24, 1990. S. Fish and Wildlife Service and the National Marine Fisheries Service (NMFS) . NCDOT has never received any notice from these agencies that SAV impacts were anticipated for this project. AS a result of this coordination, NCDOT has logically assumed that SAV impacts were not a major issue on this particular project . We have consulted with the NMFS and USFWS on the SAV issue for other NCDOT projects . it is apparent from these discussions that previous attempts to create SAV beds as mitigation have been unsuccessful . Although the proposed project may have SAV impacts, NCDOT' s position is that at this time we cannot offer an SAV mitigation plan that will have much probability of success . we are therefore requesting that Condition #i be removed from CAMA Permit #112-91 . we have also detected a minor problem with condition #3 . As stated in the permit, this condition specifies that the excavation will not exceed 6 feet below the elevation of normal water. However, the permit application and project plans show that the bottom of the proposed channel will be at elevation -6 .0 feet . Since the elevation of normal water is at +0 . 7 feet, the limit of the proposed excavation will occur 6 . 7 feet below normal water, thereby violating the permit as currently worded. Consequently, we request that Condition #3 be reworded to correct this minor discrepancy. As you are aware, this project has been seriously delayed during the coordination of this permit . Box 25201 Raleigh, NC 27611-5201 Dear Dr. Goode: The Division of Coastal Management has received your letters dated August 21 and September 10, 1991, requesting that we reconsider certain conditions placed on CAMA Permit #112-91 for replacing the Perquimans River Bridge. I will address each of the conditions in question separately. - Condition #3 specifies that depth of excavation not exceed 6 feet below the elevation of normal water. You have requested that it be reworded to allow depths to be 6.7 feet below normal water. We agree with your reasoning and you may consider this letter a refinement to Permit #112-91 to allow the 6.7 feet of excavation below normal water. - Condition #2 restricts excavation and filling between February 15 and September 30. You are requesting that the period be amended to say that no construction may occur between March 1 and June 15. The moratorium period on the permit came as a recommendation from the North Carolina Division of Marine Fisheries (DMF) to protect spawning and juvenile fish known to be using the area during that period. Although time periods vary from location to location, this is a standard condition for projects requiring excavation. Since the condition originated with DMF, we asked them to consider your request and respond. They notified us in a memo dated September 10, 1991 that they continue to support the moratorium period specified on the permit. Therefore, Condition #2 must remain on the permit. You may want to contact Mr. Harrell Johnson, District Manager, DMF, directly if further negotiations on this issue are necessary. P.O. Mitigation for these types of resource impacts is becoming standard procedures on permits for both private and public projects. Such a requirement is supported by rules of the Coastal Resources Commission and policies of various State and Federal resource agencies. We asked the principal agency, National Marine Fisheries Service (NMFS) , to reconsider their recommendation for the Plan. They and the Corps of Engineers have advised us that they cannot agree with removing the condition. Therefore, Condition #1 must remain a part of the permit. You raised the issue of SAV impacts not being identified during earlier project review and preparation of the Environmental Assessment. My staff has re-reviewed that document and found that there was no description or mention of a proposal to excavate a construction channel. Therefore, there was no need to evaluate any impact except those caused by the bridge itself. If the channel had been proposed in the document, we would have either surveyed the area ourselves, or, asked that your agency provide the resource information. In fact, our comments on the document raised the question of whether or not a channel would be needed. It is difficult for us to coordinate with your agency on projects if the required environmental documents do not completely describe the project. I understand that there is potential for resolving the mitigation issue by coordinating the requirements on this project with those of the Currituck Sound Bridge project. My Elizabeth City staff and I recently met with your staff and NMFS representatives to discuss the mitigation requirements of the Currituck site. Since similar resources are being replaced, the two projects can perhaps be coordinated in such a way as to avoid your having to attempt a project that may not be successful. In order to protect juvenile finfish populations, no excavation or filling will be permitted between February 15 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. 2 . A silt screen will be left between the area to be excavated and the existing river and wetlands and a 24 hour period after completion of the excavation will elapse prior to plug removal to prevent unnecessary siltation into the adjacent water body. 4 . PROJECT SUMMARY: Applicant proposes upgrading existing two-lane roadway to four lanes with a new two-lane bridge over the Perquimans River. NC DOT - Perquimans River Bridge Bio Report Page Two Site Description The applicant, NC Department of Transportation (NCDOT) , proposes upgrading the existing two lane, US Highway 17, roadway to four-lanes in the vicinity of Hertford, Perquimans County. The proposed project will necessitate the construction of a new 2 ,•900 ft. bridge beside the existing Perquimans bridge to handle the additional new lanes. The proposed project will be built within the existing state right-of-way on the east side of US 17 . The soils within the project area are: Tomotley fine sandy loam, Dorovan muck and old road fill . On the south bank the road project will be build on old fill . Vegetation in this area consists of black medick (Medicago lupulina) , tall fescue (Festuca arundinacea) , bracted planton (Plantaqo aristata) , and broomsedge (Andropogon virginicus) . Approximately 5, 200 sq. ft. of common reed (Phragmites australis) growing in a Dorovan muck soil forms a fringe along the south bank. Bordering the proposed road project along the eastern edge of the state's right-of-way is an extensive bottomland hardwood forest. Dominant vegetation includes red maple (Acer rubrum) , black willow (Salix nigra) , yellow poplar (Liri.odendron tulipifera) , bald cypress (Taxodium distichum) and wax myrtle (Myrica cerifera) . A few bald cypress trees are found within the nearshore area. There is no evidence of either Osprey or eagle nesting activity within the area. No submerged aquatic or emergent aquatic vegetation is found along the southside with the exception of the aforementioned common reed. The north shore rises 3 to 10 ft. above the NWL level of the Perquimans River. No fringe wetlands are found along this portion of the project area. A few bald cypress, black willow, and wax myrtles dot the shoreline. This shoreline is protected with riprap and asphalt. No submerged aquatic vegetation exists near the north shore. Landward of the shoreline is an area of old road fill within the highway easement and a farmed terrace consisting of Tomotley fine sandy loam elevated approximately 10 feet above NWL. Vegetation consists primarily of tall fescue and Kudzu (Pueraria lobata) within the non-farmed areas. The proposed project is within CAMA's estuarine system AEC. NC Department of Environmental Management classifies these waters as SB. Navigation charts indicate the maximum depth of the Perquimans River to be 9 feet within the project area. Construction will require the placement of 65 cubic yards of fill within an area of shallow water 105 ft. x 23 ft. along the north shore. Riprap consisting of #2 stone will be used to protect the filled area from erosion. Fill will not be placed within any wetlands or shallow water habitat on the southside. Dredging will be done by hydraulic dredge. An estimated 19 , 800 cubic yards of spoil will be removed. Spoil will be contained within a dike on the highground terrace, thirty feet from the NWL along the north shore. The dike walls will be 44 ft. wide at the base and 12 ft. high. An outfall pipe, riser and flash boards will be installed to handle excess water. The dike is designed to handle 18 . 4 acre feet of spoil within an area of 147, 084 sq. ft. (3 . 37 acres) . The proposed bridge will be 27 ft. wide and will rise 35 ft. above the mean low water level at its highest point. The existing bridge fenders will be extended under and beyond the proposed bridge at the site of the established navigation channel . There will be a 55 ft. horizontal clearance between the fenders. Anticipated Impacts A dredging project of this magnitude will create considerable temporary turbidity. The resulting channel should not create any permanent water quality problems. No aquatic vegetation will be destroyed with the possible exception of some common reeds along the south shore. A few wax myrtle and black willows will be destroyed along the north bank. Likewise, several bald cypress will be removed on both shorelines. An area approximately . 25 acres in size will be disturbed within 75 ft. of the Perquimans River. There appears to be an underground utility cable within the project area which may have to be relocated. Eroding fill material will be contained by silt fences until the area is stabilized with vegetation. The existing highway right-of-way abuts significant fresh water wetlands which in turn are adjacent to the Perquimans River estuarine shoreline. The proposed road expansion and fill may encroach this area by as much as 35 ft. along the entire length of the highway expansion project south of the Perquimans River. CAMA Review According to the applicant they have conducted an archeological survey of the project area. The applicant does not indicate whether any historical/archeological sites of significance were discovered. According to state archives, a possible significant site exists along the north bank of the Perquimans River east of the project area. No sites are identified within the project area. • • NC DOT - Perquimans River Bridge Bio Report Page Four The Perquimans LUP classifies this area as transition with the exception of the area of regulated wetlands which is classified as conservation. The stated purpose of the transition class is "to provide for future intensive urban development on lands that are suitable and that will be provided with necessary urban services" . The plan states "all land uses that can be permitted under the existing regulation of the various state, federal and local government agencies with jurisdiction are allowed in the conservation district" . Dear Dr. Goode: Please reference our earlier letter to you dated November 16, 1990 regarding your application for a CAMA permit to construct an additional bridge spanning the Perquimans River in Perquimans County. This letter requested additional information necessary to process your application. One of the requested items involved the location, dimension and details of the spoil site required for the proposed channel to be excavated by hydraulic dredge. We have received your letter dated January 8, 1991 and corrected application for a CAMA permit for the Perquimans River Bridge. All additional items requested have been completed except for the spoil site information. North Carolina general statutes 113-229 (pertaining to permits to dredge or fill in or about estuarine waters or state-owned lakes) indicates that " (b) All applications for such permits shall include a plat of the areas in which the proposed work will take place, indicating the location, width, depth and length of any proposed channel , the disposal area, and a copy of the deed or other instrument under which the applicant claims title to the property adjoining the waters in question, (or any land covered by waters) , tidelands, or marshlands, or if the applicant is not the owner, then a copy of the deed or other instrument under which the owner claims title plus written permission from the owner to carry out the project on his land" . Further the Coastal Resources Commission's regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 7J . 0203 (a) (1) require that planview plats must show excavated areas and fill areas. Our review has revealed your application to be incomplete and lacking in information necessary to process your request. Complete item #1 on the application form. 2 . Identify the spoil site location, dimensions and provide a cross-section of the dike construction. 3 . Clarify/correct depth of proposed work channel; application shows -3 . 3 ' , plats show -6 ' . 4 . Notify both adjacent riparian landowners on both shores: North shore: William Nixon and R. L.
