At your request, I revisited the two locations on November 10 and November 17 , 1989 to reevaluate my original recommendation, c= September 17 , 1986 to T. L. Waters former Assistant Highway Administrator, to place the temporary detours for these projects on the upstream (east) side of the existing NC 210. Based on these visits to the bridge sites my recommendations still stand. This is based on the fact that both Harrisons Creek and Merricks Creek provide habitat for anadramous fish. The location of a temporary detour on the downstream side of either one of the existing structures will have a significant impact on these habitats. You have indicated that DOT is concerned with the time necessary to replan and redraw the project to represent the eastward location of the detours. However my comments were submitted in 1986 as is mentioned above. If there are questions concerning the above or if I can be of any other assistance, please advise. Sincerely, 1CW C. Smith Street Burgaw, NC 28425 Dear Mr. Hoskins: This is with reference to NC 210 relocation in Pender County, North Carolina and the activities associated with the action as permitted by State Permit # 55-86. I made an inspection of the site on June 9, 1988 along with Mr. Eddie McCormick of your Division. Also present were Superintendent Fred Boyles of the Park Service and Ms. Tere Barrett of this office. Based on my observations, I have determined that the material associated with the former bridge approach fills does not appear to have been removed to the level of the existing wetlands as required by the permit. I have been in contact with Hugh Heine of the US Army Corps of Engineers and he concurs with this determination. Our recommendation is that the area in question be re-excavated so that the final grade is equal to that of the lowest non-water areas located 100', more or less, to either side of the fill. This is open to negotiation and Mr. Heine and 1 will be available to give final guidance on this elevation level. Project summary Applicant proposes to reroute existing N.C. 210 by aligjiing the new roadway along the southerly edge of the Moores Creek National Battlefield (outside the park) . The existing bridge and fill will be removed. The new crossing of Moores Creek will be by bridge and filled causeway. North Carolina Department of Transportation Page 2 9. PROJECT DESCRIPTION: The project has been modified to only address the rerouting of N.C. 210 to the alternate identified as #3 on the gatefold plat of the originial application. (Figure #3) . This alignment crosses an area acquired during the 70s for the reasons indicated on Figure 3. Alternate 3 crosses two major and one minor wetland area. In addition several wetland (pocossin) pockets are included within the right-of-way east of Moores Creek. The first of the two major wetland areas is Moores Creek Channel and the wooded swamp wetland to either side of the run. Plans presented with the application indicated that the combination of the wooded swamp and creek is approximately 240' wide. There is a small berm on the west bank of the creek surrounded by this wetland. This wetland is separated from the second area by a highground island which is approximately 365' wide. This second area is (based on field observations and Figure 3 examination) approximately 325' wide. This differs from the same area shown on Sheet 2 of 4 by being approximately 45' wider than the 280' shown on Sheet 2. The minor wetland area is not shown on the plans but occurs just west of Station 59.0. It is a small drain which was flowing at the time of the field investigation. The applicants propose to construct a new roadway to divert N.C. 210 to the southern portion of the park grounds. The total length of the roadway fill is approximately 9,100' long x 80' wide average x 1.75' deep average (0-'16') . A new bridge is proposed over the main run of Moores Creek. This bridge will be approximately 150' long x 30' wide. The clearance is not clearly shown. Fill will encroach into the wetlands to either side of the actual bridge so that the bridge does not cross from highground to highground but from this fill on either side (see Sheet 2 of 4) . The entire 325' wide second wetland area will be covered by fill (approxi- mately 100' wide) . Three 36" culverts are now propsed to replace the single 72" concrete pipe originally proposed. (See Sheet 2 of 4) . The stream at Station 59.0 is not addressed in the plans. It appears to be wet enough to require culverting. Approximately 46.750 cubic yards of material will be used for fill of this approximately 4,255 cubic yards will be placed below the MHW contour, as estimated by the applicant. 10. ANTICIPATED IMPACTS: The new alignment will cause to be consumed approximately 47,950 s.f. (1.1 acres) of wooded swamp and/or stream habitat. At the old bridge site the applicant's are proposing to remove approximately 19,500 s.f. of existing fill associated with the approaches. A net wetland loss of approximately 28,450 s.f. (.65 ac) will result based on our calculations. The applicant has estimated that only .57 ac will be lost. The addition of two extra culverts should provide for better interchange through the wetland area east of the bridge. We still believe that a culvert is required at or near Station 59.0 to provide for the stream at that location. SUBMITTED BY: C. We have no objections to the modified request and recommend the following conditions: (1) The side slopes through all wetlands must not exceed a 2:1 proportion. (2) Adequate stabilization structures must be in place throughout all wetland crossings. (3) A culvert must be installed at Station 59.0 adequately sized to pass the flow of the existing stream at this site. Box 769 Morehead City, NC 28557 919/726-7021 • PLANNING AND COMPLIANCE MEETING FOR RELOCATION OF NC 210 PROJECT A meeting was held at Patriots Hall, Moores Creek National Battlefield, Currie , NC on September 17, 1985 to discuss the above proposal. A list of participants and their addresses are attached. The meeting was opened by Barney O'Quinn, NC DOT, by giving a background summary of the project and stated that the basic question at this point was whether to fill the new channel at Moores Creek and restore the old one . Fred Boyles of Moores Creek National Battlefield then gave a presentation on why this project is so vital to Moores Creek Battlefield. He gave a brief background on the length of planning, legislative history, land purchases and the NPS appropriations for FY 86 to restore park lands after the relocation of NC 210 is complete . The floor was then open for discussions. Ken Jolley, U. S. Army Corp of Engineers , stated that the Corps sees two outstanding objections: 1. Alteration of the current channel of Moores Creek. 2. Mitigation of wetlands crossed in the new area. At this point discussion centered on the proposed changes in the stream course . Ken Jolley stated that four agencies had strongly opposed stream relocation. Those agencies are the Corps, NC Division of Coastal Management, Environmental Protection Agency and the N. C. Department of Environmental Management. Within this issue many points were brought out by nearly all the participants . At this point Preston Pate stated that all four agencies objecting to the relocation are firm and would not likely change their objection. Fred Boyles noted the National Park Service desire to not let the stream relocation to cause failure of the total project. Therefore the NPS will withdraw that aspect of the program if it is agreeable with all parties . Barney O'Quinn felt that withdrawal of this aspect of the project would satisfy all parties with objections . A second issue was raised in regards to the location, size and number of culverts at gum cypress slough. After discussion it was agreed that three 36" pipe culverts would be placed between stations 37 and 40 in leiu of a 72" pipe at station 38 plus 75. Another discussion centered around mitigation of displaced wetlands associated the new relocated NC 210 bridge. The size of the wetland to be filled by the new alignment agreed upon was approximately 1.4 acres. The amount of wet- lands to be reclaimed by removing the old road fill would be approximately .75 acres. Discussion centered around banking wetlands and creating wetlands . Both these proposals were seen as unacceptable . The DOT stated that they felt they had gone as far as possible and that mitigation was adequate . Ken Jolley stated that the Corps required adequate mitigation acceptable to various commenting agencies and that one to one replacement was not necessary. At this point Ken Jolley indicated that the Corps (as the permitting agency) may take the position that the net loss of half the acreage is in the public interest. Barney O'Quinn indicated that he would write CAMA indicating modification in the permit in reference to the stream relocation and design. The letter would indicate that a total mitigation package was agreed upon. Project summary applicant proposes to reroute the existing N.C. 210 by aligning the new road way along the southerly edge of the Moores Creek National Battlefield. The existing bridge and fill would be removed. The new crossing of Moores Creek will be by bridge and filled causeway. • NORXH CAROLINA DEPARTMENT OF TRANSPORTATION PAGE 2 • 9. PROJECT DESCRIPTION: The project is divided into two distinct parts. The first of these is the rerouting of N.C. 210 to the alternate identified as #3 on the gatefold plat (Figure 3) . This alignment crosses an area acquired during the 70s for the reasons indicated on Figure 3. Alternate 3 crosses two major and one minor wetland area. In addition several wetland (pocossin) pockets are included within the right-of-way east of Moores Creek. The first of the two major wetland areas is Moores Creek Channel and the wooded swamp wetland to either side of the run. Plans presented with the application indicated that the combination of the wooded swamp and creek is approximately 240' wide. There is a small berm on the west bank of the creek surrounded by this wetland. This wetland is seperated from the second area by a highground island which is approximately 365' wide. This second area is (based on field observations and Figure 3 examination) -approximately 325' wide. This differs from the same area shown on Sheet 2 of 4 by being approximately 45' wider than the 280' shown on Sheet 2. The minor wetland area is not shown on the plans but occurs just west of Station 59.0. It is a small drain which was flowing at the time of the field investigation. The second part of this project is sited at the existing N.C. 210 Bridge o location. The run of Moores Creek was diverted in the 1950s in order to straighten a severe bend in the creek at the road location. The original channel was filled by the road fill. It appears that this new channel was cut out of the existing wetlands adjacent to Moores Creek. The new run also exhibits a stable appearance when compared to other segments of the unaltered stream. There are two fingers of bridge approach fill which total approx- imately 18,255 s.f. of impact on the existing wetland. The Moores Creek National Battlefield is east of the stream at this location. Paved roads, brick buildings, concrete paths and monuments are located through the park grounds. The applicants propose to construct a new roadway to divert N.C. 210 to the southern portion of the park grounds. The total length of the roadway fill is approximately 9,100' long x 80' wide average x 1 .75' deep average (0'-16') . A new bridge is proposed over the main run of Moores Creek. This bridge will be approximately 150' long x 30' wide. The clearance is not clearly shown. Fill will encroach into the wetlands to either side of the actual bridge so that the bridge does not cross from highground to highground but from this fill on either side (see Sheet 2 of 4) . The entire 325' wide second wetland area will be covered by fill (approximately 100' wide) . A single 72" concrete pipe will be provided for interchange across the area now unencumbered. The stream at Station 59.0 is not addressed in the plans. It appears to be wet enough to require culverting. Approximately 47,750 cubic yards of material will be used for fill of this approximately 4,255 cubic yards will be placed below the MHW contour, as estimated by the applicant. ' NORTH CAROLINA DEPARTMENT OF TRANSPORTATION PAGE 3 The second project covered by the application is the removal of the N.C. 210 Bridge and associated fill. Also proposed is the refilling of what is con- sidered the new run of the creek at the bridge and the reopening of the old run which is now filled by the bridge approach on the east side of Moores Creek. Approximately 18,255 s.f. of area would be restored by the bridge fill removal. The new channel involves approximately 11,200 s.f. of area and 6,250 cubic yards of material would be used to raise the elevation to that of the existing wetlands to either side of the creek. The old run excavation would be as part of the bridge fill removal and involves approxi- mately 1,500 s.f. 10. ANTICIPATED IMPACTS: The new alignment will cause to be consumed approximately 47,950 s.f. (1.1 acres) of wooded swamp and/or stream habitat. At the old bridge site the applicant's are proposing to remove approximately 18,255 s.f. of existing fill associated with the approaches. However, the applicants are also pro- prosing to fill approximately 11,200 s.f. of open water back to the elevation of the existing wetlands to either side and will convert one habitat type for another. It appears that it may take several years for the proposed filled area to become stabilized. In addition to the question of fill the project area is also located within a 100-year floodway. The existing bridge approach fill at the N.C. 210 crossing blocks all but 35' of a 375' wetland area (Sheet 4 of 4) . The new crossing involves two wetland areas. The bridge site is approximately 240' wide and the opening between the two approach fills is approximately 110' wide. This area is seperated from the second wetland by the highground island. The entire 325' width of this second wetland would be filled except for a 72" culvert placed approximately in the middle of the fill. Based on the visual inspection of the site at this second location it does not appear that a single culvert will adequately replace the existing interchange of water or the existing free passage of fishery resources now using the area. There is also the question of the flowing stream at Station 59.0. It appears that a culvert is needed at this site also. The siting of this new alignment through the wetlands is also within the conservation classification of the Pender County Land Use Plan. It will be necessary to ask for a consistency determination from the Planning Department for the project. SUBMITTED BY: C. Robert Stroud, Jr. OFFICE: DCM-Wilmington DATE: March 15, 1985 Re: Application for a State Permit - NCDOT - Moores Creek We have stated on several occasions that the refilling of the existing new run is not consistent with the State Management Plan. Therefore we recommend that this portion of .the project be denied. The activity is not water dependent; it would disrupt the productivity of the area for an unknown amount of time and would destroy openwater habitat and the ecosystem that has established since the channel was dug in the 1950s. The rerouting of NC 210 in the new alignment will also cause the disruption of wetlands, however the majority of the wetlands are not within CAMA jurisdiction and the bridge will cross the public trust area. We recommend the following conditions: (1) The side slopes through all wetlands must not exceed a 2:1 proportion. (2) Adequate stabilization structures must be in place throughout all wetland crossings. (3) In addition to the single 72" culvert at least two other culverts must be installed in the 325' wetland area on the east side of the new bridge site. These are necessary to help anticipate the loss of the free interchange of water and fishery resources in this area. (4) A culvert must be installed at Station 59.0 adequately sized to pass the flow of the existing stream at this site. The information was complete. In coordinating the project review with Mr. Ken Jolly, U.S. Army Corps of Engineers we visited the site on March 5, 1985 and walked the proposed alignment from both ends. Based on the visual inspection of the alignment I have the following comments concerning the project: 1. There is a flowing stream at Station 59.0 which will need a culvert. 2. The wetland area where the 72" culvert is proposed appears to be approxi- mately 325' wide. There was water in the area approximately 18" deep. Sampling activities by the Division of Marine Fisheries in the past indicate that the creek and wetlands are used by anadramous members of the Herring Family. We are recommending that additional culverts be included in this area in order to facilitate the use of the area by fish. 3. We are also recommending that the new run remain as it is. We have determined in the past that the proposed activity on behalf of the National Park Service is not consistent with our management plan and our position remains unchanged. P.O. Based on my observations at the time, I estimated that the stream at the point of crossing is approximately 30 ' wide. The associated wetlands appear to be flooded backwater wooded swamp. According to the "A Catalogue of the Inland Fishing Waters of North Carolina" Moores Creek offers good fishing for various freshwater species . It also in- dicates that navigation may be somewhat restricted by vegetation. It appears that the stream is public trust water and a CAMA permit will be required. BS/sbm
