Any violation of these terms may subject , • permittee to a fine,imprisonment or civil action;or may cause the permit to be null and void. , . (1 ) a) Overburden material from road right-of-way and borrow area must be . placed and retained on highground. , . b) The temporary fill for the borrow area haul road must be placed on . filter cloth or similar material to facilitate removal of the fill . , (2) The side slopes of all fill in the wetland areas must be maintained at , , 2: 1 in order to minimize encroachment. , (3) All new water courses must be completed and stabilized prior to diverting , the flow from the natural stream. , (4) All permanent culverts must be designed to accommodate at least the 100 . year storm with whatever excess capacity is required to prevent upstream flooding in excess of one (1 ) foot. , (5) The median width must not exceed 48 feet between lanes in wetland crossing , (See attached sheet for Additional Conditions) ' ' This permit action may be appealed by the permittee Signed by the authority of the Secretary of DNRCD and ' ' or other qualified persons within twenty (20) days of the the Chairman of the Coastal Resources Commission. . NOTE: The Division of Coastal Management supports the present mitigation plan which involves purchase of the borrow area tract with subsequent / transfer of title to said land to a public institution for management and study. / NOTE: A Section 401 Water Quality Certification has been issued for this / project. / /
