• This permit,issued on t 1 'loa:, , is subject to compliance with the application (where consistent ,
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject ,
• permittee to a fine,imprisonment or civil action;or may cause the permit to be null and void. ,
. (1 ) a) Overburden material from road right-of-way and borrow area must be
. placed and retained on highground. ,
. b) The temporary fill for the borrow area haul road must be placed on .
filter cloth or similar material to facilitate removal of the fill . ,
(2) The side slopes of all fill in the wetland areas must be maintained at ,
, 2: 1 in order to minimize encroachment. ,
(3) All new water courses must be completed and stabilized prior to diverting ,
the flow from the natural stream. ,
(4) All permanent culverts must be designed to accommodate at least the 100 .
year storm with whatever excess capacity is required to prevent upstream
flooding in excess of one (1 ) foot.
, (5) The median width must not exceed 48 feet between lanes in wetland crossing ,

ADDITIONAL CONDITIONS
in order to reduce habitat loss.
(6) Wetlands within the interchange loop will remain in a natural state and /
be connected to surface drainage of Smith Creek.
NOTE: The Division of Coastal Management supports the present mitigation
plan which involves purchase of the borrow area tract with subsequent /
transfer of title to said land to a public institution for management
and study. /
NOTE: A Section 401 Water Quality Certification has been issued for this

project.
