THAT IF THE ABOVE CONDITIONS AND THE PLANS AND SPECIFICATIONS SUBMITTED AS PART OF THE APPLICATION (WHERE NOT IN CONFLICT WITH THE CONDITIONS)ARE NOT FOLLOWED PRECISELY, THE PERMITTEE IS SUBJECT TO A FINE, LMPRISONMENT, OR CIVIL ACTION AS PROVIDED IN G. S. 113-229 (K) AND (L). That this permit may be objected to by the permittee within twenty (20) days of the date of issuance. Failure to submit such objection shall be interpreted as an agreement of compliance with all permit conditions. That this permit must be displayed along with a copy of the application and the project plat in the cab (or pilot-house) of the equipment working on the project, or be easily accessible, on site, to Department person- nel when the project is inspected. That any maintenance work or project modification requires further Departmental approval. Subject to permit renewal, all work must cease when permit terminates. (B) This agency objects to the project as proposed. The objection is based upon findings which lead to the conclusion that there will be one or more adverse effects as covered in G. S. 113-229 (e) 1-5. (e) (1) . . . that there will be significant adverse effect of the proposed dredging and filling on the use of the water by the public; II (e) (2) . . . that there will be significant adverse effect on the value and enjoyment of the property of any riparian owners; (e) (3) . . . that there will be significant adverse effect on public health, safety, and welfare; (e) (4) . . . that there will be significant adverse effect on the conservation of public and private water supplies; (e) (5) . . . that there will be significant adverse effect on wildlife or fresh water, estuarine or marine fisheries. This Div. has no objection to the project as proposed even though it entails destruction of appx. 3400 sq.ft. of marsh grasses. The proj. is viewed as one that will result in public benefit from widening of the earthen causeway. We recommend the following conditions: (1) That in order to protect juv. shrimp populations, no excavation or filling be permitted-between April 1 and Sep- tember 30 of any year without the prior approval of the DMF; (2) That silt screens be placed along the toe of the proposed fill area to prevent erosion onto the adj. marsh areas. • (D) Comments are submitted that do not directly relate to item B but are relevant to the public interest. Marine Fisheries PO Box 769 Morehead City, NC 28557 April 13, 1977 MEMORANDUM TO - John Parker From Preston Pate Subject App. for State permit - NC DOT 3-30-77 Location - Pender County on an unnamed tributary of the AIWW near Belvedere Planta- tion subdivision. Investigative process - App. rec. Raleigh 3-31-77; Morehead 4-4-77. On-site visit made 4-8-77. Environmental setting - The project site is located on a small tidal unnamed creek which enters the AIWW between Hamstead and Holly Ridge. At the point of crossing for SR 1566, the creek is 25' wide and bordered on each side by a homogeneous stand of black needlerush (Juncus roemerianus). SR 1566 is presently an earthen causeway which spans the 200' wide marsh area. A narrow strip of small woody shrubs grows along each side of the causeway and on the slope of the road. Small patches of Spartina a'_terai=lora grow at each of the four corners of the bridge where it ad- joins the causeway. Project proposal - The applicant plans to upgrade the existing bridge and road faci- lities by replacing the timber bridge with one made of corrugated arches and widen- ing the causeway slightly. Fill material for road widening will be obtained from an outside source. Environmental impact - Widening the existing causeway as proposed on the attached plat will cause to be filled approximately 3200 sq.ft. of black needlerush. The results of this action will be a slight decrease in the production of nutrient ma- terial available to the adjacent creek. Approximately 200 sq.ft. of salt marsh cord- grass will also be filled with the same results. Some short term turbidity will oc- cur in the creek as a result of excavation to necessary accommodate the new bridge structure.
