This permit, issued on S/1/01 is u ct • compliance with the application (where consistent
with the permit), all applicable regulations, special condit •n al notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Installation of rock riprap and fill material along the road shoulder for
shoreline stabilization and shoulder widening
1) Fodrey Creek supports both spawning adult and juvenile anadromous fish. Therefore, no in-water work
shall be conducted from February 15 to September 1 of any year without the prior approval of the NC
Division of Coastal Management (DCM), in consultation with the NC Wildlife Resources Commission.
2) The authorized alignment of the proposed riprap must be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to •
initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will
require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected
start of construction. •

other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) Placement of riprap shall be limited to the areas as depicted on the attached workplan drawings. The
riprap and associated fill material must be clean and free from loose dirt or any pollutant except in trace
quantities. It must be of a size sufficient to prevent its movement from the site by wave or current
action. The riprap material must consist of clean rock or masonry materials such as but not limited to i•
granite or broken concrete.
4) The riprap shall not extend waterw ore than 8 1 feet from the normal water level at any point along
its alignment at the time of cons c • n.

7) The temporary placement or double handling of e :v. -. or fill materials within waters or vegetated
wetlands is not authorized.
8) All work along the canal bank shall be contained within turbidity curtains. This requirement may be
waived by DCM after consultation with the N.C. Wildlife Resources Commission.
9) No vegetated wetlands will be excavated or filled.
10) This permit does not authorize any excavation. If any excavation is required, a modification of this r
permit will be necessary. •
Sedimentation and Erosion Control
11) This project is in a High Quality Water Zone and must comply with the Design Standards in Sensitive
Watersheds, 15A NCAC 4B .0124.
12) In order to protect water quality, runoff from construction must not visibly increase the amount of
suspended sediments in adjacent waters.
13) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within fifteen days of project completion.
14) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, riprap, etc.).
NOTE: Because of the sensitivity of the adjacent waters and the potential for fill material to be eroded
away prior to becoming stabilized, the permittee is encouraged to implement all practicable
measures to adequately stabilize this area to prevent sediment from entering adjacent waters.

15) The permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of.the qr.. ure or work herein authorized, or if, in the opinion of the
Secretary of the Army or his,autho • _-• -presentative, said structure or work shall cause unreasonable
obstruction to the free naviga •. e navigable waters, the permittee will be required, upon due
notice from the Corps of Engine: to remove4�"yelocate, or alter the structural work or obstructions
caused thereby, without expense to the nit?d•Stafes. No claim shall be made against the United States
on account of any such removal or alte ti.on. ./
16) The authorized activity will not cause an unacceptable interference with navigation.

NOTE: The N.C. Division of Water Quality authorized the proposed project on 6/22/01 (DWQ Project
No. 01-0718) under General Water Quality Certification No. 3258 and the Tar-Pamlico Buffer
Rules.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No.
198000291 (COE Action ID. No. 200110774), which was issued on 7/16/01.

SUBJECT: Request for Authorization of shoreline stabilization on SR 1136 (Landing
Road)in Hyde County under a CAMA Major Permit
The North Carolina Department of Transportation proposes to stabilize 1050 feet
of the canal shoreline along Landing Road(SR 1136)with Class B rip-rap. The purpose
of this project is to stabilize the eroding shoreline that is the road shoulder to SR 1136.
This shoreline has been eroding due to wind tides about one foot per year. The rip-rap
will extend an average of 7.65 feet(maximum of 8.25 feet)from the shoreline and will
require about 247.3 cubic yards of stone to be placed below water level. Shoulder
construction will include rip-rap placed approximately one foot above high water level
and about 180 cubic yards of sand from one foot above high water level to existing
shoulder. Filter fabric will be placed between the rip-rap and the soil layer and the
shoulder will be planted with centipede grass.

retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh,NC 27611, (919)733-2698 within twenty (20)days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval.Please read your permit carefully prior to starting work and review all project plans,as approved.If
you are having the work done by a contractor,it would be to your benefit to be sure that he fully understands all permit -
requirements.

8. PROJECT SUMMARY:Applicant proposes to place rock riprap along the shoreline of the existing canal and
place fill material over the rock.

Project Setting
The applicant maintains a two lane asphalt road(SR1136)adjacent to a manmade canal that
is contiguous with Fodrey Creek in Swan Quarter,Hyde County,North Carolina. The existing road
is approximately 25 feet wide with shoulders that are 1 to 4 feet wide.The northern road shoulder is
adjacent to a manmade canal canal,and is experiencing erosion in several areas.In a few small areas,
unauthorized rock or masonry material has been placed along the shoulder to protect the road and to
address safety concerns.
The project area is bordered on the south side by numerous commercial fishing businesses.
Vehicular traffic on this road consists of commercial fishermen, trucks transporting seafood,
employees of the local businesses,and customers of the seafood houses.The north side of the project
area is a manmade canal. The opposite shore of the canal is predominately coastal wetland and is
vegetated with Juncus roemerianus, Spartina cynosuroides,Distichlis spicata,and Spartina patens.
The marsh covers several acres north of the project area.
There is a small undeveloped lot to the east of the project area. This lot is high ground
and is vegetated with a mix of upland grass species. There is a water control structure at the
culverted access to the lot. Immediately east of the lot is the town of Swan Quarter. The west end
of the project area borders an old hotel site. There is an existing dirt parking lot and the hotel
structure is still standing. The hotel has not been operational for several years, and is in disrepair.
Fodrey Creek classified SA ORW by the Environmental Management Commission and is not
open to shell fishing at this location.
Project Description
The applicant proposes to install 1050 ft of rock riprap an average of 7.65 ft waterward of
NWL in a manmade canal adjacent to an existing two lane road. The toe of the rock will be a
maximum distance of 8.25 ft waterward of NWL. The road shoulders will be widened by placing
filter fabric and sand over the riprap. Fill material will be brought to the site to create the wider
shoulders.
Anticipated Impacts
The project as proposed would impact 8,033 ftz of canal bottom will be filled by the proposed
rip rap. Localized short term turbidity increases will result from construction activities.

Reference the application of the NC Department of Transportation for a Department of the
Army permit to place rock riprap material along the shoreline of an existing man-made canal, on
property located off State Road 1136, adjacent to Fodrey Creek, in Swan Quarter, Hyde County,
North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
permit plans, which are a part of this permit.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States. No
claim shall be made against the United States on account of any such removal or alteration.
3. No vegetated wetlands will be excavated or filled.
4. The temporary placement or double handling of excavated or fill materials within waters
or vegetated wetlands is not authorized.
5. The riprap and associated fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will not be used.

of this letter verifies your acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be
granted until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of
a request for certification is a reasonable time for State action. Therefore, if you have not acted
on the request, or asked for an extension of time, by August 12, 2001, the District Engineer will
deem that waiver has occurred.

SUBJECT: NCDOT request for a CAMA/Dredge and Fill permit for SR 1136 improvements
on a manmade canal contiguous with Fodrey Creek in Hyde County,North
Carolina.
We have reviewed the information included in the package received from the Division of
Coastal Management. Our comments are provided in accordance with provisions of the Fish and
Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal
Area Management Act(G.S. 113A-100 through 113A-128).
We do not object to the issuance of the CAMA permit for this project provided that the
following conditions are include in the CAMA Permit:
L,...1e A11 riprap placed in-water should be free of pollutants and soil.
Ems`All work along the canal bank should be contained within turbidity curtains.
3. .e'"are should be taken to minimize soil falling into the water.
4. Fodrey Creek supports both spawning adult and juvenile anadromous fish, therefore,
7'we request that no in-water work occurs from February 15 to September 1.
NCDOT is expected use Best Management Practices for the protection of Surface Waters
( sedimentation and erosion control measures sufficient to protect aquatic resources.

Dear Ms. Shacochis:
You have our approval, in accordance with the attached conditions, to place fill material in 8033 square feet of canal bottom
(water) acres of wetlands or waters for the purpose of stabilizing canal shoreline along SR1136, as you described in your
application dated June 8, 2001. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3274. In addition,you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,you
must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the
future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to
be valid, you must follow the conditions listed in the attached certification. This approval shall expire when the corresponding
Nationwide Permit expires or as otherwise provided in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within
60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150E of
the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This
certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act If you have any

I have reviewed the application for a CAMA Major Permit submitted to this office by North
Carolina Department of Transportation in regards to the rules and regulations adopted by the CRC,
specifically NCAC 7H.0206, .0207, .0208 and .0209. My review indicates that the proposal appears to
be consistent with these regulations. However, the project as designed and shown on the plats provides
no method for preventing the earthen fill material from entering the adjacent waterbody. Therefore, if the
permit is issued, I recommend the following conditions be included:
Conditions:
1)Backfill material must be contained landward of the permitted riprap.
2) Filter fabric associated with riprap/backfill must be in place prior to the placement of any
I'backfill.
3)The riprap will not extend waterward more than 10 ft from the normal water level at any point
along its alignment.
4) The riprap must be free from loose dirt or any pollutant. It must be of a size sufficient to
prevent its movement from the site by wave or current action.
5) All backfill material will be obtained from a high ground source.
6) The riprap material must consist of clean rock or masonry materials such as, but not limited
to granite or broken concrete.

7) The fill material will be clean and free of any pollutants except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.
8)In order to protect water quality, runoff from the construction area must not visibly increase
the amount of suspended sediments in the adjacent water.
9)The permittee will maintain the authorized work in good condition and in conformance with
the terms and conditions of this permit. The permittee is not relieved of this requirement if he
abandons the project without having the permit transferred to a third party.

Dear Ms. Shacochis:
This office received a copy of your CAMA Permit application and supporting
information on June 6, 2001. Staff review of the plans and specifications has determined that the
project, as proposed, consists of activities that will not add any additional impervious surface to
the project site. The Director has determined that projects that are reviewed and approved by the
Division as not posing water quality threats from stormwater runoff should not be subject to the
stormwater management permitting requirements of 15A NCAC 2H.1000. For this reason, we
are informing you by way of this letter that your project will not require a stormwater
management permit.
Please keep in mind that this determination does not affect your legal requirements to
obtain other permits which may be required by the Division of Water Quality, the Division of
Land Resources, Coastal Area Management Act or any other Federal, State or Local
Government. Any future modifications to the project may require an additional review from this
office to assure that stormwater impacts are not an issue.

I disagree with DOT on a few points. Yes, the shoulder is very narrow on
this road, and I can see why they want to widen it. The road is not very high,
but it is higher than the water level. The low elevation supports my
recommendation that the riprap be elevated to provide some protection to the
fill material. When the water level rises, there is nothing to keep that new
shoulder width from washing away, into the aquatic system, where we don't like
added dirt. I recommended a 2 :1 slope with the base of the rock out a little
further than proposed to allow the added height. I am not an engineer, but I
believe that without a method to stabilize the earthen material, they might as
well not do the work. It just won't stay.

I never suggested that they remove the earthen fill from the proposed project.
I recommended that there be some riprap waterward of the earthen fill. This
gives drivers the proposed sod area plus a row of rock before they hit the
canal instead of just the dirt. The riprap could conceivably add to safety
because it would be a little higher than the earthen shoulder, creating a
slight bump that might keep a car out of the water.

We permit 2 :1 slopes for shoreline stabilization frequently, and this slope is t 1`d„^q,
accepted as stable. DOT has placed rock on steeper slopes in other locations,
but we are not requesting a steeper slope here. And, I agree. Any rock added (#.\ •
here will change the width of the canal. That's an impact we can live with, if

No more so than trying to mow an eroding bank.
Bottom line, unless the fill material is stabilized, it will wash into the
adjacent waterbody, and DOT will be responsible for allowing the discharge of
unconfined earthen fill into an adjacent waterbody. I have written NOV's for

DOT called me on Friday to ask for a status report on their CAMA permit
application for SR 1136 in Hyde County (All agency comments have been
received - we are awaiting the federal comments from Raleigh Bland) . I
also notified DOT that a CAMA permit for SR 1234 in Tyrrell County had
just been issued. Both projects are very similar. However, SR 1234
proposes that the backfill is placed entirely behind the riprap, whereas
SR 1136 proposes backfill on top of the rip rap. Please let me know if
you have any thoughts on the attached e-mail from Kristen Shacochis. I
asked her to write this e-mail as a follow-up to my telephone
conversation with her on Friday. Thanks.

have with SR 1136 in Hyde County shoreline stabilization project.
I have discussed these concerns with the NC DOT engineers and
they had these remarks to make about the agencies comments.
The backfill along the shoreline was recommended to be placed
behind the rip rap, rather than exposed close to the water line.
Although SR 1234 and SR 1136 are similar rip rap projects, they
have different environmental and engineering constraints. The
shoulder on SR 1136 is very narrow between the road and the
canal, sometimes as little as 1 foot versus on SR 1234 where
there is a minimum of a 6 foot shoulder. SR 1234 is a very high
road (crown of road is about 9 feet from marina basin bottom)
verses SR 1136 is almost level with the water (road is about 3
feet above canal bottom) . The purpose of stabilizing SR 1234 is
to prevent further storm damage whereas on SR 1136 the main
concern is adding a road shoulder that has resulted due to
previous storms. Both road will use the standard practice of

using large size of rip rap stone in a 2:1 slope to one foot
above water level and then backfill. The problems with having
backfill behind the rip rap as requested on SR 1136 is (1) road
safety, (2) stone stabilization and (3) maintenance concerns.
1) At the time that this permit application was sent, SR 1234 in
Tyrrell county was also being reviewed by the agenices. SR 1234

SUBJECT: Request for Authorization of shoreline stabilization on SR 113o (Landing
Road) in Hyde County within the Tar-Pamlico Buffer
The North Carolina Department of Transportation proposes to stabilize 1050 feet
of the canal shoreline along Landing Road(SR 1136)with Class B rip-rap. The purpose
of this project is to stabilize the eroding shoreline that is the road shoulder to SR 1136.
This shoreline has been eroding due to wind tides about one foot per year. The rip-rap
will extend an average of 7.65 feet(maximum of 8 25 feet)from the shoreline and will
require about 247.3 cubic yards of stone to be placed below water level_ Shoulder
construction will include rip-rap placed approximately one foot above high water level
and about 180 cubic yards of sand from one foot above high water level to existing
shoulder. Filter fabric will be placed between the rip-rap and the soil layer and the
shoulder will be planted with centipede grass.
Since this project is within the Tar-Pamilco watershed,NC DOT is requesting
authorization from DWQ for shoreline along SR 1136. I have enclosed a vicinity map,
plat drawings pictures of the site, and a check to cover all permit costs. If you have any

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,

USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography,building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
NC DOT cannot repair the road shoulder and stabilize the canal bank without impacting
the canal. The road shoulder must be repaired and stabilized for road safety reasons, tides
and previous storms have damaged much of this canal bank and there is less than 2 feet of

road shoulder in some areas. Rip rap is the preferred stabilization technique because of
the steepness of the canal bank. In order to revegetate the area, the slope would need to be
flatter. This is unfeasible because the impact to this "Public Trust" AEC (CAMA
jurisdiction) would cause it to be unaccessable to small boats. and it is one of the primary
canals in the network of canals that surround the Swan Quarter area.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500. mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE — In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strmaide.html.

2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that

will be notified early in the review process by the 401/Wetlands Unit if payment into the
