Any violation of these terms may be subject to fines,imprisonment or civil action; or may cause the permit to be null and void. Installation of Riprap along road shoulder for Shoreline Stabilization 1) This minor modification authorizes the stabilization of approximately 70 linear feet of shoreline located in and adjacent to a man-made canal off Fodrey Creek and Swan Quarter Bay, at a 90-degree turn along the shoulder of SR 1136 (Landing Road). NOTE: The disturbance includes approximately 35 square feet of high ground, 75 square feet of Coastal Wetland, and 380 square feet of Estuarine and Public Trust Waters. 2) Due to the presence of anadromous fish, no in-water work shall be conducted from February 15th to September 1st of any year without prior approval of the NC Division of Coastal Management (DCM), in consultation with the NC Wildlife Resources Commission (WRC). (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. It must be of a size sufficient to prevent its movement from the site by wave or current action. 6) The riprap material must consist of clean rock or masonry materials such as but not limited to granite or - broken concrete. 7) The authorized structures and associated activity must not cause an unacceptable interference with navigation. 8) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 9) This minor modification must be attached to the original Major Permit No. 96-01, which was issued on 8/1/01, and both documents must be readily available onsite when a Division of Coastal Management representative inspects the project for compliance. 10) All conditions and stipulations of the original permit remain in force under this modification unless specifically altered herein. NOTE: This permit does not eliminate the need to obtain any additional state, federal, or local permits, approvals, or authorizations that may be required. The project plan is to stabilize 70 linear feet of shoreline along SR 1136 in Hyde County with rip rap to prevent further soil losses and future road undermining due to erosion. Placement of riprap will extend an average of 10 feet and a maximum of 14 feet into the canal from the existing shoulder, creating a 6-foot shoulder with 2:1 slope to the canal bottom. The average depth of riprap will be 3 feet. Calculating the volume of riprap fill using these dimensions results in approximately 77 cubic yards of fill. This filling action will impact around 98 square feet (0.002 acres) of wetland vegetation. Please draft the $100.00 application fee using WBS element 1.204811. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113- 229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor,it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. Mathis, DOT Project Coordinator/Field Representative SUBJECT: Request for a Minor Modification of CAMA Major Permit# 96-01 DATE: March 29, 2004 On March 26, 2004, the Elizabeth City District Office received a request from the North Carolina Department of Transportation (NCDOT), to modify CAMA Permit #96-01. The Department of Transportation is proposes to stabilize approximately 70 linear feet of shoreline along SR 1136. The project area is located in, and adjacent to, a man-made basin off Fodrey Creek and Swan Quarter Bay, in Swan Quarter, Hyde County. State Road 1136(Landing Road) accesses the areas local fish/seafood houses that ship to outside communities. The road accessing these businesses follows along the shoreline of an adjacent basin, making a 90-degree turn that large trucks can no longer make with out crossing through the waterward edge of the basin. Trucks accessing the area have damaged wetland vegetation along the fringe of the basin and road, and undermined the road shoulder and pavement. Located adjacent to the project area, approximately 12' waterward of NWL, are nine creosote pilings. According to NCDOT the pilings delineate where the road shoulder was located a number of years ago. The shoreline gently slopes into the adjacent water body creating an opportune location for Spartina alterniflora growth. According to the plans submitted there are approximately 98 square feet of Spartina alterniflora along the shoreline where the stabilization activities will occur. Staff estimates the amount of wetland vegetation to be slightly less than 75 square feet in area, and subject to constant disturbance by trucks hauling in and out of the docks. The adjacent water bottom is fine silt muck with an average depth of three feet below normal water level (NWL), measured along the waterward toe of the proposed riprap alignment. All fill above and below NWL will be rock riprap. No dirt fill is being proposed in conjunction with this project. The placement of the riprap, if approved, will result in the loss of a marginal 75 square foot Coastal Wetland fringe. • Based on the information provided, it appears that the total area of disturbance will be approximately 490 square feet. The disturbance within the Division of Coastal Management 's Areas of Environment Concern (AEC)will include approximately 35 square feet of high ground, 75 feet of Coastal Wetland, and 380 square feet of Estuarine and Public Trust Waters. The project area is located in water classified as SA and Outstanding Resource Water, and is within a designated PNA. There is no evidence of submerged aquatic vegetation within the proposed project area. I would like to recommend the following conditions be added to the existing CAMA Major Permit#96-01: 1) All conditions and stipulations of the previous authorizations under permit#96-01, and be readily available on site when the Division representative inspects the project for compliance. 2) The riprap will not extend waterward more than 14' from the water level at any point along its alignment at the time of construction. 3) No excavated or fill material will be placed at any time, in any marsh or surrounding waters, outside of the alignment of the fill area indicated on the work plans dated as received in the Elizabeth City District Office on March 26, 2004. 4) The authorized riprap alignment must not cause an unacceptable interference with navigation. 5) In issuing this permit, the State and Federal Governments do not assume any liability for the following: (a) Damages to other permitted or unpermitted activities or structures caused by the authorized activity; and, (b) Damage claims associated with any future modification, suspension, or revocation of this permit. NOTE: The permittee and/or his contractor are urged to meet with the Field Representative to project initiation. NOTE: The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit.
