SR 1234 (Taylor Beach Road)near Columbia , as requested in the permittee's application dated 5/7/01. • including attached workplan drawings (2), dated 4/26/01 • This permit, issued on 7/20/01 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Installation of rock riprap along the road shoulder 1) The authorized alignment of the proposed riprap must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The riprap will not extend waterward more than 13 feet from the normal water level at any point along its alignment at the time of construction. 3) No vegetated wetlands will be excavated or filled. (See attached sheets for Additional Conditions) _ This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission. date. Department of Transportation Permit#91-01 Page 2 of 3 ADDITIONAL CONDITIONS 4) No excavation will occur within waters of the United States. 5) Filter fabric associated with riprap/backfill must be in place prior to the placement of any backfill. 6) Placement of riprap shall be limited to the areas as depicted on the attached workplan drawings. The riprap material must be free from loose dirt or any pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. The riprap material must consist of clean rock or masonry materials such as but not limited to granite or broken concrete. 7) All backfill material will be obtained from a high ground source and confined behind the permitted riprap. No unconfined backfill may be discharged into estuarine or public trust waters. The fill material will be clean and free of any pollutants except in trace quantities. 8) The temporary placement or double handling of excavated or fill materials within waters or vegetated : wetlands is not authorized. Sedimentation and Erosion Control • 9) In order to protect water quality, runoff from construction must r of visibly increase the amount of suspended sediments in adjacent waters. 10) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.). 11) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion within thirty days of project completion. General 12) The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized,.or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 13) The authorized activity will not cause an unacceptable interference with navigation. NOTE: The permittee and/or his contractor is strongly encouraged to contact a representative of DCM's Washington District Office at (252) 946-6481 to request a preconstruction conference prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. N.C. EASLEY LYNDO TIPPETT GOVERNOR SECRETARY May 7, 2001 Steve Trowell Division of Coastal Management Washington Regional Office 943 Washington Square Mall Washington,NC 27889 SUBJECT:Major Permit for Road Shoulder Stabilization using rip-rap on SR 1234 (Taylor Beach Road) Tyrrell County Dear Mr. Trowell The Department of Transportation proposes to stabilize the shorebank with rip- rap, damaged by previous storms, on Taylor Beach Road(SR 1234),Tyrrell County at the Canal/Marina crossing at the existing pipe. Shoulders are less than 6 feet in some places and are badly eroded and rounded. The pipe will not be replaced by this project. The purpose of this project is to have 10 foot pavement, 6 foot of earth shoulder at a 1": 1' fall, and 1.5:1 side slopes lined with"Class I"rip-rap to improve road safety. The rip- rap will extend approximately 115 feet in length on the Marina side of the road and average a distance waterward of 10 feet with a maximum distance waterward of 13 feet. Because of the elevation and steep slope(elevation= 10 feet),no wetlands are impacted but approximately 0.053 acres of existing high quality waters are impacted with rip-rap. The NC DOT is requesting that the proposed project be authorized under the Coastal Area Management Act major permit. The original (buff-colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings,P.O. Drawer 11666, Raleigh,NC 27611, (919)733-2698 within twenty(20)days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the fmal decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance require additional approval.Please read your permit carefully prior to starting work and review all project plans,as approved.If you are having the work done by a contractor,it would be to your benefit to be sure that he fully understands all permit requirements. From time to time,Department personnel will visit the project site.To facilitate this review,we request that you complete and mail the enclosed Notice Card just prior to work initiation.However,if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. PROJECT SUMMARY: Applicant proposes to refurbish and widen an existing road shoulder to 6' in width along 115' of roadway adjacent a man made canal and stabilize the road shoulder with riprap. North Carolina Department of Transportation SR 1234 at Taylors Beach Tyrrell County Project Setting The project site is located on SR 1234 in Tyrrell County at Taylors Beach near Columbia, North Carolina. Taylors Beach is a residential water front community with a canal system bisected by SR 1234. A relatively undeveloped one acre parcel located in the central portion of the community serves as a base for several commercial fishing operations. At the proposed project site SR 1234 is a 20'wide paved roadway(two 10'travel lanes)that is bordered by the canal system on both sides for approximately 200'. The road shoulders on either side are less than 6' in width and have experienced some scouring over time. A 96" culvert under SR 1234 maintains flow to the Albemarle Sound. The Division of Coastal Management jurisdiction only applies to the northern half of the canal system. The top of the road shoulder slope is approximately 5.5'above the normal water level in the canal. The road shoulder is vegetated with domestic grasses. The northern half of the canal system at the project site is 60'wide and has three small docks located on the opposite shore. Water depths in the canal are between 4'to 6'. The Albemarle Sound is classified as SB in the vicinity of the project site. Project Description The applicant proposes to refurbish and widen the existing road shoulders to 6' and stabilize the side slope with rip-rap for a distance of 115' along the canal. The new road shoulder will have a side slope of 1.5:1. The rip-rap alignment will average 10' waterward of the normal water level with a maximum distance waterward of 13'. Project Impacts The project as proposed will result in the filling of 1,150 ft2 of canal bottom and 460 ft2 of uplands. There will be some localized short term turbidity during installation. Apparently I was not clear enough in my statement about "plats drawn on graph paper are unacceptable". Please understand that we will continue to return applications with plats drawn on graph paper. Reasons for this include the distraction created by the clutter of printed verticle and horizontal lines and drawn verticle and horizontal lines. Photocopies of plats drawn on graph paper are difficult to follow and understand and will not be accepted. Attached to this letter is a copy of North Carolina Administrative Code T15A: 07J.0200. I encourage you to carefully study this section "Application Process" particularly subsection 7H.0203 "Preparation of Work Plats". I ask that you express to the project engineers that they become familiar with this administrative code and provide the necessary information on the permit plats in the proper manner outlined in subsection 7H.0203. Please proof read the application for errors to avoid mistakes such as placing a"N/A" on an applicable application section. The site location map needs a title block that ties in the map to the rest of the application package. The plan view plat needs to show the limits of construction. The plan view plat needs to clearly show the canal with the normal water level(NWL)labeled,all areas to be excavated or filled and all areas to be covered with rip rap. The cross section shows a 6'road shoulder that will require some earthen fill material to be hauled to the site. The areas to be filled need to be shown on the plan view. If the dashed line on the plan view plat indicates the edge of pavement(the dashed line is not labeled but I am assuming it represents the edge of pavement)then you need to show the rip rap coming up the road shoulder stopping 6'from the edge of pavement. If I review the plan view it appears to me that the rock will be placed beginning at the canal's edge, extending 10' waterward which contradicts what the profile view shows with the area to be stabilized with rip rap extending up the embankment with a 6'road shoulder. The plan view plat and the profile view need to show both sides of the canal. All of the work shown on the plan view needs to be to scale.
