be subject to fines, imprisonment or civil action; or ysiu the permit to be null and void.
Installation of rock riprap along the road shoulder
1) The authorized alignment of the riprap must be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of any construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, will require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
2) No vegetated wetlands will be excavated or filled.
3) No excavation will occur within waters of the United States.
4) Filter fabric associated with riprap/backfill must be in place prior to the placement of any backfill.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
5) The riprap will not extend waterward more than 10 feet from the normal water level at any point along
its alignment.
6) All backfill material will be obtained from a high ground source, and confined behind the permitted
riprap.
7) No unconfined backfill may be discharged in estuarine or public trust waters.
8) The fill material will be clean andf af,any pollutants except in trace quantities.
9) Placement of riprap shall be limited to the—aIeas as depicted on the attached workplan drawings. The •
riprap material must be free from loose irt'or any pollutant. It must be of a size sufficient to prevent its •
movement from the site by wave or cu nt action. The riprap material must consist of clean rock or •
masonry materials such as but not limited to granite,,.or broken concrete.

Sedimentation and Control
11) In order to protect water quality, runoff from the construction area must not visibly increase the amount
of suspended sediments in adjacent waters.
12) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, sand fence, etc.).
General •
13) The permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable
obstruction to the free navigation of the navigable waters, the permittee will be required, upon due
notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions
caused thereby, without expense to the United States. No claim shall be made against the United States
on account of any such removal or alteration.
14) The authorized activity will not cause an unacceptable interference with navigation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required. •
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water •
Quality Certification No. 3274 (DWQ Project No. 00-1573), which was issued on 2/2/2001.

Dear Mrs. Wheeler,
NCDOT is making application for a CAMA Major Permit to stabilize approximately
910' of shoreline on SR 1182(Bayside Shores Road). Backfill will be placed to fill the
eroded areas and fabric will be placed prior to RipRap placement. Work will not extend
10' waterward of the existing shoreline. Prior to beginning work we would like to
schedule a preconstruction meeting and get an alignment staked by CAMA. Please let me
know if there is additional information required.

The enclosed permit constitutes authorization under the Coastal Area Management Act,and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff-colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval.Please read your permit carefully prior to starting work and review all project plans,as approved.If
you are having the work done by a contractor,it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time,Department personnel will visit the project site.To facilitate this review,we request that you
complete and mail the enclosed Notice Card just prior to work initiation.However,if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

Project Setting
The applicant maintains a two lane asphalt road(SR1182)adjacent to a manmade canal that
connects to Chocowinity Bay and the Pamlico River near Washington in Beaufort County,North
Carolina.The existing road is approximately 25 feet wide with shoulders that are 3 to 18 feet wide.
The road was constructed on a filled causeway through a coastal wetland and is elevated
approximately 4 ft above the normal water level (NWL) in the canal. The eastern road shoulder
drops sharply to the canal,and is experiencing erosion in several areas.In 1990,NCDOT was issued
a Notice of Violation(#90-22B)for unauthorized placement of broken concrete and dirt along the
road shoulder in an attempt to retard the erosion.
The project area is bordered on the north and south sides by manmade canals that run
adjacent to developed residential areas.The canal banks are stabilized on most of the developed lots,
and are vegetated with lawn grass immediately adjacent to the bulkheads. There is a 20 ft by 4 ft
fringe of Spartina cynosuroides in the northeast corner of the project area between an existing
bulkhead and a small area of broken concrete in a subsided area of NCDOT's road shoulder.
The east and west sides of the project area are predominately coastal wetland and are
vegetated with Spartina cynosuroides,and a fringe of Spartina patens.The road shoulders are 3 to 18
ft wide and are vegetated with various upland grass species.
The Pamlico River and Chocowinity Bay are classified SB NSW by the
Environmental Management Commission and are not open to shell fishing at this location.
Project Description
The applicant proposes to install 910 ft of rock riprap an average of 5 ft waterward of NWL
in a manmade canal adjacent to an existing two lane road. The toe of the rock will be a maximum
distance of 10 ft waterward of NWL.The road shoulders will be widened to an average of 8 ft from
the edge of the riprap to the edge of pavement. Fill material will be brought to the site to create the
wider shoulders.
Anticipated Impacts
The project as proposed would impact 6,905 f12. Approximately 4,550 fl of canal bottom and
an 80 ft2 coastal wetland fringe will be filled by the proposed rip rap. Approximately 2,275 ft2 of
highground will be filled to widen the existing road shoulder. Localized short term turbidity
increases will result from construction activities.

I have reviewed the application for a CAMA Major Permit submitted to this
office by North Carolina Department of Transportation in regards to the rules and
regulations adopted by the CRC, specifically NCAC 7H.0206, .0207, .0208 and.0209.
My review indicates that the proposal appears to be consistent with these regulations. If
the permit is issued, I recommend the following conditions be included:
Conditions:
1) prap will not extend waterward more than 10 ft from the normal water

2) • er fabric associated with riprap/backfill must be in place prior to the
acement of any backfill.
3) confined backfill may be discharged into estuarine or public trust waters.
4) The riprap must be from loose dirt or any pollutant. It must be of a size
sufficient to prevent its movement from the site by wave or current action.

ehind the permitted riprap.
6)The riprap material must consist of clean rock or masonry materials such as,

7) The fill material will be clean and free of any pollutants except in trace

Dear Mr. Huggett:
Reference the application of NC Department of Transportation for a Department of the Army
(DA) permit to install rock riprap material along an existing road shoulder, on property located
off State Road 1182, adjacent to a manmade canal to Chocowinity Bay,near Washington, in
Beaufort County,North Carolina.
The Federal agencies have completed review of the proposal as presented by the application
and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
permit plans, which are a part of this permit.
2. The permittee understands and agrees that, if future operations by the United States
require the removal,relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required,upon due notice from the Corps of Engineers,to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States. No
claim shall be made against the United States on account of any such removal or alteration.
3. No vegetated wetlands will be excavated or filled.

4. The temporary placement or double handling of excavated or fill materials within
waters or vegetated wetlands is not authorized.
5. The fill material will be clean and free of any pollutants except in trace quantities.
Metal products, organic materials, or unsightly debris will not be used.
6. The authorized activity will not cause an unacceptable interference with navigation.

accomplished by the North Carolina Division of Coastal Management. Comments from Federal

State-Federal positions or policies, the final action taken on your application by the State will
result in your receiving written notice from us that your application is consistent with the general

of this letter verifies your acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be
granted until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt
of a request for certification is a reasonable time for State action. Therefore, if you have
not acted on the request, or asked for an extension of time, by March 19, 2001, the District
Engineer will deem that waiver has occurred.

APPROVAL of 401 Water Quality Certification
Dear Mr. Johnson:
You have our approval, in accordance with the attached conditions. to place fill 0.11 acre of wetlands in
order to stabilized an existing road shoulder to protect SR 1182 from erosion in Beaufort County. as described in
your application received by the Division of Water Quality on December 21, 2000. After reviewing your
application, we have determined that this fill is covered by General Water Quality Certification Number 3274.
This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal
Management. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application for a new
certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter
and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the
future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For
this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition
conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O.
Box 27447, Raleigh. N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask
for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act. If you have any questions, please telephone John Dorney at 919-733-9646.

DATE: January 18, 2001
Land Use Plan Consistency: The project proposal is consistent with the Beaufort County
1997 Land Use Plan certified by the CRC on November 20,
1998 provided all state and federal agencies regulations are
complied with.
Overview: The Department of Transportation proposes to place 910 ft. of riprap along SR 1182's road
shoulder. The site is adjacent a manmade canal that connects to Chocowinity Bay and Pamlico River.
Anticipated impact associated with the proposal includes the filling of about 4,550 sf. of canal bottom and
80 sf. of coastal wetlands fringe.
Basis for Determinations: The Beaufort County Land Classification Map identifies the site area as at
the juncture between the "Urban Transition" and "Rural w/Services" designations. Since the site area is
also within a Coastal Wetlands area the site also qualifies for the "Conservation" classification. (LUP
page III-2.) Beaufort County has no policy statements specifically for riprap-ing areas however related
policy for bulking is as follows:

This letter is in reference to the application for a CAMA Major permit received
by this office on 20 November 2000 for shoreline stabilization adjacent to SR 1182 on a
manmade canal contiguous with Chocowinity Bay near the city of Washington in Beaufort
County, North Carolina. I have reviewed the application and have found the following
items that need to be addressed prior to accepting the application as complete.
Overall
The combined processing fee for a project involving more than 150 ft of stream impact
is$475. Please submit a check for this amount payable to NCDENR, and we will forward
the appropriate application fee to the Division of Water Quality for the 401 Certification.

A page of the application form is missing from the package. Questions 4 and 5 were not
included with the submitted application.

The location map is not labeled, has no North arrow, and has no title.
The plan view drawing is not numbered. DCM-MP3 states that wetlands will be filled, however, none
are shown on the drawing.
The cross-section drawing is not numbered.
I am returning the entire application package, including your $400 check (#8263), to you so that
these items can be addressed. As soon as you can provide this information to me and I can accept the
application as complete, the 75-day processing time can begin. When the permit is issued, I will be glad
