Bridge Construction •
1) Debris resulting from demolition of the existing bridges, including deck components, shall not enter
wetlands or waters of the United States, even temporarily.

2) All excavated materials and debris associated with the removal of the existing bridge will be disposed of

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of any excavated or fill material within waters or vegetated
wetlands is not authorized, with the exception of that associated with the water line installation. This
condition also applies to the removal of the existing bridge structure.

8) In accordance with environmental commitments made within the Categorical Exclusion document dated
7/28/97, all standard procedures and measures including NC DOT's Best Management Practices for
' Protection of Surface Waters and NC DOT's Stream Crossing Guidelines for Anadromous Fish Passage
will be implemented, as applicable,to avoid or minimize environmental impacts.
, 9) In accordance with environmental commitments made within the Categorical Exclusion document dated
7/28/97, construction will be scheduled to avoid the necessity of instream activities during the spring
months (February 15 —June 15)to minimize the impacts to anadromous fish passage.

7/28/97, waste and borrow sites will be kept out of wetland areas. -
Water Line Installation

natural vegetation of the impacted areas.

Mitigation
16) In order to further reduce wetland impacts at the site, the old bridge approaches shall be restored to
forested wetlands by removing fill from the old approaches to wetland elevation at pre-construction
contours and revegetating with native wetland species.

Subject: CAMA Major Permit for Replacement of Bridges 118& 119 over Northeast Creek
overflow&Northeast Creek on NC 1406. Onslow County: Federal Aid Project No.
BRSTP-1406(2). State Project No. 8.2260701. T.I.P No. B-3215.
The North Carolina Department of Transportation (NCDOT)proposes to replace bridges Nos. 118 and
119 over the Northeast Creek overflow and Northeast Creek respectively. The project consists of
replacing the existing bridges on new alignment north of the existing bridges with the centerlines offset
approximately 21 ft. Approach roadways will have a 36 ft travelway with 8 ft shoulders, including 4 ft
paved shoulders and 11 ft shoulders where guardrails are warranted. The approach work will extend
approximately 950 ft northwest of Bridge No. 118 and 1350 ft southeast of Bridge No. 119 to the existing
three lane roadway section northwest and southeast. The proposed project will be built in phase
construction. Construction sequence will consist of construction of the new alignment while maintaining
traffic on the existing road.
STREAM/WETLAND IMPACTS
Stream impacts associated with the project will consist of the permanent fill of 130 linear feet of the
overflow channel for Northeast Creek a Class "SC-NSW" stream (Index No. 19-16(0.5), 8/1/91) and 8
feet of temporary stream impacts resulting from a water line installation. Additionally, the deck and
bridge railings for the superstructure for Bridges No. 118 and No. 119 are composed of concrete, while
the substructure is composed of timber. Both the bridge rail and substructure will be removed without
dropping them into Waters of United States, however, temporary fill resulting from dropping deck
components into waters of the U.S. will be 16 yd' and 17 yd3 respectively.
Permanent impacts to jurisdictional wetlands will result from fill, excavation,and mechanized clearing.
Total permanent wetland impacts will be 0.615 acres. Temporary wetland impacts will result from
excavation (0.7 acres)and fill (0.7 acres)associated with the installation of a new water line. Total
temporary wetland impacts will be 0.14 wetland acres. A summary of all permanent stream and wetland
impacts is included in Table 1 and the attached permit drawings.

AVOIDANCE AND MINIMIZATION
In efforts to reduce wetland impacts,NCDOT has incorporated the following avoidance and minimization
measures:
1) Reductions of the proposed roadway fill slopes from 3:1 to 2:1.
2) Excavation of the new overflow channel from only the west bank to minimize impacts due to
mechanized clearing. The channel construction sequence will include placement of a
temporary dike in the overflow channel, backfilling the existing channel, and cutting the new
channel. This will take approximately six weeks.
3) All waste and borrow sites will be kept out of wetlands to eliminate additional wetland
impacts.
4) Removal of lateral ditches from wetlands areas.
THREATENED AND/OR ENDANGERED SPECIES
As of December 20, 1999, there are 11 species that are listed as Endangered(E), Threatened(T), or
Threatened Due to Similarity of Appearance T(S/A) for Onslow County,North Carolina. Additionally, a
January 10,2000 review of the North Carolina Natural Heritage Program (NCNHP)database indicated
that there is no known occurrence of the eleven federally protected species within 1.0 mile of the project
area. Relevant information for those species listed for Onslow County is included in Table 2.

NEPA DOCUMENT STATUS /REGULATORY APPROVALS
The project is being processed by the Federal Highways Administration as a"Categorical Exclusion"
(CE) in accordance with 23 CFR 771.115(b). The project, however, occurs in a Coastal Area
Management Act(CAMA)designated county and does not meet the criteria for a•General CAMA bridge
replacement permit. This letter therefore is a request for a CAMA Major Permit.
Attached for your information is a copy of the CAMA Major permit application, preconstruction
notification form(PCN), CE planning document, permit drawings, Wetland Delineation Sheets, Wetland
Rating Sheets, and a check for$250(See Attachments). Additionally, copies of the letters sent to the
property owners and the certified mail receipts are attached. The signed return receipts from these
property owners will be forwarded to you as soon as possible. By copy of this letter,NCDOT also
requests Nationwide permits 23 and 12 from the United States Army Corps of Engineers(USACOE), and
the appropriate 401 General Certifications from the North Carolina Division of Water Quality(DWQ).

8. PROJECT SUMMARY: The applicant is the N.C. Department of Transportation. The proposal is to
replace the two bridges, #'s 118 and 119 over Northeast Creek, on State Road 1406 (Piney Green Rd.) in
Jacksonville, NC. The bridges will be replaced slightly north of the existing alignment, with a water line
installed under the creek and south of the eastern approach.

9. PROJECT DESCRIPTION:
The site of this proposal is State Road 1406 (Piney Green Rd.) in Jacksonville, NC, where
Bridges #118 and#119 cross Northeast Creek overflow (#118) and Northeast Creek (#119). This
is in the area of Pumpkin Center. The site is approximately +13' msl, and is flanked with
wooded swamp on either side. The proposal is to replace the existing bridges slightly north of
the existing alignment, with an additional width of 28' to allow for 3 lanes. The approaching
roadway will also be widened to three lanes, with a future projection of widening Piney Green
Road to five lanes. This area is primarily residential, and undeveloped wooded swamp and
forest. The roadway is extremely heavily traveled, with a traffic volume of±20,000 vehicles per
day, and a projected volume of 26,000 vehicles per day.
The site consists of a 24' wide creek body at Bridge#119 (sheet 6 of 12 in the application), and a
18' to 20' wide creek body at Bridge #118 (sheet 4 of 12 in the application). There is a large
amount of delineated Section 404 Wetland in the form of wooded swamp on the site. This
system consists of Tulip Poplar, Loblolly Pine, Red Maple, Sweet Gum, Laurel Oak, Chinese
Privet, Bald Cypress, Green Ash, Black Gum, Red Bay, White Bay, Soft Needle Rush, Catbrier,
and American Elm. The adjacent uplands are forested, and are vegetated primarily with various
pines, Tulip Poplar, Red Bay, Water Oak, and Groundsel Bush. Soils in the area are loans and
sandy loans. Northeast Creek is inland waters at the project site, and is classified SC-NSW by
the Division of Water Quality. The area is closed to shellfishing, and is not designated as
primary nursery area by the North Carolina Wildlife Resources Commission. The creek
overflow at Bridge #118 effectively ends at the project site, terminating in a stagnant pool. The
City of Jacksonville Land Use Plan designates the project area as Developed, with all areas lying
within CAMA Areas of Environmental Concern designated Conservation.
The Department of Transportation proposes to replace both bridges slightly north of the existing
alignment, install a new water line, and relocate the channel of the creek overflow at site #118.
Both bridges are currently 52' x 25' in size, with a 10.5' clearance on #118, and a 9.5' clearance
on#119. Normal low water at both sites is ±-2'. The proposed bridges are to be 52' in width, and
80' across for #118 and 100' across for#119. Both are to be cored slab, with two sections of 40'
and 50', with a bent in the middle. There will be 10.5' clearance for both. Both will be stabilized
on the north side with class I rip rap.
The 24" water line will be installed below the creek bed and to the south side of the roadway,
approximately 5' below grade. This installation will require the temporary excavation of .07
acres of wooded swamp and stream, and the temporary fill of .07 acres of the same, through the
side cast methodology to be employed for temporary spoil storage.
The creek in the overflow area, #118, is to be re-channelized to the main channel, some 90' from
the bridge. The application states that 65' will be re-channelized, however, this was calculated
from the end of the existing creek bed. The entire 90' x 20' will be excavated to the point of
intersection with the existing creek. This will require the excavation of approximately 1800
square feet of wooded swamp, and the filling of approximately 5040 square feet of water and
wooded swamp where the existing creek bed terminates. The intent of this aspect of the project
is to improve water quality and navigation.

The approaches to the bridge will be widened to 36', with 2:1 side slopes to minimize impacts.
The shoulders will be 8', except where guardrails are warranted, where the side slopes will be 11'.
The approaches will extend to 950' northwest of Bridge #118, and 1350' southeast of Bridge
#119.
Construction of this infrastructure is to be accomplished in stages, accommodating existing
traffic during construction.
10. ANTICIPATED IMPACTS:
As proposed, this bridge replacement with approach work, channel re-alignment, and water line
installation will result in the following impacts: Approximately 4704 square feet of wooded
swamp will be excavated, 6490 square feet of same will be filled, and 21,693 square feet of the
same will be compacted through mechanized clearing. Approximately 1089 square feet of open
water will be filled and 2288 square feet of same will be usurped by the bridges. Approximately
26,136 square feet of high ground will be graded and filled for the roadway and approaches.
Approximately .14 acres of the wetland impacts are expected to be temporary, as the water line
ditch will be returned to grade, and all temporarily stored spoil removed. There is a high
probability of turbidity to be expected during the construction of this project. Stringent
sedimentation/erosion control measures can minimize this. While the use of 2:1 side slopes
limits direct wetland fill, it is conducive to a large amount of indirect fill, due to the fact that silt
fencing is an inadequate measure to control slopes this abrupt.
Congestion and traffic hazards should be reduced with the widening of the bridges and
approaches to allow for turn lanes. Navigation under the bridges will be eased slightly with the
reduction of the two bents per bridge to a single bent per bridge.
The collective disturbance area for the project is 1.43 acres.

material in 0.149 acres of wetlands and 130 linear feet of streams. Moreover, this certification authorizes
• the excavation in 0.108 acres of jurisdictional wetlands and mechanical clearing in 0.498 acres of
jurisdictional wetlands. The authorized impacts are for the purpose of replacing Bridges 118 and 119 over
the Northeast Creek on SR 1406 in Onslow County. The project should be constructed in accordance with
your application dated January 28,2000. After reviewing your application,we have decided that this fill is
covered by General Water Quality Certification Number 3112. This certification corresponds to the
Regional Permit Number 198000291 issued by the Corps of Engineers,and CAMA Major Permit issued by
the Division of Coastal Management. In addition, you should acquire any other federal, state or local
permits before you proceed with your project including(but not limited to) Sediment and Erosion Control,
Non-Discharge and Water Supply Watershed regulations. This approval will expire with the accompanying
404 permit unless otherwise specified in the Water Quality Certification.
This approval is valid solely for the purpose and design described in your application(unless modified
below). Should your project change,you must notify the DWQ and submit a new application. If the
property is sold,the new owner must be given a copy of this Certification and approval letter,and is thereby
responsible for complying with all the conditions. If total wetland fills for this project(now or in the future)
exceed one acre,or of total impacts to streams(now or in the future)exceed 150 linear feet,compensatory

This General Certification is issued in conformity with
requirement of Section 401,Public Laws 92-500 and 95-217 of the United
States and subject to the North Carolina Division of Water Quality
Regulations in 15 NCAC 2H,Section.0500 and 15 NCAC 2B .0200 for the
discharge of fill material as described in General Permit 198000291.
This Certification replaces Water Quality Certification Number 3025
issued on September 6, 1995. This WQC is rescinded when the Corps of
Engineers reauthorizes Regional General Permit 0291 or when deemed
appropriate by the Director of DWQ.
The State of North Carolina certifies that the specified category
of activity will not violate applicable portions of Sections 301, 302,
303, 306 and 307 of the Public Laws 92-500 and 95-217 if conducted in
accordance with conditions hereinafter set forth.
Conditions of Certification:
1. Activities authorized by CAMA major permits require written
concurrence from the Division of Water Quality as well as
compliance with all conditions of this General Certification;

3. Appropriate sediment and erosion control practices that equal
or exceed those outlined in the most recent edition of the
"North Carolina Sediment and Erosion Control Planning and
Design Manual"or the"North Carolina Surface Mining Manual"
(available from the Division of Land Resources in the DEHNR
Regional or Central Offices)shall be utilized to prevent
exceedances of the appropriate turbidity water quality
standard(50 NTUs in freshwater streams and rivers;25 NTUs
in all saltwater classes, and all lakes and reservoirs);
4. All sediment and erosion control measures placed in wetlands
or waters shall be removed and the natural grade restored
after the Division of Land Resources has released the
project;
5. If an environmental document is required,this Certification
is not valid until a FONSI or ROD is issued by the State
Clearinghouse;
6. Measures shall be taken to prevent live or fresh concrete
from coming into contact with waters of the state until the
concrete has hardened;
7. Additional site-specific conditions may be added to projects
which have applied for CAMA major permits which are proposed
under this Certification in order to ensure compliance with
all applicable water quality and effluent standards;
Violation of the conditions herein set forth by a specific project
shall result in revocation of the Certification for that project and may
also result in criminal and/or civil penalties.
The Director of the North Carolina Division of Water Quality may
require submission of a formal application for individual certification
for any project in this category that, in his judgement,poses a threat
of significant adverse impact on water quality or remove the existing
uses of the wetland or downstream waters.
Public hearings may be held for specific applications or groups of
applications prior to a certification decision if such hearings are
deemed to be in the public's best interest by the Director of the North
Carolina Division of Water Quality.

SUBJECT: CAMA/Dredge&Fill Permit Application for NCDOT bridges#118 & #119 on SR
1406 (Piney Green Rd.), Onslow County, North Carolina.
The North Carolina Wildlife Resources Commission has reviewed the project for impacts
to wildlife and fishery resources. A site visit was made on May 1, 2000. Our comments are
provided in accordance with provisions of the Fish and Wildlife Coordination Act(48 Stat. 401,
as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act (G.S. 113A-100
through 113A-128).
The applicant proposes to replace 2 bridges crossing Northeast Creek and an associated
overflow slightly north of their present alignment. The number of lanes accommodated by the
bridges will increase from 2 to 3, although designing provisions will be made for a future 5 lane
roadway and structure. It is our understanding the project will include the trenching in of a
relocated water line and re-excavation of the overflow. NCDOT's Best Management Practices
for otection of Surface Waters and Stream Crossing Guidelines for Anadromous Fish Passage

Total permanent impacts to high quality forested wetlands providing excellent wildlife
habitat will approximate 0.6 acre. This total does not include impacts from the future 5 lane
expansion, however. So far as we can tell, there are no plans to restore the old bridge approaches
to wetlands. Removing fill from the old approaches to wetland elevation and planting with
etland species would further reduce wetland impacts at the site. Low dissolved oxygen levels in
Northeast Creek exacerbated by elevated turbidity, especially during hot weather, are a particular
concern. Therefore, we recommend the following conditions to permit issuance.
Onslow Co. bridge replacements 2 05/09/00
1. The old bridge approaches shall be restored to forested wetlands.
2. All instream construction shall be contained by turbidity curtains.

Cumulative impacts from this type of project could cause deterioration in water quality. The proposed project
would increase impervious surfaces and alter natural drainage patterns. There would be a loss of natural
vegetation causing an increase in stormwater runoff which could jeopardize the open status of adjacent waters.

The subject project is located in an area open to shellfish harvesting. The 10-slip dock, as proposed, would not
cause closure in accordance with 15A NCAC 18A MARINAS: DOCKING FACILITIES: OTHER MOORING AREAS;
however, dockage at the facility could exceed 10 boats. If this was to occur, closure would be recommended in

Major Development and state dredge and fill permit to carry out construction on Bridges#118
and #119 on SR1406 (Piney Greed Road), crossing the upper reaches of Northeast Creek in
Jacksonville, Onslow County. Although processing of the application is nearing completion,
additional time is needed for this office to complete the review and make a decision on your
request. Therefore, it is necessary that the standard review time be extended. An additional
75 days is provided by G.S. 113A-122(c)which would make July 15,2000 the new deadline
for reaching a decision on your request. However,we expect to take action prior to that time
and will do so as soon as possible. In the interim, if you have any question on the status of
your application, do not hesitate to contact this office.

excavation, and 0.498 acres of mechanized clearing. Temporary wetland impacts associated with
the installation of a new water line will include 0.07 acres of fill and 0.07 acres of excavation.
Permanent stream impacts will consist of 130 feet of fill in the Northeast Creek overflow.
Approximately 65 ft of channel will be relocated. Temporary stream impacts consist of 8 feet of
stream excavation due to the water line installation.
A permit from the North Carolina Division of Coastal Management is required for this work.
This permit is being obtained by the North Carolina Department of Transportation (NCDOT). In
that your property is adjacent to the site where this permit is required, a copy of the permit
application is being provided for your review; however, no action is required on your part.

The North Carolina Department of Transportation proposes to replace bridges 118 and
119 over the Northeast Creek overflow and Northeast Creek on SR 1406 in Onslow
County. The proposed project will involve replacing the existing structures with two new
bridges 80 ft long and 52 ft wide, and 100 ft long and 52 ft wide respectively. This
replacement will take place north of the existing alignment and local traffic will be
maintained on site while the project is built in stage construction.
The project will require permanent wetland impacts of 0.079 acres of fill, 0.038 acres of
excavation, and 0.498 acres of mechanized clearing. Temporary wetland impacts
associated with the installation of a new water line will include 0.07 acres of fill and 0.07
acres of excavation. Permanent stream impacts will consist of 130 feet of fill in the
Northeast Creek overflow. Approximately 65 ft of channel will be relocated. Temporary
stream impacts consist of 8 feet of stream excavation due to the water line installation.
A permit from the North Carolina Division of Coastal Management is required for this
work. This permit is being obtained by the North Carolina Department of Transportation
(NCDOT). In that your property is adjacent to the site where this permit is required, a
copy of the permit application is being provided for your review; however, no action is
required on your part.

This letter is in response to a request by Eric Black of your staff to amend Condition No.
1 of the above referenced permit, which was issued by the N.C. Division of Coastal
Management on 6/2/00. Condition No. 1 states as follows:
K t 1) Debris resulting from demolition of the existing bridges, including deck
't t:„ 14_ ,`� components, shall not enter wetlands or waters of the United States,even
temporarily.
Mr. Black stated that the N.C. Department of Transportation intends to require that the
existing bridge shall be removed by sawing and/or non-shattering methods such that
' ' debris will not fall into the water. However, Mr. Black asked if Condition No. 1 could
be amended to recognize the possibility that small amounts of debris may accidentally
fall into the water during demolition.
" DCM has determined that Condition No. 1 shall remain as written. Please be assured
z that it is not the intent of DCM to issue violations for accidental minor discharges into
i, wetlands or waters of the United States that may occur during demolition of the existing
bridge, as long as such occurrences are rare, very minor in nature and are rapidly
cleaned up. If any accidental discharge should occur, we request that Tere Barrett, our
Field Representative for this project, be contacted immediately at (252) 808-2808.

I talked to Ellis Powell, the State Bridge Construction Engineer. He said the removal methods used
nowadays follow this note:
The existing bridge shall be removed by sawing and/or non-shattering methods such that debris will not
fall into the water. The contractor shall submit the plan for the bridge demolition to the resident
engineer for the resident engineer's review and approval.
The above note is being added to all bridge removals in the state, and has been accepted by US Fish and
Wildlife in several projects I have been involved in. Let me know if you need more information.
