Consequently, the impacts to Coastal Wetlands are greater than that normally associated with projects involving the replacement of a bridge with a bridge. It appears that approximately 2,800 ft2 of Coastal Wetlands would be filled during the project. And although the project was modified to minimize the overall impact to the wetlands, I recommend that the permit be conditioned to include a mitigation requirement for the impacts to the Coastal Wetlands. I also recommend that no excavation or filling of Coastal Wetlands or in Estuarine Waters be permitted during the time identified by the Division of Marine Fisheries as the peak period of biological activity for Back Creek. Given those comments and with the following conditions attached, I have no objections to the permitting of the proposed project: 1. A silt screen will be placed immediately upstream and downstream of the project site prior to any excavation and filling activity and not removed until 24 hours after the completion of all such activities. 2. The fill and riprap associated with the shifting of the road within the southwestern most canal will not extend waterward more than 10 feet from the mean high water level at any point along its alignment at the time of construction. The riprap along the southeastern most canal will not extend waterward more than 7 feet from the mean high water level at any point along its alignment. 3. The riprap material must be free from loose dirt or any other pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. 4. The riprap material must consist of clean rock or masonry materials such as, but not limited to, granite or broken concrete. Materials such as tires, car bodies, scrap metal, paper products, tree limbs, wood debris, organic material or similar material, are not considered riprap. Doug Huggett memo October 10, 1995 Page 2 5. All backfill material will be obtained from a highground source and confined behind the permitted riprap. 6. The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 7. The temporary placement or double-handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 8. No excavated or fill material will be placed at anytime in any marsh or surrounding waters outside of the alignment of the fill area indicated on the work plat(s). 9. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTUs or less are not considered significant. 10. Prior to initiating any land-disturbing activity associated with the upgrading/shifting of SR 1300, appropriate erosion and sedimentation control devices, measures, or structures shall be used to prevent sediment from entering the adjacent wetlands and watercourses outside the area of direct impact(e.g., silt fence, diversion swales/berms, sand fence, etc.). 11. The project site is located on SR 1300 near Merrimon on Back Creek in Carteret County. AECs impacted by the project include Public Trust Areas, Estuarine Waters, the Estuarine Shoreline and Coastal Wetlands . Waters at the site are classified as SA NSW and are closed to the harvesting of shellfish. The area is a Primary Nursery Area. I have reviewed this project for consistency with the 1991 Carteret County Land Use Plan (LUP) , as amended September 24 , 1993 , and offer the following comments . The general area of the project is classified as Rural, while the AECs impacted by the activity are classified as Conservation. Applicable policies contained in the amended LUP include Resource Production and Management Policies for Marine Resource Areas (Page IV-11) . With certain exceptions, none of which appear to be applicable to this project, Carteret County supports the use standards for estuarine and public trust areas . Economic and Community Development Policies regarding Commitment to State and Federal Programs (Page IV-16) state that the County will continue to fully support state and federal programs, particularly those which provide improvements to the County. The LUP specifically mentions the North Carolina Department of Transportation road and bridge improvement programs . Full support for these programs, which are very important to Carteret County, is stated. Pages V-2 and V-3 of the amended plan discuss the Coastal Wetlands Conservation Classification. Except as prohibited in the policies section of the plan, development allowed by the 7H Use Standards will be allowed in areas identified by the NC Division of Coastal Management as coastal wetlands . I can find no policy in the amended LUP which would appear to prohibit this project . I The amended LUP does provide for some restrictions which exceed state minimum standards for development in Primary Nursery Areas . However, these policies involve construction of marinas, docks and piers and are not applicable to this bridge replacement project . The proposed bridge replacement project on SR 1300 (Merrimon road) meets the approval of this agency pursuant to the following, recommended changes. The upper reaches of Back Creek are highly productive nursery areas for juvenile finfish and shellfish (particularly shrimp) . The classification of the waters at the project site as PNA and SA NSW cause particular concern due to the magnitude of the area impacted (13,540 ft2) . First, to reduce the area impacted by this project, the new bridge should be constructed at the site of the old bridge, utilizing as much of the existing structure as possible. This is opposed to shifting the road alignment 400' on each side of the bridge by 4-5' . Second, the width of the creek must be maintained and not further encroached upon so as not to impede water flow in this area. Good water flow is critical at this site because of the its' location near Open Grounds Farm and the classification as NSW. Finally, because this area is highly productive as nursery habitat, any maintenance/construction activities should occur prior to or after the time of maximum usage by juvenile life history stages of finfish and shellfish species (April 1- Sr 1) . Staff biologists with the Wildlife Resources Commission have reviewed the project and associated impacts on wildlife and fishery resources in the area. A site visit was made on October 2, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area Management Act(G.S. 113A-100 through 113A-128). The NCDOT is proposing to replace an existing timber bridge with a concrete bridge over Back Creek. Activities, including prepping the approaches to the bridge and stabilization of shoreline areas along existing canals, will result in the filling of about 8,400 ft of coastal wetlands and estuarine waters. According to the permit application, the applicant has modified the project proposal from it's original design and has greatly reduced adverse impacts to the area. Best Management Practices are proposed to minimize adverse impacts resulting from project related sedimentation. Back Creek is a tributary of the Neuse River and is classified as 'SA NSW'. This section of the creek is designated as a Primary Nursery Area. Our major concern is the potential adverse impacts to aquatic fauna resulting from turbidity associated with the bridge replacement. Elevated turbidity reduces water quality and stresses aquatic organisms. Excessive turbidity is particularly damaging to egg and larval life stages of aquatic fauna. Therefore, we recommend no in-water work occur between April 1 and September 30 to protect sensitive aquatic resources. Thank you for the opportunity to comment on this project. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs in trout waters). Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within sixty (60) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O.Box 27447, Raleigh, N.C. 27611-7447. The proposed work will involve the excavation of about 540 square feet of wetlands as a result of channel stabilization and shifting of the existing road alignment. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following condition(s) be included in the State authorization: All work authorized by this permit must be performed in strict compliance with the permit plans. ti The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. A review of your application received September 1, 1995, for Department of the Army authorization to replace an existing timber bridge with a concrete slab bridge over Back Creek, on SR 1300, near Merrimon, in Carteret County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be informed regarding its further management. If there are no unresolved differences in State-Federal positions or policies, the final action taken on your application by the State will result in your receiving written notice from us that your application is consistent with the general permit and you may commence your activity. Only after receiving such confirmation should you begin work. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404 (b) (1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. The proposed action will include the demolition and replacement of bridge No. 3 over Back Creek. The bridge will be replaced along the existing alignment and will not require a temporary detour. The existing bridge is outdated and in need of repair. There is also an erosion problem along the approach roads to this facility creating a safety hazard. During the design of the project, measures were taken to avoid and minimize impacts to waters of the US including wetlands. In addition, the proposed project will improve water quality and navigation within the main channel. The elevation of the new structure will be slightly higher (6 inches) than the existing bridge and will have fewer piers in the channel. The existing abutments will be retained if not damaged during construction. In addition, the grade of the approach roads will be raised approximately 1_ i'._ bL, .to li i. as erosion problems. The elimination of the erosion problems will improve water quality in the area and the navigation within Back Creek will also be improved by constructing a higher bridge with fewer piers in the channel. The impacts to wetlands have also been reduced from the original proposal which required excavation in 0.09 acres of tidal marsh to maintain the existing navigational channel adjacent to the southern approach road. This proposal avoids these impacts by shifting the alignment of the approach roads 4 to 5 feet to the west. 0 2 As a result of these avoidance, minimization and improvement measures (mitigation) it is our opinion that compensatory mitigation is not required for the project. The NCDOT is requesting that the proposed work be authorized under the COE general Permit Number SAWCO80-N-000-0291.
