Excavation/Fill

1) In order to protect juvenile finfish populations, no excavation or filling will be permitted
between April 1 and September 30 of any year without the prior approval of the Division of '

SUBJECT: Currituck County, Replacement of Bridge No. 8 on SR 1245 over
Coinjock Bay, Federal Project BRZ-1245 (1) , State Project No.
8.2040101, TIP # B-2536.
Please find enclosed a copy of the CAMA Permit application, drawings and
a copy of the fee check for the above referenced project. The proposed
action will include the demolition and replacement of bridge No. 8 over
Coinjock Bay. The bridge will be replaced along the existing alignment and.
will not require a temporary detour.
The elevation of the new structure will be slightly higher (0.66 ft)
than the existing bridge (see Drawing 2-5) . A temporary access bridge will
be required for bridge construction south of the existing structure.
Shoreline stabilization is necessary along the sides of the approach roads
due to erosion problems resulting in a potential safety hazard and to
eliminate future erosion concerns. The side slopes have been lengthened
along the approach roads and rip rap is proposed surrounding the bridge
abutments. The increased side slopes and rip rap will result in filling 0.40
acres of surface waters located within the channel adjacent to the roadway.
In addition, an estimated 0.17 acres of wetland marsh along the northern side
of the eastern approach road will be impacted.
NCDOT has consulted with the Division of Coastal Management (Mr. Preston
Pate) to determine reasonable mitigation options for projects such as these
with minimal impacts. Mr. Pate has agreed to consider such options as
restoration of hydrology to the upstream reaches of creeks and tidal marshes
that have been altered by the construction of causeways in the past. Mr.
Pate agreed that it would be acceptable to condition our CAMA permit to
require that such mitigation be initiated during the three years that the
permit is valid. Mr. Pate suggested that we could meet to select an
appropriate site after the permit is issued.
The NCDOT is requesting that the proposed work be authorized under a
Coastal Area Management Act (CAMA) permit. the USACOE issued a Nationwide
Permit 23 for the project in October of 1993 (Action ID No. 199304485) .
However, a response from the NC Division of Environmental Management
concerning the 401 certification was never received for the CE document that
was distributed. If you have any questions regarding this request, please do

SITE DESCRIPTION
SR 1245 connects the Currituck County mainland to Bells Island over a causeway
which includes Bridge No. 8. Bridge No. 8 crosses the adjacent marsh and waters of the
Coinjock Bay. Bells Island is located approximately one mile south of the Currituck County
Court House and is surrounded by the Currituck Sound and the Coinjock Bay. Water levels
on the Coinjock Bay, the Currituck Sound and it's tributaries are determined by wind tides.
The existing bridge was constructed in 1947 and has a roadway width of 18 ft. and
length of 98 ft. The current bridge structure provides an average vertical clearance of 2.5 ft.
and a horizontal clearance of 7 ft. The average channel depth is 3.5 ft. at NWL.
It is estimated that the existing bridge handles 1200 vehicles per day. Remnant
wooden bridge pilings are still present adjacent to the current bridge. County records indicate
that Bells Island has been accessed by animal drawn carts and later vehicular traffic since the
early eighteen hundreds. Previous access was along a high embankment approximately 300
yards north of the current crossing and this access was initially used by the region's earliest
inhabitants.
NC DOT proposes to replace the current bridge structure. The new bridge will utilize
the same alignment as the present structure.
The SR 1245 crosses over an extensive juncus marsh as it accesses Bells Island.
Coinjock Bay and the adjacent marsh are located within the N.C. Estuarine AEC. Juncus
roemerianus is the predominant plant species. Other dominant plant species include Typha
latifolia and Phragmitis australis. A list of plant species in the vicinity of Bells Island and
the Coinjock Bay are included in Appendix 1. This is one of the Currituck Sound's most
visible coastal marshes.
The waters and marsh along the Coinjock Bay provide habitat for several aquatic fish
and shellfish species as well as several species of bird, reptile, amphibian and mammal
wildlife. Species which have been identified or could be expected are included in Appendix
2.
PROPOSED DEVELOPMENT
The applicant proposes to replace Bridge No. 8 at this existing location and utilize the
same alignment. Approximately 1600 ft. of roadway approach would be widened.
Construction of the new 30 foot wide bridge would be phased with one lane of traffic

maintained by temporary traffic signals. NC DOT also proposes to construct a temporary
mat and wooden bridge structure adjacent to the current bridge to work from.
The new bridge would be 130 feet long. The new structure will provide 0.66 ft.
additional clearance over public trust waters than the existing structure and provide at least
three 10 ft. wide horizontal clearance openings.
Associated shoreline stabilization is also proposed for this project. NC DOT proposes
to rip rap 869 ft. of Estuarine Shoreline at a distance waterward of the NWL of 6.7 ft.
ANTICIPATED IMPACTS
The proposed project includes widening of the existing roadway approach to the
proposed bridge. This associated fill and rip rap would directly impact 17,140 sf. (0.40 A)
of shallow water habitat / public trust waters and 1,285 sf. (0.17 A) of coastal wetlands. In
addition, the temporary wood pile work bridge structure would impact 7,500 sf. (0.18A) of
public trust waters and shallow water habitat.
The use of a temporary wooden mat and pile bridge would impact the principle two
SAV species. These include Ruppia maritima (wedgeon grass) and Myriophyllum spp.
(milfoil). It is unknown to what degree of impact would be experienced by SAV
communities. It is anticipated that the temporary work bridge would be in place during the
duration of the bridge construction. It is estimated that bridge construction would take
approximately six months.
It is anticipated that by utilizing a temporary work bridge and the same bridge
alignment as the current bridge that long term and permanent impacts will be minimized.
This alternative will also allow traffic to continue on and off the island with a minimum of
delay to vehicular traffic as well as a minimum impact to public trust waters and coastal
wetlands. However, it is anticipated that some temporary damage may be experienced by
SAV species.
Temporary turbidity will also be experienced in the vicinity of the proposed development
until construction is complete and the site is stabilized and restored.
NC DOT also proposes to raise the bridge elevation. The proposed clearance over
public trust waters would be 0.66 ft. higher the current bridge and would improve access to
public trust waters as well as access for future bridge maintenance. However, the bridge
widening and height increase would require additional roadway widening and fill placement
in Coastal Wetlands, Estuarine Waters and shallow water habitat.

Widening of the bridge and roadway approach would provide a safer crossing for
vehicular traffic.
CAMA REVIEW
Sites of archaeological significance have been identified within 1 - 2.0 miles from the
site in Currituck County. They include sites CK9, 10 and 34 designated by the Division of
Archives and History.
The land use on Bells Island is residential. The Currituck County Land-Use Plan
shows the project area to be in the land-use classification of Conservation. Steve Gabriel
will forward the CAMA review at a later date.

The proposed bridge replacement project will use the least
impact option regarding this bridge replacement. The new bridge ,
structure will be the same alignment as the existing bridge. The
applicant proposes to phase construction and use a temporary
barge/bridge structure to work from so that coastal wetland impacts
can be minimized.
I recommend approval of this proposed project with the
following conditions.
1) All fill material will be obtained from an upland source.
2) All fill material will be clean and free of any
pollutants, except in trace quantities.

construction site.
4) Appropriate erosion and sedimentation control devices,
measures or structures shall be used to prevent sediment
from entering the adjacent marsh and estuarine waters.

phase of grading on cut or filled slopes.
6) Activities will be conducted in such a manner as to
prevent significant increase in turbidity outside the
construction area.

Mitigation
10) Several resource management agencies have expressed
concerns about resources losses and impacts. This
project will result in wetland and public trust water
losses. Therefore, I recommend that impacts be
mitigated. Such mitigation should offer a 3 : 1 ratio for
coastal wetland losses.

This proposal by NCDOT involves the replacement of bridge #8 on SR 1245 leading
to Bells Island in Currituck County, NC. Also included is the widening of the bridge
approach. Resource impacts include the fill of 7285 sq. ft. of Coastal Wetlands, 17,140 sq.
ft. of shallow water habitat, and 1.4 acres of upland/estuarine shoreline.
The County's overall perspective with regard to resource impacts is best summarized
in the Environment chapter of its plan. There, the County says "development need not be
detrimental to the environment. Responsible construction can occur with negligible impact
on the County's natural resources" (pg 59), and "with proper planning, the impact of
development on the environment can be minimized" (pg 60).
Pages 52 and 53 contain design principles that the County has identified for such
responsible development which address various resource impacts. Among the many
principles, first on the list is "avoid development in critical areas such as wetlands". The
County's Coastal Wetlands Goal is "To protect coastal wetlands so that they can continue to
serve their vital function in the environment" (pg 64). The County indicates that acceptable
uses in Coastal Wetlands include those that comply with CAMA.

For Estuarine Water s, the County's goal is "to maintain the high quality of estuarine
waters and to promote appropriate development along estuarine shorelines so as not to
degrade the estuarine system" (pg 62). Here too, the County finds acceptable those uses that
comply with CAMA regulations. In Public Trust Waters, the County's goal is to "Keep all
public trust waters open for navigation including those areas under the jurisdiction of the
federal government" (pg 63). This was an important issue for the County during its land use
plan update, particularly given the County's water-based tourist economy and overall way of
life for its residents, and it was the focus of much thoughtful discussion. In this proposal,
NCDOT contemplates increasing slightly the amount of vertical and horizontal clearance for
navigational purposes beneath the new bridge.
Based on the above, so long as the rip-rap is found to be within acceptable limits, and
Coastal Wetland impacts are resolved to the extent that they are found to comply with
CAMA regulations, this replacement of bridge #8 will be cosaistent with the Currituck
County land use plan.

Staff biologists with the North Carolina Wildlife Resources Commission(NCWRC) have
reviewed this permit application and are familiar with habitat values of the project area. Our
comments are provided in accordance with provisions of the Coastal Area Management Act
(G.S. 113A-100 through 113A-128), as amended, and the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to replace an existing highway bridge over a small watercourse of
Coinjock Bay. The project site consists of vegetated shallow water fishery habitat and is used as
a spawning and nursery area for numerous species of freshwater, estuarine, and anadromous fish.
The shallow waters of Currituck Sound also provide resting and feedings areas for wintering
migratory waterfowl. Wetlands such as those found on this site provide functions which benefit
the public as well as fish and wildlife. Wetlands act as a stormwater runoff purification zone
between upland areas and surface waters. Wetlands store and convey flood waters and provide
shoreline erosion protection through attenuation of wave energy. Wetlands also serve as a
physical habitat for numerous species of amphibians, reptiles, birds, and mammals. In some
instances, wetlands serve as a spawning and nursery area for anadromous fish. Through
deposition of detritus into adjacent waters, wetlands contribute large quantities of organic carbon,
forming the food chain base and the resulting biological productivity for many aquatic
ecosystems. In summary, we consider the wetlands and shallow waters of Coinjock Bay to be

very high quality fish and wildlife habitat and we place great emphasis on the protection of such
habitats.
The project as proposed will result in the filling and permanent loss of 1,285 square feet
(possibly 7,285 square feet according to one figure given in the Division of Coastal Management
Field Investigation Report) of coastal wetlands, 17,140 square feet of vegetated shallow water
fishery and waterfowl habitat, and would also affect 7,500 additional square feet of shallow
water habitat from a proposed wooden mat work structure. Due to these habitat losses, it is our
opinion that fish and wildlife habitat values of the area will be significantly diminished by this
project as proposed.
However, we would not object to the issuance of the CAMA permit if the following
recommendations were included as permit conditions:
✓ 1. In-water work should not be permitted from April 1 to September 30 of any year
during the construction of this project.
2. Sedimentation and erosion control measures should be designed for High Quality
Waters. Special devices such as silt curtains should be used to protect surrounding
SAV beds and nursery areas.
3. Side slopes on the bridge approaches should be steepened to the maximum amount
possible. Side slopes of 2 to 1 or less is preferred.
4. Acceptable mitigation should be provided for the 0.40 acres of shallow water habitat/
public trust water loss and for the 0.17 acres of coastal wetland loss. NCDOT should
( ..S 11-'' look for in-kind mitigation in the project vicinity. Out-of-kind mitigation would be
O'`1 inappropriate for resources of this quality.

The following comments by the North Carolina Division of Marine Fisheries are
provided pursuant to General Statute 113-131.
Coinjock Bay and the surrounding waters around Bells Island functions as spawning
and nursery area for blueback herring and alewife. Spot, croaker, white perch, yellow
perch, catfishes, blue crabs, and other commercially and recreationally important species also
utilize the area as a nursery. SAVs are found throughout the area; the importance of these
types of vegetation has been well documented.
This agency is concerned with the loss of 17,140 sq. ft. of shallow water habitat.
The importance of this shallow water habitat is documented above by the use of various
species as a nursery. The filling of the shallow water habitat would also result in the loss of
SAVs in the area.
The project proposes to fill 7,285 sq. ft. of coastal wetlands. No mitigation is
proposed for the loss of these wetlands. Wetlands are of great importance to fisheries
resources, serving as sources of basic biological productivity, providing food directly and
indirectly, and serving as nursery areas for many species. Finally, wetlands perform
important roles in modifying acute impacts of hydrologic events, moderating stormwater
flows, trapping sediments, and providing nutrients for incorporation into resident plants.
Appropriate mitigation should occur for the loss of 7,285 sq. ft. of coastal wetlands.
DEM wetland restoration guidelines should be implemented. The Division remains
concerned with the impacts and loss of shallow water habitat and SAVs.

Dear Mr. Parker:
Reference the application of the North Carolina Department of
Transportation (NCDOT) for a Department of the Army (DA) permit to replace
an existing bridge and place riprap material along the shoreline, at NCDOT
Bridge No. 8, located on S.R. 1245, adjacent Coinjock Bay, near Currituck,
Currituck County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
1. Prior to beginning work, the NCDOT will develop and submit for review
a mitigation plan to compensate for emergent wetland and shallow water habitat
losses.
2. All work authorized by this permit must be performed in strict
compliance with the permit plans.
3. The riprap material will not be positioned farther waterward than
7-feet from the normal water level (NWL) elevation contour at any point along
its alignment.
4. All backfill materials will be obtained from a highground source and
confined landward of the permitted riprap.
5. No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters outside of the permitted area.
6. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
7. All fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
8. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.

In accordance with Part II, Section 4 of the current Memorandum of
Agreement between the Departments of Commerce and the Army, I am
offering the following comments on permit application 199503843 (GP)
dated June 19, 1995. The applicant, the North Carolina Department
of Transportation (NCDOT) , proposes to place fill material in
wetlands to replace the existing SR 1245 bridge (Bridge No. 8) over
the wetlands and waters of Coinjock Bay, Currituck County, North
Carolina. The purpose of the work is to improve access to Bells
Island by replacing the existing bridge with a new structure.
The project consists of the removal of the existing bridge and
replacing it along the same alignment with a new 130-foot-long by
30-foot-wide bridge. The new structure will provide additional
vertical clearance and three 10-foot-wide horizontal clearance
openings. Also proposed is widening the existing roadway approach
and the placement of 869 feet of riprap at the base of the bridge
along the shoreline. In order to maintain access to Bells Island,
the new bridge will be constructed one lane at a time from a
temporary work bridge.
Based on coordination with the N.C. Division of Coastal Management
and our knowledge of the project area, we are concerned that the
work will result in the loss of 0. 17 acre of wetlands predominately
vegetated with needlerush (Juncus roemerianus) . Irregularly
flooded wetlands provide nutrients, habitat, and water quality
maintenance functions that are important for the continued
production of fishery resources. 1 In addition, the proposed fill
and riprap will impact 0.40 acre of shallow water habitat. Shallow
water nearshore areas provide feeding habitat and a refuge from

predators for fishery resources.2 Juveniles of a variety of
commercial, recreational, and ecologically important fishery
resources including spot (Leiostomus }tanthurus) , Atlantic croaker
(Micropogonias undulatus) , flounders (Paralichthys spp. ) , Atlantic
menhaden (Brevoortia tyrannus) , and killifish (Fundulus
heteroclitus) use the project area as habitat.
Also of concern is the impact of the temporary work bridge on
submerged aquatic vegetation (SAV) , primarily widgeon grass (Ruppia
maritima) and milfoil (Myriophyllum spp. ) , present in the proposed
work bridge alignment. SAV is an important source of primary
productivity in the form of organic detritus, which is an important
component of the aquatic food chain. It also provides a refuge
from predators for juveniles of the above species and functions to
maintain good water quality. 3
We agree that avoidance and minimization of wetland losses has
occurred for this project, however, under the current plans,
wetland losses do occur and no mitigation to offset these losses is
proposed. Therefore, we recommend that federal authorization of
this work not be granted unless the following conditions are
incorporated into the issued permit.
1. Prior to beginning work, the NCDOT will develop and submit for
review a mitigation plan to offset all emergent wetland and shallow
water habitat losses.
2 . Pre- and post-construction surveys of SAV habitat in the
project area will be conducted. If these surveys document a
permanent loss of SAV habitat, mitigation for this loss will be
provided.

1. The area be properly graded.
2 . A permanent ground cover sufficient to restrain erosion
be provided on all exposed areas within the shorter of
30 working or 120 calendar days after project comple-
tion.
3 . The exterior slopes of the disposal area dikes be at an
angle no steeper than 1 1/2 H: 1 V.
'4 . Appropriate erosion and sedimentation control devices,
measures , or structures be used to prevent sediment
from entering the adjacent wetlands/watercourses/
property (e.g. , silt fence, diversion swales/berms ,
sand fence, etc. ) .
(/ 5. A ground cover sufficient to restrain erosion be
provided within 30 working days of completion of any
phase of grading on cut or filled slopes.
6. An erosion and sedimentation control plan be submitted
at least 30 days prior to initiation of land-disturbing
activities.
7. Additional information concerning the area of the land-
ward disturbance be submitted to determine if an
erosion control plan is required.

Major Development permit to carry out construction on property located at Bridge #8 over
Coinjock Bay, in Currituck County. Although processing of the application is nearing
completion, additional time is needed for this office to complete the review and make a decision
on your request. Therefore, it is necessary that the standard review time be extended. An
additional 75 days is provided by G.S. 113A-122(c) which would make October 9, 1995 the
new deadline for reaching a decision on your request. However, we expect to take action prior
to that time and will do so as soon as possible. In the interim, if you have any question on the
status of your application, do not hesitate to contact this office.

The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located at the bridge over Coinjock Bay
on SR 1245 in Currituck County. It was received on May 12, 1995, and appears to be
adequate for processing at this time. The projected deadline for making a decision is 41y
26, 1995. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will
be contacted by the appropriate State or Federal agency. Please contact me if you have any

The North Carolina Department of Transportation proposes to replace the
existing bridge on SR 1245 over Coinjock Bay. The bridge will be replaced
along the existing alignments and will not require a temporary detour.
A permit from the NC Division of Coastal Management (DCM) is required to
complete this work and is in the process of being obtained by the NCDOT.
