RE: Refinement of CAMA Major Permit No. 101-95;
Replace Bridge No. 8 on SR 1245
Dear Mr. Turner:
The Department of Transportation's request to refine the above permit will allow "in-water"
construction to occur beyond the April 1' cut-off. Our office has discussed the request with Sara Winslow with
the Division of Marine fisheries and agree to the refinement with the condition that the Department of
Transportation will be required to maintain sediment curtains around all bottom disturbing activities.

SUBJECT: Request for Refinement to CAMA Major Development Permit No. 101-95;
Replace Bridge No. 8 on SR 1245 over Coinjock Bay, Currituck County TIP
No. B-2536; State Project No. 8.2040101; Federal Aid No. BRZ-145(1)
The Department of Transportation requests that the subject permit be refined to
allow"in-water construction activities to continue beyond the April 1 moratorium cut-off.
While all or most of the planned "in-stream" construction may be completed by April
1st, there is a real possibility; due to weather, etc.; that this goal may not be achieved.
In anticipation of this contingency, the Department met with Ms. Sara Winslow,
Biological Supervisor with the Division of Marine Fisheries, at the work site on February
26, 1997. The Department agreed to agressively maintain all sediment curtains during
any bottom-disturbing activities whether they occur before or after the moratorium.
Please issue a refinement letter authorizing the Department to continue
construction activities beyond the moratorium start-up on the condition that all existing
sedimentation controls are strictly enforced.
