I .P. No. B-2019 Reference the CAMA Major Permit Application received by the Division of Coastal Management on April 25, 1995 for this project. Per the request of the North Carolina Wildlife Resources Commission, attached is a copy of the waterline relocation plan. The existing waterline is to be replaced in conjunction with widening of the bridge and its approaches. This work is to be performed by an NCDOT contractor, and will provide the same or greater hydraulic capacity than the existing utility. The waterline will be located within NCDOT right—of—way. A copy of the Debit Transaction Form for the Company Swamp Mitigation bank is included for your records. By copy of this letter, this form will also be provided to the U.S. Fish and Wildlife Service. No. B-2019 The North Carolina Department of Transportation proposes to replace and widen the above referenced bridge on existing location, along with associated approach work. The new bridge will be approximately 81 meters long with a 7.5 meter travelway and a vertical clearance of 2.6 meters above ordinary high water. The paved approaches will be widened from the existing 6.0 meters to 7.5 meters. This will require widening of the shoulders and infringement upon the adjacent wetlands. The proposed construction will require 0.149 hectare (0.37 acre) of fill in non-tidal , bottomland hardwood and deep swamp wetlands. No temporary fill in wetlands will be required, as no on-site construction detour will be necessary. No stream relocation or channel change will be involved. The bridge will be closed throughout construction and local traffic will be detoured onto secondary roads in the area. In order to mitigate the wetland impacts associated with this project, NCDOT proposes to debit 0.5 hectare from the Company Swamp Mitigation Bank. This represents a mitigation ratio exceeding 3 to 1. A Categorical Exclusion was circulated for this project on May 17, 1993 and approved by the U.S. Army Corps of Engineers on September 30, 1993. Application is hereby made for a Major CAMA Permit as required for such activities. By copy of this letter, a request for Section 401 Water Quality Certification by the North Carolina Division of Environmental Management is April 17, 1995 ' Page 2 hereby made. A check in the amount of $250 has been transmitted to the DCM office in Raleigh to cover the CAMA processing fee. A copy of the check is included herein. This relocation would be subaqueous and in conjunction with the bridge replacement project. I would have no objections to including the water line relocation in their permit with the following conditions applying: 1. There must be no resultant change in preconstruction bottom contours. Authorized fill includes only that necessary to backfill or bed the water line. Any excess material must be removed to an upland disposal area. 2 . All spoils which are permanently removed must be placed on a highground disposal site and stabilized so as not to return to waters, marsh or other wetlands. 3 . Any additional backfill material required must be clean sand or rock free of organic matter. 4 . The Craven County LUP allows all uses permitted by 15A NCAC 7H in conservation classified AECs, including Public Trust Areas (Pages III-2 and III-3) . Applicable policies include Resource Production and Management Policies for Marine Resource Areas (Page IV-8) . These policies reiterate Craven County' s support for the use standards for public trust areas as specified in 15A NCAC 7H. Policies regarding Commitment to State and Federal Programs (Economic and Community Development Policies, Page IV-11) state support for the North Carolina Department of Transportation road and bridge improvement programs . Craven County' s policy regarding development in "404 ' wetlands is discussed on Page IV-3 , Resource Protection Policy for Physical Limitations . Craven County will cooperate with the U.S. Army Corps of Engineers in the regulation/enforcement of the ' 404 ' wetlands permit process . However, additional wetlands regulations will not be supported or locally imposed by the County. Staff biologists with the North Carolina Wildlife Resources Commission(NCWRC) have reviewed the project and associated impacts on wildlife and fishery resources in the area. A site visit was made on June 9, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act(48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area Management Act(G.S. 113A-100 through 113A-128). The NCDOT is proposing to replace the fixed-span bridge#38 over Swift Creek with a new and slightly larger one. Construction activities will result in the filling of about 0.149 ha of `404' wetlands. Also, an existing potable waterline that crosses the creek will have to be relocated, however plans are not currently available. During construction, the bridge will be closed and traffic detoured to other roads. NCDOT is proposing to mitigate wetland impacts by debiting 0.5 ha from the Company Swamp Mitigation Bank. Swift Creek is a tributary of the Neuse River and is classified as `C Sw NSW'. This section of the creek is not designated as a Primary Nursery Area. A bottomland hardwood swamp forest dominated with swamp tupelo, bald cypress, black gum, swamp cottonwood, black willow, and red cedar borders Swift Creek. Our major concern is the potential adverse impacts to aquatic fauna resulting from turbidity associated with the proposed activities. Elevated turbidity could reduce water quality in these areas and stress aquatic organisms. Excessive turbidity is particularly damaging to egg and larval life stages of aquatic organisms. Therefore, we recommend that bridge replacement be prohibited between April 1 and September 30 and that silt curtains be placed immediately upstream and downstream of the project site. 5, It 4er ua s h4 L. 4` • !cr Habitat conducive to small mammals such as gray fox, raccoon and otters exists on both sides of the highway. Therefore, we recommend that a minimum of 3' e left between the rip-rap and both sides of the main channel of Swift Creek. This would provide a travel corridor for small animals and reduce the chance of wildlife crossing the highway. We are also concerned about the relocation of the potable waterline resulting from the proposed activities. We recommend that the bottomland hardwood swamp forest located in the area be avoided during the relocation process. We also request that, prior to the issuance of the applicable permit(s),NCDOT proceed with a formal request to use the Company Swamp Mitigation Bank. NCDOT should: 1) Complete a Debit Transaction Form (or a form that contains similar information) as found on page 10-4 of the Final Report on the Company Swamp Mitigation Bank. 2) Contact the U.S. Fish and Wildlife Service to fulfill requirements under item 9 in the MOU. 3) Circulate documentation for concurrence from all Company Swamp MOU signatories. As you can see, WRC has requested that a formal request be made to allow for debiting wetland impacts from Company Swamp Bank. It would help out the permit review if WRC's concerns could pie addressed. Also, as we discussed, the Public Notice on this project will still be active for 3 more weeks, so the lack of a formal debit request should not hold up the permit process for now.
