Box 27687 Raleigh, NC 27611-7687 E Subject: Major Permit for Caffideolitilitt Water Resources Concerns f, Dear Mr. Huggett: This is in reference to our earlier conversation regarding the permit application submitted March 1, 1995 for the proposed bridge replacement in Camden Point and Mr. John Sutherland's letter of April 25, 1995 expressing the concerns of the Division of Water Resources. Mr. Sutherland was concerned that the flushing and water quality upstream may be reduced with the installation of a culvert as compared with the existing structure. Attached are photographs of the substructure of the existing bridge. As you can see there are many timbers under this structure, apparently remnants of a previous bridge, that are obstructions to the current water flow. At the time of our investigations there were large tree limbs, grass and other debris hung up on these timbers contributing to the blockage. Even though the cross sectional area of the projected culvert will be slightly smaller it will have no obstructions. It will also be State Maintained and will received routine maintenance which will consist of removing blockages as necessary. The existing structure receives no maintenance. There was also a question raised in reference to navigation under this bridge. Currently there are parallel timbers under the structure only inches above the water elevation. Navigation is currently not possible under this structure. However, with the installation of the culvert, navigation will be possible for small boats or canoes. t r Mr. Huggett Page 2 May 8, 1995 Mr. Sutherland also suggested that a new larger bridge with more clearance be constructed rather than a culvert. The cost to construct such a structure would be a minimum of$75,000 as compared with approximately $15,000 to construct the culvert. As you can see this is not financially feasible. If we cannot be permitted to install the culvert, nothing will be done to the structure and it will remain in the hands of the property owners in its current condition. PROJECT SUMMARY: NCDOT proposes to replace the existing wooden span bridge with a culvert and fill bridge on SR 1163, Camden Point Shores, Camden County. N.C. DOT Bridge SR 1163 Camden Point Shores - Sailboat Road Bio Report Page Two Site Description Camden Point Shores and the Sailboat Road Bridge are located approximately 10 miles southeast of the community of Shiloh in Camden County. This bridge is located at the end of the existing hard surface road on Sailboat Road (SR 1163). The existing wooden bridge is currently maintained by the Camden Point Home Owners Association. The existing bridge allows only limited vehicular access and is in need of repair or replacement. N.C. DOT and the Camden Point Shores Home Owners Association have agreed to a mutual bridge replacement project. In this agreement, the Camden Point Shores Home Owners Association would provide the culvert/bridge material, and N.C. DOT would construct the new bridge and maintain it. Clearances beneath the existing bridge do not allow any public trust access upstream of the bridge and restrict movement of waters between the Albemarle Sound and the man-made canal adjacent to the present structure. Migration of fishery resources may also be limited by the existing wooden structure. The applicant proposes to remove the existing bridge and replace it with a culvert with an opening of 142" x 91" and a length of 60 feet. This replacement would include 200 cubic yards of fill to be placed below the NWL and would impact 1,000 sf. of non-vegetated wetlands (ie., shallow water habitat). This proposed project would directly impact 400 sf. of freshwater wetlands, including areas vegetated with plant species Arundinaria gigantea (giant cane) and Phragmitis australis (giant reed). No coastal or submerged species are present at this location. Approximately 60 linear feet of shoreline adjacent to the crossing structure slope would also be stabilized with rip-rap stone material. The proposed roadway would be 40 feet in width with 10 foot of slope on both sides of the roadway. A total area of 2,400 sf. would be impacted by this project. Anticipated Impacts This proposed project would directly disturb an area of 2400 sf. (0.058 A.). Approximately 1,000 sf. (0.024 A.) of impacts would be directly to non-vegetated wetlands and estuarine waters. In addition, approximately 400 sf. of freshwater wetlands would be filled. 1,000 sf. (0.024 A) of upland would be filled. N.C. DOT Bridge SR 1163 Camden Point Shores - Sailboat Road Bio Report Page Three The current bridge limits upstream public trust access and also restricts flow as well as the movement of fish resources. The proposed structure would allow limited public trust access to several miles of canals and may improve movement of fishery resources upstream. The proposed structure may also improve upstream flushing and water quality. Some temporary turbidity would be experienced downstream from the bridge site until construction is complete and the site stabilized. The improved roadway would also provide a dependable vehicular access to several residents located beyond the existing bridge on Sailboat Road. CAMA Review The land use in the vicinity of Camden Point Shores is residential with some small commercial family fishing operations. Hawthorn `' SUBJECT: NC DOT 1163 Camden Point Shores Bridge DATE: April 10, 1995 The applicant proposes to replace the existing wooden bridge structure on SR 1163, Camden Point Shores, Camden County. This proposal includes the removal of the existing bridge structure and replacing it with a 142" x 91" metal culvert structure. The proposed replacement would result in the loss of 400 sq. ft. of freshwater wetlands and 1000 sq. ft. of estuarine waters. The current structure entirely limits any public trust access from the Albemarle Sound to the upstream waters and significantly limits the exchange of fisheries and water resources. The proposed structure would allow public access for small vessels and improve the movement of fishery and water resources upstream. It must be of size sufficient to prevent its movement from the site by wave or current action. 7) The temporary placement or double-handling of fill or excavated materials within waters or vegetated wetlands is not authorized. Anticipated impacts include the fill of 400 sq. ft. of 404 wetlands and the loss of 1000 sq. ft. of shallow water habitat. 0, Camden County places all AECs in the Conservation classification of its land use plan. For Conservation classed areas as well as the specific policies for AECs, the County allows all uses that can be permitted under applicable local, state and federal regulations. The same can be said for the County's freshwater swamps and marshes policy. In addition, while this proposal replaces a span bridge with a culvert and fill structure, public navigation upwater of the structure will actually be enhanced. " The size of the opening has been reduced from about 170 square feet to around 90 square feet. Even with the timbers in the drainageway under the bridge, the area through which the water must move will be reduced. What would improve flushing and water quality would be to increase the size of the opening and replace the existing bridge with a larger bridge with only middle supports. The bridge could also be raised a couple of feet so that real navigation would be possible - with the culvert, only very small boats could get through in low water. As we discussed, this structure is currently on property owned by the Camden Point Shores Property Owners Association. We have been petitioned by the Property Owners and the County to add this bridge and section of road to the State System. This permit application was submitted as part of our investigation of this request. The addition of this road is contingent upon approval of this permit. If the permit is approved we will proceed with the addition. If the permit is denied the road will not be added and will remain property of the association since the structure does not meet NC Department of Transportation requirements. If the permit is approved, we will provide the Division of Coastal Management proof of ownership prior to beginning construction. It was received on March 1, 1995, and appears to be adequate for processing at this time. The projected deadline for making a decision is May 15, 1995. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
