both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, [phone] within twenty (20) days of
this decision on your permit. You should also be aware that if another qualified party submits a valid objection to
the issuance of this permit within twenty(20)days, the matter must be resolved prior to work initiation.The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require

smaller diameter culvert within a man-made canal which is connected to the Albemarle Sound.

Site Description
The NC DOT desires to replace an existing culvert under SR 1429 (Holiday Lane),
Holiday Island Subdivision, Perquimans County. The project site crosses a man-made canal
which is connected to the Albemarle Sound.
The existing culvert has a diameter of 120 inches and is believed to be made from an
old fuel tank. (At the time this culvert was put in Holiday Lane was a private road.) The
existing culvert has deteriorated and does not meet current NC DOT standards. NC DOT
proposes to replace this culvert with a 96 inch diameter aluminum culvert. The proposed
excavation, culvert replacement and refilling will take place within the footprint of the
existing road, shoulder and culvert.
The project site consists of a 22 ft. wide asphalt road with a road bed surface elevation
of 10 ft. above the canal bottom. The canal is approximately 50 ft. wide and 5 ft. deep
under normal conditions. Vegetation on the shoulder consists of mowed grasses and
deciduous trees closer to the canal (Liquidambar styraciflua (sweetgum) and Acer rubrum
(red maple)). A narrow fringe of Typha sp. (cattails) (20' x 3') lies along the east bank of
the canal adjacent to the perimeter of the proposed project area.
Anticipated Impacts
The diameter of the culvert should have no effect on stormwater flow within the canal
on this site. Water circulation within the canal is believed to be poor. Reducing the size of
the culvert under Holiday Lane may decrease water circulation. Finfish movement may be
inhibited by the reduction in culvert diameter. No wetlands nor any submerged aquatic
vegetation beds will be impacted by the project. Water turbidity levels within the canal will
be temporarily increased during construction. Navigation under Holiday Lane is not possible
now nor will it be with a smaller culvert.
CAMA Review
The proposed project will not involve areas known to have any archeological/historical
significance. The narrow fringe of cattails should not be impacted by the project. No
endangered and/or threatened species of plants and/or animals have been identified in the
area.
Discussion of the project's consistency with the Perquimans County Land Use Plan will
be forthcoming under separate letterhead.

This proposal involves the removal and replacement of an existing culvert with a
smaller diameter culvert within a man-made canal which is connected to Albemarle Sound.
Estuarine Waters and Shoreline AECs, and the Public Trust Waters AEC are involved, and
minimal impacts to these AECs are anticipated.
Perquimans County's policies for AECs is to place them in the Conservation land
class of the County land use plan. In that land class, the County allows all those uses that
can be permitted under the existing state, federal and local regulations. No other specific
policies apply to the activities contained in this proposal.
Based the above, so long as the proposal is found to satisfy applicable CAMA
regulations, inconsistent with the Perquimans County land use plan.

The following comments by the North Carolina Division of Marine Fisheries are
provided pursuant to General Statute 113-131.
The existing culvert has a diameter of 120 inches and is proposed to be replaced with an
aluminum culvert with a 96 inch diameter. Due to the current poor water circulation that exists
in the canal with the existing culvert, this agency objects to a culvert with a 96 inch diameter
being installed. The Division would approve of the proposed project if a culvert of the same
size (120 inch diameter) or larger were installed.

The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of property located at SR 1429 (Holiday Lane), Holiday
Island Subdivision, Perquimans County, Albemarle Sound. It was received on March 1,
1995, and appears to be adequate for processing at this time. The projected deadline for
making a decision is May 15, 1995. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a final
action by the initial deadline stated above, you should consider the review period extended.
Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will
be contacted by the appropriate State or Federal agency. Please contact me if you have any
