• This permit,issued on DECEMBER 20, 1994 , is subject to compliance with the application(where consistent
with the permit),all applicable regulations,special conditions and notes set forth below. Any violation of these terms may be
subject to a fine,imprisonment or civil action; or may cause the permit to be null and void.
Excavation and Filling
1) No excavated or fill material will be placed, at any time, in any marsh or surrounding waters.
2) Only high ground excavation behind the existing abutments is authorized. /
3) All backfill material will be obtained from a highground source and confined behind the existing

abutments. /

4) In order to protect water quality, runoff from the construction must not visibly increase the
amount of suspended sediments in adjacent waters. /
NOTE: The permittee is advised to consult with the county regarding measures to minimize
' mosquito habitat production.

This letter is in reference to your letter dated August
15 , 1994 , in which you requested more information on the CAMA
Major Permit Application submitted to your office on August
8 , 1994 . The second paragraph in the cover letter dated
August 1 , 1994 , contained several errors and should read ;
"No fill is to be placed in wetlands or below ordinary
high water . The' average daily flow is estimated to be
2 . 0 cfs . No excavation in wetlands will be required.
Excavation above ordinary high water will be
approximately 30 cubic yards , and involve an area of
approximately 20 feet by 40 feet , in order to replace
the bridge caps on the existing embankment . Excavation
spoil will be disposed of on an upland , off-site
disposal area. Best management practices will be
implemented to minimize any adverse effects which may be
caused by project-related sedimentation. "
This should clarify the items mentioned in your letter
and hopefully will clear the way for this application to be

Upper Spring Creek on SR 1230 near Hobucken .
The North Carolina Department of Transportation proposes
to replace Bridge No . 11 over Upper Spring Creek on SR 1230
near Hobucken . The proposed action will involve replacing
the existing bridge structure with one 45 foot prestressed
cored slab, supported by new end bents . This bridge
replacement will take place on existing alignment and local
traffic will be detoured along existing roadways .
No fill is to be placed in wetlands or below ordinary
high water . The average daily flow is estimated to be 2 . 0
cfs . Excavation in wetlands will be less than 0 . 01 acres and
below ordinary high water will be approximately 30 cubic
yards . Best management practices will be implemented to
minimize any adverse effects which may be caused by project-
related sedimentation .
NCDOT is requesting that the proposed work be authorized
under the appropriate Coastal Area Management Act (CAMA)
permit . This project may be authorized under Nationwide
Permit 26 "Above Headwaters" and the corresponding General
Water Quality Certification, and because the acreage impacted
will be less than 1/3 of an acre , no agency notification will
be required . Included for your information is a permit
application and permit drawings ( 3 pages ) . A processing fee
of $250 is enclosed . (Check #649198 )

Dear Sir:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original(buff-colored
form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign
both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
. 121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of
this decision on your permit. You should also be aware that if another qualified party submits a valid objection to
the issuance of this permit within twenty(20)days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department,personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise

9. NARRATIVE DESCRIPTION:
Project Setting
The project is located on SR 1230 near Hobucken on Upper Spring Creek in
Pamlico County. The existing bridge is approximately 25' wide by 36' long and spans
Upper Spring Creek which flows west into Goose Creek and the AIWW. An extensive
marsh system vegetated with Juncus roemerianus, Cladium jamaicense and Baccharis
halimifolia borders the creek and dominates much of the adjoining properties. This marsh is
separated from the high ground/road easement by drainage canals which run parallel with SR
1230. Vertical clearance under the existing bridge is only a 2.5' to 3'. Upper Spring Creek
is a Primary Nursery Area and classified SA NSW. This area of the creek is open to
shellfishing.
Project Description
The applicant proposes to replace an existing bridge with a new bridge along the
existing alignment. A 45-foot prestressed cored slab would span the creek and be supported
by new end bents outside (or landward of) the existing abutments. The use of the cored slab
eliminates any need for support structures in the creek. Excavation would be limited to an
area of high ground approximately 5' wide X 28' long X -3' deep (approximately 30 yds3)
in preparation for placement of the new bridge caps. The resultant spoil would be trucked
off site to an upland location. During the construction phase, local traffic would be detoured
along existing roadways.
Anticipated Impacts
The project as proposed would have negligible impact on the AECs in the project
area (Estuarine Waters, Public Trust Areas and Coastal Wetlands). No filling or excavation
activity is proposed in any wetland or open water area. And since only limited high ground
excavation and filling is proposed (approximately 30 yds3) there should be minimal adverse
effects caused by project-related sedimentation. The proposed project would have no effect
on navigation.

The North Carolina Department of Transportation proposes to replace
an existing bridge on SR 1230 near Hobucken on Upper Spring Creek
in Pamlico County.
AECs impacted by the proposal include Public Trust Areas, Estuarine
Waters, and the Estuarine Shoreline . Waters at the site are
classified as SA NSW and are open to the harvesting of shellfish.
The area is a Primary Nursery Area.
I have reviewed this project for consistency with the 1992 Pamlico
County Land Use Plan (LUP) Update and offer the following comments .
The general area of the project is classified as Rural with
Services . The Estuarine Shoreline AEC is classified as Conservation
I, while the Public Trust and Estuarine Waters AECs are classified
as Conservation IV.
Within the Conservation I classification, Pamlico County has
established a permanent conservation zone within seventy-five feet
of the mean high water level for all shorelines bordering primary
nursery areas and other estuarine and public trust waters .
Development activities in this conservation zone (which corresponds
to the Estuarine Shoreline AEC impacted by this project) are
strictly limited. However, allowed construction activities in these
areas include paving for access as allowed in 15A NCAC 7H.
Pamlico County allows all uses which are consistent with the 15A
NCAC 7H use standards in the Conservation IV classification.
Applicable policies in the LUP include Resource Production and
Management Policies for Marine Resource Areas (Page IV-14) . These
policies reiterate Pamlico County' s support for the use standards
for estuarine and public trust waters as specified in 15A NCAC 7H.
Economic and Community Development Policies for Transportation are
discussed on Pages IV-18 and IV-19 and support improvements that
are necessary to ensure that traffic congestion and dangerous
traffic conditions do not exist . The County' s commitment to State
and Federal Programs is discussed on Page IV-17 . Pamlico County is
generally receptive to state and federal programs, particularly
those which provide improvements to the County.

Upper Spring Creek in Pamlico County. It was initially received on August 14, 1994 and
officially accepted as complete on October 4, 1994, and appears to be adequate for processing
at this time. The projected deadline for making a decision is December 19, 1994. An additional
75-day review period is provided by law when such time is necessary to complete the review.
If you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the
75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any
questions and notify me in writing if you wish to receive a copy of my field report and/or
comments from reviewing agencies.

This letter is in reference to the 2 August 1994 CAMA Major Permit Application submitted to
this office for the replacement of an existing bridge with a new bridge over Upper Spring Creek on SR
1230 near Hobucken, in Pamlico County, North Carolina.
After a review of the application, I have determined that there is additional information that must
be included before the application can be accepted as complete and a review by the agencies can begin.
I am returning the application package along with this request for more information.
Please address the following items:
1) Your cover letter states that the amount of excavation below ordinary high water will be
approximately 30 cubic yards, yet under 6.b. you state there will be no excavation below
water level. Please clarify the inconsistency.
2) Also, if there is excavation below water level proposed, please state the type of material
to be excavated under 6.c.
3) Your cover letter also states that excavation of wetlands will be less than 0.01 acres, yet
under 6.d. you respond N/A when asked does the area to be excavated include
marshland, swamps, or other wetlands. Please clear up the inconsistency.
4) Under 6.e. for a better understanding of the area to be impacted/excavated, please
provide dimensions.
4) Under 6.g. is the upland site on or off the project site?
5) Under 6.h. since excavation is involved, either yes or no would be appropriate.
6) On the workplat, you need to show both the area of wetlands to be excavated as well as
the area below ordinary high water to be excavated.
