No. B-2120. On September 30, 1994,The Division of Coastal Management(DCM) issued a Coastal Area Management Act(CAMA)Major permit,permit number 117-94, for the replacement of the two referenced bridges on NC 130 over the Waccamaw River and Waccamaw River Overflow on the Columbus/Brunswick county line. A Corps of Engineers Nationwide Permit No. 23 (Action ID No. 199403926)dated August 10, 1994 and a Division of Water Quality General Certification#2734 were also obtained. The project was approved as a Categorical Exclusion by the Federal Highway Administration in April 1994. The chosen alternative at that time,was to detour traffic onto existing roads. Detouring traffic off-site was recommended based on lower cost and lesser impacts to wetlands, endangered species (Shortnose Sturgeon), and adjacent property. However, the Division Maintenance Office has since identified approximately $585,000 in improvements to NC 904 and NC 905 required to accommodate the additional traffic from the detour. This additional cost coupled with the need to spend $250,000 to improve SR 1333 and SR 1928 for the detour of local traffic increases the total cost for the off-site detour to $835,000. Due to this substantial increase in cost, the recommended alternative has changed to replace the bridge at the existing location with an on-site detour, Alternative 2 in the Categorical Exclusion. This was documented and approved by FHWA in an"Addendum to Categorical Exclusion" in November 1996. A copy of this Addendum is attached. 2 The new alternative will result in 0.07 acre of permanent impact in wetlands, 0.18 acre of temporary fill in wetlands, and 0.17 acre of mechanized clearing in wetlands. The on-site detour will be constructed within the maintained utility easement which is north of NC 130 and runs parallel with the road. In addition to the environmental commitments listed in the"Categorical Exclusion",NCDOT has committed to remove the temporary fill and lateral ditch and restore the area to preconstruction contour and re-vegetate. This is stated in the"Addendum to Categorical Exclusion". It is anticipated that these activities will be authorized by a major modification to the original permit. Since the original permit expires 31 December 1997,NCDOT requests that an extension be granted in the modification. Accordingly, a$250.00 check is enclosed to cover the CAMA processing fee. The adjacent property owners have been notified of the change in construction plans. Copies of the letters sent to property owners and certified mail receipts are attached. The signed return receipts from these property owners will be forwarded to you as soon as possible. By copy of this letter, a request is also made to the Corps of Engineers for issuance of a new Nationwide Permit No. 23. Thank you for your assistance. This committee consisted of representatives from the U.S. Fish and Wildlife Service, National Marine Fisheries Service, Wildlife Resources Commission, Division of Marine Fisheries, Division of Environmental Management, as well as representatives from the Planning and Environmental branch, Bridge Maintenance Unit, and Hydraulics Unit of the NCDOT. Together the attached guidelines were negotiated and developed to establish a uniform policy on handling of this issue in our various project development activities. The purpose of this document is to provide guidance to the North Carolina Department of Transportation to ensure that replacement of existing and new highway stream crossing structures will not impede the movement of Anadromous Fish. Applicable When: o Project is in the coastal plain defined by the "Fall Line" as the approXifiate western limit ( see attached figure).:.' o For perennial and intermittent streams delineated on most recent USGS 7 . 5 minute quadrangle maps . General Guidelines: o Design and scheduling of projects should avoid the necessity of instream activities during the spring migration period . For the purposes of these guidelines "Spring" is considered to fall between February 15 and June 15 . (In areas where the shortnose sturgeon may be present, the Cape Fear, Brunswick and Waccamaw Rivers, spring shall be defined as February 1 to June 15) . o Bridges and other channel spanning structures are preferred where practical. Technical Guidelines : o In all cases , the width, height and gradient c " the proposed opening shall be such as to pass the average historical spring flow without adversely altering flow velocity . Spring flow should be determined from gage data if available . In the absence of this data, bankfull flow can be used as a comparative level . (Reference, "Fisher`. - Handbook of Engineering Requirements and Biological Criteria" , Bell 1973 , for fish swimming limitations . ) o The invert of culverts shall-be set at least one foot below the natural stream bed . No. B-2120 I. Background A Project Planning Report (Categorical Exclusion) for the subject project was approved by the Federal Highway Administration in April 1994. The recommended alternate was to replace the bridge at the existing location and detour traffic off-site. Detouring traffic off-site was recommended based on lower cost and lesser impacts to wetlands, endangered species (Shortnose Sturgeon), and adjacent property. II. Environmental Commitment In addition to the environmental commitments in the Categorical Exclusion, the temporary detour approach fills and lateral ditch will be removed to preconstruction contour and re-vegetated. III. Discussion During the development of the Categorical Exclusion, no improvements to NC 904 and NC 905 were recommended. The Division Maintenance Office has identified approximately $585,000 in improvements to NC 904 and NC 905 required to accommodate the additional traffic. This additional cost increases the total off-site detour cost from the $250,000 needed to improve SR 1333 and SR 1928 for detour of local traffic to $835,000. Due to the substantial increase in the cost of the off-site detour, the recommended alternate has changed to replace the bridge at the existing location with an on-site detour, Alternate 2 in the Categorical Exclusion. Traffic will be maintained on-site with a temporary detour structure immediately north of the existing bridge. The temporary detour structure will be a bridge 150 feet in length spanning the main channel. Preliminary hydraulic studies determined that in order to accommodate the five year storm a detour structure is not required for the overflow channel. A temporary lateral ditch will be constructed along the north side of the detour to channel water from the overflow structure. The on-site detour involves construction of a temporary roadway and bridge which will parallel the existing roadway starting approximately 500 feet west of Bridge No. 63 and ending approximately 400 feet east of Bridge No. 72 for a total length of 1650 feet. Design speed for detour will be a minimum of 40 mph. The cost of the project with no improvements to NC904 and NC 905 was $1,489,500. The cost for the project, including the on-site detour, is estimated at $1,823,000. IV. Environmental Considerations The on-site detour will entail laying mats and temporarily filling approximately 2.1 acres of wetland. This fill and the temporary structure will be removed after construction of the permanent bridges is complete. An individual Section 404 permit will not be required from the Corps of Engineers because the conditions of Section 404 Nationwide Permit #23, Categorical Exclusion, under 33 CFR 330 Appendix A (B-23) are applicable. However, final permit decisions are left to the discretionary authority of the United States Army Corps of Engineers. The Shortnose sturgeon (Acipenser brevirostrum) has been documented in the lower section of the Waccamaw River, but no surveys have been conducted this far upstream. If the Shortnose sturgeon does travel here to spawn, its migration would not be hampered by the proposed project because flow will not be impeded. An informal consultation was held on February 3, 1994 at the site to determine the potential impacts to the Shortnose sturgeon. Franklin Vick of the NC Department of Transportation to modify and extend Permit #117-94. This permit was issued on 09/30/94 for the replacement of bridges #72 and #63 across the Waccamaw River on Hwy 130 in the New Britton community of Brunswick County. Waccamaw River, which has been designated as inland waters by the Division of Marine Fisheries, represents the boundary between Brunswick and Columbus counties. Bridge # 72 crosses Waccamaw River proper and therefore separates Brunswick County from Columbus County. However, Bridge #63 crosses the Waccamaw River overflow and is entirely in Columbus County The applicant is proposing to modify the permit (Alternate 2 within the original permit application) by relocating the off-site detouring traffic to an on-site location within the maintained utility easement which is north of NC 130 and runs parallel with the road. The modification has become necessary because of the additional costs for improvements ($835,000) associated with the original plan of detouring traffic to an off-site location. The applicant is proposing a 230 ft long by 25 ft wide temporary bridge over Waccamaw River as the detour for Bridge #72. The applicant is also proposing temporary fill with maximum dimensions of 160 ft by 61 ft in federal wetlands in association with the detour over the Waccamaw River overflow (Bridge #63) in Columbus County. The modifications will result in 0.07 acre of permanent impact in federal wetlands, 0.18 acre of temporary fill in federal wetlands, and 0.17 acre of mechanized clearing in federal wetlands. The applicant has committed to removing the temporary fill and restoring the area to preconstruction contour and re-vegetating at the completion of the project. The dimensions of the proposed wetland fill on the Brunswick county side of the bridge are 29.52 ft X 36.08 ft X 13.12 ft which equates to 183.28 sq. ft. or 0.0042 acres. All remaining fill within wetlands is proposed on the Columbus county side. Columbus County is not included within the twenty coastal counties which fall under CAMA jurisdiction. No fill material is proposed below normal high water. The applicant has submitted the necessary information and meets the requirements set forth in 07J.0404(a). The applicant wishes for a concomitant review of both requests (modification and extension).
