1) This minor modification authorizes the placement o our (4) 24" diameter steel piles in Spencer
Creek, as depicted in the attached location chart, for the purposes of providing safe and secure '�
mooring for crane barges during storm events. 4/
2) The permittee must install and maintain at his expense any signal lights or signals prescribed by the '
U.S. Coast Guard and/or the N.C.Wildlife Resources Commission, through regulation or otherwise, '
on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure ,
in order to make it more visible during hours of darkness or inclement weather. ,
3) The temporary piles shall be removed within six (6) months of project completion.

The Department of Transportation requests authorization for the installation of four (4)
24" diameter steel piles in a section of Spencer Creek near the Ferry Division
Maintenance Facility on SR 1105. The purpose of the mooring piles is to provide a safe
and secure harbor for crane barge(s) during storm events. Balfour Beatty, whose crane
barge(s) that are in use at the Manteo Bypass construction project, will make use of the
mooring facilities.
It is requested that you approve this activity as a Minor Modification to the existing
CAMA Major Development Permit.
The Department assures the Division of Coastal Management that there are no plans to
excavate, dredge, or otherwise modify bottom contours in the vicinity of the proposed
piling locations. Furthermore, the Department (or its contractor) will provide location
information to the U.S. Coast Guard so that it can issue a notice to mariners.
A check for$50.00 to cover the Minor Modification application fee, copies of letters and
notification forms sent to adjacent riparian landowners and maps depicting pile locations
are submitted for your consideration. Note that state plane coordinates have been
provided for each proposed piling.
Please issue the modification at your earliest opportunity. Feel free to contact me if you
need any additional information. As always, your time and cooperation and are greatly
appreciated.

SUBJECT: NCDOT Modification Request for CAMA Permit No. 7-98, Modification III
DATE: May 14, 1999
The NCDOT is requesting a modification of CAMA Major Permit No. 7-98, Croatan
Sound Bridge, Dare County to install four storm mooring pilings in Spencers Creek across
from the state ferry maintenance facility. The purpose of the moorings is to provide a safe
mooring during a storm. A chart indicating the proposed location of the mooring pilings has
been received in this office as well as copies of the adjacent riparian notification letters and
a check for $50.00 (#5328).
It is recommended that the notification request be approved with the following
conditions:
1. The authorized structure and associated activity must not cause an unacceptable
interference with navigation.
2. The permittee must install and maintain, at his expense, any signal lights, signs and/or
signals proscribed by the US Coast Guard or the North Carolina Wildlife Resources
Commission through regulations or otherwise, on the authorized structure.
3. Structure must be removed within 6 months of completion of the Croatan Sound
Bridge project.

The North Carolina Department of Transportation is proposing to install four (4) metal pilings in
the Spencer Creek channel located near the entrance to the Ferry Maintenance Facility basin at
Manus Harbor. These pilings will be used to moor crane barge(s) during storm events. The
pilings will be in place only during the construction of the Croatan Sound Bridge. The proposed
work will occur within Estuarine and/or Public Trust Waters, which are Areas of Environmental
Concern (AEC). This proposed action falls under the regulatory authority of the Division of
Coastal Management (DCM). The DCM regulates development within AECs in accordance with
the Coastal Area Management Act(CAMA).
The CAMA requires that adjacent riparian landowners be given an opportunity to review the
proposals that would constitute development in an AEC, and to comment, if they choose to do so.
Since the proposed action will require a General Permit from the DCM, the law provides for a
10-day comment period (unless you choose to respond sooner). The attached form is designed to
provide you a convenient and expeditious way to signal whether you have any objections (or
other comments) to the proposal. Should you want to comment,you may call or write to:

ADJACENT RIPARIAN LANDOWNER STATEMENT
(Dare County: Install Temporary Pilings in Spencer Creek)
The Department of Transportation is proposing to install four (4) metal pilings in Spencer
Creek near the entrance to the Ferry Maintenance Facility basin at Manns Harbor. The
24" diameter pilings will be used to moor crane barge(s) during storm events throughout
the construction of the new Croatan Sound Bridge.
The attached drawings and maps depict the proposed location of the pilings and their
relationship to adjacent landowners.
This form allows you, the adjacent riparian landowner/manager to express either: (1) that
he/she objects to the project; or, (2) that he/she does not object. Of course, the adjacent
riparian landowner need not sign this form at all if he/she so chooses. No response
within 10 days will be construed to mean the adjacent riparian landowner has no
objections.
