Dear Mr. Riddick:
This letter of refinement is in reference to your correspondence dated 21 October
1999 requesting a refinement of CAMA Major Permit #7-98 issued to the North Carolina
Department of Transportation on January 20, 1998. Permit #7-98 was issued for the
construction of a new Croatan Sound bridge with improvements to US 64/264 from west
of Manns Harbor to NC 345, south of Manteo, in Dare County.
Your request to refine the aforementioned permit to allow for a change of the
instream moratorium permit condition to start on 1 March rather than 1 February is
hereby authorized. All other permit conditions including the 31 December 2001
expiration date still apply and remain unchanged. This refinement will become a part of
the permit file and construction should be accomplished accordingly.

SUBJECT: Request for refinement of CAMA Major Development
Permit No. 7-98 for the Improvements to US 64-264 from West
of Manns Harbor to South of Manteo, Dare County; Federal Aid
Project No.NHF-64(6); State Project No. 8.T051401; TIP No. R-2551

Dear Mr. Jennings,
As you are aware, a pre-construction meeting was held for the B
section of TIP Project R-2551 on September 27, 1999. During the
meeting, permit and jurisdictional issues, as they relate to the
contract, were discussed. Condition One of CAMA Major
Development Permit No. 7-98 currently states that "In order to
protect juvenile shrimp and finfish populations, no excavation or
filling will be permitted within the waters of Spencer Creek between
February 1 to June 30 of any year without the prior approval of the
Division of Coastal Management, in consultation with the Division of
Marine Fisheries". Additionally, condition "z" of Department of the
Army Individual Permit No. 199502334 prohibits instream
construction from March 1 to September 30 of any year. The
combination of the two conditions effectively reduces the
construction window to only four months.

The North Carolina Department of Transportation (NCDOT) requests
that CAMA Major Development Permit No. 7-98 be refined to reflect
an instream moratorium from March 1 to June 30, rather than
February 1 to June 30. The moratorium in condition z of
Department of the Army Individual Permit No. 199502334 will still be
in effect from June 30 to September 30. This has been discussed
with Ms. Sara Winslow and Ms. Beth Burns of the North Carolina
Division of Marine Fisheries (NCDMF). Both Ms. Winlsow and Ms. Burns
have indicated that the NCDMF does not object to moving the
moratorium from February to March.
