Dear Mr. Bell: The purpose of this letter is to address compensatory mitigation concerns described in a letter dated April 24, 2001 from the US Environmental Protection Agency(EPA)Region 4 Wetlands Section in Atlanta. The letter was a response to the US Army Corps of Engineers Public Notice for the proposed permit modification of R-2551 for the construction of the Roanoke Island Visitor Center/Rest Area in Dare County, North Carolina. During the development of the permit application, the NC Department of Transportation (NCDOT)met on several occasions with state and federal resource agencies concerning this project. The table below provides dates of these meetings and agencies in attendance. Each meeting was held in Raleigh,NC unless otherwise indicated. One of these conditions, as requested by the Corps of Engineers, included the permanent closure of the existing access points located along the new portion of US 64-264, between the Croatan Sound and NC 345, currently under construction in Dare County near Manteo. Each of these access points, with the exception of the access to be used for the Roanoke Island Visitor Center/Rest Area, has been permanently closed. As outlined in the submitted Roanoke Island Visitor Center/Rest Area Mitigation Plan, NCDOT has also committed to the revegetation of stream buffers within NCDOT right-of-way as part of permit application due to impacts to the stream. This work will be conducted on approximately 820 ft of the stream buffers(including areas proposed for wetland creation/restoration). This mitigation package was developed in concert with all agencies for more than a year. • Attached please find a summary for the project provided at one of the interagency meetings that explains additional information about the proposed project including purpose and need, avoidance and minimization efforts, as well previous agency coordination. This is provided to specifically assist the EPA in better understanding the coordinated effort on this project. Based on the information provided above, NCDOT requests that the EPA reconsider and withdraw their recommendations made in response to the Public Notice for the permit modification associated with Roanoke Island Visitor Center/Rest Area. NCDOT feels that the mitigation plan submitted with the permit modification application adequately reflects the significant and extensive coordination that occurred with both state and federal agencies during the development of the permit application. _ Considering the urgency of this project, we request timely action on this matter in that any changes to the submitted mitigation plan will re-engage multiple agency peiinits and reviews. Dominant vegetation present in this community includes loblolly pine(Pinus teada),red bay(Persea borbonia),wax myrtle(Myrica cerifera), and red maple (Acer rubrum). A 2 NCDOT proposes to mitigate for the 1.14 acres of wetland impacts by constructing the attached onsite Roanoke Island Visitor Center/Rest Area Mitigation Plan(VCMP) dated February 2001. The VCMP proposes to restore 0.88 acres of estuarine fringe wetlands. NCDOT proposes to mitigate for the remaining impacts at off-site mitigation areas. NCDOT will mitigate for stream bank impacts by planting within the NCDOT right-of-way as provided in the VCMP. The applicant has determined that the proposed work is consistent with the North Carolina Coastal Zone Management Plan and has submitted this determination to the North Carolina Division of Coastal Management(NCDCM) for their review and concurrence. This proposal shall be reviewed for the applicability of other actions by North Carolina agencies such as: a. The issuance of a Water Quality Certification under Section 401 of the Clean Water Act by the North Carolina Division of Water Quality(NCDWQ). b. The issuance of a permit to dredge and/or fill under North Carolina General Statute 113-229 by the North Carolina Division of Coastal Management (NCDCM). c. The issuance of a permit under the North Carolina Coastal Area Management Act (CAMA)by the North Carolina Division of Coastal Management(NCDCM) or their delegates. d. The issuance of an easement to fill or otherwise occupy State-Owned submerged land under North Carolina General Statute 143-341(4), 146-6, 146-11, and 146-12 by the North Carolina Department of Administration(NCDA) and the North Carolina Council of State. e. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. The District Engineer,based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. This notice initiates the Essential Fish Habitat(EFH) consultation requirements of the Magnuson-Stevens Fishery Conservation and Management Act. The DE's initial determination is that the proposed project would not adversely impact EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Councils or the NMFS. The decision whether to issue a permit modification will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns,wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use,navigation, shore erosion and accretion,recreation,water supply and conservation, water quality, energy needs, safety, food and fiber production,mineral needs, considerations of property ownership, and, in general,the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit modification will be denied if the discharge that would be authorized by such modification would not comply with the Environmental Protection Agency's 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit modification will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally,the decision whether to issue this Department of the Army(DA)permit modification will not be made until the North Carolina Division of Water Quality(NCDWQ)issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDWQ considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the NCDWQ for certification. 4 Additional information regarding the Clean Water Act certification may be reviewed at the offices of the North Carolina Division of Water Quality(NCDWQ), at the address specified below. The scope of work for this project was documented as a Categorical Exclusion (CE) approved by the Federal Highway Administration [Federal Aid Project NHS 64 (27), State Project 8.1052501] on 8 August, 2000. On March 5, 1998, the U.S. Army Corps of Engineers issued a permit, Action I.D. # 199502334, for improvements to US 64-264, including the construction of a new Croatan Sound Bridge, from west of Manns Harbor to NC 345 south of Manteo in Dare County [TIP No. R- 2551, Federal Aid Project No. NHF-64 (6), State Project No. 8.T051401]. This access, which is located south of the US 64-264 corridor is now owned by the N.C. Wildlife Resources Commission (WRC) has been closed and will not be used to provide access to to the new section of US 64-264 once construction is complete. A letter from WRC is included with this permit application. The access to the property on the northern side of the corridor is registered to Dare County. Terry Wheeler, Dare County Manager has informed NCDOT that the County is in the process of closing the access, however a definite date of closure is unavailable at this time. Written confirmation of this closure will be forwarded as soon as it becomes available. NCDOT is aware that this project will not be permitted unless this access is permanently closed. This permit modification is being sent with the full understanding that the issue of closure will be addressed, however this application is being sent to expedite the processing time. Environmental Impacts Jurisdictional Streams. An unnamed tributary to the Croatan Sound [DWQ Index No. 30- 20-(2), (8/1/90)], will be crossed by the driveway for the visitor center and rest area resulting in 145.5 linear ft of impacts. This is a perennial stream in the Pasquotank River Basin which carries a Best Usage Classification of SA which are salt waters suitable for commercial, shellfishing, and all other tidal saltwater uses by definition. No stream relocation or channel change will be involved. There will also be 0.01 acres of fill in surface waters Jurisdictional Wetlands. Project construction will result in 1.14 ac of permanent impacts to a portion of a estuarine fringe forest. Dominant vegetation present in this community include loblolly pine (Pinus taeda), red bay (Persea borbonia), wax myrtle (Myrica cerifera), red maple (Acer rubrum), greenbrier (Smilax sp.), and American holly (Ilex opaca). Impacts consist of 0.82 acres of fill, 0.18 ac of isolated wetlands, and 0.15 acres due to mechanized clearing. Permit drawings depicting this proposed work are attached. Threatened And Endangered Species. The following species are listed as threatened, endangered, or experimental for Dare County: A Biological Conclusion of No Effect has been reached for each of the following species. Final concurrence from the U.S. Fish and Wildlife Service was issued for each of these species on February 20, 2001. • Red wolf(Canus rufus). Experimental. • Loggerhead turtle (Caretta caretta). Threatened • Piping plover(Charadrius melodus). Threatened • Green sea turtle (Chelonia mydas). Threatened • Leatherback turtle (Dermochelys coriacea). Endangered • American alligator (Alligator mississippiensis). Threatened (S/A) • Hawksbill sea turtle (Eretomochelys imbricata). Endangered • Bald eagle (Haliaeetus leucocephalus). Threatened • • Kemp's ridley sea turtle (Lepidochelys kempii). Endangered • West Indian manatee (Trichechus manatus). Endangered • Red-cockaded woodpecker (Picoides borealis). Endangered • Roseate tern (Sterna dougallii). Endangered • Seabeach amaranth (Amaranthus pumilus). Threatened Cultural Resources. No historic structures listed in or eligible for the National Register of Historic Places are located within the project area. This determination was issued by the State Historic Preservation Office (SHPO) and the Federal Highway Administration (FHWA) on May 10, 2000. There is one known archaeological site, 31DR76, within the proposed project. The site was originally thought to have been eligible for the National Register. However, after additional evaluation, SHPO found the site to be not eligible. Mitigation Sequencing Avoidance. The NCDOT is committed to incorporating all practicable design features to avoid and minimize wetland impacts, and to provide full compensatory mitigation of the remaining wetland impacts. During the design of this project,NCDOT has investigated several alternatives for the location of the driveway entrance to the Visitor Center and Rest Area. The Categorical Exclusion (CE) describes in detail why the current location was selected; however, there have been some developments relating to this issue since the CE was signed. The Army Corps of Engineers, the N.C. Division of Water Quality, and the N.C. Wildlife Resource Commission all expressed their concern over the location of the driveway entrance and the associated impacts to wetlands and the unnamed tributary to the Croatan Sound. Based on these comments,NCDOT investigated moving the location of the driveway such that it would avoid impacting these resources. By moving the driveway entrance north of the proposed location, additional wetland impacts would occur. NCDOT's proposed location places the entrance in a location that minimizes impacts to the surrounding wetlands. Moving the driveway entrance south of its proposed location was also investigated; however, this alternative would compromise the safety of the traveling public along the US 64 Bypass as well as those exiting the Visitor Center. The minimum safe stopping/sight distance listed in the Roadway Design Manual is 917 feet. From the end of the bridge rail on the US 64 Bypass, which is the farthest point south for which cars exiting the Visitor Center can see,to the proposed driveway entrance, the sight distance is 967 feet. Therefore, the proposed entrance location is situated such that it is approximately 50 feet greater than the minimum design limit for safe stopping/sight distance as listed in the Roadway Design Manual. Moving the driveway entrance 50 feet to the south, the point of minimum design safe stopping/sight distance, would place the entrance directly on top of the unnamed tributary to the Croatan Sound and would; therefore, dramatically increase the amount of linear stream impacts associated with this project. Due to existing topography and design constraints it was determined that the driveway entrance location could not be moved without additional wetland and stream impacts or unacceptable compromises to driver safety. Avoidance measures were taken during the planning phases of the CE; minimization measures were incorporated as part of the project design. The avoidance measures will include: 1. Permanent closure of two existing access points along the portion of US 64-264 currently under construction. 2. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. 3. All wetland areas not affected by the project will be protected from unnecessary encroachment. Minimization. Minimization includes the examination of appropriate and practicable steps to reduce the adverse impacts. Minimization techniques were implemented as follows: 1. Slopes: Fill slopes adjacent to the stream crossing are at a 2:1 ratio as opposed to the original designs of 3:1. 2. High quality water standards: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands will be enforced. 3. Reduced impacts to surface waters: Impacts to surface waters were reduced to 145.5 linear ft compared to approximately 600 linear ft for the original design. Mitigation—Jurisdictional Wetlands. The project will impact 1.14 ac. of jurisdictional wetlands. NCDOT proposes to offer 0.88 ac of onsite mitigation in the form of both restoration and creation (0.11 ac., 0.77 ac. respectively). The attached Onsite Mitigation Plan for the Roanoke Island Visitor Center/Rest Area provides detailed information pertaining to onsite mitigation, but the plan is summarized in the following paragraph. NCDOT also proposes to debit wetland mitigation sites for the remaining impacts, one of which is not in Dare County. NCDOT is aware of Dare County's Land Use Plan and justification for debiting a site outside of the county is explained later in this section. Wetland compensation for the Visitor Center/Rest Area will be accomplished by restoration, creation, and preservation(see Table 1). NCDOT plans to mitigate for 0.88 ac. of the total wetland impacts through on-site restoration of 0.11 ac. (1:1) and creation of 0.77 ac. (1:1) by removing fill from portions of the onsite borrow pit. These areas will then be vegetated with species matching the estuarine fringe wetland community. NCDOT requests a 1:1 ratio for creation due to the high probability of success for extending adjacent wetland boundaries. In addition, NCDOT will preserve 1.1 ac. of estuarine fringe wetlands on the Visitor Center/Rest Area property. NCDOT plans to mitigate for the remaining 0.26 ac. of impacts offsite. NCDOT will mitigate 0.26 ac. with 0.26 ac. of successful riverine wetland restoration (1:1) at the NCDOT owned Dismal Swamp Mitigation Site in Gates and Perquimans Counties. A summary sheet showing total debits to the site and coordinates for this debit are included with this permit modification. NCDOT plans to mitigate for the remaining portion of the 0.26 ac. of impacts with 1.3 ac. of forested wetland preservation (5:1) at the Mashoes Road Mitigation Site in Dare County. Per conversations with resources agencies, no stream restoration will be required due to impacts being less than 150 ft however,NCDOT will vegetate the portions of the stream banks where vegetation has been removed do to a.stream restoration project. The stream banks to be vegetated are within NCDOT right-of-way and will include species matching the estuarine fringe wetland community. TABLE 1. Total 3.54 Dare County's Land Use Plan requires that "Mitigation activities and improvements designed as compensation for wetland loss occurring in Dare County shall be located, whenever possible, in Dare County and in proximity to the loss." Landmark Design Group (formerly Langley and McDonald), conducted a wetland mitigation search for the Pasquotank River Basin in September of 1998 under contract with NCDOT. Of the sites identified, only one (Mashoes Road Site) included mitigation within Dare County matching the impacts associated with this project. The Forested Wetland Restoration acreage at this site has been debited for other NCDOT projects. Therefore,NCDOT proposes to debit 0.26 ac of wetland restoration outside of Dare County. The N.C. Coastal Resources Commission has adopted a 30 ft buffer for new development along navigable waterways in the 20 counties governed by the N.C. Division of Coastal Management. A portion of the fill material necessary for the Visitor Center/Rest Area will be placed within 30 ft of the unnamed tributary to the Croatan Sound. NCDOT plans to remove portions of the existing fill material that falls within the 30 ft buffer and replace it with new fill material to create a more stable fill slope. However, this new fill material will not exceed the footprint of the existing fill material and NCDOT has minimized where possible, the need to place any fill material within the 30 ft buffer. Also included with this permit modification is revised information for wetland reforestation planting in wetland areas east of the new Croatan Sound bridge currently under construction. At the request of the Roanoke Corridor Commission, indigenous wetland trees will be planted from the toe of slope to existing vegetation and/or right-of-way line totaling 2.1 ac. No additional fill, excavation, or clearing in jurisdictional wetlands will occur as a result of this reforestation. The mix will planted at rate of approximately 680 trees/acre and include: 20%Pinus taeda, loblolly pine 20% Quercus virginiana, live oak (planted closest to the toe of slope) 20 % Taxodium distichum, bald cypress 20%Magnolia virginiana, sweetbay magnolia 20% Quercus nigra, water oak It is anticipated these activities will be authorized by a modification to the existing U.S. Army Corps of Engineers (Action ID No. 199502334). Checks in the amount of$100.00 are enclosed to cover the CAMA processing fee and $475.00 for the NCDWQ processing fee. The adjacent property owner has been notified of this permit request. A copy of the letter sent to the property owner and the certified mail receipt are attached. The signed return receipt from this property owner will be forwarded to you as soon as possible. The N.C. Stormwater Management permit application is also attached as required by NCDWQ. By copy of this letter,NCDOT requests a modification of the permits issued by N.C. NCDOT proposes to debit 0.26 ac of wetland restoration outside of Dare County. 2.0 Roanoke Island Visitor Center/Rest Area Mitigation Site The purpose of this report is to document the existing site conditions at the location of the proposed Visitor Center/Rest Area, to describe the wetland restoration, and to establish the restoration monitoring for the Roanoke Island Visitor Center/Rest Area Mitigation Plan. This plan includes on-site wetland restoration and creation associated with the borrow pit that previously existed onsite. As described earlier, the 0.11 ac. of on-site wetland restoration and 0.77 ac. of creation is proposed as a portion of the required mitigation for Visitor Center/Rest Area. 2.1 Site Description The existing site is approximately 9.2 ac in size. Before the purchase of the property by NCDOT, the majority of the property was used as a borrow pit and spoil basin. Since that time, the basin walls have been pushed in and the spoil material has been mixed with material from the berm that once enclosed the basin. The change in slope across the site is from 1.5 feet above mean sea level (msl) to 5.0 feet above msl. The wetland area east of the borrow pit is characterized as an estuarine fringe forest community. Dominant vegetation present in the estuarine fringe community includes loblolly pine (Pinus taeda), red bay (Persea borbonia), wax myrtle (Myrica cerifera), red maple (Acer rubrum), greenbrier (Smilax sp.), and American holly (Ilex opaca). The wetland area east of the borrow pit has the same vegetation as the east side, with the exception of less loblolly pine and silverling (Baccharis halimifolia) is the dominant vegetation. The soils in this area are mapped by the Soil Survey of Dare County (NRCS, 1992) as the Baymeade-Icaria-Johns association. However, Urban fill is the dominant soil type in the study area,primarily associated with the borrow pit. Baymeade fine sand, Leon fine sand, and Belhaven muck are also located within the project study area. 2.2 Methodology The goal of the mitigation plan is to establish a wetland community classified as Estuarine Fringe. The proposed Visitor Center/Rest Area Mitigation Site will provide 0.88 acres of on-site wetland restoration/creation by removal of the existing fill associated with the borrow pit that was previously onsite (Figure 1). One of the two access points to the section of US 64-264 currently under construction between the new Croatan Sound Bridge and NC 345 south of Manteo, has been permanently closed at the request of the U.S. Army Corps of Engineers. This access, which is located south of the US 64-264 corridor is now owned by the N.C. Wildlife Resources Commission (WRC) has been closed and will not be used to provide access to to the new section of US 64-264 once construction is complete. A letter from WRC is included with this permit application. The access to the property on the northern side of the corridor is registered to Dare County. Terry Wheeler, Dare County Manager has informed NCDOT that the County is in the process of closing the access, however a definite date of closure is unavailable at this time. Written confirmation of this closure will be forwarded as soon as it becomes available. NCDOT is aware that this project will not be permitted unless this access is permanently closed. This permit modification is being sent with the full understanding that the issue of closure will be addressed, however this application is being sent to expedite the processing time. Environmental Impacts Jurisdictional Streams. An unnamed tributary to the Croatan Sound [DWQ Index No. 30- 20-(2), (8/1/90)], will be crossed by the driveway for the visitor center and rest area resulting in 145.5 linear ft of impacts. This is a perennial stream in the Pasquotank River Basin which carries a Best Usage Classification of SA which are salt waters suitable for commercial, shellfishing, and all other tidal saltwater uses by definition. No stream relocation or channel change will be involved. There will also be 0.01 acres of fill in surface waters Jurisdictional Wetlands. Project construction will result in 1.14 ac of permanent impacts to a portion of a estuarine fringe forest. Dominant vegetation present in this community include loblolly pine (Pinus taeda), red bay (Persea borbonia), wax myrtle (Myrica cerifera), red maple (Acer rubrum), greenbrier (Smilax sp.), and American holly (Ilex opaca). Impacts consist of 0.82 acres of fill, 0.18 ac of isolated wetlands, and 0.15 acres due to mechanized clearing. Permit drawings depicting this proposed work are attached. Threatened And Endangered Species. The following species are listed as threatened, endangered, or experimental for Dare County: A Biological Conclusion of No Effect has been reached for each of the following species. Final concurrence from the U.S. Fish and Wildlife Service was issued for each of these species on February 20, 2001. • Red wolf(Canus rufus). Experimental. • Loggerhead turtle (Caretta caretta). Threatened • Piping plover(Charadrius melodus). Threatened • Green sea turtle (Chelonia mydas). Threatened • Leatherback turtle (Dermochelys coriacea). Endangered • American alligator (Alligator mississippiensis). Threatened (S/A) • Hawksbill sea turtle (Eretomochelys imbricata). Endangered • Bald eagle (Haliaeetus leucocephalus). Threatened • Kemp's ridley sea turtle (Lepidochelys kempii). Endangered • West Indian manatee (Trichechus manatus). Endangered • Red-cockaded woodpecker (Picoides borealis). Endangered • Roseate tern(Sterna dougallii). Endangered • Seabeach amaranth (Amaranthus pumilus). Threatened Cultural Resources. No historic structures listed in or eligible for the National Register of Historic Places are located within the project area. This determination was issued by the State Historic Preservation Office (SHPO) and the Federal Highway Administration (FHWA) on May 10, 2000. There is one known archaeological site, 31DR76, within the proposed project. The site was originally thought to have been eligible for the National Register. However, after additional evaluation, SHPO found the site to be not eligible. Mitigation Sequencing Avoidance. The NCDOT is committed to incorporating all practicable design features to avoid and minimize wetland impacts, and to provide full compensatory mitigation of the remaining wetland impacts. During the design of this project,NCDOT has investigated several alternatives for the location of the driveway entrance to the Visitor Center and Rest Area. The Categorical Exclusion (CE) describes in detail why the current location was selected; however, there have been some developments relating to this issue since the CE was signed. The Army Corps of Engineers, the N.C. Division of Water Quality, and the N.C. Wildlife Resource Commission all expressed their concern over the location of the driveway entrance and the associated impacts to wetlands and the unnamed tributary to the Croatan Sound. Based on these comments,NCDOT investigated moving the location of the driveway such that it would avoid impacting these resources. By moving the driveway entrance north of the proposed location, additional wetland impacts would occur. NCDOT's proposed location places the entrance in a location that minimizes impacts to the surrounding wetlands. Moving the driveway entrance south of its proposed location was also investigated; however, this alternative would compromise the safety of the traveling public along the US 64 Bypass as well as those exiting the Visitor Center. The minimum safe stopping/sight distance listed in the Roadway Design Manual is 917 feet. From the end of the bridge rail on the US 64 Bypass, which is the farthest point south for which cars exiting the Visitor Center can see, to the proposed driveway entrance, the sight distance is 967 feet. Therefore, the proposed entrance location is situated such that it is approximately 50 feet greater than the minimum design limit for safe stopping/sight distance as listed in the Roadway Design Manual. Moving the driveway entrance 50 feet to the south,the point of minimum design safe stopping/sight distance, would place the entrance directly on top of the unnamed tributary to the Croatan Sound and would; therefore, dramatically increase the amount of linear stream impacts associated with this project. Due to existing topography and design constraints it was determined that the driveway entrance location could not be moved without additional wetland and stream impacts or unacceptable compromises to driver safety. Avoidance measures were taken during the planning phases of the CE; minimization measures were incorporated as part of the project design. The avoidance measures will include: 1. Permanent closure of two existing access points along the portion of US 64-264 currently under construction. 2. No staging of construction equipment or storage of construction supplies will be allowed in wetlands or near surface waters. 3. All wetland areas not affected by the project will be protected from unnecessary encroachment. Minimization. Minimization includes the examination of appropriate and practicable steps to reduce the adverse impacts. Minimization techniques were implemented as follows: 1. Slopes: Fill slopes adjacent to the stream'crossing are at a 2:1 ratio as opposed to the original designs of 3:1. 2. High quality water standards: Strict enforcement of sedimentation and erosion control Best Management Practices (BMP) for the protection of surface waters and wetlands will be enforced. 3. Reduced impacts to surface waters: Impacts to surface waters were reduced to 145.5 linear ft compared to approximately 600 linear ft for the original design. Mitigation—Jurisdictional Wetlands. The project will impact 1.14 ac. of jurisdictional wetlands. NCDOT proposes to offer 0.88 ac of onsite mitigation in the form of both restoration and creation (0.11 ac., 0.77 ac. respectively). The attached Onsite Mitigation Plan for the Roanoke Island Visitor Center/Rest Area provides detailed information pertaining to onsite mitigation, but the plan is summarized in the following paragraph. NCDOT also proposes to debit wetland mitigation sites for the remaining impacts, one of which is not in Dare County. NCDOT is aware of Dare County's Land Use Plan and justification for debiting a site outside of the county is explained later in this section. Wetland compensation for the Visitor Center/Rest Area will be accomplished by restoration, creation, and preservation (see Table 1). NCDOT plans to mitigate for 0.88 ac. of the total wetland impacts through on-site restoration of 0.11 ac. (1:1) and creation of 0.77 ac. (1:1) by removing fill from portions of the onsite borrow pit. These areas will then be vegetated with species matching the estuarine fringe wetland community. NCDOT requests a 1:1 ratio for creation due to the high probability of success for extending adjacent wetland boundaries. In addition,NCDOT will preserve 1.1 ac. of estuarine fringe wetlands on the Visitor Center/Rest Area property. NCDOT plans to mitigate for the remaining 0.26 ac. of impacts offsite. NCDOT will mitigate 0.26 ac. with 0.26 ac. of successful riverine wetland restoration (1:1) at the NCDOT owned Dismal Swamp Mitigation Site in Gates and Perquimans Counties. A summary sheet showing total debits to the site and coordinates for this debit are included with this permit modification. NCDOT plans to mitigate for the remaining portion of the 0.26 ac. of impacts with 1.3 ac. of forested wetland preservation (5:1) at the Mashoes Road Mitigation Site in Dare County. Per conversations with resources agencies, no stream restoration will be required due to impacts being less than 150 ft however, NCDOT will vegetate the portions of the stream banks where vegetation has been removed do to a stream restoration project. The stream banks to be vegetated are within NCDOT right-of-way and will include species matching the estuarine fringe wetland community. TABLE 1. Total 3.54 Dare County's Land Use Plan requires that "Mitigation activities and improvements designed as compensation for wetland loss occurring in Dare County shall be located,whenever possible, in Dare County and in proximity to the loss." Landmark Design Group (formerly Langley and McDonald), conducted a wetland mitigation search for the Pasquotank River Basin in September of 1998 under contract with NCDOT. Of the sites identified, only one (Mashoes Road Site) included mitigation within Dare County matching the impacts associated with this project. The Forested Wetland Restoration acreage at this site has been debited for other NCDOT projects. Therefore,NCDOT proposes to debit 0.26 ac of wetland restoration outside of Dare County. The N.C. Coastal Resources Commission has adopted a 30 ft buffer for new development along navigable waterways in the 20 counties governed by the N.C. Division of Coastal Management. A portion of the fill material necessary for the Visitor Center/Rest Area will be placed within 30 ft of the unnamed tributary to the Croatan Sound. NCDOT plans to remove portions of the existing fill material that falls within the 30 ft buffer and replace it with new fill material to create a more stable fill slope. However, this new fill material will not exceed the footprint of the existing fill material and NCDOT has minimized where possible, the need to place any fill material within the 30 ft buffer. Also included with this permit modification is revised information for wetland reforestation planting in wetland areas east of the new Croatan Sound bridge currently under construction. At the request of the Roanoke Corridor Commission, indigenous wetland trees will be planted from the toe of slope to existing vegetation and/or right-of-way line totaling 2.1 ac. No additional fill, excavation, or clearing in jurisdictional wetlands will occur as a result of this reforestation. The mix will planted at rate of approximately 680 trees/acre and include: 20%Pinus taeda, loblolly pine 20% Quercus virginiana, live oak (planted closest to the toe of slope) 20 % Taxodium distichum, bald cypress 20%Magnolia virginiana, sweetbay magnolia 20% Quercus nigra, water oak It is anticipated these activities will be authorized by a modification to the existing U.S. Army Corps of Engineers (Action ID No. 199502334). Checks in the amount of$100.00 are enclosed to cover the CAMA processing fee and $475.00 for the NCDWQ processing fee. The adjacent property owner has been notified of this permit request. A copy of the letter sent to the property owner and the certified mail receipt are attached. The signed return receipt from this property owner will be forwarded to you as soon as possible. The N.C. After every runoff producing rainfall event and at least monthly inspect the infiltration system for erosion, trash accumulation,vegetative cover,and general condition. 2. Repair eroded areas immediately,re-seed as necessary to maintain adequate vegetative cover,mow vegetated cover to maintain a maximum height of six inches,and remove trash as needed. 3. After every runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow structures for blockage and deterioration. Remove any blockage and repair the structure to approved design specifications. 4. Remove accumulated sediment from the pretreatment system and infiltration basin annually or when depth in the pretreatment unit is reduced to 75%of the original design depth. The system shall be restored to the original design depth without over-excavating. Over-excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality(i.e. stockpiling near a stormwater treatment device or stream, etc.). A benchmark shall be established in the pretreatment unit. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the design depth reads 0 P 1 feet in the pretreatment unit,the sediment shall be removed from both the pretreatment unit and the infiltration basin. 5. If the Division determines that the system is failing,the system will immediately be repaired to original design specifications. The site is located in a marshy area with water standing at or slightly above the ground surface. After notifying the Hydraulics Unit of this condition, a percolation test was not attempted at this site. Site No. 2 is located right of-L- Rev. station 125+20 to 125+80±. The percolation test was conducted 30 meters right of-L- Rev. station 125+40. Ground elevation is 5.2 fmsl. Estimated AASHTO Soil Classification is A-2-4, fine to coarse sand. Estimated seasonal high water table elevation is 2± fmsl. The percolation test site was prepared as follows: Hole depth = 44" Hole diameter= 4" 2" gravel placed at bottom of hole Hole filled with water to within 30" of ground surface -2- Test Results Min. I would like to respond to several issues that you raised in your e-mail: • In order to allow adequate time for review, while still meeting the June 19th let date and the May 1st review date, it is very important that DOT submit the CAMA minor modification request as soon as there is a final design and a final mitigation plan that are not anticipated to change based on any ongoing conversations DOT may be having with the U.S. Army Corps of Engineers. DCM does not have the same requirements as USACOE regarding closure of access points. • As you are aware, the Dare County Land Use Plan contains a policy [p. 60. Policy 2.1.2 (h-1)] that requires that "Mitigation activities and improvements designed as compensation for wetland loss occurring in Dare County shall be located, whenever possible, in Dare County and in proximity to the loss." It should be noted that Dare County policy Policy 2.1.2 (h-1) does not absolutely preclude out-of-county mitigation. However, prior to authorizing any out-of-county mitigation site, a permit applicant must prove to DCM's satisfaction that no reasonable mitigation site or sites exist within Dare County. The mitigation proposal associated with the minor modification request should include an explanation of the attempts DOT made to locate mitigation within Dare County, and a justification for why a portion of the mitigation is being proposed outside of Dare County. • In addition to our normal mitigation proposal review, we will also need to consider the recent violation of a permit for dredging disposal activities that occurred at the proposed location for the Roanoke Island Visitor Center. The permittee was required to complete a restoration plan for the high-quality waters and wetlands impacted by the permit violation. We will need to ensure during our review that DOT's mitigation proposal for on-site mitigation does not in any way duplicate restoration work that was required through the restoration plan. Additional supporting documentation may be required for a complete review. • DCM will review DOT's proposal to construct the Roanoke Island Visitor Center as a minor modification request to CAMA major permit No. 7-98. Effective as of August 1, 2000, the fee for a CAMA permit minor modification request is $100.00. The minor modification request should be submitted with a check for$100.00 to Frank Jennings,Field Representative in the DCM Elizabeth City District. P.No. K-4003 COASTAL MANAGEMENT Purpose of the Meeting NCDOT proposes to construct a new Visitor Center and Rest Area along the proposed US 64-264 Manteo Bypass on Roanoke Island. The project is not being carried through the NEPA/404 Merger process; therefore, no concurrence is being requested. The project will; however, impact wetlands and a stream and will require permits. It is the intent of the meeting to review the proposed project with those agencies with issuing permits and to address any potential issues that could be encountered in the permitting process. General Description of the Project The proposed Visitor Information Center and Rest Area would be constructed on the south side of the proposed US 64-264 Manteo Bypass,currently being constructed. The proposed site for the visitor center is currently being used as a dredged spoil site by a private dredging operation. The proposed visitor center will contain two facility structures and vehicle parking for both cars and trucks. The entrance to the proposed site would be located directly across the US 64-264 Bypass from a court appointed access point on the north side of the proposed roadway. The proposed visitor center will require the acquisition of approximately 6.5 acres of additional right of way;however,the site will be entirely contained within the control of access for the US 64-264 Bypass project. It is anticipated that approximately 0.48 acres of wetlands and 140 linear feet of streams will be impacted by the proposed project. Purpose and Need of the Project The visitor center and rest area proposed by this project includes constructing a roadside facility along the new alignment of US 64-264, currently under construction as part of T.I.P. Project R-2551. The center would serve to enhance highway safety by providing highway travelers with a conveniently located rest area that will allow for short breaks from traveling. Existing Conditions US 64-264 is the major thoroughfare through the town of Manteo, located on Roanoke Island. US 64-264 departs the mainland of North Carolina just north of Manns Harbor, crosses the Croatan Sound via the Umstead Bridge, and enters Roanoke Island at its northern tip. Once on Roanoke Island,US 64-264 continues south through large areas of mostly commercial development and then turns east towards the Outer Banks at its intersection with NC 345. There is an existing rest area, the Roanoke Island Visitor Center and Rest Area at Fort Raleigh, along US 64-264 located at the northern end of Roanoke Island,just east of the Umstead Bridge. Located on the south side of US 64-264, this rest area allows for eastbound traffic to turn right into the rest area instead of having to turn left across oncoming traffic. This site placement provides the safest means of entry for the direction of the predominant traffic flow,the eastbound traffic heading to Manteo and the Outer Banks. Transportation Improvement Project R-2551, currently under construction, will widen existing US 64-264 to a multi-lane facility and construct new bridges across the Croatan Sound and Spencer Creek. The project will improve traffic flow and enhance safety,especially during emergency hurricane evacuations occurring during the peak tourist season. T.I.P. Project R-2551 begins at the intersection of US 64 and US 264 west of Maims Harbor and ends at the intersection of US 64-264 with NC 345 southeast of Manteo. US 64-264 will be resigned and directed over the new bridge over the Croatan Sound. The existing Umstead Bridge will remain in place,but will no longer be a part of the US 64- 264 corridor once T.I.P. Project R-2551 is completed. In addition to the existing visitor center and rest area located on the northern end of Roanoke Island,there are three existing visitor centers located in close proximity to Roanoke Island. The Aycock Brown Visitor Center and Rest Area, located north of Roanoke Island on the Outer Banks in Kitty Hawk serves all tourist traffic entering the Outer Banks from points north of Roanoke Island, mainly northeastern North Carolina and Virginia. South of Kitty Hawk is the Nags Head Visitor Center, located at Whalebone Junction. This visitor center is located on National Park Service property and is federally owned; however,the Dare County Tourist Bureau staffs the visitor center during the summer months. The Roanoke Island Visitor Center at Manteo is located in the heart of Manteo and serves as the headquarters for the Dare County Tourist Bureau which oversees the operations of all the visitor centers on the Outer Banks. With the construction of the proposed project,the Nags Head Visitor Center,the Roanoke Island Visitor Center and Rest Area at Fort Raleigh, and the Roanoke Island Visitor Center at Manteo would be consolidated into the new Roanoke Island Visitor Center and Rest Area proposed by the subject project. The headquarters for the Dare County Tourist Bureau would then relocate to this new visitor center. By consolidating the existing visitor centers,there would be a visitor center and rest area located at two major highway access points to the Outer Banks,the Aycock Brown Visitor Center at the northern access and the proposed Roanoke Island Visitor Center and Rest Area at the western access. Measures Taken to Avoid or Minimize Environmental Impacts Avoidance Wetland delineations, conducted during the environmental surveys for the US 64-264 Manteo Bypass, determined that much of the area in the vicinity of the project was considered to be a wetland, except for a small upland pocket situated to the south of, and adjacent to,the US 64-264 Bypass corridor. This site appeared to be the most desirable location for the placement of the proposed visitor center and rest area due to its avoidance of impacts to wetlands and streams. However, constructing the proposed visitor center and rest area at this upland location will not completely avoid impacts to wetlands and streams. Therefore,the following avoidance measures were investigated. Bridging Alternative The majority of the wetland impacts associated with this project would result from the construction of the driveway entrance. A small wetland pocket is currently situated between the existing unnamed tributary to the Croatan Sound,the US 64-264 Bypass corridor, and the proposed visitor center and rest area site. Because of the design constraints,the driveway entrance will pass through the southern most portion of this wetland. During the preliminary design phase,NCDOT studied a bridging alternative for the driveway entrance. It was estimated that the construction of a bridge, from high ground to high ground, would cost approximately $1,400,000. It is NCDOT's opinion that the bridging alternative, in comparison to the overall cost of the project and the amount of impacted wetlands that would result, was not a feasible alternative. For this reason, this alternative was dropped from further consideration. Driveway Location Alternative NCDOT originally planned to locate the driveway west of the unnamed tributary to the Croatan Sound in order to avoid impacting the stream. Preliminary plans were to move the existing access point, located to the north of the US 64-264 Bypass corridor,west such that it aligned with the proposed driveway entrance to the visitor center and rest area. During this time period, it was discovered that the location of the northern access point was set by a court case involving a property dispute during the right of way acquisition phase of the US 64-264 Bypass project, thereby making the movement of this northern access point impossible. It was also determined that locating the driveway access close to the bridge would result in a sight distance problem for driver's exiting the visitor center and rest area, due to the final grades of the driveway and the US 64- 264 Bypass. The driveway entrance was then shifted to the east so that it was aligned opposite the court negotiated northern access point along the US 64-264 Bypass. NCDOT originally investigated placing the entrance to the visitor center and rest area just west of this northern access point; however, it was determined during the design phase that the required finish grades along US 64-264 would create a sight distance conflict for traffic exiting the visitor center onto US 64-264. Because the finish grade of the roadway would be considerably higher than the driveway exiting the proposed site, a driver's field of vision towards the west would be severely limited due to their position being lower than the roadway they were wishing to enter. Offset intersections have statistically higher accident rates than four-legged intersections. This is due in part to the fact that each new access along a facility adds an additional conflict point for the facility. The more conflict points a facility has,the higher the accident rates typically are. In this particular situation,with the major flow of traffic coming from the west, and with the possibility of future development on the north side of US 64-264, the northern access point has the potential to generate a significant amount of traffic. This being the case,with an offset intersection, eastbound traffic turning left into the future municipal complex would use the center turn lane of the five-lane section as storage. Westbound traffic trying to enter the visitor center and rest area would then be in direct conflict with the eastbound vehicles waiting to turn left. With the possible development of the municipal complex,there is a strong possibility that the northern access intersection with US 64-264 would be signalized once the development was complete. Having an offset intersection in close proximity to a signalized intersection is also an undesirable design in regards to traffic flow and operation of the intersection,as well as safety This location eliminated the sight distance problem associated with the original location. It also provided for a four-legged intersection, thereby eliminating an offset intersection that would have created an overlapping left turn situation for travelers along the US 64-264 Bypass. For these reasons,the driveway entrance was located east of the unnamed tributary to the Croatan Sound. Minimization Minimization includes the examination of appropriate and practicable steps to reduce the adverse impacts to Waters of the United States. Implementation of these steps will be required through project modifications and permit conditions. Minimization typically focuses on decreasing the footprint of the proposed project through the reduction to median widths, right-of-way widths, and/or fill slopes widths. Several minimization efforts were included as part of the project. Sideslopes in the vicinity of the unnamed tributary to the Croatan Sound were reduced from the standard 4:1 slope to 2:1 sideslopes in order to minimize impacts to the stream. A grassed shoulder section along the driveway entrance was used instead of curb and gutter in order to allow runoff to filter through a grass swell before entering the wetland, thereby filtering the majority of the runoff. The overall size of the visitor center and rest area was reduced from its original design size,while still meeting all necessary design criteria, such that it now fits entirely within the disturbed, upland area,thereby minimizing impacts to the surrounding wetlands and stream. Finally,the driveway entrance was redesigned so that it would cross the unnamed tributary at a perpendicular angle, thereby minimizing the footprint of the roadway at the stream crossing. All of these items were incorporated into the final design as a means of minimizing the overall environmental impacts of the project. The end result of these minimization measures resulted in a reduction in the linear footage of stream impacts. The original site design would have resulted in approximately 700 linear feet of stream impacts while the new design, which incorporates these minimization efforts,reduced the overall stream impacts to 140 linear feet. Wetland impacts remained about the same for both designs due largely in part to the fact that the majority of wetland impacts are a result of the driveway location and not the sideslope or the size of the site itself. The driveway will isolate a wetland pocket, cutting it off from the rest of the surrounding wetland system. Although this pocket will remain intact,the entire wetland was considered in the impact calculations for the project and will be mitigated for. Agency Coordination • Initial Project Meeting A meeting was held on March 6, 2000 to discuss the proposed Roanoke Island Visitor Center and Rest Area project. Representatives from NCDOT met with representatives from the North Carolina Division of Water Quality,North Carolina Division of Coastal Management,the U.S. Fish and Wildlife Service, and the North Carolina Division of Marine Fisheries. The proposed project was presented to those present and their comments and concerns were then discussed. The meeting did not generate any major concerns with those present and the meeting ended under the pretense that the next time the resource agencies would see the project would be when the final environmental document was circulated for review. On Site Agency Meeting A meeting was held on June 6, 2000 at the project site to discuss the proposed project and the associated wetland and stream impacts with the resource agencies. NCDOT biologist Chris Rivenbark and Project Engineer Craig Young met with representatives from the North Carolina Division of Water Quality,the U.S. Army Corps of Engineers, and the North Carolina Division of Coastal Management. Estimated stream and wetland impacts were discussed as well as permitting issues for the project. As a result of the meeting, it was determined that the original design involved extraneous stream impacts. The designs for the site were adjusted after the meeting such that the entire project would only impact the stream in the vicinity of its crossing. In addition, sideslopes were changed from 4:1 slopes to a combination of 3:1 and 2:1 slopes in the vicinity of the wetlands and the stream crossing as a method of minimizing impacts. The driveway entrance was also realigned so that it crossed the stream at more of a perpendicular angle than originally planned,thereby reducing the overall stream impacts from approximately 700 linear feet to 140 linear feet. I do not have a final copy of the Perquimans County Land Use Plan Update to review, but I do not expect it would have any radically different policies. I will double-check with our District Planner and let you know if there is anything unexpected in the final version of the Perquimans County land use plan. As I stated in my 3/30/00 letter, this information is provided as a preliminary review of land use plan policies which may be relevant to mitigation being considered by DOT. This is not a formal DCM land use plan review. A formal DCM land use plan review for all aspects of the proposed project will be conducted upon receipt of a request from DOT for authorization pursuant to the Coastal Area Management Act. As I also stated in my 3/30/00 letter, DOT will need to prove to DCM's satisfaction that no reasonable mitigation site or sites exist within Dare County in order for DCM to approve DOT's proposal to mitigate for Dare County impacts within Gates/Perquimans Counties. Finally, please note that my comments do not take into consideration the suitability of the mitigation from a wetlands perspective. DCM will make a determination of the suitability of the proposed mitigation from a wetlands perspective after Kelly Williams, DCM Wetland Restoration Specialist, has had an opportunity to review the proposed mitigation plan. In instances when improvements to publicly-owned or managed facilities conflict with freshwater wetland protection programs, an alternatives analysis should be conducted in an effort to avoid wetland loss or alteration. For projects which involve County-owned facilities or land, Dare County will conduct an alternatives analysis for these projects. However, should the analysis determine that there is no practicable alternative, a mitigation permit proposal shall be implemented. Mitigation activities and improvements designed as compensation for wetland loss occurring in Dare County shall be located,whenever possible,in Dare County and in proximity to the loss (emphasis added). It should be noted that Dare County policy Policy 2.1.2 (h-1) does not absolutely preclude out-of-county mitigation. However,prior to authorizing any out-of-county mitigation site, a permit applicant must prove to DCM's satisfaction that no reasonable mitigation site or sites exist within Dare County. 1993 Gates County Land Use Plan Update.
