1) This modification authorizes the construction of the Roanoke Island Visitor Information Center and Rest e
Area adjacent to US 64-264 between the Croatan Sound and the US 64/NC 345 intersection as depicted '
on the attached workplan drawings. '
2) No development or land disturbing activity shall take place within 30 feet of the mean high water line .,
except that the permittee may remove portions of the existing fill material that falls within the 30-foot
buffer and replace it with new fill material to create a more stable fill slope as depicted on the attached
workplan drawings. The permittee must minimize as much as possible the need to place any such new '

Sedimentation and Erosion Control

' 11) This project must conform to all requirements of the NC Sedimentation Pollution Control Act and the
NC Department of Transportation's Memorandum of Agreement with the NC Division of Land

12) In order to protect water quality, runoff from construction must not visibly increase the amount of
suspended sediments in adjacent waters.

' 13) In accordance with the 2/23/2001 application letter for this project, the permittee shall strictly enforce '

waters and wetlands.

ensure that eroded materials do not enter adjacent wetlands and watercourses (e.g. silt fence, diversion
swales or berms, sand fence, etc.).

NOTE: The Roanoke Island Visitor Center and R ea wi anently impact approximately 1.15 ,
acres of jurisdictional wetlands and approximat 145. 1 ear feet of jurisdictional stream. In ,
addition, there will be approximately 0.01 acre i rface waters. The impacted wetlands .
are estuarine fringe wetland forest with domi egetation including loblolly pine, red bay,
wax myrtle, red maple, greenbrier and American holly. Wetland impacts consist of f
approximately 0.82 acres of fill, approximately 0.18 acres of isolated wetlands, and
' approximately 0.15 acres due to mechanized clearing. These impacts and their associated
approved mitigation as described below is in addition to impacts and mitigation previously
authorized by CAMA Permit No. 7-98.
17) Approved mitigation sites for wetland impacts resulting from this project include: on-site restoration,
creation and preservation at the Roanoke Island Visitor Center/Rest Area Mitigation Site, North and
South tracts in Dare County and preservation at the Mashoes Road Mitigation Site in Dare County.
NOTE: DCM appreciates the permittee's successful efforts to locate mitigation within Dare County, and.
in conformance with the Dare County Land Use Plan. The Dare County Land Use Plan requires
that "mitigation activities and improvements designed as compensation for wetland loss
occurring in Dare County shall be located, whenever possible, in Dare County and in proximity .
to the loss."
18) On-site mitigation shall be conducted in accordance with the Roanoke Island Visitor Center/Rest Area
Mitigation Plan dated May 2001 except as altered herein and except as altered by conditions of the
modification to Water Quality Certification No. 3167 (DWQ Project No. 000964) issued by the N.C.
Division of Water Quality (DWQ) on 5/29/01. /
19) After environmental permits have been received for this project, the permittee shall revise the Roanoke '
Island Visitor Center/Rest Area Mitigation Plan to incorporate changes required by environmental '
permit conditions. The final approved Roanoke Island Visitor Center/Rest Area Mitigation Plan shall be
distributed to DCM, DWQ, the U.S. Army Corps of Engineers (USACE) and the N.C. Wildlife ,
Resources Commission (WRC)prior to initiating construction on any portion of this permitted project. ,
20) The Roanoke Island Visitor Center/Rest Area Mitigation Site shall be constructed concurrent with '
construction of the Roanoke Island Visitor Center and Rest Area, except for the vegetative planting '
which shall be completed within one year after initiating construction on any portion of the Roanoke '
Island Visitor Center and Rest Area. '

,• 21) Annual monitoring reports shall be provided to DCM and DWQ for five years for the Roanoke Island ,
Visitor Center/Rest Area Mitigation Site. Annual monitoring reports shall include photos, hydrologic
data from monitoring gauges, an evaluation of that data, and an assessment of whether success criteria '
are being met. Progress reports shall also be provided upon request. After five years, monitoring may '
cease if the permittee can demonstrate that success criteria have been met and written concurrence is
received from DCM and DWQ. Failure to meet success criteria will necessitate additional monitoring ',
and/or remedial actions.

Quality Certification No. 3167 (DWQ Project No. 000964), which was issued on 5/29/01. Any violation
of the Water Quality Certification issued by DWQ will be considered a violation of this CAMA permit.
NOTE: The permittee is encouraged to contact the Public Health Pest Management Section at (919) 733-
6407 to discuss mosquito control measures.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
' NOTE: The wetland reforestation planting in wetland areas east of the new Croatan Sound Bridge
currently under construction as described in the 2/23/01 application letter for this project is

The North Carolina Department of Transportation (NCDOT) proposes to construct a
visitor information center and rest area on a 9.2 ac. parcel adjacent to US 64-264 between the
Croatan Sound and the US 64/NC 345 intersection, Dare County. The scope of work for this
project was documented as a Categorical Exclusion (CE) approved by the Federal Highway
Administration [Federal Aid Project NHS 64 (27), State Project 8.1052501] on 8 August, 2000.
On January 20, 1998, The N.C. Division of Coastal Management issued Permit No. 7-98,
for improvements to US 64-264, including the construction of a new Croatan Sound Bridge,
from west of Manns Harbor to NC 345 south of Manteo in Dare County [TIP No. R-2551,
Federal Aid Project No. NHF-64 (6), State Project No. 8.T051401]. At the request of the
resources agencies,NCDOT proposes to modify this permit as opposed to applying for a separate
permit for impacts associated with the visitor information center and rest area.

One of the two access points to the section of US 64-264 currently under construction
between the new Croatan Sound Bridge and NC 345 south of Manteo, has been permanently
closed at the request of the U.S. Army Corps of Engineers. This access, which is located south
of the US 64-264 corridor is now owned by the N.C. Wildlife Resources Commission (WRC)
has been closed and will not be used to provide access to the new section US 64-264 once
construction is complete. A letter from WRC is included with this permit application.
The access to the property on the northern side of the corridor is registered to Dare
County. Terry Wheeler, Dare County Manager has informed NCDOT that the County is in the
process of closing the access, however a definite date of closure is unavailable at this time.
Written confirmation of this closure will be forwarded as soon as it becomes available. NCDOT
is aware that the project will not be permitted unless this access is permanently closed.
Environmental Impacts
Jurisdictional Streams. An unnamed tributary to the Croatan Sound [DWQ Index No. 30-
20-(2), (8/1/90)], will be crossed by the driveway for the visitor center and rest area resulting in
145.5 linear ft of impacts. This is a perennial stream in the Pasquotank River Basin which
carries a Best Usage Classification of SA which are salt waters suitable for commercial,
shellfishing, and all other tidal saltwater uses by definition. No stream relocation or channel
change will be involved. There will also be 0.01 acres of fill in surface waters
Jurisdictional Wetlands. Project construction will result in 1.14 ac of permanent impacts
to a portion of a estuarine fringe forest. Dominant vegetation present in this community include
loblolly pine (Pinus taeda), red bay (Persea borbonia), wax myrtle (Myrica cerifera), red maple
(Acer rubrum), greenbrier (Smilax sp.), and American holly (Ilex opaca). Impacts consist of 0.82
acres of fill, 0.18 ac of isolated wetlands, and 0.15 acres due to mechanized clearing. Permit
drawings depicting this proposed work are attached.
Threatened And Endangered Species. The following species are listed as threatened,
endangered, or experimental for Dare County: A Biological Conclusion of No Effect has been
reached for each of the following species. Final concurrence from the U.S. Fish and Wildlife
Service was issued for each of these species on February 20, 2001.
• Red wolf(Canus rufus). Experimental.
• Loggerhead turtle (Caretta caretta). Threatened
• Piping plover(Charadrius melodus). Threatened
• Green sea turtle (Chelonia mydas). Threatened
• Leatherback turtle (Dermochelys coriacea). Endangered
• American alligator(Alligator mississippiensis). Threatened (S/A)
• Hawksbill sea turtle (Eretomochelys imbricata). Endangered
• Bald eagle (Haliaeetus leucocephalus). Threatened
• Kemp's ridley sea turtle (Lepidochelys kempii). Endangered
• West Indian manatee (Trichechus manatus). Endangered
• Red-cockaded woodpecker (Picoides borealis). Endangered
• Roseate tern (Sterna dougallii). Endangered
• Seabeach amaranth(Amaranthus pumilus). Threatened
Cultural Resources. No historic structures listed in or eligible for the National Register of
Historic Places are located within the project area. This determination was issued by the State
Historic Preservation Office (SHPO) and the Federal Highway Administration (FHWA) on May
10, 2000. There is one known archaeological site, 31DR76, within the proposed project. The
site was originally thought to have been eligible for the National Register. However, after
additional evaluation, SHPO found the site to be not eligible.
Mitigation Sequencing
Avoidance. The NCDOT is committed to incorporating all practicable design features to
avoid and minimize wetland impacts, and to provide full compensatory mitigation of the
remaining wetland impacts. During the design of this project,NCDOT has investigated several
alternatives for the location of the driveway entrance to the Visitor Center and Rest Area. The
Categorical Exclusion (CE) describes in detail why the current location was selected; however,
there have been some developments relating to this issue since the CE was signed.
The Army Corps of Engineers, the N.C. Division of Water Quality, and the N.C. Wildlife
Resource Commission all expressed their concern over the location of the driveway entrance and
the associated impacts to wetlands and the unnamed tributary to the Croatan Sound. Based on
these comments,NCDOT investigated moving the location of the driveway such that it would
avoid impacting these resources.
By moving the driveway entrance north of the proposed location, additional wetland
impacts would occur. NCDOT's proposed location places the entrance in a location that
minimizes impacts to the surrounding wetlands.
Moving the driveway entrance south of its proposed location was also investigated;
however, this alternative would compromise the safety of the traveling public along the US 64
Bypass as well as those exiting the Visitor Center. The minimum safe stopping/sight distance
listed in the Roadway Design Manual is 917 feet. From the end of the bridge rail on the US 64
Bypass, which is the farthest point south for which cars exiting the Visitor Center can see, to the
proposed driveway entrance, the sight distance is 967 feet. Therefore, the proposed entrance
location is situated such that it is approximately 50 feet greater than the minimum design limit
for safe stopping/sight distance as listed in the Roadway Design Manual. Moving the driveway
entrance 50 feet to the south, the point of minimum design safe stopping/sight distance, would
place the entrance directly on top of the unnamed tributary to the Croatan Sound and would;
therefore, dramatically increase the amount of linear stream impacts associated with this project.
Due to existing topography and design constraints it was determined that the driveway
entrance location could not be moved without additional wetland and stream impacts or
unacceptable compromises to driver safety.
Avoidance measures were taken during the planning phases of the CE; minimization
measures were incorporated as part of the project design. The avoidance measures will include:
1. Permanent closure of two existing access points along the portion of US 64-264
currently under construction.
2. No staging of construction equipment or storage of construction supplies will be
allowed in wetlands or near surface waters.
3. All wetland areas not affected by the project will be protected from unnecessary
encroachment.
Minimization. Minimization includes the examination of appropriate and practicable
steps to reduce the adverse impacts. Minimization techniques were implemented as follows:
1. Slopes: Fill slopes adjacent to the stream crossing are at a 2:1 ratio as opposed to the
original designs of 3:1.
2. High quality water standards: Strict enforcement of sedimentation and erosion control
Best Management Practices (BMP) for the protection of surface waters and wetlands
will be enforced.
3. Reduced impacts to surface waters: Impacts to surface waters were reduced to 145.5
linear ft compared to 600 linear ft for the original design.
Mitigation—Jurisdictional Wetlands. The project will impact 1.14 ac. of jurisdictional
wetlands. NCDOT proposes to offer 0.88 ac of onsite mitigation in the form of both restoration
and creation (0.11 ac., 0.77 ac. respectively). The attached Onsite Mitigation Plan for the
Roanoke Island Visitor Center/Rest Area provides detailed information pertaining to onsite
mitigation, but the plan is summarized in the following paragraph. NCDOT also proposes to
debit wetland mitigation sites for the remaining impacts, one of which is not in Dare County.
NCDOT is aware of Dare County's Land Use Plan and justification for debiting a site outside of
the county is explained later in this section.
Wetland compensation for the Visitor Center/Rest Area will be accomplished by
restoration, creation, and preservation (see Table 1). NCDOT plans to mitigate for 0.88 ac. of the
total wetland impacts through on-site restoration of 0.11 ac. (1:1) and creation of 0.77 ac. (1:1)
by removing fill from portions of the onsite borrow pit. These areas will then be vegetated with
species matching the estuarine fringe wetland community. NCDOT requests a 1:1 ratio for
creation due to the high probability of success for extending adjacent wetland boundaries. In
addition,NCDOT will preserve 1.1 ac. of estuarine fringe wetlands on the Visitor Center/Rest
Area property.
NCDOT plans to mitigate for the remaining 0.26 ac. of impacts offsite. NCDOT will
mitigate 0.26 ac. with 0.26 ac. of successful riverine wetland restoration(1:1) at the NCDOT
owned Dismal Swamp Mitigation Site in Gates and Perquimans Counties. A summary sheet
showing total debits to the site and coordinates for this debit are included with this permit
modification. NCDOT plans to mitigate for the remaining portion of the 0.26 ac. of impacts with
1.3 ac. of forested wetland preservation (5:1) at the Mashoes Road Mitigation Site in Dare
County.
Per conversations with resources agencies, no stream restoration will be required due to
impacts being less than 150 ft however, NCDOT will vegetate the portions of the stream banks
where vegetation has been removed do to a stream restoration project. The stream banks to be
vegetated are within NCDOT right-of-way and will include species matching the estuarine fringe
wetland community.

Dare County's Land Use Plan requires that "Mitigation activities and improvements
designed as compensation for wetland loss occurring in Dare County shall be located, whenever
possible, in Dare County and in proximity to the loss." Landmark Design Group (formerly
Langley and McDonald), conducted a wetland mitigation search for the Pasquotank River Basin
in September of 1998 under contract with NCDOT. Of the sites identified, only one (Mashoes
Road Site) included mitigation within Dare County matching the impacts associated with this
project. The Forested Wetland Restoration acreage at this site has been debited for other
NCDOT projects. Therefore,NCDOT proposes to debit 0.26 ac of wetland restoration outside of
Dare County.
The N.C. Coastal Resources Commission has adopted a 30 ft buffer for new development
along navigable waterways in the 20 counties governed by the N.C. Division of Coastal
Management. A portion of the fill material necessary for the Visitor Center/Rest Area will be
placed within 30 ft of the unnamed tributary to the Croatan Sound. NCDOT plans to remove
portions of the existing fill material that falls within the 30 ft buffer and replace it with new fill
material to create a more stable fill slope. However, this new fill material will not exceed the
footprint of the existing fill material and NCDOT has minimized where,possible, the need to
place any fill material within the 30 ft buffer.
Also included with this permit modification is revised information for wetland
reforestation planting in wetland areas east of the new Croatan Sound bridge currently under
construction. At the request of the Roanoke Corridor Commission, indigenous wetland trees will
be planted from the toe of slope to existing vegetation and/or right-of-way line totaling 2.1 ac.
No additional fill, excavation, or clearing in jurisdictional wetlands will occur as a result of this
reforestation. The mix will planted at rate of approximately 680 trees/acre and include:
20%Pinus taeda, loblolly pine
20% Quercus virginiana, live oak (planted closest to the toe of slope)
20 % Taxodium distichum, bald cypress
20%Magnolia virginiana, sweetbay magnolia
20% Quercus nigra, water oak
It is anticipated these activities will be authorized by a minor modification to the existing
CAMA Major Permit No. 7-98. Checks in the amount of$100.00 are enclosed to cover the
CAMA processing fee and $475.00 for the NCDWQ processing fee. The adjacent property
owner has been notified of this permit request. A copy of the letter sent to the property owner
and the certified mail receipt are attached. The signed return receipt from this property owner
will be forwarded to you as soon as possible. The N.C. Stormwater Management permit
application is also attached as required by NCDWQ. By copy of this letter,NCDOT requests a
modification of the permits issued by the U.S. Army Corps of Engineers (Action ID No.
199502334) and Division of Water Quality (WQC Project No. 970856).

the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff-colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions,you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh,NC 27611, (919) 733-2698 within twenty(20)days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the fmal decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications; time extensions, and future maintenance require
additional approval.Please read your permit carefully prior to starting work and-review all project plans,as approved.If
you are having the work done by a contractor,it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time,Department personnel will visit the project site.To facilitate this review,we request that you
complete and mail the enclosed Notice Card just prior to work initiation.However,if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for

Department requests that the existing permit be modified to authorize the construction of
a visitor's welcome center to be located on the south side of the US64/264 bridge

Dear Mr. Gilmore:
Reference the Department of the Army(DA)permit issued to you on March 5, 1998,
associated with the widening of approximately 10 miles of U.S. 64-264, including constructing
a new bridge over the Croatan Sound and adjacent marshes, from US 64-264 West of Manns
Harbor to NC 345 South of Manteo, in Dare County,North Carolina(TIP No. R-2551,Federal
Aid Project No.NHF-64(6), State Project No. 8.T051401). Also reference your subsequent
written request dated February 23, 2001, for a permit modification to:
'1. Move the permitted access point to the section of US 64-264 currently under
construction between the new Croatan Sound Bridge and NC 345 south of Manteo to the location
in the attached drawings.
. FilI 1.0 acr)of Section 404 wetlands,mechanize land clear 0.14 acres of Section 404
wetlands, and partially fill 145.5 linear feet of stream to construct the Roanoke Island Visitor
Information Center and Rest Area from the new access point to a 9.2 acre parcel adjacent to US
64-264,between the new Croatan Sound Bridge and NC 345 south of Manteo in Dare County.
This modification request was coordinated by public notice dated April 5, 2001,with the
North Carolina Division of Water Quality, and other appropriate State and Federal agencies. This
coordination revealed one objection to this modification request. By letters dated April 24 and
May 15, 2001,the Environmental Protection Agency requested higher mitigation ratios than
those supplied by the applicant and that stream impacts be mitigated. The applicant addressed
these concerns and agreed to mitigate for stream impacts. However,the wetland creation,
_>y. restorationnand pre a ation is adequate mitigation for project impacts when associated with the
closing of all future acces;ivoints alon this bypass project: Additional access points could
produce secondary wetland impacts.
•

Therefore, the permit is hereby modified in accordance with the specific work activities
described above. It is understood that all conditions of the original permit remain applicable and
that the expiration date is unchanged. In addition,the permittee will comply with the following
special permit conditions:
a. To partially mitigate for project impacts and to prevent secondary wetland impacts
from this project,no access points will be granted along the TIP R-2551,Manteo Bypass project.
b. The Permittee shall fully implement the mitigation plan, entitled Roanoke Island
Visitor Center/Rest Area Mitigation Plan, dated May 2001, and this plan will be commenced
immediately, and implemented concurrently with all phases of construction activities authorized
by this permit modification.
c. NCDOT will maintain the wetland and stream mitigation sites utilized to satisfy
Special Condition(b.)in perpetuity in the condition established by the mitigation plan.
Prohibited activities within these mitigation areas specifically include,but are not limited to: the
construction or placement of roads,walkways,buildings, signs, or structures of any kind (i.e.,
billboards,interior fences, etc.);filling,grading,excavation, leveling, or any other earth moving
activity that may alter the drainage pattern on the property;the cutting,mowing, destruction,
removal, damage or other alternation of.any vegetation; disposal or storage of any debris,waste
or garbage; except as may be authorized by the mitigation plans or subsequent modifications
which are approved by the Corps of Engineers. In addition,the permittee shall take no action,
whether on or off the mitigation properties,which will adversely impact the mitigation sites.
d. Special Condition(c.), above, runs with the land. The permittee shall not sell, lease,
or otherwise convey any interest in the properties used to satisfy mitigation requirements for this
permit, to any third party,without the express written consent of the US Army Corps of
Engineers.
e. The permittee will identify and survey the acreage at the mitigation sites utilized to
satisfy Special Condition(b.) above and provide a copy of the survey to the US Army Corps of
Engineers, Washington Regulatory Field Office,NCDOT Regulatory Project Manager,within 45
days of the date of this permit. In addition, a deed showing ownership of the wetland and stream
mitigation areas described in Special Condition(b.) above,must accompany the surveys.
f. The permittee shall contact the Corps of Engineers,Washington Regulatory Field
Office NCDOT Regulatory Project Manager and provide him with the opportunity to attend the
annual mitigation monitoring efforts.
g. The permittee will monitor the wetland and stream mitigation sites for a minimum of
five years and submit the annual mitigation monitoring reports by December 31 of each
monitoring year.

does not meet one or more of the minimum requirements of the
permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director
for modifying the site to meet minimum requirements . The
permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have
been made.
II . SCHEDULE OF COMPLIANCE
1 . The permittee will comply with the following schedule for
construction and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed in
its entirety, vegetated and operational for its intended
use prior to the construction of any built-upon surfaces
except roads .
b. During construction, erosion shall be kept to a minimum
and any eroded areas of the system will be repaired
immediately.
2 . The facilities must be properly maintained and operated at all
times. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the
scheduled intervals .
3. The permittee shall at all times provide the operation and
maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency including, but not
limited to:

a. Semi-annual scheduled inspections (every 6 months)
b. Sediment removal
c. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved
plans and specifications
f. Debris removal and unclogging of outlet structure,
orifice device and catch basins and piping.
4 . Records of maintenance activities must be kept and made
available upon request to authorized personnel of DWQ. The
records will indicate the date, activity, name of person
performing the work and what actions were taken.
5 . This permit shall become voidable unless the facilities are
constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting
data.
6. Upon completion of construction and prior to operation of this
permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that
the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other
supporting documentation. Mail the Certification to the
Washington Regional Office, 943 Washington Square Mall,
Washington, North Carolina, 27889, attention Division of Water
Quality.
7 . A copy of the approved plans and specifications shall be
maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
III. GENERAL CONDITIONS
1 . This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be
submitted to the Division of Water Quality accompanied by an
application fee, documentation from the parties involved, and
other supporting materials as may be appropriate. The
approval of this request will be considered on its merits and
may or may not be approved.
2 . Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to enforcement action
by the Division of Water Quality, in accordance with North
Carolina General Statute 143-215 . 6 (a) to 143-215 . 6 (c) .

3 . The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
4 . In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as
the construction of additional or replacement stormwater
management systems.
5 . The permit may be modified, revoked and reissued or terminated
for cause. The filing of a request for a permit modification,
revocation and reissuance or termination does not stay any
permit condition.

NORTH CAROLINA 401 WATER QUALITY CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public Laws 92-
500 and 95-217 of the United States and subject to the North Carolina Division of Water Quality (DWQ)
Regulations in 15 NCAC 2H,Section .0500.This certification authorizes additional impacts to 1.15 acres
of jurisdictional wetlands and 146 Iinear feet of streams. It should be noted the modification is applicable
only to the additional proposed activities. All the authorized activities and conditions of certification
associated with the original Water Quality Certification dated August 19, 1998,and all other corresponding
modifications still apply.
The application provides adequate assurance that the discharge of fill material into the proposed wetlands
and waters in conjunction with the proposed development will not result in a violation of applicable Water
Quality Standards and discharge guidelines. Therefore,the State of North Carolina certifies that this
activity will not violate the applicable portions of Sections 301,302,303,306,307 of PL 92-500 and PL
95-217 if conducted in accordance with the application and conditions hereinafter set forth.
This approval is only valid for the purpose and design that you submitted in your application,as described
in the Public Notice. Should your project change,you are required to notify the T)WQ and submit a new
application. If the property is sold,the new owner must be given a copy of this Certification and approval
letter, and is thereby responsible for complying with all the conditions. If total wetland fills for this project
(now or in the future exceed one acre,compensatory mitigation may be required as described in 15A NCAC
2H .0506(h) (6)and(7). For this approval to remain valid,you are required to comply with all the
conditions listed below. In addition,you should obtain all other federal,state or local permits before
proceeding with your project including(but not limited to)Sediment and Erosion control,Coastal
Stormwater,Non-discharge and Water Supply watered regulations.
Condition(s)of Certification!
1. Appropriate sediment and erosion control practices which equal or exceed those outlined in the
most recent version of two manuals. Either the"North Carolina Sediment and Erosion Control
Planning and Design Manual" or the"North Carolina Surface Mining Manual" (available from
the Division of Land Resources in the DERNR Regional or Central Offices). The control
practices shall be utilized to prevent exceedances of the appropriate turbidity water quality
standard (50 NTUs in all fresh water streams and rivers not designated as trout waters;25 NTUs
in all lakes and reservoirs,and all saltwater classes;and 10 NTUs in trout waters);
2. All sediment and erosion control measures placed in wetlands or waters shall be removed and
the natural grade restored after the Division of Land Resources has released the project;
3. Measures shall be taken to prevent live or fresh concrete from coming into contact with
waters of the state until the concrete has hardened;
4. There shall be no excavation from or waste disposal into jurisdictional wetlands or waters
associated with this permit without appropriate modification of this permit. Should waste or
borrow sites be located in wetlands or stream,compensatory mitigation will be required since it is
a direct impact from road construction activities;
5. Compensatory mitigation shall be done for 1.15 acres of wetlands impacts as follows:

All Qnsite mitigation shall be constructed as presented in your final mitigation plan dated May
2001 (received May 24,2001).
6_ Hydrologic success for the onsite mitigation at the South and North Tracts shall be achieved by
demonstrating soil saturation within 12 inches of the surface for the same number of consecutive
days as the reference sites,plus or minus 20 percent. In the event that the constructed sites
demonstrate consecutive days of saturation within 12 inches of the surface for a number of days
equal to the reference site,minus 20 percent,the site must still meet the US Army Corps of
Engineers definition of a jurisdictional wetland to be considered successful.
7. The proposed riparian buffers shall be planted as described in the May 24,2000 Final Mitigation
Plan.
S. After the reference gauges are installed,the NC Department of Transportation shall submit annual
monitoring reports for the hydrologic and vegetative monitoring to the North Carolina Division of
Water Quality.
9. None of the proposed mitigation sites(the South Tract,the North Tract,or the onsire riparian
buffers) shall be considered successful until the NC Division of Water Quality agrees in writing to
suspend rnonitorii g. The North Carolina Division of Water Quality retains the right to require
corrective measures to ensure success, should either of the constructed sites,or the riparian
buffers fail to demonstrate success.
10. All other conditions written into previous Water Quality Certifications for this project still apply.
Violations of any condition herein set forth shall result in revocation of this Certification and may result in
criminal and/or civil penalties. This Certification shall become null and void unless the above conditions
are made conditions of the Federal 404 and/or coastal Area Management Act Permit. This Certification
shall expire upon expiration of the 404 or CAMA permit.

Consistency Determination: The proposal is consistent with the Dare County 1994
Land Use Plan certified by the CRC on July 29, 1994, and
as amended both January 23, 1998, and May 28, 1999
(see page #2)
Background Overview: NCDOT proposes to construct a visitor information
center and rest area on a 9.2-acre parcel adjacent to U.S. 64/NC 345
intersection in Dare County. Anticipated impacts from the project include the
filling of 1.14 acres of both Estuarine/Public Trust Waters and Section 404
Jurisdictional Wetlands. The mitigation required for the 1.14-acre loss totals
3.54 acres. Part of the mitigation will be onsite and the balance elsewhere in
Dare County except for a .26 acre portion debited to the Dismal Swamp.
Overview of LUP Policy: The Dare County Land Classification Map identifies the
site area as "Community". Due to project also being within an Estuarine Shoreline
AEC, it also qualifies for the "Conservation Classification. The following policies
are related to this request:
Freshwater Swamps & Marshes: Policy 2.1.2(h-1), pg. 60 (amended 1998).
"Dare County supports the Coastal Commission's policy to mitigate losses of Coastal
Resources for those projects shown to be in the public interest as defined by the standards
in 15NCAC7M .0700 et. Seq. and only after all other means of avoiding or minimizing such
losses have been exhausted."

Implementation Strategy
1. In instances when improvements to publicly owned or managed facilities conflict with
freshwater wetlands protection programs, an alternative analysis should be
conducted in an effort to avoid wetland loss or alteration Mitigation activities and
improvements designed as compensation for wetland loss occurring in Dare County
shall be located, whenever possible, in Dare County and in proximity to the loss.
Freshwater Swamps & Marshes: Policy 2.1.2 (h-2), pg. 61 (amended 1998)
"Dare County supports the U.S. Army Corps of Engineers Nationwide Permit Program."
Discussion of Determination:
Dare County's Land Use Plan requires that "Mitigation activities and
improvements designed for wetland loss occurring in Dare County shall be
located, whenever possible, in Dare County and in proximity to the loss."
NCDOT's correspondence dated February 23, 2001 noted that alternative
design efforts and alternatives were explored to avoid the wetland related
impacts of the project. Alternatives were determined to either result in either
increased wetlands related impacts or increase safety risks for vehicular
movements. Further the mitigation credits and sources proposed will result in
over 96% of the mitigation to be located either on site or within Dare County.
Therefore I recommend a determination that the project be determined as
consistent with and not in conflict with the Dare County LUP, provided
mitigation is accomplished.

This is in response to the above mentioned public notice for the North Carolina
Department of Transportation(NCDOT), to modify an existing permit for the widening of
US4l264 and fill an additional 1.0 acre of wetlands, mechanize land clear an additional 0.14
acres of wetlands, and partially fill 145.5 linear feet of stream to construct the Roanoke Island
Visitor Information Center and Rest Area. Wetland mitigation is proposed in the form of a
combination of(a) 0.11 acre wetland restoration, 0.77 acre wetland creation, and 1.1 acre
wetland preservation on-site, (b) 0.26 acre riverine wetland restoration at the Dismal Swamp
Mitigation Site in Gates and Perquimans Counties, and (c) 1.3 acre of wetland preservation at the
Mashoes Road Mitigation Site in Dare County. No stream restoration is proposed.
The U.S. Environmental Protection Agency, Region 4 Wetlands Section (EPA) has
reviewed the public notice, and recommends that the applicant be required to provide
compensatory mitigation for the stream impacts. We understand that the State of North Carolina
typically does not require compensatory mitigation for stream impacts less than 150 linear feet.
However, the federal agencies have no such limits, and we believe that high quality waters such
as SA waters should be mitigated regardless of the amount of impacts. The stream functions
should he replaced a the following minimum mitigation ratios:
Stream restoration 1.5:1
Stream enhancement (more activities 3:1
than just planting of vegetation) •
Stream stabilization 5:1
Stream preservation (with buffer) 10:1

We note that the planting of vegetation along the remaining reach of the creek may be utilized as
stream stabilization credit.
EPA also believes that the wetlands mitigation is insufficient. We do not believe it is
appropriate to compensate wetland losses with 1:1 restoration, 1:1 creation, or 5:1 preservation.
Although the credit makeup of mitigation banks allows the use of 1:1 and 5:1 for restoration and
preservation (respectively), an applicant must typically pay for 2 credits for each acre of impact.
We recommend that the EPA's recommended mitigation ratios be applied to the mitigation
proposal. Applying these ratios, one arrives at the following number of acres which are
compensated:
0.11 acre Estuarine Fringe Restoration _ 2 = 0.06
0.77 acre Estuarine Fringe Creation = 6= 0.13
0.26 acre Riverine Wetland Restoration 4. 2 = 0.13
1.3 acre Forested Wetland Preservation_ 10 = 0.13
1.1 acre Estuarine Fringe Preservation= 10= 0.11
Total 0.56 acres compensated
As the total number of wetland impacts is 1.14 acres, the applicant should mitigate for the
remaining 0.58 acre. We note that the use of the Dismal Swamp mitigation bank is acceptable.

The NC Division of Coastal Management(NC DCM) is reviewing the attached request from the NC Department
of Transportation (NC DOT)for the above referenced project. NC DCM is processing this request as a minor
modification to existing CAMA permit No. 7-98 which was issued to NC DOT on 1/20/98 for proposed
improvements to US 64-264 from West of Manns Harbor to South of Manteo at US 64-264 and NC 345 in Dare
County, including a new bridge over the Croatan Sound (R-2551).

The applicant should be advised that plans and specifications for all water system improvements must be
approved by the Division of Environmental Health prior to the award of a contract or the initiation of construction (as
required by 15A NCAC 18C 0.0300 et. seq.). For information, contact the Public Water Supply Section, (919)733-

This project will be classified as a non-community public water supply and must comply with state and federal
drinking water monitoring requirements. For more information, the applicant should contact the Public Water
Supply Section, (919)733-2321.
If this project is constructed as proposed, we will recommend closure of adjacent waters to the harvest of shellfish.
For information regarding the shellfish sanitation program, the applicant should contact the Shellfish Sanitation
// Section, (252)726-6827.
Cumulative impacts from this type of project could cause deterioration in water quality. The proposed project
would increase impervious surfaces and alter natural drainage patterns. There would be a loss of natural
vegetation causing an increase in stormwater runoff which could jeopardize the open status of adjacent waters.

The subject project is located in an area open to shellfish harvesting. The 10-slip dock, as proposed, would not
cause closure in accordance with 15A NCAC 18A MARINAS: DOCKING FACILMES: OTHER MOORING AREAS:
however, dockage at the facility could exceed 10 boats. If this was to occur, closure would be recommender in
accordance with DEH rules. For information regarding shellfish sanitation, the applicant shculc contact the Shellfish

inclusion in the National Register of Historic Places. We have no further comment on this phase of the project.
